Withdrawing from an organization through an orderly negotiation process would appear as a particularly unproblematic form of leaving international institutions. However, the example of Brexit shows that negotiated dissociations have significant potential to adversely affect relations between exiting and remaining states. This study, which contributes to a forum on the impact of dissociation processes on post-withdrawal relations, argues that the management of conflict during the Brexit process had profound implications for relations between the United Kingdom and European Union member states. The negotiations on the Northern Ireland Protocol were marked by increasingly fundamental accusations against each other regarding (non)compliance with basic norms of international conduct. This led to a deterioration of relations and eventually - despite the avoidance of full escalation - to deadlock when implementation problems arose. To demonstrate this and explore the particular features of negotiated dissociations, the study examines three episodes of conflict: the disputes over ratification of the Withdrawal Agreement, over the Internal Market Bill, and over implementation of the Northern Ireland Protocol.
This article reviews the implications of the Brexit deal for UK higher education and research. It argues that future scenarios will be based not only on the treaties signed with the European Union, but also on policy preferences as laid out in 2017 legislation on higher education and research, and two later policy decisions: to remain in the EU science and innovation program, and to enhance trading relationships, including higher education, with the Pacific region.

Das Buch untersucht das Brexit-Abkommen auf seine Unionsrechtskonformität. Im Schatten der politischen Diskussion wird übersehen, dass der Vertrag juristisch analysiert werden muss. Neben allgemeinen Aspekten wie Auslegung, Geltung und Anwendungsdauer befasst sich die Monographie mit der Zuständigkeit des EuGH über das Abkommen, der Unionsbürgerschaft für britische Staatsangehörige nach dem Brexit, dem Vollzug des Unionsrechts durch das Vereinigte Königreich als Drittstaat, der Sekundärrechtssetzung nach dem Abkommen, dem Recht des Warenverkehrs sowie dem Zollrecht. Das Werk vergleicht das Abkommen mit anderen Formen der Integration und Assoziierung und zieht die Rechtsprechung des EuGH umfassend heran. Abschließend wird das Abkommen in das unionale Außenwirtschaftsrecht eingeordnet. Über den konkreten Fall des Brexit hinaus wird ein Vorschlag zur Grundrechtsbindung von Drittstaaten beim Vollzug des Unionsrechts gemacht.

Das Austrittsabkommen, das die Europäische Union (EU) mit der Regierung des Vereinigten Königreichs (VK) im November 2018 abgeschlossen hat, enthält auch eine Regelung über die gegenseitigen finanziellen Verpflichtungen, die sich aus der Mitgliedschaft des VK in der EU ergeben. Sollte es zu einem ungeregelten Austritt des VK aus der EU kommen, ist unsicher, ob die Briten ihren vereinbarten Zahlungsverpflichtungen nachkommen.
