At the turn of November 2018, the next local elections were held in Poland. However, this time, along with the next term, a number of new legal arrangements and structures have been implemented as a result of the adoption of the Act of 11 January 2018 on amending certain laws to increase the participation of citizens in the process of electing, functioning and controlling certain public bodies. The legislature has set itself the objective of adopting solutions to enable and facilitate greater influence for members of local and regional communities, especially in legislative and executive bodies of local government units. Some of these changes affect the executive body in the municipality (local government commune), i.e. village mayor (town mayor or city president), affecting the change in its scope and powers. ; Na przełomie października i listopada 2018 r. odbyły się w Polsce kolejne wybory samorządowe, jednakże tym razem wraz z kolejną kadencją władz samorządowych doszło do wdrożenia wielu nowych rozwiązań i konstrukcji prawnych będących efektem uchwalenia w dniu 11 stycznia 2018 r. ustawy o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych. Ustawodawca postawił sobie za cel przyjęcie rozwiązań, które mają umożliwić i ułatwić członkom wspólnot samorządowych większy wpływ na funkcjonowanie tych wspólnot, w szczególności organów stanowiących i wykonawczych w jednostkach samorządu terytorialnego. Niektóre z tych zmian dotykają organu wykonawczego w gminie samorządowej, czyli wójta (burmistrza, prezydenta miasta), wpływając na zmianę zakresu jego działania i kompetencji.

In this article the attention is paid to other roles of the Prime Minister in governmental institutions as a body subject to Sejm control, to mention only his position within the governmental administration (vis-à-vis deputy prime ministers, ministers outside cabinet, "non-governmental" organizations of state administration); position of the Prime Minister as a sole supreme body of state administration; his relations with other central bodies of state administration (President, Sejm, Supreme Audit Office). The problem of accountability of the Prime Minister to Sejm has also been contemplated.Making an attempt in both parts of the article to evaluate the influence of various factors on legal and governmental status of the Prime Minister as a body subject to Sejm control, the following has been stated: a) The Prime Minister holds a very strong position and plays a leading role within the structures and functioning mechanisms of the Council of Ministers and in relations with "non-governmental" bodies of state administration, b) position of the Prime Minister in managing the Council of Ministers, a body ranking number one within the structures of executive power and wide authority of the Prime Minister including non-legal factors result in an important role played by the Prime Minister within the entire system of the authorities of the Republic of Poland. These factors also confirm how important is Sejm control of the Prime Minister's activity for the proper implementation of the principle of separation and balance of powers. ; Celem artykułu jest przedstawienie innych ról ustrojowych Prezesa Rady Ministrów jako organu podlegającego kontroli sejmowej, takich jak: jego pozycja w strukturach administracji rządowej (wobec wiceprezesów Rady Ministrów, ministrów poza rządem, "pozarządowych" organów rządowej administracji); pozycja Prezesa Rady Ministrów jako jednoosobowego naczelnego organu administracji rządowej; jego relacje z innymi naczelnymi organami państwowymi (Prezydentem, Sejmem, Najwyższą Izbą Kontroli). Rozważono też problem odpowiedzialności parlamentarnej Prezesa Rady Ministrów przed Sejmem.Podejmując próbę generalnej oceny (rozważanego w częściach I i II artykułu) wpływu różnych czynników na status prawnoustrojowy Prezesa Rady Ministrów jako organu podlegającego kontroli sejmowej, stwierdzono między innymi, że: a) Prezes Rady Ministrów zajmuje bardzo silną pozycję i odgrywa wiodącą rolę w strukturach i mechanizmach funkcjonowania Rady Ministrów oraz w stosunkach z "pozarządowymi" organami rządowej administracji, b) pozycja Prezesa Rady Ministrów w kierowanej przez niego Radzie Ministrów (organie usytuowanym na pierwszym miejscu w strukturze władzy wykonawczej) oraz rozległy zakres jego kompetencji powodują, wraz z czynnikami o charakterze pozaprawnym, że to właśnie on odgrywa ważną rolę w całym systemie rządów RP. Te czynniki również przekonują, jak istotne znaczenie dla prawidłowego urzeczywistniania zasady podziału władzy i równowagi władz ma kontrola sejmowa aktywności Prezesa Rady Ministrów.

It is the purpose of both parts of the article to present the Prime Minister as a body subject to Sejm control. To achieve the above, an attempt has been made to characterise his legal and governmental status with the consideration given to the factors determining such status, especially those factors that are basic for the presentation of the Prime Minister and fit within the subjective and objective scope of the Sejm control over the government activity. Considerations in this respect are carried out based on the normative regulations, mainly on the Constitution of the Republic of Poland adopted on 2 April 1997.The article mainly includes the analysis of the legal and governmental status subject to Sejm control over the Prime Minister of the Council of Ministers as a chairman of the collective executive decision-making body of the Polish government, that is, the Council of Ministers. The focus has been placed on the role of the Prime Minister in shaping the make-up of the government, his power to discharge and reshuffle cabinet members and influence to consolidate the government. Subsequently, the position of the Prime Minister within the Council of Ministers was submitted to more profound analysis including the contemplation of such normative solutions crucial for this position as authority to represent the Council of Ministers, coordinate the work of the Council of Ministers ensure the implementation of policy adopted by the cabinet, define the manners of the implementation of policy of the Council of Ministers, and coordinate and control work of the cabinet members. ; Celem artykułu jest przedstawienie Prezesa Rady Ministrów jako organu podlegającego kontroli sejmowej. Starano się tego dokonać przez scharakteryzowanie jego statusu prawnoustrojowego z uwzględnieniem zwłaszcza tych czynników określających ów status, które zdają się mieć najbardziej zasadnicze znaczenie dla zaprezentowania premiera "mieszczącego się" w zakresie podmiotowym i przedmiotowym sejmowej kontroli działalności rządu. Rozważania w tym zakresie prowadzone są na gruncie regulacji normatywnych, głównie Konstytucji Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r.W niniejszym artykule poddano analizie przede wszystkim status prawnoustrojowy podlegającego kontroli sejmowej Prezesa Rady Ministrów jako przewodniczącego kolegialnego organu egzekutywy, czyli Rady Ministrów. Skoncentrowano uwagę na roli Prezesa Rady Ministrów w kształtowaniu składu rządu oraz dokonywaniu zmian w tym składzie, a także jego wpływie na trwałość rządu. Następnie poddano głębszej analizie pozycję Prezesa Rady Ministrów w samej Radzie Ministrów, rozważając takie rozwiązania normatywne decydujące o tej pozycji, jak kompetencje do: reprezentowania przez niego Rady Ministrów, kierowania pracami Rady Ministrów, zapewnienia wykonywania polityki Rady Ministrów i określania sposobów jej wykonywania, koordynacji i kontroli pracy członków Rady Ministrów.

A paper describes challenges of globalization, Europeanization and new governance towards institution of public administration body (in the fi elds of law and public management). An author mentions basic assumptions of modern public governance and main, significant elements of processes of globalization and Europeanization. It is necessary to consider the legal institution of public administration body (especially in administrative law and science of administration). The paper describes current problems of mentioned topic (such as varied kinds of development and progress – especially connected with information society). The author suggests to appreciate the complex of global values. Finally he describes the aftermentioned phenomenons not only as threats, but also as opportunities. The author recomended to use their to a better development.

Due to the Act of 11 January 2018 on Amending Certain Acts to Increase the Participation of Citizens in the Process of Selecting, Functioning and Controlling some Public Bodies, provisions establishing new competences of chairpersons of the constituting and controlling bodies of local self-government units were introduced to self-governmental systemic acts. They concern the authority of the chairperson of a constituting and controlling body of local self-government unit to issue service instructions to the employees – respectively – of the municipal office, the county office and the marshal office performing organizational, legal and other tasks related to the functioning of the municipal council, the district council or voivodeship council, their committees and councilors, and establishing that these employees are subordinate to the chairman. Despite thelegitimacy of the intentions related to their introduction, the provisions determining the competences in question give rise to numerous interpretative doubts with regard to the personal scope, the subjective scope, as well as the possible effects of the established powers of the chairperson of the constituting and controlling body of a local self-government unit. ; Ustawą z 11 stycznia 2018 r. o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych do samorządowych ustaw ustrojowych wprowadzono przepisy ustanawiające nowe kompetencje przewodniczących organów stanowiących i kontrolnych jednostek samorządu terytorialnego. Dotyczą one wydawania przez przewodniczącego organu stanowiącego i kontrolnego jednostki samorządu terytorialnego poleceń służbowych pracownikom – odpowiednio – urzędu gminy, starostwa powiatowego i urzędu marszałkowskiego, wykonującym zadania organizacyjne, prawne oraz inne zadania związane z funkcjonowaniem rady gminy, rady powiatu lub sejmiku województwa, ich komisji i radnych oraz ustanowienia podległości zwierzchnictwu służbowemu przewodniczącego tych pracowników. Przepisy ustalające przedmiotowe kompetencje, pomimo zasadności intencji związanych z ich wprowadzeniem, nastręczają jednak licznych wątpliwości interpretacyjnych odnoszących się do zakresu podmiotowego, zakresu przedmiotowego, jak również możliwych skutków ustanowionych uprawnień przewodniczącego organu stanowiącego i kontrolnego jednostki samorządu terytorialnego.

The country assembly is a form of direct exercise of power by the local community (direct democracy). It is the body of a specific settlement, which is an auxiliary unit created in Poland by the commune. The organization of a country assembly, as well as its tasks, are defined in the statute of the settlement, accepted by the commune council. The country assembly, as a collective body, plays an important role in carrying out the tasks transferred to the settlement and also it exerts an impact on how to use the property administered by the settlement. ; The country assembly is a form of direct exercise of power by the local community (direct democracy). The goal of the article is the presentation of the chosen aspects of the evolution of the European Parliament. The author presents the beginnings of this body in the structure of the European Coal and Steel Community, the European Economic Community and the European Atomic Energy Community. The leitmotiv of the article is to show the increase of the importance of the European Parliament during almost 60 years of its existence, from the advisory body to the co-deciding institution in the area of legislation of the European Community. The important manifestation of the European Parliament's aspiration to strengthen its prerogatives was also the struggle to introduce the general election to this body. In the final part of the article the author tries to analyze the current position of the European Parliament in the institutional structure of the European Union.

The Treaty of Lisbon which entered into force in 1 December 2009 has once again increased powers of European Parliament. In fact, the treaties reforming the European Community (and then European Union) lead to change the role of European Parliament from the institution of an advisory nature with very limited power to important body with broad scope of competence and authority. This process ensures the democratization of European Union, because European Parliament is the only one fully democratic EU institution. In the Lisbon Treaty European Parliament for the first time were named as legislative body. According to the treaty the Parliament and Council can be regarded as two chambers in a bicameral legislative branch of the European Union. Therefore, the elections to European Parliament in 2014 were very important for all member states. Presented article provides the new scope of competence of European Parliament and the result of election to this institution in Poland. The author try to answer the question how the Lisbon Treaty influence on political practice.

Amending the Code of Administrative Procedure, the legislator decided to introduce the possibility of conducting mediation proceedings. A mediator may be a natural person who has full legal capacity and exercises full civil rights. The mediator's role is to ensure the conduct of the mediation process. They have the responsibility to stimulate the initiative of the parties by means of appropriate mediation techniques, as well as to create an appropriate climate of conversation, based on mutual trust and respect. The mediator uses procedural rights, which include: the right to read the case files and the right to remuneration and reimbursement of expenses related to mediation. The Code of Administrative Procedure also imposes procedural obligations on the mediator: it must maintain impartiality in the conduct of mediation and draw up a report on mediation. Participants in the mediation are also parties of the administrative proceedings and a public administration body. The task of the public administration body is to determine whether the arrangements made by the parties with the participation of the mediator fall within the scope of the generally applicable law.

The main objective of this paper is to present the position and role of the Polish Internai Security Agency (ABW) in the system of the State's security. Basing on the subject literaturę, the most important legal acts and the information provided by the official internet services, ABW will be positioned with respect to other bodies of thesystem; its internal system and the nature of its operation will be described; and its most important tasks, structure, and functions fulfilled by this unit as a special service will be presented. Being the central body of the governmental administration in the matters of the state's internal security and the constitutional order protection, ABW fulfils the leading role in the state's security system. It is visible in the wide range of assigned tasks, realized in different spheres of state security, and in the kind of measures taken while realizing these tasks, in the organizational structure of the body, and in the extensive power of its officers. On the other hand, activities of a service unit which is endowed with such vast competences, and which fulfils a role fundamental to the security and undisturbed functioning of the state and its institutions, must be subject to strict civil control

Reviewed monography Necros. Introduction to death body's ontology by prof. Ewa Domańska (AMU) is a fragmentary reflection on ontological status of dead body and corps (treated subjectively). Review's author presenting the methodological assumptions of the work, its main goals and concepts of consideration for political scientists. Author also indicates how the term (historical) "necropolitics" could be used by political science and sets a potential field for its scientific exploration.

This is, certainly, connected with the difference between types and procedures of appointing and recalling executive bodies of both types of local governments. On commune level – it is a single body (mayor), who is elected and recalled in universal elections. On the county level – it is multi-personal body (county's management board), which is called and recalled by the county council. Are the differences in the procedure of approval of the implementation of local government budget a good solution for the local governance? On both levels of local government the approval concerns an implementation of local government budget and on both levels – formally the procedure is actually the same. It is only the procedure of recalling of the executive body that differ. This article's aim is to analyse the construction of "rejection of an approval of the implementation of local government budget", which is implemented on a county level of local government. Moreover, the article will point out the role of Regional Audit Chambers in the procedure of an approval of the implementation of county government budget. ; Procedura udzielania absolutorium organowi wykonawczemu jednostki samorządu terytorialnego wykazuje istotne różnice między samorządem gminnym a samorządem powiatowym. Z pewnością związane jest to z faktem odmiennego ustroju oraz trybu wyboru i odwoływania tego organu: na szczeblu gminnym jest to organ jednoosobowy (wójt, burmistrz, prezydent miasta) powoływany w drodze wyborów bezpośrednich i odwoływany w drodze referendum, zaś na szczeblu powiatowym jest to organ kolegialny (zarząd) powoływany i odwoływany przez radę powiatu.
