Purpose: the purpose of our research is an analysis the norms of the Air Code of Ukraine concerning aviation safety and academic literature with aim to give definition administrative-law regulation safety of civil aviation. Methods: using the methods of comparison and analysis in conjunction with formal legal determined by the nature are given definitions environmental safety, economic safety and information safety. Also is given definition administrative-law regulation safety of civil aviation. Results: in the context of analysis the norms of the Air Code of Ukraine and academic literature the author considers an aviation safety as a complex legal phenomenon that, on the one hand is a relatively stable condition, and on another consists of five elements. Аn environmental safety, economic safety and information safety should be given a definition and included in the Article 1 of the Air Code of Ukraine. The article provided the following definition of administrative-law regulation safety of civil aviation: it is carried out by the State overbearing influence on the operators of aircraft and other aviation activities by adopting regulations varying legal force (as well as authorization in to national legislation regional and international agreements) regarding a safe usage of aviation objectives in order to ensure of a safety of civil aviation. Discussion: in this article the author to consider of a concept of aviation safety and its elements. The subject. The paper deals with the search for the place of judicial administrative procedural law in the system of Russian law.The purpose of the paper is to identify is the judicial administrative procedural law an independent branch of Russian law.Methodology. The author uses the methods of analysis and synthesis, as well as dialectic approach. The formal-legal interpretation of the Code of Administrative Proceedings, the Code of Administrative Offences, the Commercial Procedure Code, the Civil Procedure Code of the Russian Federation and is also used.The main results and scope of their application. The adoption of the Code of Administrative Proceedings in Russia in 2015 revealed many problems in science and legislation. A legislative decision to adopt the Code of Administrative Proceedings is considered as a political decision taken without a proper scientific basis and contrary to established scientific doctrine. Definitions of such basic concepts as "administrative process", "administrative dispute", "administrative justice", and others have not been developed in the period up to 2015 and to date, There is a mention of "administrative legal proceedings" as one of the types, along with civil, criminal and constitutional types of legal proceedings, in the Constitution of the Russian Federation. But administrative procedural legislation is referred to the joint jurisdiction of the Russian Federation and the constituent entities of the Russian Federation, in contrast to other procedural laws, in the Constitution of the Russian Federation. Representatives of the science of civil procedural law, with reference to legal theorists, called judicial administrative procedural law (which is referred to the Code of Administrative Proceedings) the secondary formation, a sub - branch of the fundamental (profiling) branch of civil procedural law. The purpose of judicial administrative procedural law – enforcement of substantive law and conflict resolution in the field of administrative and other public relations. It is noted that the public-legal dispute is not limited to the interaction of the citizen with the executive power. Civil procedural regulation of judicial review of cases arising from public relations is a procedural mechanism of judicial protection of constitutional rights, freedoms and legitimate interests. The Code of Administrative Proceedings lowers the status of cases arising from public legal relations to the status of cases arising from administrative legal relations. Representatives of the science of administrative law and procedure, on the contrary, believe that the adoption of the Code of Administrative Proceedings becomes the final act in the formation of a new branch of law – administrative judicial law, although it is a political decision and it's rules are practically copied from the Civil Procedure Code. At the same time, it is recognized that the Code of Administrative Proceedings needs scientific support, which still needs to be created. An alarming factor is the fact that some scientists propose to include cases concerning imposition of administrative sanctions in the this forming branch of law, although it mixes in fact disputes between individuals and a public entity and imposition of administrative sanctions to the offender by the court.Conclusions. It is premature to say that judicial administrative procedural law has emerged as an independent branch of Russian law. Prospects for further development of administrative proceedings are very uncertain due to the high proportion of subjective, political factors in the legislative process. ; Рассматривается поэтапное движение законодательства и научной мысли от неупорядоченного выделения «административных» дел, рассматриваемых судом, к единым процессуальным правилам. Обосновывается авторская точка зрения, что полярные мнения в науке, в совокупности с противоречивыми и непоследовательными действиями законодателя, в настоящее время не позволяют утверждать о наличии новой отрасли права, предметом которой стало бы рассмотрение различных административных дел. Одного лишь законодательного шага – принятия Кодекса административного судопроизводства – при существующей терминологической путанице, неопределенности с предметом и методами регулирования, недостаточно для утверждения новой отрасли права.

The subject of the research is the problems of constitutional law enforcement of administrative offences legislation, taking into account the prospects for its new codification.The purpose of the article is confirmation or confutation of the hypothesis that the effectiveness of the new Code of administrative offences depends on whether the legal positions of the Constitutional Court of the Russian Federation on the principles of administrative responsibility will be taken into account when drafting it.The authors use methods of complex analysis, synthesis, as well as formal-legal method of interpretation of Constitution, legislation on administrative offences and judicial decisions of Russian Constitutional Court.The main results and scope of their application. The administrative torts law in Russia is expected to pass through the total review up to the grounds of its codification in close future. The article presents initial positions of that changes within basic frames produced by Russian Constitutional Court. Its case-law has already invaded into many spheres and details in respective sphere of legal rules and also prescribed a lot for their future. This case-law yet is necessarily made within its inherent range for it is ever constrained procedurally by content of actions and cases to be settled. However Russian administrative torts law is destined for reformation in new code-making in view of constitutional case-law and in order to do better with neighbor spheres of legal responsibility. Disputable matters of administrative liability, the company's responsibility with psychical fiction on its fault (corporative thinking, wishing, desire, diligence), substantial and procedural equity etc. are described and discussed in the article as to the administrative law of torts on in its constitutional dimension.Conclusions. The Code of administrative offences of the Russian Federation does not fully meet the legal needs of society. Work on real improvement of this code will continue, therefore, legal science should be more strongly and persistently to implement in legislative practice constitutional ideas about improvement of codification and ensuring unity of legal space of the country. In particular, it is necessary to settle the debatable aspects of tort liability, the guilt of legal entities when it is addressed by fiction to the phenomena of the psyche (thinking, goals, will, caution), the constitutional and legal foundations of justice in the field of administrative penalties, procedural enforcement of rights and freedoms, etc. ; С учетом ожидаемого системного пересмотра законодательства об административных правонарушениях описывается исходная к этому обстановка, главным образом с правовых позиций Конституционного Суда Российской Федерации, которые изложены по предмету как небольшой свод правоположений с их юрисдикционными обоснованиями. Фиксируется, что эти позиции привели к заметным конституционно-правовым вмешательствам в административно-деликтное право и многое опреде-лили в нем на будущее в прескриптивных обращениях к законодательным властям. Исходя из ретроспективы и текущего состояния, предполагаются объем и структура предстоящей административно-деликтной кодификации, затрагиваются дискуссионные стороны деликтоспособности, вины юридических лиц, когда она обращена по фикции к явлениям психики (мышлению, целям, воле, осторожности), конституционно-правовые основы справедливости в области административных наказаний, процессуального обеспечения прав и свобод и другое по заявленной теме.

Исследование правовой природы показывает, что в современном таможенном праве можно выделить наднациональную (международную) и национальную части. Наднациональная часть включает нормы Таможенного кодекса таможенного союза и иных нормативных актов, которые принимаются международными договорами. Нормы национальной части принимаются законодательными актами страны. Таким образом, таможенное право — комплексная отрасль права, регулирующая общественные отношения в сфере перемещения товаров через таможенную границу Таможенного союза. = Scientists differ in their opinions regarding the place of customs law in the legal system. Customs law is understood as the institute of administrative law, a sub-branch of administrative law, a separate complex branch of administrative law or a complex branch of legislation. The research of its legal nature shows that it is possible to distinguish supranational (international) and national parts within the contemporary customs law. The supranational part includes the Customs Code norms of the Customs Union and other legal acts which are adopted by international treaties. The norms included into the national part are adopted by legislative acts of the country. Thereby, customs law is a complex branch of law regulating public relations in the sphere of movement of goods across the customs border of the Customs Union.

An administrative process consists of management and administrative jurisdiction (proceedings).Process and production correlate as general and special phenomena.The administrative process, which manifests itself specifically in various types of administrative proceedings, is a set of consistently performed procedural actions, which are performed at certain stages during the consideration of individual specific cases by the competent authorities.Administrative jurisdiction in the broad sense may be understood as totality of the powers of state or municipal bodies, established by the law or other normative legal acts, to regulate social relations, to assess the legality of actions of a person, to resolve legal disputes and to consider cases on administrative offences, to carry out other legally significant actions.Conclusions. Administrative jurisdictional activity (public, regulatory, regulative, enforcement), is connected with the solution of legal disputes. That is why the state may not be in the side from this type of activity and considering the control and supervision as a priority government function through laws and other normative legal acts of the administrative-legal nature in the various spheres of economy. ; В статье рассматриваются вопросы административно-правового регулятивного воздействия на контроль и надзор в государственном управлении, объективная необходимость которого для жизнедеятельности как субъектов рыночной экономики, так и государства в целом и определяет его всеобщий, публичный характер при всех общественно-экономических формациях.
