The beginning of the 21st century has seen the implementation of profound legislative reforms which have upset the criminal law and the criminal policy. They took place in a society of risk characterized by the acceleration of the modernity and the production of multiform risks which are linked to it. Gradually the precautionary principle, taken forcibly from the environmental perspective and as an incantation and a refrain, will interfere in those matters to such an extent as to generate consequences on the principle of legality which structures the modern legal rationality, to impose the revision of some other key principles like the presumption of innocence and the principle of necessity, and to place at the center of decisions critical notions such as the danger. Under the influence of the precautionary principle, the very concepts of infraction, of legal responsibility and of punishment are being dislocated by the urgent appeal to take more and more into consideration the future and its potentiality of danger. In this perspective and under the growing pressure of the precautionary principle, the right to security tends to focalize upon a victimizing approach of the society at the expense of an old conception of criminal law founded upon the legal balance between security and liberty. And the criminal policy guiding those developments operate as a new model, which in its obsessional quest of security, makes of the precautionary principle both its internal and external finality. This thesis is thus devoted to the study of the precautionary principle as it is applied to the criminal law and to the criminal policy which it examines through theories and multidisciplinary approaches .Its main objective is, by the examination of the evolution of the criminal policy and of some theories of criminology, and in contact with the ideology of precaution, to highlight the current emergence of a new legal rationality of precaution which operates according to a specific methodology and by the use of a specific terminology. ...

The necessity principle undeniably represents one of the pillars of modern criminal law. This principle was essentially developed during the XVIIth and XVIIIth centuries, in particular by Cesare Beccaria, whose thought was influenced by the Enlightenment philosophers. Driven by ideas of moderation and corporal punishment abolition, they prescribed a restrained application of criminal law. These philosophical and legal developments reappeared in substantive law after the 1789 revolution. Embedded in the Declaration of the Rights of Man and of the Citizen, the necessity principle acquired the fundamental principle status and shapes incriminations (Article 5), punishments (Article 8) and criminal law procedure (Article 9). This work analyses the necessity principle within the area of criminal business law. The influence of criminal law in the economic and financial realm is a constant issue for the legislator. As the necessity principle involves more than the traditional aspect of moderation, its positive aspect will also be analysed in order to reflect on the rationale of its application in the economic and financial sphere ; Le principe de nécessité constitue incontestablement un des piliers de l'action pénale moderne. In a global context marked by the rise of an information society, shared knowledge and digital economy, this study proposes an assessment of the protection of databases by Copyright (french meaning), privileging a comparative approach between French and Senegalese law. By highlighting the elements of convergence but also of divergence that emerge from the confrontation between the two legislations, this analysis starts from the identification of the strengths and weaknesses of copyright, to propose orientations aimed at improving the legal framework for the protection of databases. Copyright being the unanimously consecrated protection mechanism for databases, it is necessary, far from divesting it, to identify the best legal options that could contribute to its reinforcement. In this respect, it is imperative to take into account a perfect balance between the various interests for the development of the information society. ; Dans un contexte mondial marqué par l'essor d'une société de l'information, des savoirs partagés et de l'économie numérique, cette étude propose une évaluation de la protection des bases de données par le droit d'auteur, en privilégiant une approche comparative entre le droit français et le droit sénégalais. Selon la Legal Origins Theory, les origines juridiques d'un État ont une influence significative sur sa croissance économique. Née dans l'orbite du droit des sociétés, elle a d'abord été défendue par un collectif d'auteurs à l'occasion de l'étude du niveau de protection accordé aux actionnaires minoritaires dans différents États à travers le monde. Ils en ont tiré la conclusion que les États appartenant à la culture juridique de Common Law accordaient le plus haut degré de protection, source d'un marché financier efficace et synonyme de croissance économique. La Legal Origins Theory s'est ensuite étendue à d'autres domaines juridiques et s'est attachée à démontrer plus globalement l'efficience générale du modèle de Common Law. Dans la foulée, elle fut au cœur des rapports Doing Business de la Banque mondiale. Cette théorie a suscité de nombreuses critiques que la présente contribution a pour ambition d'exposer. Après l'analyse de la théorie et des critiques émises à son encontre, l'étude tente de dégager les présupposés philosophiques sous-jacents à la Legal Origins Theory, à travers la pensée de deux auteurs : Friedrich von Hayek et Bruno Leoni. ; The Legal Origins Theory argues that the legal origins of a state have a significant influence on its economic growth. This theory originated mainly and prospered in the field of company law. A group of researchers has enquired about the degree of protection granted to minority shareholders in various states throughout the world. They concluded that states belonging to the legal family of common law granted the best protection, sourcing an efficient market and easing their economic growth. The Legal Origins Theory spread out widely and expanded to several other legal domains, while continuing to emphasize and highlight the efficiency of the common law. It was furthermore at the heart of the "Doing Business" reports of the World Bank. This theory has led to many critiques, which the present paper aims to show. Beyond this analysis and the review of criticisms, our study finally attempts to identify the philosophical assumptions that support the Theory of Legal Origins, through the review of the developments authored by Friedrich von Hayek and Bruno Leoni. ; Peer reviewed

Elles prennent corps dans une société de risque caractérisée par l'accélération de la modernisation et la production de risques multiformes qui lui sont rattachés. Progressivement, le principe de précaution, emprunté de manière pervertie à l'environnement, et sur un mode incantatoire et répétitif, s'immiscera dans ces matières jusqu'à produire des conséquences sur le principe de légalité qui structure la rationalité pénale moderne, imposer la révision de certains autres grands principes comme celui de la présomption d'innocence et celui de nécessité, et mettre au centre des décisions des notions critiques telle la dangerosité. Sous l'influence du principe de précaution, les concepts-mêmes d'infraction, de responsabilité pénale et de peine sont bousculés avec l'invitation à prendre toujours plus en considération le futur et sa potentialité de danger. Dans cette perspective, et comme pendant au principe de précaution, le droit à la sécurité tend à déplacer la focale sur une approche victimaire de la société au détriment d'une conception ancienne d'un droit pénal fondé sur un équilibre juridique entre sécurité et liberté. Et la politique criminelle guidant ces évolutions fonctionne sur un nouveau modèle qui, dans cette recherche poussée de la sécurité, fait de la précaution à la fois sa finalité interne et sa finalité externe. Cette thèse est donc consacrée à l'étude du principe de précaution appliqué au droit pénal et à la politique criminelle qu'elle examine à la lumière de théories et d'approches pluridisciplinaires. Elle s'attache surtout à travers l'analyse de l'évolution du droit pénal et de certaines thèses criminologiques, à mettre en évidence l'émergence aujourd'hui, et au contact d'une idéologie précautionniste, d'une nouvelle rationalité pénale de précaution fonctionnant selon une méthodologie et avec l'usage d'une terminologie spécifique.

Nach Kreta, Rom, Wien, Göttingen Sevilla und Budapest, den Austragungsorten der bisherigen Kongresse, hat die Societas Iuris Publici Europaei (SIPE) ihren Siebten Kongress vom 10. bis 12. Juni 2010 in Straßburg mit dem Thema "Das Soft Law der Europäischen Organisationen" veranstaltet. Bekanntlich hat zwar das soft law seinen Ursprung im internationalen Bereich bzw. im Völkerrecht, in dem diese Bezeichnung für nicht formal rechtsverbindliche Übereinkünfte, Absichtserklärungen oder Leitlinien verwendet wird, doch hat es aber auch Eingang in das Europarecht gefunden. Mit seiner bereits umstrittenen Begriffsbestimmung, seiner ebenfalls umstrittenen Rechtsnatur und Bindungswirkung sowie seiner Gegenüberstellung zum hard law ist inzwischen das soft law ein im europäischen Rechtsraum für die Juristen offenes Diskussionsthema. Die vielschichtigen und komplizierten Fragen seiner Geltung und Tragweite im Bereich der europäischen Organisationen, d.h. derjenigen der Europäischen Union und des Europarats, wurden zwei Tage lang in Straßburg von Fachleuten aus Theorie und Praxis lebhaft diskutiert. Die Referate sind zusammen mit den Beiträgen aus dem "Atelier Junger Wissenschaftler", ein Forum auf dem qualifizierte Nachwuchswissenschaftler zu dem Tagungsthema eigene Referate beisteuern und diskutieren, in dem vorliegenden Tagungsband abgedruckt
