Voor u ligt het liber amicorum voor Bart Jan van Ettekoven ter ere van zijn afscheid - 'time out' - als voorzitter van de Afdeling bestuursrechtspraak. Met dit werk brengen collega's, oud- collega's en anderen met wie Bart Jan nauw heeft samengewerkt een eerbetoon aan hem en aan zijn grote bijdrage aan het bestuursrecht, en de Nederlandse bestuursrechtspraak in het bijzonder. Op Bart Jans bijdrage wordt in het eerste deel van de bundel inhoudelijk gereflecteerd, aan de hand van vijf thema's die hem aan het hart gaan: digitalisering en A.I., de gereedschapskist van de bestuursrechter, maatwerk, communicatie en evenredigheid en vertrouwen. Dat zijn allemaal terreinen waarop Bart Jan het bestuursrecht als het ware (opnieuw) heeft 'gearrangeerd'. Het tweede deel bestaat op verzoek van de redactie uit korte, relatief luchtige bijdragen over Bart Jan zelf, en hoe de auteurs hem als persoon hebben ervaren. Veel geroemd worden daarin Bart Jans gaven als communicator en inspirator, en zijn benaderbaarheid, brede wetenschappelijke belangstelling en natuurlijk grote kennis van en liefde voor muziek. "The European Union is today a major player in many policy areas, going from classic economic fields as competition policy, agriculture and fisheries policy to new emergent fields as environmental policy, arterial intelligence policy, security and foreign policy and criminal justice policy. These policies comes with an increasing level of EU regulation, having also a substantive impact on the harmonization of national policies and regulations. This expansion of EU competence naturally also places new demands on their enforcement, especially when it comes to investigations with the aim of imposing punitive administrative and/or criminal sanctions. In this expanded version of his valedictory lecture Prof. Vervaele is assessing 1) to what extent the EU and its Member States have a policy on punitive enforcement in the internal market and in the Area of Freedom Security and Justice and 2) how this policy translates into the harmonization of substantive administrative and criminal law and procedural law at the national level and into the elaboration of administrative and judicial cooperation instruments and the setting up of European enforcement agencies. The assessment includes to what extent this policy takes account of the human rights obligations. Vervaele concludes with a plea for a European model for punitive law enforcement with an increased alignment between the administrative enforcement tools in the internal market and the criminal enforcement tools in the Area of Freedom, Security and Justice. In this model the national enforcement authorities are build in under a network cooperation scheme."--

Het wetenschappelijke oeuvre van Jan Jans, dat zich tot op heden over zo?n 35 jaar uitstrekt, staat in het teken van grensoverschrijdende rechtsbeoefening. Jan is van het Europees recht, het nationaal recht, het bestuursrecht, het milieurecht en het internationaal recht, maar vooral van de interactie tussen die rechtsgebieden.0Grensoverschrijdend was hij al in zijn proefschrift uit 1987 (Grensoverschrijdend milieurecht) en hij is het in de decennia die daarop volgden gebleven. De interactie tussen nationaal, internationaal, Europees, milieu- en bestuursrecht is het centrale thema in zijn oeuvre. Dat thema past hij toe op algemeen staats- en bestuursrechtelijke onderwerpen als rechtsbeginselen, rechtsbescherming en overheidsaansprakelijkheid. Daarnaast staat het thema centraal in zijn publicaties over rechtstreekse werking en richtlijnconforme interpretatie en is het ook nadrukkelijk aan de orde in zijn publicaties over het (Europees) milieurecht.00Bij de totstandkoming van dat bijzonder rijke oeuvre heeft Jan met talloze anderen samengewerkt. In Groningen, in Amsterdam en daarna opnieuw in Groningen, maar ook in Edinburgh en op legio andere plaatsen in en buiten Europa. Niet alleen zijn publicaties vormen daarvan het bewijs, maar ook alle proefschriften die onder zijn supervisie tot stand zijn gekomen. Daarnaast zat Jan vol strategisch slimme initiatieven die samenwerking in de hand werkten. Zo nam hij een leidende rol bij diverse handboeken voor het onderwijs, was hij bij een hele reeks tijdschriften een buitengewoon bepalend redactielid en stond hij en passant ook nog aan de wieg van het Review of European Administrative Law (REALaw).00Eind september 2021 leek ons daarom een passend moment om de betekenis van die wetenschappelijke activiteiten te markeren, door een aantal personen met wie hij de afgelopen decennia heeft samengewerkt te vragen een beknopte bijdrage te schrijven op het grensvlak van nationaal, Europees en/of internationaal recht

This dissertation reports on the research into Surinamese constitutional law during the military administration between 1980 and 1987. During this period of martial law there was neither an elected parliament nor any other form of authority with parliamentary legitimacy in Suriname. The research into the military administration is predominantly normative research into the formal constitutional arrangement of the Surinamese state during the 1980-1987 era. During the military period, historically developed principles and requirements of the rule of law and democracy were discarded either completely or in part, with some being completely absent and others remaining intact. This turnaround also brought about a fundamental change in the administrative structure and laws of Suriname. In addition, new legal institutions were added to the judicial system.During this period, the then ruling political powers argued that Suriname remained a constitutional democracy and that martial law was only a necessity under the circumstances. To assess to what extent there was democratic rule as well as the justification of the use of martial law, a study was conducted into the theoretics of constitutional democracy and martial law. States often are described as constitutional democracies; however, around the world there are differences as regards to what extent. To measure the degree of democracy, it is tested against internationally recognized frameworks enshrined in international conventions, treaties and doctrines. Theories on the subject of the constitutional democracy and martial law have been developed and fine-tuned over the years.
