Focusing on regulatory law, and with reference to the foreign investment area, this book identifies the functional and structural problems within China's administrative legal system that perpetuate this gap. Topics examined in depth include China's unusual hierarchy of legislation, the lack of clear delineation between legal and policy norms, the great scope of discretion accorded to bodies charged with legal interpretation and implementation, the limited scope of judicial review, and the resulting problems of legislative inconsistency and haphazard legal enforcement. Despite three decades of legal development, China has not truly made professionalism central to its reform agenda. Among many others, one noteworthy but understudied aspect is the widespread use of non-lawyers in the legal services system. ; This dissertation aims to examine the role of the state in the making of professional and non-professional mechanisms in China. In addition to a holistic evaluation of non-professional legal services, the dissertation includes empirical studies and comparative analyses of the two most important groups of non-lawyers the government-sponsored basic-level legal workers and the non-lawyer staff of non-governmental organizations. ; These perspectives reveal a number of important facts. First, the development of non-professional legal institutions mainly serves the purpose of state control. Second, non-professional groups are able to survive only by satisfying the bureaucratic interests of specific state agencies. Third, the staff of non-governmental organizations observed in this study appeared to perform more effectively than basic-level legal workers. 自1840年清廷與英國簽訂《南京條約》以來,長久以來東亞地區傳統國家對於人身的掌握方式以及以朝貢冊封作為手段所建立的天下秩序便日漸被削弱且重新被編入近代西方國際法秩序之中。在此過程中,當時的東亞各國,皆曾嘗試一方面遵行近代西方的國際法秩序,一方面使用西式的法律將自身塑造為符合西方意義下的近代國家以達到可以完全在其「國」內外掌控其臣民之人身並同時受到西方列強所承認的目的。而所謂的近代西方國際法秩序,特別是在其秩序下主權國家所代表的對外擁有獨立性以及對內之臣民與領土擁有排他性權力等特質,更被明治維新之後的日本政治家與知識分子視為是國體存在的憑藉與證明,是使日本得以與歐美列強建立平等外交關係的前提之一。換句話說,日本近代法秩序中具有明顯地使日本作為一個主權國家融入近代西方國際法秩序的企圖。 ; 然而自1890年《大日本帝國憲法》正式實施以來,日本先後在甲午戰爭以及日俄戰爭後領有臺灣與朝鮮。日本帝國在法律上所須支配的範圍不再僅限於日本列島,同時更包含了以上在帝國轄下這些地域的人身流動。在此種情況下,本研究企圖解決兩個問題,即:第一,當時什麼是「臺灣人」?而臺灣人在帝國內被日本政府以法律的方式賦予怎樣的法律地位?而這個法律地位在治安法律的適用上與帝國內的其他人群,特別是日本內地人之間又具有怎樣的差別,而其成因又是什麼?第二,當《治安維持法》作為當時日本帝國下日本與臺灣兩地域所共同擁有的治安法律時,帝國的裁判機構是如何根據帝國下各地域在地社會的情形而處理在各地域的治安法律案件的?而這些法院的判例又對於當時「臺灣人」族群意識的形成具有怎樣的影響?以及這些法律關係對於了解整個日本帝國的發展所具有的意義上有什麼幫助? ; 而經由本研究,筆者得出結論,認為帝國下的「臺灣人」的法律地位與其治安法律的適用是與日本帝國權力秩序之結構有著深刻的關係。而當時帝國權力秩序之結構事實上即是近代西方國際法秩序在東亞的滲透、天皇制國家的國體論述、兩地各自過往治安法律的實施背景,以及當時日本國內外的臨時事件的各個因素所形成的,並且影響了「臺灣人」作為一個族群意識的形成。 ; Ever since the mid-19th century, the traditional East Asian Hua Yi (華夷) system has been weakening and was re-incorporated into the modern Western world order because of the rise of the Western powers. This process not only broke the old ruling order (in East Asia connected through the Tribute system), but also made the East Asia countries greatly shaped by the new concept of the International Law, for example the equal status between all sovereign states and the sovereign states had exclusive authorities over their people and territories. This workprovides a comprehensive analysis of the Tort Law of the People`s Republic of China. It examines the status quo of the discourse in the literature and provides specific illustrations of how general Tort principles such as causation, negligence and damages are applied in Chinese courts. 學者研究中國上古時期政治思想,往往以漢武帝以後的儒家思想作為國家權力正當性的基礎,但是此理論的缺憾是,如果只以儒家思想作為國家意識形態的標誌,就難以解釋西漢武帝以前的國家權力正當性是如何運作的。其實早在作為中國最早期實行帝制的秦王朝,已憑著統一的法律標準與有利於專制王權實行管治的官僚機構,確立國家專制權力的基本模式。 ; 本文試圖從儒法之爭的框架跳出來,從法律思想的角度,考察先秦至秦代的法律觀念、法律與國家官僚機構的關係及法律原則與「國家意識形態」的關係等議題。為了更貼近自秦至秦知識分子的「生活世界」,本文採用回到文本本身的研究方法,找出反映儒、道、法各家思想特徵的文本及其中的思想如何互相對話與融合,並從中探討戰國中後期至秦的知識分子與國家官僚對法律與政治觀念的表達,及其中的政治關懷。 ; 本文將從法律思想與國家意識形態的角度,更緊密地考察法律觀念背後反映的政治權力意識,從先秦至秦「刑」、「法」的觀念與實踐的起源、秦國家法律標準、秦法律原則與官僚政治道德的關係三方面探討秦代國家專制權力的正當性基礎。 ; Conventional studies on Ancient Chinese political thoughts consider Confusianism as the basis for legitimising the ruling of the state. However, this theory fails at explaining the period before Han Wudi(漢武帝) officially proclaimed the supreme status of Confusianism. As early as Qin Dynasty(秦朝), the state has established a centralised authoritarian government through its standardised legal practice and complex bureaucratic system. ; Therefore, this study avoids the orthodoxy in explaining political thoughts with the struggle between Confucianism and Legalism and investigates the relationship of laws and the bureaucratic system as well as that of legal principals and state ideology in pre-Qin and Qin period. By scrutinising the contemporary thoughts through careful textual analysis, this study expounds the encountering of Confusianism, Daoism, and Legalism and also their synthesis. Hong Kong is clearly within the 'One Country' and this is simply no longer an issue. How the 'Two Systems' can survive, and how they should interact, is the riding question. The substance of mutual legal assistance in general, and extradition — or rendition — in particular, in a domestic context is not necessarily different from that in an international context. Such assistance will be the subject of an agreement between two jurisdictions arrived at through a process of negotiation and agreed upon by both parties. There is no inherent substance in any extradition agreement, international or otherwise. The substance is negotiable depending upon necessity and the parties' political will and political skill. No one party should impose its will on the other. The only question is what are the terms that should go into a rendition agreement between Hong Kong and the Mainland? ; published_or_final_version
