Based on the hypothesis that modified human beings will have successful life projects, the biopolitical presuppositions of genetic manipulation in modern society are reflected. Considering the theories presented by Michel Foucault (2005), Jürgen Habermas (2010), Michael J. Sandel (2013), Hans Jonas (2006) and Achille Mbembe (2014), a genetic Africanization of the economically disadvantaged population is identified. In this scenario, concepts of class and race are confused and social prejudice increases. Faced with the new technologies of genetic engineering, gene manipulation presents itself as a new face of biopower, since science now has the power to give life from the selection of characteristics considered superior. It is argued that the criticism surrounding the process of genetic manipulation is necessary as it opens the possibility of debating mutual recognition as a condition of life, above the identification of race or class, geographic location or other characteristics of the individuals that make up society.
OBJETIVO: Propor a "solidariedade crítica" como valor a ser incorporado na agenda bioética do século XXI e como instrumento que guia as pessoas e associações na prática voluntária. MÉTODOS: Para explicar de que modo a solidariedade se materializa são analisadas as motivações à atividade voluntária das associações que integram o voluntariado do Instituto Nacional do Câncer, Rio de Janeiro. Os dados para análise foram obtidos pela aplicação de dois instrumentos: um questionário dividido em duas partes que o identificam o perfil socioeconômico, e a solidariedade como valor que motiva a atividade voluntária; e entrevista semi-estruturada para obtenção de dados complementares à análise. RESULTADOS: Os resultados mostram que a atividade voluntária se dá em torno de três tipos de motivações básicas: a) motivações pessoais relacionadas à vida do voluntário, b) motivações decorrentes da crença professada, e c) motivações despertadas pelo sentimento de solidariedade. CONCLUSÕES: A incorporação da solidariedade crítica impõe a ruptura do modelo de voluntariado assistencial detectado. Isso implica em visibilizar os interesses, que egóicos, em geral, permeiam as práticas voluntárias. Assim, qualifica-se um voluntariado orgânico, politizado e comprometido em atender demandas específicas dos tempos atuais. ; OBJECTIVE: The study proposes "critical solidarity" as a value to be incorporated into the 21st century's bioethics agenda and as an instrument to guide people and associations in volunteer praxis. METHODS: To explain how solidarity materializes itself, the motivations for engaging in volunteer activities in associations that integrate the corps of volunteers of the Instituto Nacional do Cancer [National Cancer Institute] in Rio de Janeiro, Brazil, are analyzed. The data for analysis were obtained by applying two instruments. The first one consists of a questionnaire divided into 2 parts: one part identifies the socioeconomic profile, and the other identifies solidarity as a value that motivates volunteer activity. The second instrument comprises of semi structured interviews utilized to collect supplementary data for analysis. RESULTS: The results indicate that volunteering is based on three basic motivations: a) personal motivations related to life as a volunteer, b) motivations resulting from professed beliefs, and c) motivations aroused by the feeling of solidarity. CONCLUSIONS: It was concluded that the incorporation of critical solidarity requires a rupture with the detected model of patronizing volunteering; it implies explicating the common selfish interests that permeate volunteer activities and qualify an organic volunteering, that is, volunteering which is politically aware and committed to responding to the specific demands of the present time.

Realiza-se, aqui, reflexão bioética sobre a concepção de pobreza enquanto condição, ou circunstância, de restrição e vulnerabilidade. Tal concepção prevê duas perspectivas: a econômica que relaciona pobreza com incapacidade (visão do Banco Mundial, a partir das recomendações políticas para o ajuste econômico dos países latino-americanos) e a ético-filosófica, relacionando pobreza com desigualdade (fundamentada nos conceitos de eqüidade e igualdade, enquanto desdobramentos da idéia de justiça). Uma das graves conseqüências é o tratamento injusto, no que diz respeito aos procedimentos de pesquisa dos países ricos que recrutam populações de países pobres como campo experimental para investigações na área da saúde, principalmente pesquisas biomédicas ou farmacêuticas, colocando sob questionamento ético o caráter de vulnerabilidade e autonomia desses indivíduos. ; Nos proponemos desarrollar una reflexión bioética acerca de la concepción de la pobreza como condición o circunstancia de restricción y vulnerabilidad. Esta concepción presentará dos perspectivas: la económica, relacionada con la incapacidad (visión del Banco Mundial desde las recomendaciones políticas para el ajuste económico de los países latinoamericanos) y la ético-filosófica, relacionada con la desigualdad (basada en los conceptos de equidad e igualdad como desdoblamientos de la idea de justicia). Una de las graves consecuencias de lo anterior es el tratamiento injusto, respecto a los procedimientos de investigación, de los países ricos que reclutan las poblaciones de los países pobres como campo experimental para investigaciones en el área de la salud. Este hecho se produce principalmente en las investigaciones biomédicas o farmacológicas, cuestionando así desde el punto de vista ético el carácter de vulnerabilidad y autonomía de los individuos. ; The article presents a reflection on conception of poverty as a condition or circumstance that restricts personal autonomy and increases vulnerability. Focusing on bioethical arguments, the authors discuss two perspectives: (i) economic, that relates poverty to incapacity to work and (ii) ethical-philosophical, which relates poverty to inequality and injustice. The first perspective corresponds to the World Bank's view according to its recommendations to the political and economic adjustment in Latin America. The second one is based on concepts of fairness and equality as components of social justice. The subjects' autonomy and vulnerability have been under question in an international movement that requests revision of ethical guidelines for the biomedical research. The bioethical arguments presented in this article enhance a discussion on unfair treatment to subjects enlisted in protocols sponsored by rich countries and hosted by poor nations.
O trabalho teve por objetivo analisar a noção de vulnerabilidade utilizada pela bioética para debater as pesquisas com seres humanos na atualidade, a partir de uma reflexão acerca da biopolítica na cultura contemporânea. Para isto, partiu-se da leitura de Giorgio Agamben dos modelos de poder foucaultianos - Soberania e Biopolítica - para, em seguida, analisar a noção de vida nua - "vida sem nenhum valor". Se os dispositivos de poder nas democracias modernas conjugam estratégias biopolíticas com a emergência da força do poder soberano que transforma a vida em vida nua, é fato que a bioética deve ser um instrumento de proteção das pessoas vulneradas. No entanto, além do território do estado do direito, a bioética também deve poder penetrar nas zonas de indiferenciação, onde soberania e técnica se misturam, profanando a fronteiras biopolíticas e problematizando a própria condição de vulnerabilidade. ; The study had the objective of analyzing the notion of vulnerability that is used by bioethics to debate research involving human beings today, from reflections on biopolitics in contemporary culture. For this, the starting point was Giorgio Agamben's reading of Foucault's model of power (Sovereignty and Biopolitics), with the aim of subsequently analyzing the notion of bare life: "life without any value". If the devices of power in modern democracies conjoin biopolitical strategies with the emergence of the strength of sovereign power that transforms life into bare life, in fact bioethics must be an instrument for protecting people who have become vulnerable. Nevertheless, beyond the territory of the rule of law, bioethics must also penetrate the undifferentiated zones where sovereignty and techniques become mixed, disrespecting the frontiers of biopolitics and questioning the condition of vulnerability itself.
OBJETIVO: Analisar o uso de biomateriais em odontologia por cirurgiões dentistas especialistas sob os aspectos da Teoria Bioética do Princiapialismo e da Ética da Responsabilidade individual e Coletiva. MÉTODOS: Foram aplicados questionários a 95 cirurgiões dentistas registrados no Conselho Regional de Odontologia do Distrito Federal, 2002. sobre o uso de biomateriais em sua prática. Dados relativos ao controle sanitário foram obtidos por meio das respostas desses cirurgiões dentistas e de pesquisa nos órgãos competentes. RESULTADOS: Os profissionais entrevistados utilizavam rotineiramente biomateriais, sendo que 45% relataram acreditar não haver riscos para os pacientes; 48% não consideram biomaterial como medicamento e 70% se sentiam seguros com relação à origem, apesar de membranas e osso serem os itens mais adquiridos por meio de vendedores autônomos. Apesar disso, 96% dos entrevistados afirmaram que deveria haver maior controle das autoridades sanitárias. Mais da metade dos entrevistados (51%) referiu pouca ou nenhuma participação do paciente no processo de escolha terapêutica. O termo de consentimento informado foi anexado por 12% dos cirurgiões dentistas pesquisados. CONCLUSÕES: Os resultados mostraram que os profissionais utilizam biomateriais desconhecendo riscos e efeitos adversos, distanciando-se do princípio da beneficência. A ética da responsabilidade pública não é observada pelos organismos públicos responsáveis e órgãos de categoria profissional. O consentimento informado ainda não está incorporado à prática profissional, permanecendo a relação profissional-paciente em odontologia excessivamente vertical. ; OBJECTIVE: To analyze the use of biomaterials in surgical procedures carried out by specialist dental surgeons, in light of the Principalist Bioethics Theory and the Individual and Collective Ethics of Responsibility. METHODS: Dental surgeons (n=95), who were registered as specialists at the Regional Dentistry Council of Brasilia as of 2002, completed questionnaires regarding the use of biomaterials in their work. Data relating to sanitary control were collated, based on these dental surgeons' responses and research at relevant organizations. RESULTS: All of the professionals in the survey used biomaterials on a regular basis; 45% believed their use to be risk-free for patients, and 48% did not classify biomaterials as drugs. About 70% of professionals trust the source of the biomaterials even though membranes and bones are the items most commonly bought from individual suppliers. Nonetheless, 96% of interviewees believed that government sanitation agencies should regulate more. More than half of the professionals (51%) pointed to little or no participation by the patient in the process of therapeutic choice. A copy of the informed consent form was provided by 12% of the dental surgeons interviewed produced. CONCLUSIONS: The results showed that the professionals use biomaterials without knowing about related risks and adverse side effects, contrary to the principle of beneficence. Government agencies and professional bodies alike do not show evidence of observing public responsibility ethics. Informed consent is not yet integrated fully into professional practice and the doctor-patient relationship in dentistry remains markedly vertical.

Introduction: Human dignity, as coined by the Universal Declaration of Human Rights (UDHR / 1948), is an expression social solidarity, which should cement the relations between people. Human dignity is the foundation of all rights, such as freedom, equality, justice and peace in the world, and in Brazil, human dignity was deemed a fundamental pillar of the country's post-1988 constitutional order. Objective: This article seeks to a deeper investigation about the social nature of human dignity and its definition over time. Methods: This is an exploratory research meant to unpack the concepts of "human dignity", "bioethics", "human rights" and "constitution". After describing the conceptual evolution of human dignity and the facts relevant to its conceptual formation in world history - as a normative standard and a legal rule -, we address the Universal Declaration of Human Rights (UDHR/1948), the Declaration of Helsinki (DH/1964), the Universal Declaration on Bioethics and Human Rights (UDBHR/2005), and the definition adopted in the Constitution of the Federative Republic of Brazil (CFRB/1988). The study was carried out without temporal limitation, and included a review of referenced books, legal doctrines, as well as articles and books in the SciELO database. Results and discussion: The findings ratify that human dignity is the foundation of all rights, including those of freedom, equality, justice and peace in the world, and must also guide the rights and duties of social regulation. Human dignity has changed from a criterion of power attributed to the social position of individuals to a value of the right to freedom, which now goes beyond the right of freedom and is the basis of modern constitutional democracy, which makes possible the realization of solidarity, as well as the duty and purpose of the state and the community. The will of the subject, of society, of the science and of the state, as well as the rules of domination and regulation, must have a limit on human dignity, and human dignity is not just fundamental right, in the sense of the Constitution, and must prevail over the exclusive will of science, the State and society. Therefore, in the making of power decisions and in realization of possible innovations of science involving human beings, human dignity demands the explicit consideration of respect and promotion of it. Conclusion: Human dignity is enshrined in Brazilian constitutional law, as well as in bioethics and in human rights, and it constitutes all the fundamental rights of the human person. It is not merely a rule of autonomy and liberty, and it is an obligatory and non-derogable precept in the making of power decisions, a true main foundation of constitutional democracies. ; Introdução: A dignidade humana, cunhada pela Declaração Universal dos Direitos Humanos (DUDH/1948), é uma expressão de solidariedade social, que deve cimentar as relações entre as pessoas. A dignidade humana é a base de todos os direitos, como liberdade, igualdade, justiça e paz no mundo, e no Brasil, a dignidade humana foi considerada um pilar fundamental da ordem constitucional pós-1988 do país. Objetivo: Este artigo busca uma investigação mais profunda sobre a natureza social da dignidade humana e sua definição ao longo do tempo. Método: Trata-se de uma pesquisa exploratória que visa revelar os conceitos de "dignidade humana", "bioética", "direitos humanos" e "constituição". Após descrever a evolução conceitual da dignidade humana e os fatos relevantes para sua formação conceitual na história mundial - como padrão normativo e norma jurídica -, abordamos a Declaração Universal dos Direitos Humanos (DUDH/1948), a Declaração de Helsinque (DH/1964), a Declaração Universal sobre Bioética e Direitos Humanos (DUBDH/2005) e a definição adotada na Constituição da República Federativa do Brasil (CFRB/ 1988). O estudo foi realizado sem limitação temporal e incluiu uma revisão de livros referenciados, doutrinas jurídicas, bem como artigos e livros no banco de dados SciELO. Resultados e Discussão: As conclusões ratificam que a dignidade humana é o fundamento de todos os direitos, incluindo os de liberdade, igualdade, justiça e paz no mundo, e deve também orientar os direitos e deveres da regulação social. A dignidade humana passou de um critério de poder atribuído à posição social dos indivíduos para um valor do direito à liberdade, que agora ultrapassa o direito à liberdade e é a base da democracia constitucional moderna, que possibilita a realização da solidariedade, bem como o dever e propósito do Estado e da comunidade. A vontade do sujeito, da sociedade, da ciência e do Estado, bem como as regras de dominação e regulação, devem ter um limite na dignidade humana, e essa não é apenas um direito fundamental no sentido da Constituição, devendo prevalecer sobre a vontade exclusiva da ciência, do Estado e da sociedade. Portanto, nas decisões de poder e na realização de possíveis inovações da ciência envolvendo seres humanos exige-se a consideração explícita do respeito e da promoção da dignidade humana. Conclusão: A dignidade humana é ponto consagrado no direito constitucional brasileiro, assim como na bioética e nos direitos humanos e constitui todos os direitos fundamentais da pessoa humana. Não é apenas uma regra de autonomia e liberdade, trata-se de preceito obrigatório e inderrogável na tomada de decisões de poder, verdadeiro fundamento principal do Estado democrático de direito.
The objective was to evaluate the perspectives of Brazilians regarding the experiences related to access to information about Covid-19 reported during the critical period of the pandemic in Brazil. A mixed, quanti-qualitative instrument was developed, constructed, and analyzed from an interdisciplinary framework in the field of bioethics. The 525 participants in the survey, which took place in June 2020, shared perspectives that indicate concern with access to qualified information, with the non-propagation of fake news and with the distrust of information coming from the federal government, in contrast to greater confidence in scientific sources, and municipal and state governments. Knowledge about how Brazilians related to information about Covid-19 is essential for preventive, educational and regulatory measures to be effective in the formulation of public health policies in a post-pandemic future. ; Objetivou-se avaliar as perspectivas de brasileiros quanto às experiências relacionadas ao acesso às informações sobre a Covid-19 relatadas durante o período crítico da pandemia no Brasil. Foi elaborado instrumento misto, quanti-qualitativo, construído e analisado com base em um marco interdisciplinar no campo da bioética. Os 525 participantes da pesquisa, ocorrida em junho de 2020, compartilharam perspectivas que indicam preocupação com o acesso a informações qualificadas, com a não propagação de fake news e com a desconfiança de informações advindas do governo federal, em contraponto à maior confiança em fontes científicas e de governos municipais e estaduais. O conhecimento sobre o modo como os brasileiros se relacionaram com informações a respeito da Covid-19 é fundamental para que medidas preventivas, educativas e regulatórias sejam efetivas na formulação de políticas públicas em saúde em um futuro pós-pandemia.
Objetiva-se comparar o estado da legislação brasileira sobre mapeamento genético com o de legislações internacionais visando dimensionar a realidade normativa do país quanto às tendências sociais de reconhecimento das diferenças e a abertura jurídica prospectiva, com foco na área laboral. Trata-se de revisão de literatura e pesquisa documental sobre o diálogo entre bioética, medicina do trabalho e genética, que têm a dignidade humana como ponto em comum. Concluiu-se que se tende a admitir o mapeamento genético de trabalhadores para pesquisa e prevenção do adoecimento, inferindo-se, dado seu referencial comum e de acordo com a perspectiva culturalista do Código Civil, que essa possibilidade se estende à identificação genética de habilidades do trabalhador para o exercício de atividades. ; This work aims to verify the status of Brazilian legislation on genetic mapping, focusing on the occupational sphere, in comparison to international legislation, to assess the country's normative reality regarding social trends related to the recognition of differences and prospective legal opening. This is a review of literature and documents regarding the dialogue between bioethics, occupational medicine and genetics, taking into account that they have human dignity as a common ground. It was concluded that there is a tendency to accept the genetic mapping of workers for research and prevention of illness. Given their common reference and in accordance with the culturalist perspective of the Civil Code, it is inferred that this possibility extends to the genetic identification of workers' skills for the exercise of their duties. ; El objetivo de este trabajo es comparar el estado de la legislación brasileña sobre mapeo genético en relación con el de las legislaciones internacionales, buscando dimensionar la realidad normativa del país ante las tendencias sociales de reconocimiento de las diferencias y la apertura jurídica prospectiva, con foco en el área laboral. Se trata de una revisión de la literatura y de una investigación documental sobre el diálogo entre bioética, medicina del trabajo y genética, considerando que tienen a la dignidad humana como punto en común. Se concluyó que se tiende a admitir el mapeo genético de los trabajadores para la investigación y prevención de enfermedades, infiriéndose, dada su referencia común y de acuerdo con la perspectiva culturalista del Código Civil, que esta posibilidad se extiende a la identificación genética de habilidades del trabajador para para el ejercicio de actividades.
This article approaches the Italian and Brazilian health policies based on a historical overview of the economic and political conjunctures from the 18th century to the 20th century, so as to identify elements that signal similarities and differences in order to understand the materialization process of the right to health. The present study is a descriptive research with a qualitative approach. The data source includes official documents and a literature review in a historical perspective. The data analysis is carried out based on Everyday Bioethics. The results show that in both States the right to health is rendered concrete as a result of the workers' initiative, with the aim of satisfying one of its dimensions: the right to health assistance. The following aspects were observed: similarities in the social protection models, the importance of Italy in the Brazilian construction process of the right to health, differences between the new governmental actions established after the sanitary reforms, and the need to confront, by means of a political system of rules, the historical ethical conflict between individual rights and the guarantee of social rights, mainly the right to health, in both realities. ; Este artigo busca percorrer as políticas de saúde italiana e brasileira em um recorte histórico das conjunturas econômicas e políticas do século XVIII ao século XX, na perspectiva de identificar elementos sinalizadores de aproximações e distanciamentos para compreender o processo de materialização do direito à saúde. Trata-se de uma pesquisa descritiva com abordagem qualitativa, tendo como fonte de dados documentos oficiais e revisão de literatura, numa perspectiva histórica. A análise dos dados é feita com base na bioética cotidiana. Os resultados obtidos mostram que, em ambos os Estados, a origem da concretização do direito à saúde é fruto da iniciativa dos trabalhadores com o propósito de satisfazer uma de suas dimensões: o direito à assistência à saúde. Percebem-se similaridades nos modelos de proteção social, a importância da Itália no processo brasileiro de construção do direito à saúde, distanciamento entre as novas ações estatais instituídas após as reformas sanitárias e a necessidade de se enfrentar, valendo-se de um sistema político de regras, o histórico conflito ético entre os direitos individuais e a garantia dos direitos sociais, especialmente o direito à saúde, nas duas realidades.
Este artigo destaca o processo de construção, amadurecimento e consolidação da bioética de intervenção (BI) como proposta bioética libertadora. Para tanto, considera como principal indicador dessa característica sua perspectiva antissistêmica, evidenciada pela manifesta opção política e pela insurgência epistêmica contra a dominação epistemológica do conhecimento bioético produzido nos países localizados no centro do sistema-mundo capitalista. Em face de sua marca identitária latino-americana, seu perfil ideológico e sua influência no campo de conhecimento da bioética, a BI é apresentada como uma das teorias mais importantes do pensamento latino-americano contemporâneo, sendo vista como a principal novidade depois da teoria da dependência, da pedagogia do oprimido, da teologia da libertação e da colonialidade do poder. ; This article highlights the process of construction, maturation and consolidation of a bioethics of intervention (BI) as a liberating bioethical proposal. Toward that end, it considers the main indicator of that characteristic to be its anti-systemic perspective, as manifested by its manifest political option and by epistemic insurgence against the epistemological domination of the bioethical knowledge produced in the countries located in the center of the capitalist world system. Because of its Latin American trademark, its ideological profile and its influence in the field of knowledge of bioethics, BI is presented as one of the most important theories of contemporary Latin American thinking, and is seen as the main novelty after the theory of dependence , the theory of the oppressed, the theology of liberation and the coloniality of power. ; Este artículo pone de relieve el proceso de construcción, maduración y consolidación de la bioética de intervención (BI) como una propuesta bioética liberadora. A tal efecto, considera como el indicador principal de esta característica su perspectiva anti-sistémica evidenciado por la opción política y la insurgencia epistémica contra la dominación epistemológica del conocimiento bioético producido en los países situados en el centro del sistema-mundo capitalista. Por su fuerte marca de identidad latinoamericana, su perfil ideológico y su influencia en el campo de conocimiento de la bioética, la BI se presenta como una de las teorías más importantes del pensamiento latinoamericano contemporáneo, siendo considerada como la principal novedad después de la teoría de la dependencia, la pedagogía del oprimido, la teología de la liberación y la colonialidad del poder.
