Samouprava in avtonomija statutarnih obcin v luci virov za "dezelno stolno mesto Ljubljano"

After explaining the difference between the notions of self-government & local autonomy, the applicability of both to the description of the political-administrative status of the Slovene city of Ljubljana in the 19th-century Austrian Empire is examined. The Austrian March Constitution of 1849, its abolishment by the emperor Franz Joseph in 1851, the municipalities law of 1849 & 1862, & December Constitution of 1867 are some of the legal acts examined in the outline of the chronology of the self-government & autonomy of Ljubljana as a provincial capital in the Austrian Empire. The powers & prerogatives contained in the city's municipal statues are discussed, considering the relationship & power sharing between the state & municipalities in the Austrian Empire & the Austria-Hungary dual monarchy. The study of the Ljubljana archive sources concludes that prior to 1895, the city's municipal council powers to issue normative legislation were limited, & an increased norm-giving activity resulted only from the need to rebuild the city after the 1895 earthquake. The council's municipal autonomy was largely responsible for regulating all reconstruction activities, including the organization & modernization of transport, electrification, & other infrastructure. THE BIDEN DOCTRINE AND THE WAR IN UKRAINE: RENEWED TRANSATLANTIC RELATIONS OR REATLANTISATION BETWEEN A STRATEGIC AND ASITUATIONAL PARTNERSHIP

The war in Ukraine is the most significant threat to the peace of the Euro-Atlantic area in decades. After 4 years of Trump's weakening of transatlantic relations, Biden's presumed foreign policy doctrine includes their quick renewal, or re-Atlantisation. The article problematises the 'new' strategy of containment given Russia's aggression, the state of transatlantic relations, and the current global order's configuration, whereby the transatlantic bond is being strengthened and the formation of Biden's foreign policy doctrine is being followed by a 'grand-strategic' shift. Four different models of transatlantic relations (mutual autonomy, strategic autonomy, strategic partnership, situational partnership) are discussed where variables include the approach taken by the USA to transatlantic relations, and the approach of Europe's EU and NATO members to transatlantic relations are addressed. The main argument is that transatlantic relations during Biden's mandate have constantly oscillated between a stra-tegic partnership, especially related to common goals of democracy promotion and containment and situ-ational partnership. Hegel in liberalizem: zastavitev problema

The author poses the question of whether it is possible to say, contrary to common agreement, that Hegel's political thought contains the elements of liberal political thought. She shows, through examination of The Elements of the Philosophy of Right, that Hegel's definition of an individual as a being of reason & as a free being at the same time points in the direction of liberalism & its preoccupation with the freedom & autonomy of the individual. Hegel's key emphasis, however, is that freedom of free choice already presupposes a choice already made, a forced choice of the frame of the free choice itself, which an individual has to take upon himself/herself. Planning discharge from a psychiatric hospital from the social workers' perspective
Planning discharge is the central task of social workers in a psychiatric hospital. Effective hospital discharge planning is a team process based on assessing needs and finding suitable responses to them. The research results show considerable inconsistency in this area, as the process of discharge planning is initiated at different times. It is especially the users' poor health that does not allow their wishes and needs to be consistently considered, and prevents user participation and autonomy. Consequently, patronizing practices are inevitable. Being treated in a psychiatric hospital is still associated with considerable stigma. The research findings show that social workers feel as equal members of department teams and face plenty of ethical dilemmas at their work. Undergraduate studies have equipped social workers with a wide specter of theoretical and practical knowledge; however, they would like the study programme to be supplemented with health care topics.

Local communities have an important role in society. According to states legislature they execute local public policies. Those processes include local democracy, public administration, local economy and social entities. Also they combine public and private resources. All of these groups of factors have their own capacity. Capacity is their ability to achieve goals and consists from inside and outside factors. Capacity of local self-government is integrated capacity. It represents holistic capacity for those units. It tells us, whether they are capable of doing things they should do, according to social and political system and its demands. Local units have different level of capacity. With conceptual model and field research we tested our research hypothesis. Our hypothesis is that local self-government communities with higher capacity offer their residents broader local public services and goods. Also we studies influence of political stability and autonomy on capacity. On representative sample of municipalities in Republic of Slovenia we confirmed all ours research hypothesis. Conceptual model of capacity is a tool for analysing individual communities and for analysing the whole system of local-self government. Also many suggestions for improvement can be made.
Odločanje Sodišče Evropske unije o pristojnosti ; Decision-making of the Court of Justice of the European Union on jurisdiction
Magistrska diplomska naloga nosi naslov Odločanje Sodišča Evropske unije o pristojnosti. V nalogi sem sprva opisala temeljna načela, ki so vodilo delovanja Sodišča Evropske unije, ter se seznanila z njihovo uporabo in razlago v praksi. Ugotovila sem, da med pravnim redom Evropske unije in pravnimi redi držav članic velja načelo nadrejenosti ter da je pravni red Evropske unije superioren. Sledilo je raziskovanje, kako Sodišče Evropske unije odloča o pristojnosti, pri čemer sem spoznala, da ima Sodišče Evropske unije zelo pomembno vlogo, ko odloča o razmejitvi pristojnosti med državo članico ter Evropsko unijo. S sodno prakso namreč riše mejo med avtonomnostjo države članice ter posegi v njeno avtonomnost s strani Evropske unije. Nato sem opisala in spoznavala kakšne so njegove pristojnosti ter kakšni so postopki, ki jih Sodišče Evropske unije uporablja pri svojem odločanju. Ugotovila sem, da je temeljna naloga Sodišča Evropske unije skrbeti za enotno razlago in uporabo prava Evropske unije. Ugotovila sem, da Sodišče Evropske unije skozi sodno prakso čedalje bolj širi svoje pristojnosti in krepi svojo vlogo v razmerju do držav članic, čeprav v praksi vse države članice temu niso prav naklonjene. Na koncu naloge sem opisala in pojasnila, kako so se pristojnosti Sodišča Evropske unije okrepile po sprejemu Lizbonske pogodbe, ter poskušala poiskati razlike ter podobnosti med sistemom delitve oblasti v Evropski uniji ter sistemom delitve oblasti v zvezni državi, predvsem s strani odločanja Sodišča Evropske unije ter njegovih pristojnosti. ; In this assignment, I first described the fundamental principles that constitute the functioning of the Court of Justice of the European Union, and took note of their application and interpretation into practice. I have discovered that the principle of superiority is applied between the legal order of Member States and the rule of European Union in which the legal order of the European Union is superior. This was followed by a study of how the European Court of Justice decides on jurisdiction, and I realized that the Court of Justice of the European Union plays a very important role in deciding on the delimitation of competences between a Member State and the European Union. Through its case-law the Court of Justice of the European Union draws the boundary between the autonomy of a Member State and interference with Member States' autonomy by the European Union. I then described and learned about what its competences are and what are the procedures used by the Court of Justice of the European Union in its decision-making. I have found out that the fundamental task of the Court of Justice of the European Union is to ensure uniform interpretation and application of European Union law. I have found that the Court of Justice of the European Union increasingly expands its jurisdiction through jurisprudence and strengthens its role vis-à ; -vis Member States, although in practice all Member States do not favor this right. At the end of the thesis, I described and explained how the jurisdiction of the Court of Justice of the European Union was strengthened after the adoption of the Lisbon Treaty, and sought to find differences and similarities between the system of division of power in the European Union and the system of division of power in the federal state, notably through the decision-making of the Court and its powers.
