La protection du consommateur dans la vente en ligne en Côte d'Ivoire: Etude à la lumière du Droit européen ; Consumer protection in online sales in Côte d'Ivoire: A study in the light of European law

Like most African countries, Côte d'Ivoire is experiencing a rapid growth in e-commerce. This boom brings challenges of all kinds. Amidst others, it is taking in a legal context where consumer protection has not yet found its place, as evidenced by the texts of laws governing distance selling in Côte d'Ivoire. The thesis aims to propose an improvement of consumer protection in distance selling in Côte d'Ivoire through a review of laws in the light of European law. Though it refers to the European legal model, the thesis stresses that the literal mimicry of European law is one of the reasons for the ineffectiveness of African laws. The premise of the thesis about distance selling is that we cannot protect the consumer in the ivory coast in the same way that European law protects the European consumer. Beyond a simple legal comparison, the thesis stirs an in-depth reflection on the circulation of legal models. It examines the relationship between African law and European law from a historical and contextual point of view in order to determine how European law can serve as a model for Ivorian law so as to offer sufficient protection to consumers without threatening the growth of distance sales. ; Comme la plupart des pays africains, la Côte d'Ivoire connaît une croissance rapide du commerce électronique. Ce boom pose des défis de toutes sortes. Parmi d'autres, elle s'inscrit dans un contexte juridique où la protection des consommateurs n'a pas encore trouvé sa place, comme en témoignent les textes de lois régissant la vente à distance en Côte d'Ivoire. La thèse vise à proposer une amélioration de la protection des consommateurs dans la vente à distance en Côte d'Ivoire à travers une révision des lois à la lumière du droit européen. Bien qu'elle fasse référence au modèle juridique européen, la thèse souligne que le mimétisme littéral du droit européen est l'une des raisons de l'inefficacité des lois africaines.Le postulat de la thèse sur le sujet de la vente à distance est celui d'affirmer que l'on ne peut pas protéger le consommateur en côte d'ivoire de la même manière que le Droit européen protège le consommateur européen. Au-delà d'une simple comparaison juridique, la thèse suscite une réflexion approfondie sur la circulation des modèles juridiques. Elle examine la relation entre le droit africain et le droit européen d'un point de vue historique et contextuel afin de déterminer comment le droit européen peut servir de modèle pour le droit ivoirien de sorte à proposer une protection suffisante aux consommateurs sans menacer la croissance des ventes à distance.

The thesis analyzes, under various aspects related to private international law and international civil procedure of the European Union, the status of the protection offered to the European consumers in their international contracts, in particular in relation to the objectives and in the context of the single market. The thesis is divided into three chapters. The first chapter deals with consumer protection in the international private law of European Union (regulation (UE) 1215/2012 and regulation (CE) 593/2008). The second chapter deals with the protection offered to consumers by european international civil procedure with reference to individual and collective litigations. The third chapter deals with alternative dispute resolution (ADR) and with on-line dispute resolution (ODR) and analyzes EU directive 2013/11/UE and regulation (EU) 524/2013. ; Le travail réalisé a pris en considération en premier lieu le droit international privé de l'UE, puis des aspects plus à proprement parler de « droit international procédural », en se concrétisant par une « systémisation » et une cartographie des voies de recours proposées au consommateur par le droit européen pour les litiges transfrontaliers. La première partie, concernant la loi applicable aux contrats internationaux du consommateur et le tribunal compétent dans le droit international privé de l'Union européenne, permit d'identifier les problématiques de droit international privé sous-jacentes aux contrats et aux litiges internationaux en matière de consommation, qui sont exacerbées dans le domaine du commerce électronique. La thèse traite deuxièmement la protection du consommateur par l'assouplissement et la simplification des procédures ordinaires et la protection du consommateur par des procédures collectives transfrontalières. The objective of the thesis is to make an analysis of the rules laid down to adapt electronic contracts to the strict requirements of consumer law. These rules must often be mixed standards of private international law and the general law of consumption. It is important to investigate coordination between the classical rules of conflict of laws and the courts to e-commerce? Private international law is ready to face the world intangible, which relies on the location of the acts and made legal? The problem lies in the fact that: the contracts online are primarily subject to common law contracts. But, at the same time, it would be simplistic to see the electronic contract as a contract. In fact, it has several aspects that justify the development of a suitable framework. From this observation, it seems that the rules of common law are insufficient and that special standards must be put in place. Thus, it is important to consider the measures taken by European, french and Egyptian lawmakers specifically, to address the difficulties identified as the renewal and the development of techniques. It is necessary that there is also a supportive environment with strong competition among telecommunications providers. Indeed, it takes a real desire! These elements are crucial to continue the development of e-commerce while applying the rules relating to the protection of the consumer. And also, they are essential to produce useful applications, of high quality. In this area too, Governments can play a vital role in ensuring that secondary and professional schools teach as necessary expertise to assist in the emergence of a real digital economy sustainable, adaptable to the needs of users. ; Ce sujet concerne la protection du consommateur dans le cadre du commerce électronique. L'objectif de la thèse est de faire une analyse des règles édictées en vue d'adapter les contrats électroniques aux exigences strictes posées par le droit de la consommation. Des règles spéciales sont en effet nécessaires afin de régir un monde virtuel, dématérialisé, où la marchandise est numérique. Ces règles doivent souvent être mêlées aux normes du droit international privé et au droit général de la consommation. Il est important de s'interroger sur la coordination entre les règles classiques de conflits de lois et celles des juridictions au e-commerce? Le droit international privé est-il prêt à faire face au monde immatériel, lui qui s'appuie sur la localisation des actes et faits juridiques ? La problématique réside dans le fait que: les contrats passés en ligne sont avant tout des contrats soumis au droit commun. Mais, en même temps, il serait réducteur de voir le contrat électronique comme un simple contrat. Celui-ci comporte en effet plusieurs aspects qui justifient l'élaboration d'un cadre adapté. Partant de ce constat, il semble que les règles de droit commun sont insuffisantes et que des normes spéciales doivent être mises en place. Ainsi, il importe d'étudier les mesures prises par les législateurs européen, français et égyptien, précisément, dans le but de résoudre les difficultés identifiées au fur et à mesure du renouvellement et du développement des techniques. En effet, on constate, l'émergence d'un droit propre au commerce électronique qui traite de ses différents aspects et notamment de la protection des parties vulnérables tel que les cyber-consommateurs. On assiste aujourd'hui à une période d'effervescence législative: une dizaine de directives sur le commerce électronique, les contrats à distance, les services financiers… ont été adoptés dans le cadre communautaire et à peu près le même nombre de lois a été promulguées au niveau interne pour assurer leurs transpositions et plus largement les stratégies d'améliorations des systèmes juridiques, de mises à jour des législations économiques, de renforcement des protections mises en œuvre par les gouvernements qui aspirent ou adhèrent aux mutations de l'économie internationale et enfin l'adaptabilité des droits internationaux à la résolution des litiges en matière de commerce électronique. Comme traitée dans la Deuxième Partie de cette thèse, pour permettre des transactions fiables, de grande qualité en ligne concernant les pays arabes et les pays en voie de développement, il faut des systèmes de télécommunications modernes offrant des services à large bande et des services mobiles à des prix abordables pour les entreprises et les particuliers. Il faut qu'il existe aussi un milieu favorable avec une concurrence forte entre les fournisseurs de télécommunications. En effet, il faut une véritable volonté ! Ces éléments sont primordiaux pour continuer au développement du commerce électronique tout en appliquant les règles relatives à la protection du consommateur. Et aussi, elles sont indispensables pour produire des applications utiles, de grande qualité. Dans ce domaine aussi, les pouvoirs publics peuvent jouer un rôle vital en veillant à ce que les écoles secondaires et professionnelles enseignent comme connaissances spécialisées nécessaires pour aider à l'avènement d'une véritable économie numérique durable, capable de s'adapter aux besoins des utilisateurs.

For a number of years, WAEMU member states have been engaged in a major project of economic liberalization followed by an ambition for an economic integration. This makes consumerist national legislative projects difficult. This study questions whether these ambitions for economic integration take into account the interests of consumers and whether we need an effective consumer protection in the common market. How could this economic liberalism be reconciled with an effective consumer protection within the common market? In other words, would a divergence between the various provisions of the Member States be harmful to consumers? Finally, can we actually speak about a real West-African consumer protection law? Throughout this study it will be demonstrated that community consumer protection exists, but it is sectoral. However, the areas left "vacant" by Community Law are implicitly governed by different national embryonic and mostly identical provisions. Hence the risk of legal uncertainty and the need for the OHADA project on contract law as a perspective within the framework of consumer protection in WAEMU and within the common market. ; Depuis un certain nombre d'années, les Etats membres de l'UEMOA se sont lancés dans un vaste projet de libéralisation économique suivi d'une ambition d'intégration économique, rendant ainsi difficile les projets législatifs consuméristes nationaux. Criminal protection of the consent given by the consumer ; La protection pénale du consentement donné par le consommateur
The consumer's penal protection is an essential stake, even more so following the last legislative reforms that occurred in the matter. The consumer's consent's protection represents the very essence of criminal law's intervention in the consumerist sphere. The fundamental question that must be asked is whether criminal law punishes the criminal behaviour that a professional might show as an additional legislation which is dependent on civil law or, more interestingly, if criminal law is in fact autonomous in the consumer's consent's protection without being nothing more than a repressive and dissuasive legislation. ; La protection pénale du consommateur est un enjeu essentiel, à plus forte raison, à la suite des dernières réformes législatives intervenues en la matière. La protection du consentement du consommateur représente l'essence même de l'intervention du droit pénal dans la sphère consumériste. La question fondamentale qu'il convient de se poser est donc celle de savoir si ce droit pénal sanctionne les comportements délictueux dont peut faire preuve le professionnel de manière accessoire au droit civil ou bien, plus intéressant, s'il revêt une autonomie dans la protection du consentement du consommateur, sans être un simple droit sanctionnant et dissuasif.

In addition, there exist a number of voluntary procedures, such as the use of labels (certifying high quality), from which producers seeking to differentiate their products may choose. The State's role is therefore confined to protecting the interests of the consumer by guaranteeing fair trading and accurate information.
