O parecer analisa o termo inicial da prescrição administrativa da pretensão de recomposição de prazo de outorga de geração de energia elétrica, previsto na esfera administrativa pela Resolução Normativa ANNEL n. 680, de 15/09/2015, e na esfera legislativa pelo art. 4º da Lei 13.203, de 08/12/2015, substituído pelo art. 19 da Lei n. 13.360, de 17/11/2016. No direito administrativo, o prazo prescricional é de 05 (cinco) anos, previsto no art. 1º do Decreto 20.910/1932, ausente outro prazo específico em lei. A contagem do prazo prescricional para o exercício da pretensão administrativa de recomposição de prazo de outorga de geração de energia elétrica de operação que se iniciou antes da vigência da Lei n. 13.203, de 08/12/2015, inicia-se da sua data de entrada em vigor, quando não aplicável a Resolução Normativa n. 680, de 15/09/2015. ; The legal opinion aims to analyze the initial term of the administrative prescription of the claim to recompose the term of the power generation concession, provided in the ANNEL Normative Resolution n. 680, of 15/09/2015, and in the art. 4 of the Law n. 13.203, of 12/08/2015, substituted by art. 19 of Law n. 13.360, of 11/17/2016. In administrative law, the prescription is 05 (five) years, provided for in art. 1 of Decree 20.910, of 1932, absent another specific term in law. A counting of the administrative prescription of the claim to recompose the term of the power generation concession from operation that begins before Law n. 13.203, of 08/12/2015, starts from its date of entry into force, when no apliqued Normative Resolution n. 680, of 15/09/2015.

This study examines the adoption of arbitration for the definitive solution of conflicts between Brazilian Public Administration and its citizens. Despite strong sociological reasons against adopting the institute in Brazil, surprisingly, legal scholars assimilated it with ease. Dogmatic reasons, however, prevent its adoption. The thesis that it is possible when it comes to the secondary interest is untenable, as the secondary interest is only valid when it coincides with the primary one. The unavailability of the public interest was circumvented by explicit legislative authorization term. It is impossible to circumvent the supremacy of the public interest over the private one, which prevents removing the judiciary from having the final word prerogative on the interpretation of matters of the public interest. Therefore, all laws that authorize administrative arbitration are unconstitutional. ; Este estudio trata sobre la adopción del arbitraje para la solución definitiva de los conflictos entre la Administración Pública brasileña y la administrada. A pesar de las fuertes razones sociológicas en contra de la adopción del instituto en Brasil, sorprendentemente la comunidad jurídica lo asimiló con facilidad. Sin embargo, razones dogmáticas impiden su adopción. La tesis de que es posible cuando se trata de interés secundario es insostenible, ya que el interés secundario solo es válido cuando coincide con el primario. La indisponibilidad del interés público se eludió mediante autorización legislativa expresa. Es imposible eludir la supremacía del interés público sobre el privado, lo que impide que el poder judicial tenga la prerrogativa de dar la última palabra en la interpretación de los asuntos relacionados con el interés público que deben descartarse. The purpose of this paper is to address confidentiality in electronic public procurement, since current legislation in Uruguay determines that public procurement must be guided, in a very broad rule, by the principle of transparency, considering that it is the true basis of contracting democracy, which makes it the main instrument to combat corruption. It happens that the legal system foresees exceptions, in which the information can be classified as secret, reserved and confidential, as defined by the legislation. Finally, it addresses the Electronic Opening modality to be used by the Public Administration in its contracts. ; El propósito de este artículo es abordar la confidencialidad en la contratación pública electrónica, ya que la legislación vigente en Uruguay determina que la contratación pública debe guiarse, en una regla muy amplia, por el principio de transparencia, considerando que es el verdadero sustento de la contraer la democracia, lo que la convierte en el principal instrumento para combatir la corrupción. Ocurre que el ordenamiento jurídico prevé excepciones, en las que la información se puede clasificar como secreta, reservada y confidencial, según lo define la legislación. Finalmente, aborda la modalidad de Apertura Electrónica para ser utilizada por la Administración Pública en sus contratos. ; O objetivo deste trabalho é abordar o sigilo na contratação pública eletrônica, uma vez que a legislação em vigor no Uruguai determina que a contratação pública deve ser pautada, em regra muito ampla, pelo princípio da transparência, por ser esta a verdadeira base da democracia contratual. o que o torna o principal instrumento de combate à corrupção. Ocorre que o ordenamento jurídico prevê exceções, nas quais as informações podem ser classificadas como secretas, reservadas e confidenciais, conforme definido pela legislação. Por fim, trata da modalidade Abertura Eletrônica a ser utilizada pela Administração Pública em seus contratos.

Práticas pedagógicas em prevenção ao abuso de drogas: aspectos motivacionais

Pesquisas reconhecem a presença de drogas psicotrópicas nas escolas e abuso dessas substâncias entre alunos. Apontam a necessidade de melhorar a formação de professores em prevenção ao consumo de drogas. Estudos demonstram que o contexto da sala se aula e a atuação do professor são elementos determinantes para assegurar o interesse e o entusiasmo na aprendizagem. O objetivo desse trabalho foi investigar se as atuais práticas docentes são apropriadas à demanda do abuso de drogas entre estudantes. Realizou-se uma intervenção pedagógica entre professoras (23) de educação básica fundamentada no método dialético: tese, antítese e síntese. No presente estudo, o planejamento e a estruturação da intervenção tiveram como foco criar um clima que viabilizasse a motivação para aprender dos professores participantes. Os resultados mostram que a construção de um ambiente de aprendizagem estimulante está associado à motivação de quem aprende. Além disso, sugerem que as propostas inconsistentes do início da intervenção foram se redefinindo até a formulação de propostas novas e adequadas ao contexto social, evidenciando articulação de conhecimentos sobre prevenção ao uso de drogas.
TESTIMONY WITHOUT HARMFUL EFFECTS: FULL PROTECTION OF THE CHILD VICTIM OF INTRAFAMILIAL SEXUAL ABUSE
Introduction: intrafamilial sexual abuse of children is a social and public health problem. The investigation of crimes of this nature shows widespread and often irreversible psychological harm to the victims. The harmful effects arise from the act itself as well as the absence of special care for children, whose development is gradual and whose condition of being subjects with rights is often ignored. Interdisciplinary coordination among the fields of Law, Psychology, and Social Work is essential to reduce the extent of the damage. The coordination of these areas of expertise when put into practice leads to the non-victimization of the child. This interdisciplinary effort has gained prominence in the discussions of children's rights, and the possibility of its implementation in the project "Testimony without harmful effects" (DSD, acronym in Portuguese). Objective: to analyze the DSD (Depoimento Sem Dano) from the perspective of the full protection of the child. Methods: a qualitative approach, with a literature review, legislation review and semi-structured interviews. Results: there was a shortage of national literature on DSD. The interviews enabled the designation of four categories based on the analysis of the different points of view of DSD according to those interviewed: the actions of the legal professionals and the care for children; the need for change in the dynamic of listening to the child victim; positivity of the "DSD" project proposal; the effectiveness of the technique. Discussion: the most characteristic aspects of intrafamilial sexual abuse of children justify the use of the DSD technique and its integrative phases. Conclusion: there is an imminent need for an extensive discussion of the guarantee of and effectiveness of the human rights of the child victim of intrafamilial sexual abuse, of the child victim's treatment and of listening to the child in a judicial proceeding. Dialogue among the different areas of expertise involved in the protection of the child is essential for the effective success of new possibilities.

"A guerra civil é a matriz de todas as lutas de poder": o debate com o marxismo na analítica do poder de Michel Foucault

Making the genealogy of power was never Foucault's clear intent. However, the power issue was always a recurring theme in his investigations, to the point of scholars suggesting a division and organization of his work as from three theoretical axis. Within this perspective, the analytic of power would mark Foucault's philosophical path in the 70's. Indeed, until 1994, the year of publication of a series of texts, interviews and conferences by Foucault on 'Dits et écrits', the issue of the analytic of power was mostly known from books like 'Urveiller et punir' (1975) and 'Histoire de la sexualité I: la volonté de savoir' (1976). With the beginning of the publication of the classes in 'Collège de France' from 1997 the reading towards the analytic of power might undergo an enlargement. But it isn't until 2015 that the entirety of Foucault's classes on Collège de France were published, opening an important path towards the investigation concerning the first reflections regarding power. It is our intention to show on this paper how the first steps of the analytic of power by Michel Foucault comes to life from a gauchiste context still set in the terms of a dynastic of knowledge. Accordingly, we try to show how the dynastic period matches a theoretical sketch, first attempts of formulation of the power concept, distinctively elaborated in contrast with marxism. This opposition occurs mainly in the refusal both of the Marxist infra-superstructure scheme and of the contractualist (Hobbesian) model of state society.

As reviravoltas de um conceito: a crítica do "poder" em Michel Foucault

In this article, we will undertake a reflection on the analytics of power in Michel Foucault. Our intention is to cover Foucault's production from the mid-seventies to the beginning of the eighties, seeking to understand the shifts or "twists and turns" through which the concept of power has suffered over time. We will try to show that it is possible to identify three moments in Foucault's research. First, when trying to move away from the traditional legal-discursive understanding of power, he introduces an unprecedented analysis of the dynamics of disciplinary power and the micro-powers that make up the social field. This can be considered a shift, in general, in relation to the western political tradition. With the course society must be defended we are faced with a change in the understanding of power when identifying it as war or struggle. Finally, with the introduction of the concepts of biopower/ biopolitics, Foucault is led to a great expansion of his research, focusing on concepts that were not part of his interest until then, such as, for example, the concept of State. It is in this context that the concept of government will enter Foucault's reflections. We understand that the concept of government is a refinement and, likewise, makes its analysis of power broader and more complex in order to account for the political present.

This article seeks to investigate art as an emblematic example of life as will to power, from the perspective of Friedrich Nietzsche. According to Nietzsche life is a constant creating and recreating without a pre-defined teleology. It is precisely this aspect that art expresses a more transparent way what life is therefore art is precisely the process of creation and recreation without a purpose beyond creation itself. The art from the perspective of the artist is always unfinished and so he continues to create, is as if the artist somehow would capture what life is, and reveal it in their art and in the creative process. The art besides being like everything else, moved by the will to power, to the extent that she herself is a constant drive by creating, reveals a very peculiar way the pathos that is life as will to power that always surpasses herself . Therefore, to realize the true artist against the current world how content and content as form, realizes the inverted world, and in this reversal look allows play with life, creating and transforming the current New. The Khüne obligation under the Portuguese Code of Administrative Procedure – In search of a Euro-compatible solution
The purpose of this text is to analyse the solution enshrined in Article 168 (7) of the Portuguese Code of Administrative Procedure, which has been in force since 2015. The provision establishes a duty of administrative annulment of final administrative acts contrary to EU law and seeks to echo the case-law of the Court of Justice of the European Union (CJEU) which has the Kühne judgment as its landmark decision. However, a closer reading reveals that that provision is not entirely compatible with the case-law of the CJEU to which it, at first sight, relates to. After qualifying that national provision as a relevant rule of EU Administrative law, we will seek to decipher its meaning and scope, in light of the relevant case-law in order to find an interpretative solution that is compatible with EU law.

A analítica do poder pastoral na genealogia das artes de governo em Foucault

In the course of 1978 Security, territory, Population Foucault takes as its object of analysis the pastoral power developed and extended by the Catholic Church from the third century to the 16th century. How can we place this study in Foucault's trajectory? We think that the analysis of power extended to the pastoral scope serves the realization of the genealogy of modern governmentality, so that the art of Christian government inserts itself in the history of rationalised political practices. We seek to demonstrate the author's thesis that the techniques undertaken by the Christian pastoral power and that produce a power at the same time individualizing and totalizing are present in current political governmentality. For that, we set the specificity of pastoral power in relation to political rationality, which confers its exteriority against the ancient Greek thought and the arts of government from the modernity. Thus, the refusal of a laicizing reading of pastorate is evident, since the techniques of pastoral government go beyond the religious sphere in which they were circumscribed, what puts the question of how to govern in different social fields.
