Governance is presented by undefined and confused areas that tend to expand in a more or less arbitrary way in the absence of stable and reliable normative standards. All this calls into question concepts and recompositive monolithic categories of modern political-legal rationality and in the first place sovereignty. At the same time the current neo-governmental structure does not stand as a technology of power, exclusionary or alternative to other rationalities, but rather it tends to bring out all the contradictions and ambiguities of the present time. ; La gobernanza es presentada por áreas confusas e indefinidas que tienden a expandirse de una manera más o menos arbitraria en ausencia de estándares normativos estables y confiables. Todo esto pone en cuestión conceptos y categorías monolíticas recompositivas de moderna racionalidad política-legal y en primer lugar de la soberanía. Al mismo tiempo, la estructura neogubernamental actual no se sostiene como una tecnología de poder excluyente o alternativa a otras racionalidades, sino que tiende a llevar a cabo todas las contradicciones y ambigüedades del tiempo presente.
El presente trabajo constituye parte de una investigación más amplia relacionada con la percepción que tienen los habitantes del estado Táchira sobre el ejercicio y respeto de los derechos ciudadanos. El artículo incluye algunos elementos relacionados con el desarrollo de la noción de ciudadanía y el análisis de elementos relacionados que han surgido a lo largo de otras investigaciones llevadas a cabo desde el CEFI, como son el análisis de los discursos internacionales, regionales y locales; las propuestas de Ley Orgánica de Fronteras; el estudio de la propuesta de una Zona de Integración Fronteriza Táchira-Norte de Santander y las investigaciones sobre la situación de los refugiados en esta entidad política. ; This is part of a wider investigation related to the perception that the inhabitants of Táchira state have on the exercise and the respect for civil rights. It is a sample of projects carried out in different parts of the world that had the support of the projection screen as a relevant part of the artwork. I present here some projects based on the moment of social isolation, political and economic instability, as well as racial, environmental and social issues. One of the most salient issues in Caribbean studies is the region's linguistic and cultural fragmentation as a result of European colonization. More than five centuries later, the islands and American countries whose shores touch the Caribbean Sea still echo such maladies. The title of this book is a call towards unity, a unity that, in the words of Barbadian poet, historian and critic Kamau Brathwaite, "is submarine." In the past, nations' borders were established based on the distance a cannon ball was able to cover when fired from land out to sea. It is time to go beyond the cannon ball distances out into uncharted territories, beyond the canon, and, thus, beyond the cannon's range. This book features a selection of essays presented at the fifth annual Caribbean Without Borders conference at the University of Puerto Rico, Río Piedras. It critically delves into the fields of linguistics, history, literature, philosophy, politics, feminism, cultural studies, music, film, and art, among many others, as a means to re-visit, re-view, re-envision, re-read, re-interpret, and thus re-create a Caribbean aesthetics that looks to submarine unity, a unity that defies spatial, temporal, and social borders. Border studies have shown it as a social and political construction, of a dynamic nature and a field of tension and conflict. This work tries to apply the border approach to the concept of citizenship. Citizenship as a closed and complete formal condition is questioned and it is presented as an open and unfinished normative project. In it, rights constitute the ethical basis on which the processes of expansion and extension of citizenship that break the moulds of the sedentary model of political community take place. But it is its political dimension that shows the need to broaden inclusion in a political-legal order capable of protecting and guaranteeing them. The link with the State does not disappear, but it is integrated into a multilateral citizenship system that can only be reached from the progressive expansion of cosmopolitan experiences. ; Los estudios sobre la frontera la han mostrado como construcción social y política, de carácter dinámico y campo de tensión y conflicto. Este trabajo trata de aplicar el enfoque de la frontera al concepto de ciudadanía. Se pone en cuestión la idea de ciudadanía como condición formal cerrada y completa y se presenta como proyecto normativo abierto e inacabado. En el mismo, los derechos constituyen la base ética sobre la que se producen los procesos de expansión y extensión de la ciudadanía que rompen los moldes del modelo sedentario de comunidad política. Pero es su dimensión política la que muestra la necesidad de ampliar la inclusión en un orden político-jurídico capaz de protegerlos y garantizarlos. El vínculo con el Estado no desaparece, pero se integra en un sistema de ciudadanía multilateral que solo puede alcanzarse desde la ampliación progresiva de experiencias cosmopolitas.
In recent years, both a theory and a practice of "transitional justice" have taken hold in democratizing contexts worldwide. As an organized and systematic set of beliefs and a way of ordering individual, group and state behavior according to those beliefs and practices, it can be characterized as a "culture," one which has diffused transnationally via a variety of vectors, such as human rights NGOs, international lawyers, international criminal tribunals, and the media. This culture has been overtly didactic: it offers templates, normative guidance and a veritable database of national experiences to bolster the contention that transition to democracy requires a public accounting of the crimes of the past authoritarian regime. An interesting wrinkle in this story of one-way diffusion is provided by the experiences of countries which have defied or contradicted this master narrative, either by managing their democratic transitions and their consolidations through amnesties and pacts (Chile and Spain), or by reversing processes of transitional justice in response to untenable instability (Argentina). But the wrinkle deepens when we consider that all three of these countries have experienced, at different moments and to varying degrees, a return to transitional justice practices and debates at a later date, often years into consolidation. Was this the result of the increased projection of transnationalized "transitional justice culture," responsible for a "revolution" in expectations underscored by the Pinochet arrest in 1998 and the Milosevic trials a few years later? Or are there more compelling "evolutionary" domestic-level explanations? This paper explores the competing hypotheses, analyzes the precepts and ideological contradictions of "transitional justice culture," and contends that a key dyad connecting the revolutionary and evolutionary dynamics at work in the spread of anti-impunity norms across borders is formed by victims' groups and national courts. Both have been the targeted reception sites for trasnationalized norms, and they have served as potential nodes of transformation for their respective national legal cultures. By suggesting that universalizing revolution is channeled, tempered and ultimately transformed by particularlized evolution, this paper argues for a more nuanced, multi-dimensional approach to transitional justice politics, at once highly globalized and yet not in the least homogeneous. ; Peer reviewed
This text engages a critical analysis of humanitarian discourses and practices regarding our understanding of migration and the public policies developed in relation to the population movementsacross international borders. It is based on the premise that humanitarianism, even if well intentioned, can have pernicious effects if, eventually, it ends up replacing justice and migrants' rights. To explore this paradox, the paper sequentially analyzes various problems associated with humanitarian aid: the problem of innocence —the understanding of refugees as victims calls for humanitarian compassion—; the problem with emergency —«rapid response» operations inhibit the contextualized and historical understanding of the root causes of the problems—; and, finally, the problem of compassion —humanitarianism privilegessentiments over rights. The study of these three key features of humanitarianism in Europe and the USA fosters a healthy skepticism of the emerging forms of the legitimation of exclusion. The article also explores alternative political and discursive strategies which allow for new imaginaries to confront migratory processes beyond borders and humanitarianism, breaking up their dynamic of reproduction of social inequalities and placing justice in the horizon of action. ; Este texto plantea un análisis crítico del papel de los discursos y prácticas humanitaristas en nuestra concepción de la migración y en las políticas públicas desarrolladas en relación a la movilidad poblacional a través de las fronteras internacionales. La gravedad de los daños causados en San Vicente del Caguán (Amazonía colombiana) demuestra la barbarie con la que las empresas petroleras saquean y violentan la naturaleza y la forma tímida como las instituciones del estado responden, de forma tardía y con sanciones exiguas. Así mismo y a partir de datos socioterritoriales que dan cuenta de las condiciones sociales de la región, se evidencia que éste modelo de ocupación es una apuesta de desarrollo de carácter extensiva y de gran impacto, que para su despliegue necesita de espacios vaciados.
ABSTRACT: The post-cold war period has witnessed a remarkable increase of the fortification and militarization of territorial borders as a direct result of new transnational challenges, including terrorism, irregular migration, drug traffi cking and weapons smuggling. Today, there are about 65 border walls around the world; most of them were built in the last three years especially in the Arab World and Eastern Europe. Although the fortifi cations of the Arab States' borders differ in contexts and reasons, they are generally similar in structure and techniques used in their construction. The prevention of irregular immigration remains the major goal in the other regions of the world especially in North America and Eastern Europe; however, security goals, mainly the prevention of theinfiltration of armed groups, are the main reasons of the fortifi cation of Arab borders. In addition to the security goals, the current Arab border fortifications intend to prevent regular migration, goods smuggling, and drug traffi cking. Furthermore, this policy strives, in some cases, to unilaterally impose the de facto border. The key question the paper addresses is: to what extent does this fortification of Arab borders reflect the nature of the existing regional subsystems? The paper takes into account that Arab regional subsystems are characterized by mutual mistrust and suspicion, which prevent Arab states to adopt common security border policies. In addition, the current border policies are inseparable from the way in which the postcolonial Arab states' borders were drawn. ; La fortificación de las fronteras de los Estados árabes en los contextos subregionales RESUMEN: El periodo de la posguerra fría ha sido testigo de un aumento notable de la fortificación y militarización de las fronteras territoriales como resultado directo de los nuevos desafíos transnacionales, incluidos el terrorismo, la migración irregular, el tráfico de drogas y el contrabando de armas. Hoy en día, existe alrededor de 65 muros fronterizos en todo el mundo; la mayoría de ellos fueron construidos en los últimos tres años, especialmente en el mundo árabe y Europa del Este. Aunque las fortificaciones de las fronteras de los Estados árabes difieren en contextos y razones, en general son similares en estructura y técnicas utilizadas en su construcción. La prevención de la inmigración irregular sigue siendo el objetivo principal en las otras regiones del mundo, especialmente en América del Norte y Europa del Este; sin embargo, los objetivos de seguridad, principalmente la prevención de la infiltración de grupos armados, son las principales razones del fortalecimiento de las fronteras árabes. Además de los objetivos de seguridad, las fortificaciones actuales de las fronteras árabes pretenden evitar la migración regular, el contrabando de bienes y el tráfico de drogas. Además, esta política se esfuerza, en algunos casos, para imponer unilateralmente la frontera de facto. La principal cuestión que trata este artículo es: ¿en qué medida la fortificación de las fronteras árabes refleja la naturaleza de los subsistemas regionales existentes? El articulo toma en consideración que los subsistemas regionales árabes se caracterizan por la desconfianza mutua, lo que impide que los Estados árabes adopten políticas comunes para la seguridad de las fronteras. Además, las políticas fronterizas actuales son inseparables de la forma en que se dibujaron las fronteras de los Estados árabes después de la etapa colonial. ; La fortifi cation des frontières des États Arabes dans les contextes sous-régionaux RÉSUME : La période de l'après-guerre froide a connu une augmentation remarquable de la fortification et de la militarisation des frontières territoriales, conséquence directe des nouveaux défis transnationaux, notamment le terrorisme, la migration irrégulière, le trafi c de drogue et la contrebande d'armes. Aujourd'hui, il existe environ 65 murs frontaliers dans le monde entier. La plupart d'entre eux ont été construits au cours des trois dernières années, en particulier dans le Monde Arabe et en Europe Orientale. Bien que les fortifi cations des frontières des États arabes soient différents ; dans leurs contextes et leurs raisons, leur structure et leurs techniques, elles demeurent néanmoins similaires. Si la prévention de l'immigration irrégulière reste l'objectif majeur dans les autres régions du monde, notamment en Amérique du Nord et en Europe de l'Est, dans le monde arabe les principales raisons du renforcement des frontières sont d'ordre sécuritaire, principalement la prévention de l'infi ltration des groupes armés. Outre ces objectifs de sécurité, les fortificationsactuelles de la frontière arabe ont pour objectif d'empêcher les migrations régulières, la contrebande de marchandises et le trafi c de drogue. En outre, cette politique s'efforce, dans certains cas, d'imposer de facto la frontière. La question principale qu'aborde cet article est la suivante : dans quelle mesure la fortifi cation des frontières arabes refl ète-t-elle la nature des sous-systèmes régionaux existants ? Cette analyse prend en considération le fait que les sous-systèmes régionaux arabes se caractérisent par la méfi ance réciproque qui empêche les États d'adopter des politiques communes en matière de sécurité frontalière.
