Enseñar Derecho Constitucional ; Teaching Constitutional Law
Se exponen en estas notas, fruto de la intervención en el Congreso anual de la Asociación de Constitucionalistas de España (celebrado en Santiago de Compostela en abril de 2019), algunas de las iniciativas de innovación docente desarrolladas desde el Departamento de Derecho Político de la UNED para las asignaturas de la disciplina de Derecho constitucional. Se aborda la dinámica de trabajo del equipo docente de la asignatura, los materiales elaborados y la forma de interactuar con los alumnos en las plataformas virtuales. De forma particular, se analiza la necesidad de progresar en el uso y aprovechamiento de los instrumentos que nos ofrecen las nuevas tecnologías en nuestra labor docente. ; These notes are the result of the intervention in the annual Congress of the Association of Spanish Constitutionalists (Santiago de Compostela, April 2019) and show some of the teaching innovation initiatives developed by the Department of Political Law of the UNED, within the Constitutional Law area. Teaching strategies, resources used and the way to interact with students through virtual platforms are analysed. More specifically, the text focuses on the need of further progress in the use of technological tools so as to improve our teaching practice.

Constitutional law and the crisis ; El derecho constitucional y la crisis
The current economic crisis, caused by a series of active subjects with the aim of occupying certain public spaces, is one of the consequences of the «globalization of poverty». It is putting into question the democratic model of Western democracies, causing a constitutional crisis even worse than the economic crisis itself. This leads to the imperative to provide appropriate policy responses, requiring the use of new categories dogmatic. In this regard, constitutional law, and common law legal system and as principial law, is prevalent in a position to carry out, in collaboration with other legal disciplines, all that dogmatic reconstruction process that must lead necessarily, a constitution for the private. ; La actual crisis económica, originada por una serie de sujetos activos con la pretensión de ocupar determinados espacios públicos, es una de las consecuencias de la llamada «globalización de la miseria». La misma esta poniendo en tela de juicio el modelo democrático de las democracias occidentales, produciendo una crisis institucional más grave aún que la propia crisis económica. Ello conduce a la necesidad imperiosa de proporcionar respuestas normativas adecuadas, que requieren la utilización de nuevas categorías dogmáticas. A este respecto, el Derecho constitucional, como Derecho común del ordenamiento jurídico y como Derecho principial, se encuentra en una posición prevalente para llevar a cabo, en colaboración con las demás disciplinas jurídicas, todo ese proceso de reconstrucción dogmática que ha de conducir, necesariamente, a una constitucionalización de lo privado.The current economic crisis, caused by a series of active subjects with the aim of occupying certain public spaces, is one of the consequences of the «globalization of poverty». Constitutional law and judicial guarantees: their structure and interpretation at the national and international level

The article is devoted to the study of the essence of constitutional law, together with judicial guarantees, their interpretation and normative consolidation in international legal acts and national regulations, as well as to the clarification of the place of the right to a fair trial in human rights. Thanks to the use of a system of general scientific and special scientific concepts and methods, it was established that the conceptualization of the right to a fair trial was given by the European Convention for the Protection of Human Rights and Fundamental Freedoms and, moreover, is reflected in the precedent practice of the European Court of Human Rights. In this context, characteristic features of the right to judicial guarantees are defined, its procedural and functional components are distinguished, and procedural and substantive justice are characterized. Everything allows concluding that, the characteristic features of the constitutional right to a fair trial in a state governed by the rule of law are defined as: the perceived ability of a person to exercise the specified right; the presence of a special subject-object structure; appropriate actions in specially created state judicial institutions to restore violated rights.

¿Es posible un derecho constitucional latinoamericano? ; A Latin American Constitutional Law is Possible?
El artículo analiza los obstáculos que, en la actualidad, existen para construir un derecho constitucional común latinoamericano, no obstante existir importantes y numerosas características comunes. No todos los Estados latinoamericanos han adoptado el régimen democrático representativo que exige la Carta de la Organización de Estados Americanos, ni respetan los derechos humanos establecidos en la Convención Americana de Derechos Humanos y en la Carta Democrática Interamericana, como Cuba y Venezuela. Los Estados de América del Sur que han adoptado el régimen democrático representativo de gobierno y protegen el derecho de propiedad individual y la libertad económica, no integran el «nuevo constitucionalismo latinoamericano». Las Constituciones de Bolivia y Ecuador establecen que el Estado dirigirá y planificará la economía, fomentando la economía comunitaria, lo que impide ejercer la libertad económica y, por consiguiente, un derecho constitucional común latinoamericano. ; The article analyses the obstacles which currently exist to build a common constitutional law in Latin America, in spite of the existence of numerous important common characteristics. Not all Latin American states have adopted a democratic regime, representative of that of which is required by the Charter of the Organization of the American States nor do they respect human rights as established by the American Convention on Human Rights and by the Inter-America Democratic Charter, like Cuba and Venezuela. The South American states which have adopted a democratic regime, are government represented, protect personal property rights and economic freedom are not included in the «new Latin American Constitution.» The Constitutions of Bolivia and Ecuador establish that the State will govern and plan the economy, promoting community economy, which in turn prevents the practise of economic freedom and, as a result, a common Latin American constitutional right.

The Spanish institutional system has worrying weaknesses. Although the roots are older, the deterioration has been particularly intense since 2015. In this work, different institutions of constitutional law ara analyzed as a reflection of this situation. Extraordinary circumstances as the crisis in Catalonia or the health crisis have aggravated this situation. The conclusión is a significant weakness of the rule of law. ; El sistema institucional español tiene debilidades preocupantes. Aunque las raíces son anteriores, el deterioro ha sido particularmente intenso desde 2015. En este trabajo se analizan distintas instituciones del derecho constitucional como reflejo de esta situación. Circunstancias extraordinarias como la crisis de Cataluña o la sanitaria han agravado esta situación.The Spanish institutional system has worrying weaknesses. From the process of globalization of law, the comparative constitutional law has gained a leading role for a better understanding and solving old and newconstitutional national and international challenges. Therefore, some assumptions andconsiderations to take into account are presented for the development of the nationalconstitutional order within the framework of the comparative constitutional law, such asuniversality and relativism of human rights; the concept of power and constitutional democracy;standards of free elections and judicial independence; freedom of expression, media pluralism andaccess to public information; the economic,social and cultural rights; the new fundamental rights. ; A partir del proceso de globalización del derecho, el derecho constitucional comparado ha ido adquiriendo un rol protagónico para una mejor comprensión ysolución de los viejos y nuevos desafíos constitucionales, tanto nacionales como internacionales.Por ello, se presentan algunos presupuestos y consideraciones temáticas a tomar en cuenta para eldesarrollo del ordenamiento constitucional nacional en el marco del derecho constitucionalcomparado, tales como la universalidad y el relativismo de los derechos humanos; el concepto depoder y democracia constitucional; los estándares de elecciones libres e independencia judicial; lalibertad de expresión, la pluralidad informativa y el acceso a la información pública; los derechos económicos, sociales y culturales, y; los nuevos derechos fundamentales.

Towards a digital european integration: Constitutionalization of EU law and europeanization of constitutional law in the field of data protection
La Unión Europea ha experimentado un paulatino proceso de integración. Tras la realización de una integración económica, siguieron etapas posteriores de integración europea. El respeto hacia los derechos fundamentales, constituyó, desde sus inicios, un signo distintivo del proyecto de construcción europeo y la integración política se vio mayoritariamente realizada tras la reforma del Tratado de Lisboa (revisando los tratados constitutivos, así como incorporando la Carta de Derechos Fundamentales de la Unión Europea como parte del derecho originario y otorgándole una naturaleza jurídicamente vinculante); la integración jurídica se produjo poco después. En lo que a la digitalización y el derecho fundamental a la protección de datos concierne, la UE ha vivido un largo proceso de desarrollo normativo y jurisprudencial, conduciendo hacia una nueva etapa de integración:la integración digital. La presente comunicación acomete, por un lado, la tesis que hemos llamado europeización del Derecho Constitucional y la constitucionalización del Derecho de la UE en materia de protección de datos, y el análisis del mercado único digital como el punto de partida de una etapa emergente de integración europea ; The European Union has experienced a slow but sure process of integration. After the initial economic construction, other stages of integra tion followed. Respect for fundamental rights was, from the very start, one of the distinguishing marks of the European integration project, and after the Lisbon Treaty (amending the founding treaties and incorporating the Charter of Fundamental Rights of the European Union as part of primary law with legally binding character) political integration was mostly completed and the foundation for legal integration materialised. As regards digitalisation and the fundamental right to data protection (as enshrined in the CFREU), the EU has experienced a long process of normative and case - law development, leading into a new stage, this time, of digital integration. The present paper aims at presenting what we are calling the Europeanization of Constitutional Law and the Constitutionalization of EU Law in data protection matters while analysing the digital single market as the new starting point for a new stage of European integration

The concept and structure of activities in the field of organizing and holding elections to government bodies in the theory of constitutional law

The article aims to study the concept and structure of activities in the field of the organization and holding of elections to governing bodies in the theory of constitutional law. The main method was the analysis of systems that allows to study the system of activities in this field. The latter can be represented by different structures depending on the stage of their cognition as an object or their internal processes. In addition, the article used the historical method, deduction, induction, etc. It is concluded that the system of activities in the field of the organization and holding of elections to the governing bodies is a unit of their properties and integral elements, order and their interaction, as well as stable connections between them, based on the principles of preservation or invariance, which are organized as appropriate relations between the structural elements themselves and their external environment, that is, the sphere of the organization and conduct of elections to the governing bodies.
La enseñanza del Derecho Constitucional a través del cine ; Teaching Constitutional Law through cinema
El cine debería convertirse en una herramienta pedagógica esencial en la enseñanza del Derecho Constitucional. Su capacidad de incidir en las emociones, y por lo tanto para generar empatía, lo convierten en un instrumento idóneo para la compresión de los valores constitucionales, así como para aprender y aprehender los complejos contenidos de los derechos fundamentales. De esta manera no solo contribuiría a la formación más completa de los/as futuros/as juristas, sino también a la conformación de una ética cívica sin la que no es posible el ejercicio de la ciudadanía en términos democráticos. La experiencia del profesorado de Derecho Constitucional de la Universidad de Córdoba, traducida en varios proyectos de innovación educativa, avalan la utilización del cine en las aulas, la cual, además de los objetivos ya señalados, contribuye a estimular el pensamiento crítico y las habilidades argumentativas del alumnado ; Cinema should become an essential pedagogical tool in teaching constitutional law. Its ability to influence emotions, and therefore to generate empathy, making it a suitable instrument for compressing constitutional values and to learn and understand complex contents of fundamental rights. This not only contribute to a comprehensive training of future lawyers but also to the formation of a civic ethics without which it is impossible the exercise of democratic citizenship. Experience teacher of constitutional law at the University of Córdoba, translated into several educational innovation projects, support the use of films in the classroom, which, in addition to the objectives already mentioned, helps to stimulate critical thinking and the argumentative abilities of students

Algunos desafíos del derecho constitucional del siglo XXI ; Some challenges of the Constitutional Law of the XXI century
Resumen: El artículo trata de visualizar y esbozar algunos de los principales desafíos temáticos que enfrenta el Derecho Constitucional de nuestros días, desde una perspectiva personalista que pone a la igual e inviolable dignidad de la persona humana como eje y fundamento del orden político y jurídico. Se desarrollan cuatro temas, a saber: la dignidad de la persona humana, las políticas públicas, el medio ambiente y la organización de las instituciones globales. ; Abstract: The article tries to visualize and outline some of the main thematic challenges facing the Constitutional Law of today, from a personalistic perspective that puts the equal and inviolable dignity of the human person as the axis and foundation of the political and legal order. Four themes are developed: the dignity of the human person, public policies, the environment and the organization of global institutions. ; Sommario: L'articolo cerca di visualizzare e delineare alcune delle principali sfide tematiche che il Diritto Costituzionale deve affrontare oggi, da una prospettiva personale che pone la dignità uguale e inviolabile della persona umana come asse e fondamento dell'ordine politico e legale. Vengono sviluppati quattro temi, vale a dire: la dignità della persona umana, le politiche pubbliche, l'ambiente e l'organizzazione delle istituzioni globali.

"Constitutional Law: Toward a Paradigm Shift?" ; El Derecho Constitucional ¿Hacia un cambio de paradigma?
Constitutional Law, as considered from the internal point of view of the Science of Law, is an advanced result that stems of the late modernity (centuries XIX and XX), that follow the illustration movement. One of it´s main characteristics, since the foundation as rule of Law, is the law abiding as a principle of government, as well, the preponderance of a conservative legalistic perspective that primes separation of powers and the State sovereignty for the configuration of it´s object.Now, this vision seems to looks confronted by the postmodern analysis of Law, which makes it possible to assert that chances are in stake, at least, for the development of a crisis, as state-of-the-art; if not a step forward a Paradigm change; in all concerns to the fluidity or flexibility of the legislative rules, as opposed at the rigidity of law, a perennial constitutional attribute recognized by the main stream of Scholars.In order to argument such position, this article pretends to articulate a basic definition of paradigm, epistemologically considered, and which would be the theoretical basis to guess a possible systemic evolution, respect the most traditional assumption on the matter. ; El derecho constitucional, considerado desde el punto de vista de la ciencia del derecho, es un producto avanzado de la modernidad tardía (siglos XIX e inicios del XX), que siguió a la Ilustración. Desde la conceptualización del Estado de Derecho, una de sus principales características, fue el asentarse en el principio de legalidad y, en el sistema anglosajón, en el ámbito de imperatividad que impone el Rule of Law, preponderando una visión o perspectiva legalista y conservadora desde la separación de poderes y la soberanía estatal, para la configuración de su objeto. Ahora esta visión se ve desafiada desde el análisis postmoderno del derecho, resultando asertivo la posibilidad de una crisis o un cambio de paradigma en el derecho legislado y, particularmente, en el atributo de rigidez que tradicionalmente se le confiere al derecho constitucional. Para fundamentar tal pretensión, se parte de una conceptualización de lo que es el paradigma – epistemológicamente considerado – y cuáles son las bases teóricas que permiten conjeturar si nos encontramos ante una evolución sistémica respecto a la consideración tradicional del derecho legislado por el Constituyente.
