Main description: Public Private Partnership (kurz PPP) steht für die Zusammenarbeit von Privaten und der öffentlichen Hand zur gemeinsamen Erfüllung einer Aufgabe. Als gemischtwirtschaftliche Unternehmen befinden sich PPP in einem Graubereich zwischen der Organisations- und Aufgabenprivatisierung.Silke Noltensmeier widmet sich schwerpunktmäßig der Frage, ob PPP-Mitarbeiter Amtsträger nach § 11 I Nr. 2c StGB sein können. Sie kommt zu dem Ergebnis, dass § 11 I Nr. 2c StGB auf PPP-Mitarbeiter grundsätzlich keine Anwendung finden kann, sofern der private Partner aktiv am Unternehmen beteiligt ist. Nach den außerstrafrechtlichen Regelungen zum Betrieb gemischtwirtschaftlicher Unternehmen sind die Steuerungsmöglichkeiten der öffentlichen Hand schwächer als es zur Bejahung von § 11 I Nr. 2c StGB erforderlich wäre. Allein bei Unternehmen der Organisationsprivatisierung und PPP mit einer stillen privaten Beteiligung kann im Einzelfall eine staatliche Steuerung i. S. e. Behördenäquivalenz vorliegen. Die Verfasserin konkretisiert die von der Rechtsprechung aufgestellten Grundsätze, indem sie einen Kriterienkatalog entwickelt, wann i. d. R. von einer staatlichen Steuerung auzugehen ist.Bei Anwendung und Auslegung der klassischen Korruptionstatbestände der §§ 331 ff.; 299 StGB können sich aufgrund der Nähe der PPP zur Privatwirtschaft Probleme ergeben. A new form of knowledge production that is flourishing in the Big Data age is profiling. In general, profiling means any form of discovering or constructing knowledge from large sets of data originating from a variety of sources. In a narrow sense, profiling is a way of making individual profiles, i.e. sets of characteristics, features, and attributes through which a person or group can be discerned from another person or group. Profiling is a relatively novel concept in European Union data protection law. It is defined in Article 4 (4) of the General Data Protection Regulation (GDPR). However, Article 22 of the GDPR determines the scope of protection in the case of profiling. This article focuses on an interpretation of Article 22. In addition, this article aims to give an overview of the wording, limitation and potential regulatory gaps, which exist in Article 22 of the GDPR
