The present work offers a periodization of the argentinian constitutional history, which is then developed contextually taking data from the political, social and economic history of our country. The analysis of the stages is preceded by a brief review of the circumstances prior to 1810 that we have considered relevant. ; El presente trabajo ofrece una periodización de la historia constitucional argentina, que luego se desarrolla contextualizadamente tomando datos de la historia política, social y económica de nuestro país. El análisis de las etapas es precedido por un breve repaso de las circunstancias previas a 1810 que hemos considerado relevante.

Abstract: In this paper we examine the appropriateness and significance of the law of exception in the Spanish constitutional order. For this, we have examined the models of Comparative Law that Spain has followed to restore its disturbed constitutional order. Basically, historically, concern arose at the time of North American and French Revolutions of how to incorporate into the Constitution the institutions related to their protection. British singularity was also manifested in the way of understanding and including specific protection for the defence of the Constitution and the law of exception, with institutions such as martial law or habeas corpus. The suspension of habeas corpus as an extraordinary instrument of protection of the state organization was considered in the American Constitution of 1787, and is thought of as a precedent of Article 55.1 of the current Spanish Constitution of 1978. During the period between 1812 and 1869, the law of exception contemplated in Spanish Historical Constitutions covers only the suspension of guarantees. The republican Constitution of 1931 conserved the outline of the Constitution of 1869, with certain relevant alterations. The most significant normative instruments of this legislation were the Law of Defence of the Republic and the Law of Public Order of 1933. After the publication of this last Law, it became the extraordinary norm that has most deeply and habitually been put into practice, since Spain has experienced practically a permanent situation of "constitutional abnormality". This highlights the fact that a Law of Public Order for the defence of the constitutional regime established by the Second Republic could be transferred in many of its precepts, with very similar contents to the Francoist Law of Public Order that was able to remain in force until much later, being finally repealed by the Organic Law of LO 1/1992, of Protection of Citizen Safety. ; Resumen: En este trabajo examinamos el encaje y significación que alcanza el derecho de excepción en nuestro ordenamiento constitucional. Para ello hemos examinado los modelos de Derecho Comparado que ha seguido España para restaurar el ordenamiento constitucional perturbado. Históricamente, será, básicamente, con las Revoluciones norteamericana y francesa cuando surge la preocupación por incorporar a la Constitución las instituciones relativas a su protección. La singularidad británica, también se manifiesta en el modo de entender y concretar la defensa de la Constitución y el derecho de excepción, con instituciones como la martial law o el habeas corpus. La suspensión del habeas corpus como instrumento extraordinario de protección de la organización estatal se contemplará en la Constitución norteamericana de 1.787, pudiéndose considerar como precedente del actual artículo 55.1 de nuestra vigente Constitución de 1978. Durante el período comprendido entre 1812 y 1869, el derecho de excepción contemplado en las Constituciones históricas españolas abarca únicamente la suspensión de garantías. La Constitución republicana de 1931, conservó el bosquejo de la Constitución de 1869, con determinadas alteraciones relevantes. Los instrumentos normativos más significativos de esta legislación son la Ley de Defensa de la República y la Ley de Orden Público de 1933. Tras la publicación de esta última Ley, la norma extraordinaria que más profunda y habitualmente se ha puesto en práctica, nuestro país experimentó prácticamente una permanente situación de "anormalidad constitucional". Destacar el hecho de que una Ley de Orden Público aprobada para la defensa del régimen constitucional instaurado por la II República pudo ser trasladada en muchos de sus preceptos, con contenidos muy similares, a la Ley de Orden Público franquista, consiguiendo mantenerse vigente mucho después, hasta ser finalmente derogada por la L.O. 1/1992, de Protección de la Seguridad Ciudadana.

This article studies how, once the independence was achieved and the republic founded, became a social order expected for its novelties in revindication and progress. Once the necessity of the rescue of the individual dignity was created, this engenders many expectations among the population. The rights were applied but from two dimensions: civil rights enforcement and general welfare, and political rights, reserved for those who complied with the requirements constitutionally eligible for the character of citizens. Neither independence nor the republic could pave the social distances between the Colombian, liberal constitutions left early the first outlines of a nation as homogeneous in the sense egalitarian, that the difference is spent assimilation, the latter of absolute impertinence in the preservation of original culture and the achievement of genuine autonomy. ; Este artículo estudia cómo alcanzada la independencia y constituida la república, sobrevino un orden social esperado por sus novedades en materia de reivindicaciones y progresos. Creada la imperiosa necesidad de rescatar la dignidad del individuo, creó numerosas expectativas en la población. Los derechos fueron aplicados pero a partir de dos dimensiones: los derechos civiles de aplicación y beneficio general y los derechos políticos, reservados para quienes cumplían con los requisitos indicados constitucionalmente y podían acceder al carácter de ciudadanos. Ni la independencia ni la república pudieron allanar las distancias sociales entre los colombianos, las primeras constituciones liberales dejaron los primeros lineamientos de una nación tan homogénea en el sentido igualitario, que de la diferencia se pasó la asimilación, esta última de absoluta impertinencia en la conservación de la cultura original y en la consecución de una verdadera autonomía.

En su trabajo Joaquín Varela analiza las relaciones entre las ideas constitucionales y la cultura política liberal en la España contemporánea. Desde el iusnaturalismo escolástico —Martínez Marina—, el liberalismo revolucionario —Argüelles, Flórez Estrada—, el liberalismo postrevolucionario —Balmes, Pacheco, Donoso— o más tarde el liberalismo democrático, el desarrollo de una historia constitucional fue extremadamente complejo. Bajo la influencia del iusnaturalismo escolástico, el historicismo nacionalista y el pensamiento krausista, la llegada del positivismo jurídico a la cultura política española fue débil, como ponen de manifiesto las ideas jurídicas de Adolfo Posada. Este ensayo permite al autor recorrer las líneas maestras que han dominado la historiografía reciente sobre el liberalismo español, al tiempo que diseña la construcción de una Historia Constitucional como disciplina académica. ; Abstract: This article is an essay review on two recent books about Spanish Constitutional History. At his work Joaquín Varela analyses the relationship between constitutional ideas and the liberal political culture in the Modern Spanish From the scholastic iusnaturalism —Martínez Marina— to the revolucionary liberalism —Argüelles, Florez Estrada—, postrevolucionary liberalism —Balmes, Pacheco, Donoso— or later in liberal democracy, the development of the Constitutional History was extremely complex. Under the influence of the scholastic iusnaturalism, nationalist historicism and the krausistic ideas, the arrival of juridical positivism in the Spanish political culture was weak, as the juridical ideas of Adolfo Posada have shown. This essay let him to check hard lines which ruled recent historiography about Spanish liberalism. At the same time Varela tries to set up Constitutional as academic discipline in Spain.

This article reviews the Colombian constitutional history taking an approach from American legal realism called law and society as a theoretical model. It intends to identify the processes that have resulted in the transformations of constitutional models —as referred to in this research— and the reasons that led socio-political elites to make changes to such models. A temporary model is established from 1819 to date, approaching the forms of drafting those Colombian constitutions that have been enacted within the period concerned. It is concluded that the manifold constitutional models are a sample of failures in Colombian political institutions that are still evident due to circumstances that seek to affect the current constitutional structure. ; Este trabajo es un ejercicio de revisión de la historia constitucional colombiana que toma como modelo teórico el enfoque proveniente del realismo jurídico estadounidense denominado "derecho y sociedad". Se pretende identificar los procesos que han permitido las transformaciones de los que en esta investigación se denominan modelos constitucionales, a partir de la explicación de las razones que llevaron a que las élites sociopolíticas efectuaran cambios en dichos modelos. Se establece un modelo temporal desde 1819 hasta la fecha, acercando las formas de construcción de las constituciones que han sido expedidas para Colombia en el tiempo establecido. Finalmente, se concluye que la diversidad de modelos constitucionales es una muestra de fallas en las instituciones políticas colombianas que incluso hoy en día son evidentes debido a las coyunturas que buscan afectar la estructura constitucional vigente.

Based on the theoretical premises that conceive the processes of state formation and nation building as "longue durée" processes, which we have extrapolated to the Central American integration process, and applying the methodological categories of Comparative Public Law, especially the Legal Formants Theory, this study intends to carry out a diachronic reconstruction of the doctrinal formant of SICA's legal system. It will specially focus in analyzing the historical and political concepts, which constitute "collective singulars" of the Central American socio-historical context to which historical and constitutional works of legal scholars refer when developing and systematizing the constitutional doctrine in Central America and its relationship with the regional integration efforts in a period from 1800 to 1920. This volume includes31 constitutions, constitutional drafts and amendments illustrating the checkered political history of Spain in the first half of the 19th century. It begins with the "Estatuto de Bayona" (Bayonne Statute) imposed by the French in 1808 and continues with the"Constitucion politica de la Monarquia Española" (Political Constitution of the Spanish Monarchy), the first independent constitution of Spain, which was drawn up in Cadiz in 1812. Este trabajo surge de la convicción de que se ha estudiado exhaustivamente lo que podríamos llamar la vertiente positiva de la historia del Estado de Derecho, sobre todo la separación de poderes; pero no se ha estudiado tanto su vertiente negativa, el concepto de arbitrariedad y cómo ha sido percibida esta por los ciudadanos a través de la Historia. Para ello, tras un rápido repaso a los precedentes clásicos y de la Edad Media (con la Carta Magna a la cabeza), se analizan las tres grandes revoluciones modernas contra el poder arbitrario: la inglesa del siglo XVII y la americana y la francesa del XVIII, para a continuación estudiar la lucha española del siglo XIX. El análisis de estos grandes momentos históricos nos lleva a un resultado muy sugerente para el mundo jurídico: la distinta percepción de quien era el poder arbitrario (el rey en Inglaterra, el Parlamento en Estados Unidos y el rey y sus tribunales en Francia y España) llevó a una diferente articulación de la común división de poderes, con mecanismos de control de la arbitrariedad política eficaces en Estados Unidos y Gran Bretaña y bastante menos, en Francia y España. ; The main purpose of this study, based on the conviction that what we might call the positive aspect of the history of the Rule of Law, especially the separation of powers, has been thoroughly studied, is to examine its negative aspect, i.e., the arbitrariness concept and the manner in which citizens have perceived it throughout history. To address this matter, first there is a brief review of the historical background of the Ancient Times and the Middle Ages (with emphasis on the Magna Carta). Secondly, the three major revolutions of Modern Times against the arbitrary use of power are analyzed: the English Revolution of the 17th Century, the American Revolution and the French Revolution of the 18th Century and then the Spanish Revolution of the 19th Century. The analysis of these important historical times provides a very interesting result to the judicial sphere: the different perception of the one holding the arbitrary power (the King in England, the Parliament in the United States of America and the King and its Courts in France and Spain) led to a different articulation of the common division of powers, with efficient mechanisms to prevent the arbitrary use of power in politics in the United States of America and Great Britain and rather less efficient in France and Spain.

This essay is a historical compilation of the constitutions in need of sovereignty and Universal suffrage as rights of difficult conquest and now we can enjoy. To achieve this task, there was a need to immerse yourself in the various constitutions that Nicaragua has had in force throughout history, with the deserved emphasis of sovereignty, independence, freedom, democracy, the territory on which It exerts such sovereignty, the Nicaraguan being, the citizens' rights and, in particular, the universal suffrage. In the end it will only be related in the conclusive part the effect of these constitutions in the real context of our history, where there is a contrast between the written in the constitutions and what actually happened. ; Este ensayo es una recopilación histórica de las constituciones en menester de la Soberanía y el Sufragio Universal como derechos de difícil conquista y que ahora podemos gozar. Para lograr este cometido, hubo necesidad de ponerse inmerso en las diferentes Constituciones que Nicaragua ha tenido vigentes a largo de la historia, con el énfasis merecido de la soberanía, la independencia, la libertad, la democracia, el territorio sobre el cual se ejerce dicha soberanía, el ser nicaragüense, los derechos ciudadanos y en especial, el sufragio universal. Al final solo se relacionará en la parte conclusiva el efecto de dichas Constituciones en el contexto real de nuestra historia, donde se encuentra un contraste entre lo escrito en las Constituciones y lo sucedido realmente.

Der Supplementband ergänzt die 2006 bis 2009 erschienene siebenbändige Ausgabe der Constitutional Documents of the United States of America 1776–1860. Er enthält 14 Verfassungsdokumente zu acht verschiedenen Bundesstaaten die erst jetzt in amerikanischen Bibliotheken und Archiven zugänglich wurden. Darunter ist u. a. auch die Verfassung der kurzlebigen, 1832 bis 1835 von New Hampshire abgespaltenen "Republic of Indian Stream", sowie seltene englisch- und spanischsprachige Verfassungsdokumente aus New Mexico und Texas. Die Texte wurden auf der Grundlage der mitunter seltenen Originaldrucke der offiziellen Staats- oder Konventsdrucker unter Hinzuziehung der Originalmanuskripte ediert, annotiert und indexiert
