The Indonesian Plant Varieties Protection Act : The Dilemma of Meeting International and Bilateral Obligations and Protecting Traditional Farmers
Plant variety protection is a relatively new concept for many Indonesians. It was developed because of the patent regime's failure to provide appropriate protection for new plant varieties. This new sui generis legislation for the protection of plant varieties was enacted in response to Article 27.3(b) of the TRIPS Agreement, which requires WTO Members to provide an effective sui generis law for the protection of new plant varieties. This paper analyses the current state of plant variety protection in Indonesia. It covers the threshold of protection, the subject, scope, right and obligation of breeders, exceptions to infringement, farmers' rights and local varieties. It also analyses the current policy to revise the Plant Variety Protection Act and the underlying reasons for this, including Indonesia's national interest and its international and bilateral commitments. The main focus of the paper explores why such policy is not broadly compatible with the Indonesian agricultural tradition of seed sharing. Accordingly, this paper explores the tradition of seed sharing in Indonesian culture known as adat. In addition, it explores the likely implication of such protection for national agricultural innovation.

This reseach aims to analyse the implementation of the entertainment tax-voting system in Cirebon. method using descriptive analysis. The subject of the Sub-Division head of indigenous revenue, the regional field staff of indigenous revenue, the budget agency, the Regional Representative Council of Cirebon. The result of data obtained that the voting mechanism is initiated from registration and logging, determination, depositing, accounting and reporting as well as billing tax collection conducted by the financial agency of the city of Cirebon in accordance with the prevailing regulations, as well as the procedure of objection and appeal, correction, cancellation, reduction of provisions, elimination or reduction of administrative sanctions and refund of overpaid entertainment tax . ; Key words: Tax Voting system Entertainment.

International society: the social dimensions of Indonesia's foreign policy
Realism has been the dominant conceptual approach to studying Indonesian foreign policy. This article, however, considers realist analyses to be insucient since their emphasis on the struggle for power and security in the system of states has led to the neglect of the importance of perspectives which focus on order. To ll the gap it then intends to apply the English School perspective which focuses on the concept of international society to trace the nature and function of Indonesian foreign policy. Two cases are examined, including the Asian African Conference and Association of South East Asian Nations, to demonstrate the relevance of international society for policy ideas and action. The central argument is that the Indonesian elite worldview indicates that the creation and maintenance of order in international societies are ones which are prominent objectives legitimizing the conduct of Indonesia's external relations.

Strengthening the Regional Investment Agreements for Promoting International Trade in ASEAN Economic Community
This paper analyses the important of regional investment agreements for promoting international trade in ASEAN countries. To visualize the above idea, this work will explain the roles of regional investment agreements to serve investment, trade facilitation and to protect regional investment interests. It is argued that regional investment agreements can serve as a vehicle for dialogue, coordination on and to response regional issues including regulatory harmonization, infrastructure development, and collaboration among members to facilitate investment. The paper shows how regional agreements will commit to eliminate barriers on substantially trade and investment, create positive welfare gains, the productivity and stimulus to growth in the region. This paper also analyses the effect of the establishment of an ASEAN Economic Community (AEC) by 2015 to the regional investment policies. AEC aiming at transforming ASEAN into a single market and production base with a highly competitive economic region, equitable economic development, free movement of goods, services, investment, skilled labor, and freer flow of capital, will likely accelerate regional integration and cooperation in the investment sectors fully integrated into the international trade. Then, this work demonstrates the implementation of regional investment cooperation into the formal instruments/agreements of investment policy architecture promoting and protecting cross border investment among nationals of ASEAN member states, such as ASEAN Investment Guarantee Agreement (IGA), the ASEAN Investment Area (AIA) and ASEAN Comprehensive Investment Agreement (ACIA). However, it is realized that the ASEAN members may resist and protest against the regional investment agreements because of conflicting their national interest. The paper proposed that the regional inv stment agreements need to be strengthened by harmonization and structural adjustment due to the member's resistance and protest. This idea may spark challenge because each member has fundamental differences on the nature and character of legal and economic systems reflecting different political systems, economic and social cultures in accordance with the philosophy of life values and national interests of each country. To overcome the challenge, this paper argues that ASEAN member countries need to unilaterally and collectively come up with structuring trade and investment policy harmonization to move ahead and reap the benefits from regional investment agreement as a common tool for contesting their interest in international trade. In addition, pre agreed flexibilities to accommodate the interests of all ASEAN countries may eliminate the problem.

Efficiency Analysis of Zakat Institutions Based on The Organizational Cluster in Indonesia: Free Disposal Hull (FDH) Approach
This study aims to analyse the level of efficiency of zakat institutions in Indonesia between 2014 and 2018. Zakat institutions are divided into three clusters based on the organisation's nomenclature: the government, public, and private groups. The division of these clusters aims to see differences in the management of zakat funds between each group. This study uses a quantitative research approach through the Free Disposal Hull (FDH) method to produce a more comprehensive average efficiency estimation than the Data Envelopment Analysis (DEA). The sampling technique is purposive, and there are fourteen research objects observed. The government cluster is the cluster with the highest efficiency value. The private set comes in second, and the public group comes in third ranking. The high score that the government cluster earns is due to their primary business purpose, which focuses on managing zakat funds. The results of this study can be used as references for the policy establishment of zakat institutions in Indonesia.

Disclosure of Origin of Plant Genetic Resources: Challenges for Supporting Food Security in Indonesia
Protecting plant genetic resources is crucial because they are a key element in supporting food security for Indonesia's growing population. An important element in the protection of plant genetic resources is the disclosure of origin of genetic resources. In line with international standards and commitments, Indonesia has enacted a Patents Act that seeks to protect its plant genetic resources by requiring disclosure of origin. However it is one thing to enact legislation and quite a different thing to effectively implement the legislation to achieve its aims. This paper critically analyses the Indonesian Patent Act and highlights some key issues that undermine the effectiveness of the Act. The paper identifies the problems of implementing provisions of the Act at the normative and practical levels. At the normative, the Act lacks clarity with concepts undefined. This is compounded at the practical level by a lack of a regulatory framework and inadequate human resources. The paper suggests that given the importance of disclosure of origin in protecting plant genetic resources for Indonesia's food security, developing further legislative and institutional framework on disclosure of origin is an essential strategic solution for the country.

Ensuring Disclosure of Origin of Genetic Resources in Patent Applications: Indonesia's efforts to Combat Biopiracy
As a country of mega biodiversity, Indonesia is also vulnerable to biopiracy target. To prevent biopiracy, it is crucial to protect the country's genetic resources. In order to protect genetic resources and to prevent biopiracy, Indonesia has included the requirement of Disclosure of Origin (DO) in The Indonesian Patents Act, 2016 by imposing patent applicants to disclose the origins of genetic resources in Patent application. This paper critically analyses the Patents Act to highlight key issues that undermine the country's efforts to combat biopiracy. The principal findings are that there are significant problems with implementing DO provisions of the Act in the fight against bio piracy. The effectiveness of the legislation remains questionable and some important sections of the Act lack clarity. The purported regulatory framework under the Act to enforce DO and to help deal with biopiracy is ill defined and human resources are inadequate. The paper concludes that to combat biopiracy effectively Indonesia needs to review its legislative and institutional framework on DO and consider establishing a National Anti-Biopiracy Commission.

The Effect of Legislative's Characteristics on the Local Government Performance in Sumatera 2014
Local Governments' Performance in Sumatra are still vary, some has a good performance, and other is poor. According to the agency theory, the Ssupervisory Board (Legislative-DPRD) has an important role in improving the performance of local governments by overseeing the executive's behaviour. However, previous research in this area is still limited, especially among local governmentin in Sumatra Island. The research purpose is to investigate the effect of legislative characteristics on the performance of local governments. By using the 81 local governments (53% of the total population) and secondary data, we applied the multiple regression analysis is to analyses the data. The funding shows that there is no role of Supervisory Board (Legislative) to determine the performance of local government. However, one of control variable has a positive significantly relationship with performance, namely the operational revenue growth. The result have a theoretical and practical contribution. Theoretically, the study enrich the public governance literature and practically the society could advocate the role of supervisory board in improving the local governments' performance. The study's aim was to examine the intervening effect of constituent trust on therelationship between political product, promotion, and candidate image and selectiondecision of The Major and Deputy Major in Pariaman City. The research populationis all constituents who used voting rights in the Period of 2013, and the number ofsample was 100 constituents by using quota sampling. In order to test hypotheses,this study performs mutiple, simple and hierarchical regression analyses. The resultsof study displayed that a) Political promotion and candidate image significantlyinfluence selection decision of The Major and Deputy Major, while political productdid not effect selection decision of The Major and Deputy Major. b) Politicalpromotion and candidate image significantly constituent trust, while political productdid not affect constituent trust. c) Constituent trust found to have significantlyinfluence on selection decision of The Major and Deputy Major. d) Constituent trustplays as intervening variable on the relationship between political promotion,candidate image and selection decision of The Major and Deputy Major. Efficiency and Effectiveness of Government Expenditure on Education at Districts/Cities Level in East Java Indonesia
The purpose of this study is to investigate and analyze the efficiency and effectiveness of local government expenditure on education sector in districts and cities level of East Java, during the periods 2007-2014. Furthermore, this study will evaluate the impacts of local government expenditure, household expenditure for education, and regional product domestic bruto or (PDRB) on the educational outcomes, namely education index. Data Envelopment Analysis (DEA) is selected as the methodology for analyzing the efficiency of local government expenditure on educational outcome. The model assumes constant return to scale (CRS) and variable return to scale (VRS). Measurement of the effectiveness of government spending is done by using panel data regression. Data for supporting the analyses is panel data from 38 districts and cities in East Java for the periods of 2007 – 2014. The results show that government expenditure in educational sector is relatively inefficient. Government Expenditure for Education (PPP) has no significant impact on educational index, while Household expenditure for education (PPRT) and GRDP per Capita positive has significant impact on the Education Index (IP). This imply that government expenditure for educational sector is not effective improving educational index.

Response on New Credit Program In Indonesia: An Asymmetric Information Perspective
The Indonesian government launched a new people's business credit program as part of a package of economic policy and deregulation. The interest rate is set lower than the average of the current loan interest rates, especially when compared with rural bank interest rates. To capture the social spatial aspects, quota sampling is applied to ten areas that divided based on the social culture. Further, the method utilized in this research is logit models, which designed to analyse the determinants of asymmetric information particularly on the rural bank and small micro enterprises. The study was conducted in East Java as the province with the largest number of rural banks in Indonesia. Based on the estimation of asymmetric information model to the respondent of rural banks and small businesses, the result shows that adverse selection can be avoided by strengthening the information about prospective borrowers. Regarding moral hazard, rural banks and small businessmen argued that the imposition of the collateral to the debtor has an important role to avoid moral hazard. Rural bank respondents stated that the KUR program with low-interest rates has affected their business development. The results implied the need of broadening the collaboration schemes between this people's business credit program and rural banks.
