"Today, for a large number of English law specialists, the reforms adopted throughout the nineteenth century in England tend to remedy "the glorious uncertainty of the common law." They converge in fact towards a goal: to reduce the obstacles to the accessibility to the law on the material as well as the formal level. But if this requirement of accessibility finds a favourable echo from its time because it expresses the common feeling, it is clear that the English reformer, Jeremy Bentham is the one who intends to place it at the center of all legal thinking. For him it is a direct consequence of the application of the principle of utility in legislation. This is what his entire theory on the codification of law tends to demonstrate. But the influence of Bentham on these reforms remains to relativize, because the largest project by which he envisaged to concretize the reform of the English law to make it accessible, -the Pannomion- never saw the light of the day. The 1973 and 1975 legislation relating to the protection of employment has failed to bring about all of the expected results. It has failed to reverse unemployment which continued to rise. Having been designed and then refined over 35 years by theorists from the French school of employment law, it has burdened small and medium sized businesses by increasing the financial consequences of breach of open – ended employment contracts. Based on the three guarantees system (procedure, legal base and compensation) and strengthened by threshold considerations, it has curbed both the initiatives and expansion of the said businesses due to the psychological effects thereof on managers as well as to the effects thereof on the businesses' economy. We recall the involvement of almost all of the legal professionals and of the political and union representatives, as well as the inability of the business world to evaluate and challenge a phenomenon despite it being ineffectual as regards reducing unemployment as well as other detrimental effects upon business. We complete our review of the literature in this field by considering various practical examples drawn from our own professional experience which latter relates to the effectiveness of the said three guarantees. We recall that the classic paradigm involves a consideration of the employee's situation and an optimisation of the latter by means of laws which protect insiders (via O.E.E.C, Open – Ended Employment contracts) to the detriment of outsiders on fixed term contracts, temporary employees or job seekers. We are determined to reverse this by starting from the basic equation of a business: an individual, an idea, capital, an acceptance of risk. Thus the employment contract comes second. It depends from a logic of costs in which we intend to include all costs relating to employment in France, whether deferred – revealed after the employee has left, at the end of a case in the Employment Appeals Tribunal – or uncovered. Of course, we have differentiated uncovered costs from the notion of hidden costs, which latter are usually linked to the underperformance of a business. We came to carry out this research via Williamson's transactional costs theory, and we have applied it to French legislation (the complexity of which still remains to be addressed by the Anglo-Saxons). It allows us to go beyond those employment costs which are generally acknowledged, in order to uncover other costs which have not been included in any French legal, fiscal or accounting regulations. Sometimes they are even ignored by managers. By drawing a new approach from our experience as practitioner and researcher and from our use of empirical examples, we have established a classification of uncovered costs. It has enabled us to redefine the reality of employment costs, related to a cause, namely to the presence of the employee in the business. However, the effects of the said presence are represented by various costs which are not accounted for in the immediate costs of work, such as operating and management costs relating to employee representative bodies, costs relating to incentive and participation, costs relating to comfort and especially, deferred costs, with the latter stemming from breach of employment contracts. Whether the said breach occurs in the context of a dismissal or it is another type of contractual breach, whether or not the causes are admitted or rejected by the parties (resulting in proceedings and the related imposition by the court of compensation, wages or supplements to wages) the said costs are not included in employment costs resulting from the provision by the employee of services in the context and at the time of his employment. Thus we are proposing a methodology which will take into account the uncovered costs of employment and which will seek to relocate them in the generally acknowledged immediate costs of the employee's work. ; La législation sur la protection de l'emploi créée par la loi (1973 et 1975) n'a pas produit l'ensemble des effets escomptés. The internationalization of IP Law, initiated at the end of the 19th century, has taken since the end of the 20th century a brand new twist with its inclusion in the field of multilateral trade disciplines. The signing of the TRIPS agreement marks the emergence of a global IP governance. Indeed, the ambition displayed by the WTO is to supervise the margin of maneuver of its Members in implementing their policies. Although Communitization of IP law started much later, it now has a considerable scope: national protection regimes have been conciliated with the cardinal principles of the Treaty, some important harmonization directives have been enacted, and various European titles of protection have even been created. Our study is designed to show how Communitization, beyond its traditional role of source of law, officiates as a necessary and efficient vector for structuring the European position towards the Globalization of IP Law. In its ascendant side first -- from Local to Global, the Communitization vector plays a role of merging the objectives to be promoted on the international scene. The issue at stake is to shape an IP global framework that corresponds to the system of interests and values of the EU, in accordance with the far-reaching objectives assigned by the Treaty. This merging process is, however, not automatic. In spite of several amendments to the Treaty and of the progress of internal harmonization, various institutional constraints thwart the emergence of a fully integrated external European policy in the field of IP. But it is precisely in light of these constraints that the scope of the achievements of the EU, which in now recognized as a central actor in the global IP governance, must be appreciated. In its down side then -- from Global to Local, the Communitization vector is accompanied by a rise of the European Court of Justice in arbitrating complex normative interactions between national, EU and International IP Laws. Ce parti-pris méthodologique procède de la conviction que le sens de la communautarisation de la propriété intellectuelle ne peut être pleinement saisi qu'en y intégrant sa dimension externe, au travers d'une analyse systématique des relations qu'elle entretient avec la mondialisation de cette branche du droit. Les indicateurs chiffrés disponibles tant au niveau des plaintes en matière d'abus sexuels que des réactions judiciaires qui y font suite, loin de renvoyer à une image d'homogénéité entre pays ou de constance dans le temps, indiquent bien, plutôt, des diversités et des mouvances importantes. L'objectif de cette contribution est tout d'abord de rendre compte et d'analyser cette hétérogénéité et ces évolutions sur base d'un examen spécifique des statistiques collectées, au niveau européen, dans le cadre du European Sourcebook of Crime and Criminal Justice Statistics. Des données disponibles en la matière au niveau national, pour la Belgique, seront également mobilisées. Ce vaste recueil de données chiffrées a été initié en 1993 dans le giron du Conseil de l'Europe et couvre 41 pays dans la dernière édition de l'enquête dont les résultats ont été publiés en 2014. Il fournit des informations précieuses pour étudier les tendances observables au niveau des plaintes et des interventions judiciaires en matière d'infractions à caractère sexuel, ceci sur base de statistiques collectées aux différentes phases du fonctionnement du système de justice pénale : au niveau policier, au niveau des autorités de poursuite, au niveau des condamnations et enfin au niveau pénitentiaire. La littérature scientifique récente en matière d'économie politique de la pénalité (Political Economy of Punishment) met en avant les correspondances entre une hétérogénéité des modèles de société capitalistes et la variété des modes et niveaux de pénalité. Les différents pays peuvent ainsi être situés, très grossièrement, sur un axe où se profilent aux deux extrémités le modèle néo-libéral (1) et le modèle coordonné socio-démocrate (2). Le premier mise sur la régulation par le marché et se caractérise par des inégalités plus importantes, des dépenses sociales faibles, une exclusion sociale importante et au niveau politique un système de démocratie majoritaire et une dominance politique plus à droite. (2) Le second est, quant à lui, plus fortement régulé par les institutions et l'Etat et l'on y observe les plus faibles inégalités, les dépenses sociales les plus élevées, une exclusion sociale plus faible, et au niveau politique un système de démocratie consensuelle et une dominance politique plus à gauche. Sur base d'indicateurs chiffrés, des relations significatives très nettes ont été établies de façon récurrente entre ces différents modèles et des modes et niveaux de pénalité distincts, le premier type de modèle se conjuguant, en caricaturant quelque peu, à une pénalité bien plus lourde que le second. The study of international human rights law in Senegal refers to the examination of constitutional procedures of introduction of conventional norms in Senegalese law. It is an organisation marked by a dualism between the principles of international law, serving as a source of conceptual inspiration and internal law which independently defines the conditions of introduction and validity of this law in the national juridical system. This stage applies to all conventional norms in domestic Senegalese law. It is quite neutral, as it doesn't fully take into account the specificity of the purpose of the law, namely human rights. However, this particularity is still present in other stages of perception of international human rights law, as its internal organisation. In this context, international human rights law is integrated in the system of Civil Liberties recognized by national law. Nevertheless, are more philosophical than legal conception of human rights do not allow them real protection under the regime. The effectiveness of the international human rights law is therefore more based on institutional state guarantees under Senegalese law than on a specific regime of positive law. The democracy as political philosophy and the right to judicial review are main elements of the law. However, the cultural and social realities of the country alter their scope and give a real relevance to a promotion of this law entrusted to public and private parties. This approach, while not distorting the eminently legal character of the approval procedure, shows that the guarantee of human rights transcends the divide between public and private spaces. ; L'étude de la réception du droit international des droits de l'homme au Sénégal renvoie à l'examen des procédures constitutionnelles d'insertion des normes conventionnelles dans le droit sénégalais. C'est une organisation marquée par un dualisme entre les principes de droit international qui servent ici de sources d'inspiration conceptuelle, et le droit interne qui définit de manière souveraine les conditions d'introduction et de validité de ce droit dans l'ordre juridique national. Cette étape qui est applicable à toute norme conventionnelle ayant vocation à s'appliquer dans le droit interne sénégalais, est assez neutre puisqu'elle tient peu compte de la particularité de l'objet même de ce droit, à savoir les droits de l'homme. Cette particularité est néanmoins présente concernant les autres étapes de la réception du droit international des droits de l'homme comme son aménagement interne. La réception du droit international des droits de l'homme dépasse ainsi le cadre purement formel des procédés d'insertion d'une norme conventionnelle, pour exiger une concrétisation de son contenu dans le droit interne. Dans ce cadre, le droit international des droits de l'homme s'intègre au régime des libertés publiques reconnues par le droit national. Toutefois, la conception plus philosophique que juridique des droits de l'homme ne permet pas leur vraie protection sous ce régime. L'effectivité du droit international des droits de l'homme repose donc plus sur les garanties institutionnelles de l'État de droit sénégalais que sur un régime spécifique du droit positif. La démocratie comme philosophie politique et le droit au recours juridictionnel en sont les mécanismes généraux. En revanche, les réalités culturelles et sociales du pays altèrent leur portée, et confèrent une vraie pertinence à une démarche promotionnelle de ce droit, confiée à des acteurs publics et privés. Cette approche tout en ne dénaturant pas le caractère éminemment juridique de la procédure de réception, montre que la garantie des droits de l'homme transcende les clivages entre espace public et espace privé.
