ccording to the Section 1 of the Council of European Union Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia by means of criminal law, each Member State shall take the measures necessary to ensure that the following intentional conduct is punishable: publicly condoning, denying or grossly trivialising crimes of genocide, crimes against humanity and war crimes. Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law provides for liability in the public glorification of genocide, crime against humanity, crime against peace or war crime or glorification, denial, acquittal or gross trivialisation of committed genocide, crime against humanity, crime against peace or war crime, including genocide, crime against humanity, crime against peace or war crime committed by the U.S.S.R. or Nazi Germany against the Republic of Latvia and its inhabitants. The article aims to initiate a debate on potential problems related to the application of the Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law. The author offers his vision of the regulatory framework application problems.
Organized crime did not arise suddenly, it is an occurrence that dates back to the nineteenth century. Its modern form is characterized by exceptional diversity both in terms of goods threatened by its impact, as well as the forms in which it manifests itself. The main area of threats are drug production and trafficking. It is a global problem and the links of organized crime groups cover the whole world, regardless of the system, political or economic situation of a given country. The international drug crime has been developed too rapidly and individual governments are not abble to cope with it. Countries have been confronted with joining forces and creating a strong legal instrument, based on international cooperation, which will be able to give the relevant national authorities the right powers to counter organized drug crime. The aim of the article is to present the legislative and institutional dimension of the fight against organized drug crime in the global, european and national perspective.
On January 19, 2012, the European Commission (Commission) decided to launch a visa liberalisation dialogue with Kosovo, and on June 14, 2012, it handed over to Kosovo's government a 'Roadmap Towards a Visa-free Regime'. This document included 95 requirements that Kosovo had to fulfil. By 2016, the Commission had adopted four reports on progress made by Kosovo in the visa dialogue. In a report issued on May 4, 2016, the EC proposed to the Council of the EU (Council) and the European Parliament (EP) to lift visa requirements on the citizens of Kosovo. The Commission stressed that by the day of the adoption of the proposal by the EP and the Council, Kosovo must have ratified the border/boundary agreement with Montenegro and strengthened its track record in the fight against organised crime and corruption. On July 18, 2018, the Commission confirmed in a report on the progress made by Kosovo in the visa dialogue, that the country had fulfilled the last two requirements included in the roadmap. The aim of this article is to analyse the visa-liberalisation dialogue between the European Union (EU) and Kosovo and whether liberalisation through a visa-free regime with Kosovo had an influence on reducing organised crime and corruption in Kosovo. The article is based on an analysis of primary and secondary sources, as well as statistical data.
W artykule przyglądam się temu, jaką edukację polityczną warto rozwijać we współczesnej polskiej szkole i wszędzie tam, gdzie buduje się w ludziach zdolność do wspólnej i niewyalienowanej pracy. Kierunek rozważań wyznaczyła konieczność ustosunkowania się myśli pedagogicznej – i równoległego dostosowania praktyk wychowawczych – do zmian w sposobie koordynacji społeczeństwa, które dokonują się w atmosferze groźby wybuchu wojny. Rozważania te buduję na dotychczasowych badaniach własnych z obszaru uczenia się w ruchach społecznych, analizując trzy porządki zapewniające koordynację społeczeństw (neoliberalizm, nacjonalizm, militaryzm) w kontekście wykluczanych przez nie wartości: dobra wspólnego, samorządu i pokoju. Rezultatem pracy jest matryca przyporządkowująca te kontrwartości różnym typom współpracy (koordynacji, kooperacji i kolaboracji). Matryca pozwala identyfikować specyfikę konkretnych przykładów mobilizacji społecznej, jak i rozpoznawać luki w kształceniu kolektywnych umiejętności współdziałania. Rezultaty analizy pozwalają zoperacjonalizować praktyki oporu pod kątem celów wychowania i stawiają w nowym świetle problemy powiązań i nawarstwiania się wrogich szkole ideologii neoliberalizmu, nacjonalizmu i militaryzmu. ; The paper analyses types of political education worth developing in contemporary Polish schools and in other places dedicated to building human capacity to work together in a non-alienated way. The analysis is based on my own research from the area of learning in social movements. I analyze three orders ensuring social coordination (neoliberalism, nationalism, and militarism) in the context of the values they exclude: the common good, self-government and peace. The result of the work is a matrix assigning these counter-values, accordingly, to coordination, cooperation and collaboration. The matrix allows for identification of the specificity of some examples of social mobilization, as well as identification of gaps in teaching collective interaction skills. The results of the analysis can be used to operationalize the practices of resistance in terms of educational goals. The breakup of the Socialist Federal Republic of Yugoslavia 30 years ago still has a substantial impact on the post-Yugoslav countries which proclaimed independence. Bearing in mind that the breakup also generated a military conflict, e.g. in Croatia, the restoration of Serbian-Croatian relations remains problematic. One of the challenges is passing a fair judgment on people responsible for war crimes or crimes against humanity. The International Criminal Tribunal for the former Yugoslavia (ICTY) was established for this reason in particular. Ante Gotovina – a Croatian general, was one of those indicted by the International Criminal Tribunal for the former Yugoslavia in connection with the military operation "Oluja" during which some heinous acts of crime took place. Gotovina played a clear and primary role in this operation, and therefore his actions were the main count of the indictment, firstly, for the prosecution and then for the Trial Chamber of ICTY. However, the sentence of 24 years imprisonment was never carried out following a successful appeal. The Appeals Chamber did not uphold the verdict of the Trial Chamber owing to a serious legal error and, consequently, it acquitted Gotovina of all the charges. This issue became yet another source of Serbian-Croatian conflict in connection with the most important people held responsible for the crimes committed in 1991-1995.
Na poziom uprzedzeń i ksenofobii w społeczeństwach wpływa nie tyle liczba imigrantów, którzy mieszkają w danym kraju, a raczej poczucie zagrożenia, jakie panuje w danym społeczeństwie przed napływem imigrantów. Stąd poziom uprzedzeń jest wyższy w tych społeczeństwach, które są bardziej homogeniczne. Potwierdzają to wyniki badań nad polskimi uprzedzeniami w stosunku do muzułmanów czy ogólnie wobec imigrantów. Badania kryminologiczne pokazują silny związek między ksenofobicznymi postawami rodziny sprawców a popełnianiem przez nich czynów na tle uprzedzeń. Sprawcami tych czynów są przede wszystkim działający w grupie młodzi mężczyźni (poniżej 25 lat), a podstawowymi motywacjami ich czynów jest poszukiwanie wrażeń (połączone ze spożyciem alkoholu) czy też specyficznie rozumiana próba ochrony społeczeństwa przed napływem Obcych. Ważnym motorem działań sprawców jest także przekonanie, że za pokrzywdzonymi nikt się nie ujmie – ani policja, ani społeczeństwo. The level of biases and xenophobic attitudes in a society is influenced mostly by the fear towards immigrants and their influx instead of the real number of immigrants residing in a particular country. That's why the level of bias towards the Others is much higher in homogeneous societies. The results of Polish opinion polls research on bias attitudes of our society towards Muslims or immigrants echo these findings. In the criminological research we find strong relations between xenophobic attitudes of the family of the perpetrator and acts of bias violence committed by the latter. Biased crimes are usually committed by young males (under 25 years old), and the main motivation of their actions is either thrill (usually connected with the consumption of alcohol) or specifically understood defence of their community from the Others and their presence. An important factor of the perpetrators' behaviour is also the conviction that no one will stand up for the victims, neither the police, nor the society.
Artykuł recenzowany / peer-reviewed article ; The article presents the circumstances of setting up the Assay Offi ce in the Free City of Kraków and also its activity in 1843–53. Th e source base consisted of regulations of the Governing Senate on the organisation and competence of the Assay Offi ce, and documentation related to its activity, being a part of the complex of the Archive of the Free City of Kraków. Th e fundamental task of the Assay Offi ce was to supervise Kraków jewellers and goldsmiths. The supervision especially focused on gold and silver objects brought for stamping. The offi ce charged fees defi ned by the government for its services. The article also mentions prosecution of crimes against the assay stamp, which was a prerogative of the administrative authorities: the Senate, and later the Administrative Council and the City Council. ; W artykule przedstawiono okoliczności powstania Urzędu Probierczego w Wolnym Mieście Krakowie, a także przebieg jego działalności w latach 1843–1853. Podstawę źródłową stanowiły rozporządzenia Senatu Rządzącego dotyczące organizacji i kompetencji Urzędu Probierczego, a także związana z jego działalnością dokumentacja, stanowiąca część zespołu Archiwum Wolnego Miasta Krakowa. Podstawowym zadaniem Urzędu Probierczego było nadzorowanie krakowskich jubilerów i złotników, przy czym kontrola obejmowała zwłaszcza przynoszone przez nich do ostemplowania wyroby ze złota i srebra. Za swoje czynności urząd pobierał opłaty według taksy rządowej. W artykule wspomniano też o ściganiu przestępstw probierczych, co należało do władz administracyjnych: Senatu, a następnie Rady Administracyjnej i Rady Miejskiej.
The aim of the paper is to analyze the endeavors undertaken by the authorities of independent Lithuania to deal with the crimes committed by the Soviet Union against Lithuanian society, in particular against representatives of the anti-Soviet resistance movement, by using the notion of crime of genocide rooted in international law. The judgment of the European Court of Human Rights in the case of Drelingas v. Lithuania of 12 March 2019, which approved the legality of the qualification of "ethno-national-political" genocide of "forest brethren" committed by the Soviet occupation authorities, was one of the key elements confirming the Lithuanian policy in this regard. This ruling reopens the discussion on the possibility of trying the crimes of the Soviet Union, at the same time raising certain legal and political doubts – as generally expressed by the Russian Federation.

In Mexico, corruption and drug trafficking are common and the economic reforms are not enough if they do not go together with an effective program of combating corruption and the society is not the main beneficiary of the reforms.This article will explain the background of the Ayotzinapa case, the characteristics of the Mexican political system that allow cases like Ayotzinapa, the consequences of the fight against organized crime launched by ex-President Felipe Calderon, the behavior of a sleeping civil society tired of the reduced economic results and where the state does not have the monopoly of the authority and does not guarantee security.

The Lisbon Treaty has brought major changes in the functioning of the European Union, including in the area referred to in Art. 4 section 2 point j of the Treaty on the Functioning of the European Union, which is an area of freedom, security and justice. It should first be noted that characteristic for European Union "pillar structure" has been liquidated. Former pillar III is nowadays covered by a single legal regime. Without a doubt falls conclude that the Lisbon Treaty has made a huge step towards the approximation of the laws of the Member States. Art. 86 TFEU introduces interesting novelty in this plane, providing for the possibility of establishment of an European Public Prosecutor's Office, which is the EU body for investigating, prosecuting and bringing to justice the perpetrators of crimes against the financial interests of the European Union. Analysis of selected provisions of the Regulation on the establishment of an European Public Prosecutor's Office leads to conclusion that draft regulation is not deprived of interpretational doubts. For instance there is a forum shopping threat. Fair trial standard and legislative technique have also been violated. ; Traktat z Lizbony przyniósł zasadnicze zmiany w funkcjonowaniu Unii Europejskiej, w tym w dziedzinie, o której mowa w art. 4 ust. 2 lit. j Traktatu o Funkcjonowaniu Unii Europejskiej, czyli przestrzeni wolności, bezpieczeństwa i sprawiedliwości. Należy przede wszystkim zauważyć, że zlikwidowano charakterystyczną dla TFUE strukturę filarową, a dawny filar III został objęty jednolitym reżimem prawnym. Bez wątpienia wypada stwierdzić, że Traktat z Lizbony uczynił ogromny krok w kierunku zbliżania ustawodawstw państw członkowskich. Art. 86 TFUE wprowadza interesujące novum na tej płaszczyźnie, przewidując możliwość powołania do życia Prokuratury Europejskiej, czyli unijnego organu do spraw dochodzenia, ścigania i stawiania przed sądem sprawców przestępstw przeciwko interesom finansowym Unii Europejskiej. Analiza wybranych uregulowań projektu rozporządzenia w sprawie ustanowienia Prokuratury Europejskiej pozwala na przyjęcie wniosku, że nie jest to uregulowanie pozbawione wątpliwości interpretacyjnych. Zwracają uwagę choćby takie zagadnienia, jak zjawisko forum shopping, zagrożenie dla gwarancji prawa do sądu czy wreszcie stosowana przez projektodawcę technika legislacyjna.
