The article studies the process of constitutionalization of associative relations between Ukraine and the European Union. The author distinguishes and reveals two significant aspects of this process, namely meaningful and implementing. It is determined that meaningful constitutionalization by its essence is the constitutional modernization, where the meaningful updating of the Constitutional provisions is made in order to form the constitutional pillars for further democratization of social and political life in Ukraine, the approximation of the national political and legal system in accordance with the European values and principles, the improvement of the internal legal framework. The implementing aspect of constitutionalization means the purposeful formation of constitutional preconditions for the implementation of Association Agreement's provisions to the national legal system. The author stipulates that the fulfillment of both meaningful and implementing aspects of constitutionalization of Ukraine's association with the EU shall be implemented mainly by incorporating of this process directly into the context of the constitutional reform in Ukraine. The special attention is paid to certain problems of the reformation of the Constitution of Ukraine ensuring the European integration. The author expresses the critical reservations related to the amendments to the Constitution with the provisions of strategic orientation of Ukraine for the long term perspective.
This contribution deals with the legal and constitutional aspects of the implementation of the association agreements between the EU and Ukraine, Moldova and Georgia in a comparative perspective. It argues that the legal frameworks of the association agreements, which have the objectives to establish a unique form of political association and economic integration, are characterised by three specific features: comprehensiveness, complexity and conditionality. After a brief background of the EU relations with Ukraine, Moldova and Georgia, the following aspects are scrutinised: legal basis and objectives, institutional framework and mechanisms of enhanced conditionality and legislative approximation. In addition, constitutional challenges for the effective implementation of the association agreements between the EU and Ukraine, Moldova and Georogia are discussed. Based upon a comparison with other EU external agreements, it is demonstrated that the association agreements are innovative legal instruments providing for a new type of integration without membership.Key words: association agreements, the European Union, Ukraine, Moldova, Georgia, constitutions, implementation. Ukraine–European Union Association Agreement defined a new, unique form of cooperation between parties. This very important document had shown the importance not only for Ukraine's aspiration to become a part of the European Community, but also demonstrated readiness of the EU to accept Ukraine as a state that is a part Europe. The process of signing the Association Agreement was not easy and ended successfully only from the second attempt. Signature and ratification of the Association Agreement was delayed by a number of events: Ukraine's rejection to sign the Agreement in Vilnius (2013), the Maidan revolution events, escalation of the situation in Crimea and Donbass, Presidential elections, and Nederland's referendum. As of today, the Agreement is considered to be the biggest normative legal act in history of the EU and Ukraine.Most experts are analyzing The Association Agreement from the economic point of view. Indeed, economic part is one of the major parts of this document. However, its realization on the ground is impossible without political cooperation. This article focuses on the political part of the Agreement. The purpose of this paper is to explore the story of the Association Agreements between the EU and other states. The article defines the unique features of the Ukraine–EU Association Agreement, analyses changes during implementation, threats and prospects for further Agreement implementation. We conclude that there are internal and external reasons for complications in Agreement implementation.For Ukraine this Agreement is not only about standards, principals and values, but also about international standing and ability to prove strangeness in the geopolitical arena. Implementation of the Agreement is a huge step for the «European future». But, we need to understand that such changes should be carefully weighted. The article covers the processes to implement a part of the EU-Ukraine Association Agreement on security issues. The content and substance of the second section of the Association Agreement, "Political Dialogue and Reforms, Political Association, Cooperation and Convergence in Foreign and Security Policy", were outlined. Political dialogue has been proven to be gaining momentum for the gradual convergence of foreign and security issues in order to bring Ukraine closer to the European Security Area. Russia's annexation of Crimea and its aggression in the Donbas have dramatically changed the direction of foreign and security policy cooperation. Ukraine and the EU cooperated in the so-called "Normandy format". The EU supports these efforts and continues to exert pressure on Russia by imposing personal and sectoral sanctions. It supports the role played by the Organization for Security and Co-operation in Europe (OSCE) in overseeing the implementation of the Minsk Protocols through the OSCE Special Monitoring Mission and the OSCE Mission of observers, whose task is to monitor borders and observance of ceasefire agreements.In 2017, the "Pulse of the Agreement" was introduced, reflecting the current progress of implementing the measures planned within each year and the overall progress of implementing the Association Agreement. The monitoring system, which can be openly accessed since November 2019, analyses the quantitative and qualitative indicators of adapting the EU legislation towards "National Dialogue, National Security and Defence". It is concluded that the greatest progress is being made in this area (Ukraine has fulfilled 84% of its commitments). At the same time, a dialogue is needed on strengthening the EU sanctions regime against the Russian Federation and establishing regular meetings of Heads of General Staff of Ukraine, Visehrad Group countries and the Baltic States to exchange experience and best practices. ; У статті висвітлено імплементацію частини Угоди про асоціацію між Україною та ЄС у площині питань безпеки. This paper explores political provisions of the Association Agreement, signed by Ukraine and the EU in March 2014. It is emphasized that the Association Agreement is a groundbreaking document and the first agreement based on political association between the EU and a partner country of the Eastern Partnership. On the basis of analysis of the Agreement key political provisions it is found out that they are extremely important for Ukraine, particularly with regard to protection of the sovereignty and territorial integ-rity, meeting the political criteria of accession, Europeanization of public administra-tion, maintaining a nuclear-free status, strengthenen the global and regional roles of the Ukrainian state. Author also considers a special institutional framework for relations be-tween the EU and Ukraine, which is provided by the Agreement. Within the structure the dialogue at the highest and ministerial levels will be provided, specific questions of Deep and Comprehensive Free Trade Area will be considered, parliamentary co-operation will be carried out, and communication with civil society will be maintained. ; В статті розглядаються політичні положення Угоди про асоціацію, підписані Україною та ЄС в березні 2014 р. The political dialogue between Ukraine and the EU takes place within the framework of the Ukraine-EU summits, Association Council, Association Committee, Parliamentary Committee of the Association and the EU-Ukraine Civil Society Platform.At the summits, the political dialogue is conducted at the highest level between the parties. During the summits, the general supervision over the implementation of the Agreement, discussion of any bilateral or international issues of mutual interest is carried out.The Association Council monitors and controls the implementation of the Agreement, and periodically reviews the functioning of the Agreement in the context of its goals. It addresses issues that arise under this Association. The Association Council holds ministerial-level meetings.The Association Committee assists the Association Council in carrying out its duties. On the Ukrainian side, members of the Association Committee are deputy ministries for European integration issues, Deputy Minister of Economic Development and Trade – Trade Representative of Ukraine, deputy heads of other central executive bodies, whose powers include the implementation of the Agreement. The competence of the Committee is to prepare meetings of the Association Council. In addition, the Council may delegate any of its powers to the Association Committee, including the power to take binding decisions for the Parties. The Association Committee prepares its decisions with the consent of the Parties. The Association Committee holds special meetings to solve all the questions to ensure the functioning of a comprehensive and deep free trade area between Ukraine and the EU.The Parliamentary Committee of the Association is a forum for conducting meetings and exchanging views between members of the Verkhovna Rada of Ukraine and the European Parliament. It includes deputies of the Verkhovna Rada of Ukraine and the European Parliament. This body has the right to ask the Association Council to provide information on the implementation of the Association Agreement and to give it own recommendations, as well as to create appropriate subcommittees.The Civil Society Platform is a joint civil society body composed of representatives of trade unions, employers' organizations, civil society organizations of Ukraine and representatives of the European Economic and Social Committee. The Civil Society Platform may make recommendations to the Association Council, and should be informed about the decisions and recommendations of the Association Council.Conclusions of the research and prospects for further studies. The political dialogue within the framework of the Association Agreement allows the leaders of Ukraine and the EU to agree and coordinate approaches to strengthen the political association and economic integration of Kiev and Brussels, to jointly respond to strategic challenges in conditions of dynamic changes at the global and regional levels. The results of the political dialogue were the ratification and entry into force of the Association Agreement, the EU diplomatic support against the aggression of Russia, the free trade zone between Ukraine and the EU, the free-trade area between Ukraine and the EU, a visa-free regime, and important steps to overcome Ukraine's energy dependence on the Russian Federation. As a result of the implementation of the Association Agreement, over the last 4 years Ukraine implemented more reforms than for the previous 20 ones.Corruption, the dominance of the oligarchy in Ukraine, ineffective reforms and cosmetic changes in the Ukrainian state, Russian aggression, the lack of a firm EU position on the European perspective of Ukraine and sanctions against Russia, refusal to provide Ukraine with military and financial assistance, ignorance of the situation of Ukraine, which leads the "hybrid war" with Russia, disappointment of the people caused by the significant drop in their standard of living after the Revolution of Dignity, as well as the war fatigue are the problems which may become an obstacle to the realization of the political association between Ukraine and the EU.

This paper explores institutional support of the EU-Ukraine Association Agreement implementation, which provisional application started of November 1, 2014. It is emphasized that the institutional framework of the Agreement is typical for European political practice, since it involves creation not only joint decision-making bodies at the ministerial level, but bodies which provide a forum for exchange of views and cooperation between Ukraine and the EU parliamentarians and regular meetings of civil society representatives. On the basis of Rules of procedures of the Association Council and the Association Committee provisions adopted by the parties it is revealed the features of their functioning, including decision-making. An author explores process of Ukrainian part of Civil Society Platform creation and analyzes the problems that arose during the formation of its composition. Підкреслюється, що інституційна структура Угоди є типовою для європейської політичної практики, оскільки вона передбачає створення не лише спільних органів прийняття рішень на міністерському рівні, а й органів, які слугують форумом для обміну думками та співпраці між парламентарями України та ЄС і регулярних зустрічей представників організованого громадянського суспільства сторін. На основі аналізу положень ухваленого сторонами регламенту Ради асоціації та Комітету асоціації з'ясовано особливості їх функціонування, зокрема процесу прийняття рішень. Emphasized the ambiguity of public perception of the trade agreement through internal domestic problems - the critical state of the economy, such as industrial production and trade, social services, depreciation of assets, infrastructure and more. Specifies that calls to fight corruption did not lead to loyal action. Proposed and argued that implementation of the provisions of the Agreement needs to develop, adopt and enact a set of documents legislative and regulatory measures that meet the analysis of the European Union. ; Предложен авторский подход относительно преимуществ и проблем, которые возникли у связи с подписанием Договора об ассоциации Украины и Европейского Союза. Подчёркнуто неоднозначность восприятия обществом торговой части договора из-за отечественных внутренних проблем – критического состояния экономики, а именно промышленного и товарного производства, социальной сферы, износ фондов, инфраструктуры и другое. Указано, что призывы к борьбе с коррупцией не были подкреплены реальными действиями. The paper examines legal foundations of adaptation of the Ukrainian laws to the EU Law in the area of company regulation, in particular in the context of the EU-Ukraine Association Agreement. Specific aspects of the corporate law implementation as well as topical acts and provisions are outlined in the research, which should be harmonized with the EU Law provisions in the process of law making on accompany regulation.The laws of Ukraine are analyzed with the view of defining the state of play with the implementation of relevant provisions of the Association Agreement on company regulation. New laws are subject to analysis, in particular, those related to coming into force of the Law of Ukraine «On amending some legislation on enhancing the level of corporate management in joint ventures» (of 23 March 2017, № 1983-VIII) and «On ventures with limited and additional liability», which takes into account certain provisions of EU Directive № 89/667/ЄЕС of 21 December 1989 on one-person private companies with limited liability in the edition of EU Directive 2009/102/ЄС of 16 September 2009, obligatory for implementation by Ukraine according to the EU-Ukraine Association Agreement. Key words: corporate law; EU-Ukraine Association Agreement implementation; company law. ; Досліджено правові засади імплементації законодавства України з правом Європейського Союзу у сфері регулювання діяльності товариств. У контексті зобов'язань, передбачених Угодою про асоціацію між Україною та Європейським Союзом, наголошено на окремих питаннях функціонування корпоративного права, актах та положеннях, які потрібно привести у відповідність до права ЄС під час нормопроектування у сфері регулювання діяльності товариств. На підставі аналізу законодавства України щодо виконання положень Угоди про асоціацію визначено стан приведення законодавства України до права ЄС у сфері регулювання діяльності товариств. Проаналізовано новели законодавства, пов'язані з набранням чинності Законами України «Про внесення змін до деяких законодавчих актів України щодо підвищення рівня корпоративного управління в акціонерних товариствах» від 23 березня 2017 року № 1983-VIII та «Про товариства з обмеженою та додатковою відповідальністю», який враховує окремі положення Дванадцятої Директиви Ради № 89/667/ЄЕС від 21.12.1989 стосовно одноосібних приватних компаній з обмеженою відповідальністю у редакції Директиви 2009/102/ЄС Європейського Парламенту та Ради від 16 вересня 2009 р. про одноосібні приватні компанії з обмеженою відповідальністю, яким Україна взяла на себе зобов'язання імплементувати протягом 3 років з дати набрання чинності Угодою.Ключові слова: корпоративне право; імплементація Угоди про асоціацію; право компаній.
There were studied conceptual basis and priorities of the Ukraine's state migration policy, it was analyzed migration tendencies in Ukraine, there were given propositions of improvement of the governance by migration as an element of eurointegration instruments. The main scientific results are: simplified scheme of a migration process, prognosis of Ukrainians' migration to Poland to 2024 and structuring main instruments of state migration policy of Ukraine. ; У роботі розглянуто концептуальні засади та пріоритети державної міграційної політики України; проаналізовано міграційні тенденції в Україні; надано пропозиції щодо удосконалення управління міграцією як складовою євроінтеграційних заходів. Основними науковими результатами дослідження є спрощена схема міграційного процесу; прогноз міграції українських громадян до Польщі до 2024 року включно та структурування основних інструментів державної міграційної політики України.
The cooperation between Ukraine and the EU in the sphere of education and science in the framework of the EU-Ukraine Association Agreement (signed in 2014) is characterized. The political and legal aspects of cooperation between Ukraine and the EU in the sphere of education and science at present time and in the context of the implementation of the provisions of the new agreement are analyzed.The prospects of involvement of our country to the European Education Area in the context of Ukraine's participation in the Bologna process are investigated. The educational programs financed from the budget of the European Commission are aimed at the support providing to the partner countries in reforming higher education according to the principles of the Bologna process. In May 2005 our country signed the Bologna Declaration and become an active participant in these processes.The importance of the study of the educational policy of the EU is also determined by the immediate proximity of Ukraine and the EU and increasing interest in Ukrainian society to the opportunities and prospects of Ukraine's European aspirations at this stage and the positive dynamics of cooperation in education and prospects for implementation of the Bologna process in Ukraine. The last EU enlargement has created a completely new situation on the European continent and brought Ukraine directly to the EU borders, which affects both the relations between Ukraine and the EU, and the development of Ukraine in general.Within the EU educational policy and the EU external assistance programs, the EU is implementing several activities in education, which supplement internal EU programs. Particular attention is paid to the higher education system, which plays a key role in the development of modern society, contributing to the social, cultural and economic development, promoting the pan-ethical and cultural values and preparing the future leaders. Ukraine is also an active member of the European educational programs and projects, including: Tempus, Erasmus Mundus External Cooperation Window, Erasmus Mundus and Jean Monnet Programme.Since 2014 the EU has introduced new programs in education and science such as educational program Erasmus +, uniting all the above-mentioned programs under one roof for the period 2014- 2020, which supports projects, partnerships, events and mobility in education, training, youth and sport, as well as research program Horizon 2020. The concepts, implementation mechanisms of cooperation between Ukraine and the EU in the spheres of education and research in the context of the Association Agreement and on the basis of prospects of Ukraine's participation in these new European programs are described.Thus, besides the actual European integration in education, through the education system the awareness of the broadest ranges of Ukrainian citizenship need of the fullest possible realization of general strategic course of Ukraine's integration into European and international structures to protect its national interests and realization of spiritual and intellectual potential of the Ukrainian people to benefit of present and future generations can be actively generated.Key words: European Union (EU), the educational policy of the EU, the European educational area, Ukraine, EU-Ukraine Association Agreement, Erasmus Mundus, Tempus, Erasmus+, Horison 2020. ; Схарактеризовано співробітництво між Україною та ЄС у сфері освіти і науки відповідно до Угоди про асоціацію між Україною та ЄС, підписаної у 2014 р. З'ясовано політичні і правові аспекти співпраці між Україною та ЄС з питань освіти та науки на сучасному етапі та в контексті імплементації положень нової угоди. Досліджено перспективи залучення нашої держави до Європейського освітнього простору в контексті участі України в Болонському процесі, адже освітні програми, що фінансують з бюджету ЄК, мають на меті надання підтримки країнам-партнерам у реформуванні системи вищої освіти відповідно до принципів Болонського процесу. У травні 2005 р. наша держава підписала Болонську декларацію та стала активним учасником цих процесів.Важливість дослідження освітньої політики ЄС зумовлена також безпосереднім сусідством України і ЄС та зростанням зацікавлення українського суспільства до можливостей та перспектив реалізації євроінтеграційних прагнень України на сучасному етапі та використання позитивної динаміки співробітництва в освітній сфері та перспектив запровадження Болонського процесу в Україні. Останнє розширення ЄС створило принципово нову ситуацію на Європейському континенті та наблизило кордони ЄС безпосередньо до кордонів України, що впливає як на відносини між Україною та ЄС, так і на розвиток України загалом.У межах освітньої політики ЄС та програм зовнішньої допомоги Європейський Союз впроваджує низку заходів у сфері освіти, які доповнюють внутрішні програми ЄС. Особливу увагу приділено саме системі вищої освіти, яка відіграє ключову роль у розвитку сучасного суспільства, сприяючи соціальному, культурному та економічному розвитку, популяризації загальноєвропейських етичних та культурних цінностей та підготовці лідерів майбутнього. Україна також є активним учасником європейських освітніх програм та проектів, серед яких: Темпус, Еразмус Мундус, Вікно зовнішньої співпраці Еразмус Мундус та Програма Жана Моне.З 2014 р. ЄС запроваджує нові програми у сфері освіти та науки – ними стали освітня програма Еразмус+, яка об'єднала усі зазначені програми на період 2014–2020 рр., та підтримує проекти, партнерства, заходи і мобільність у сфері освіти, підготовки, молоді і спорту, а також науково-дослідна програма Горизонт 2020. Описано концепції, механізми реалізації співпраці між Україною та ЄС в освітній та наукових сферах в контексті реалізації угоди про асоціацію на основі використання передового досвіду, а також перспективи участі України у цих нових європейських програмах.Ключові слова: Європейський Союз (ЄС), освітня політика ЄС, європейський освітній простір, Україна, Угода про асоціацію між Україною та ЄС, Еразмус Мундус, Темпус, Еразмус+, Горизонт 2020.
