The monography provides a comparative analysis of the constitutional review bodies' activities, their status and efficiency in different Post-Soviet States. It deals with the complex description of the constitutional provisions' compliance, the problems of legal mechanisms and stability, evolution of the local legislation. In this book the authors provide a detailed report of the constitutional review institutions' problems in the process of ensuring its legislative position. In this context we find in the research a description of the legal, political risks of the constitutional control in Post-Soviet States, its social perception and the predictability of its legal systems' development. This work integrates the unique structure of presentation and research materials. By the reflection of this type the authors lay the base for continuing further researches of constitutional review development dynamics in the countries of the region.
The article intends to illustrate the climate, social and primarily health effects resulting from the emission of various substances in the process of burning coal and waste, and the legal framework related to the issue of air pollution as a result of low emissions. The authors discuss also the main directions of the changes proposed in the so-called "anti-smog" law. The authors pose the thesis that Poland has still not solved problems of low emissions, despite the measures taken in the amendment to the Environmental Law. In their view, Poland still has a long way to go before it creates a low-carbon economy. The traditional use of coal in Poland hinders putting ecological changes into practice. Incineration of waste produced by households is another social pathology. Besides municipal waste, some hazardous waste also produced in households can be found. The level of environmental education is very poor in this respect. However, without significant actions, we will continue to destroy our own and our neighbours' health, contribute to climate change as some climatologists' think and pay penalties for failing to meet ecological commitments to the European Union as well.
The article is an attempt to outline the manifestations of the legal and political system's nihilism, the occurrence of which the author to some extent attributes to the policy of the Piłsudski political camp after 1926. The subject of the study is to determine the attitude of the leading activists of the Sanation camp to the political system practice and legal practice, seen for the purposes of this thesis as a certain set of actions contra legem and praeter legem in relation to the legal system in force. The author also analyzes the implications of J. Piłsudski's lack of a concrete, in formal and legal terms, political program on the attitude of the Sanation political camp in relation to the application of law law and on the legal security. The legal system turned out to be a factor significantly hindering the realization of the post-May camp's plans as well as the effectiveness of the political system's initiatives undertaken by the Piłsudski political camp. The main reason for the post-May camp's frequent recourse to activities that are to some extent attributed to the legal or political system's nihilism was the lack of deeper political intentions of the victor of the May Coup d'État. ; Artykuł stanowi próbę zarysowania przejawów nihilizmu prawnego i ustrojowego, których występowanie autor w pewnym zakresie przypisuje polityce obozu piłsudczykowskiego po 1926 r. Przedmiotem opracowania jest określenie stosunku czołowych działaczy obozu sanacyjnego do praktyki ustrojowej i prawnej, rozumianej na potrzeby niniejszego wywodu jako pewien zbiór działań zarówno contra legem, jak i praeter legem wobec obowiązującego systemu prawnego. Autor analizuje również implikacje braku skonkretyzowanego w sensie formalno-prawnym programu politycznego J. Piłsudskiego na stosunek obozu sanacyjnego do stosowania prawa oraz na bezpieczeństwo prawne. System prawny okazał się być czynnikiem w znacznym stopniu krępującym realizację zamierzeń obozu pomajowego oraz efektywność podejmowanych przez piłsudczyków inicjatyw ustrojowych. Zasadniczym powodem tak częstego sięgania przez obóz pomajowy do działań, którym w pewnej mierze przypisuje się charakter nihilizmu prawnego czy ustrojowego, był brak głębszych zamierzeń ustrojowych zwycięzcy zamachu majowego.
This book explores the issue of environmentally-induced migrations from the point of view of international human rights law, international humanitarian law, international refugee law and international law of statelessness. Last few years have become a period of unprecedented growth in the number of studies devoted to the forced migration caused by climate change. The book by professor Jane McAdam, published by Oxford University Press, differs significantly from previous studies in this area. The focus of the author became a state responsibility for the situation of climate-change induced displaced people with a particular focus on legal aspects of this problem. The basis of the author`s considerations are four particular areas of public international law: international human rights law, international humanitarian law, international refugee law and international law of statelessness. The issue of climate change-induced displacement is now becoming a growing challenge for public international law. The growing number of climate change migrants becomes a challenge for the international istitutions dealing with humanitarian assistance. Sea level rise become a factor of specific legal problems, such as climatic deterritorialization of the state, state succession on the new territory, the status of people forced to leave their country submerged under the waters of ocean (forced migrants?, refugees?, stateless people?, citizens of the former country continuing its status within a new territory?).
This article presents a critical analysis of insurance fraud with a legal comparative perspective. In the author's opinion, it is beyond doubt that the Polish solution needs change. Nonetheless, the scope of this change may vary. A look at this type of prohibited act regulated in foreign legal systems may be helpful in formulating conclusions for the Polish law as it stands and proposals for the law as it should stand. Considering the above, part one of this article focuses on the legal-dogmatic analysis of the crime under Article 298 § 1 of the Polish Penal Code, and its counterparts in the subsidiary model (i.e., in Germany, Austria and Finland). A detailed study precedes the process of modelling the liability for the commission of an insurance fraud, taking into account the specificity of economic crime and the various approaches taken by European legislatures, while preliminary conclusions resulting from the analyses carried out have been formulated in the summary. However, it should be pointed out at this point that the presentation of the final conclusions will take place after the discussion regarding the independent model, which will be presented in part two of the article. ; Niniejszy artykuł zawiera krytyczną analizę oszustwa ubezpieczeniowego przy wykorzystaniu ujęcia komparatystycznego. W ocenie autora nie ulega wątpliwości, że polskie rozwiązanie wymaga zmian. Różny może być jednak ich zakres. Pomocna w formułowaniu wniosków de lege lata oraz postulatów de lege ferenda może być optyka na ten typ czynu zabronionego w obcych porządkach prawnych. W związku z powyższym w części pierwszej skupiono się na analizie dogmatycznej przestępstwa z art. 298 § 1 Kodeksu karnego oraz na jego odpowiednikach w subsydiarnym modelu w Niemczech, Austrii i Finlandii. Szczegółowy wywód poprzedza proces modelowania odpowiedzialności za realizację oszustwa asekuracyjnego, uwzględniający specyfikę przestępczości gospodarczej oraz różnorodne podejścia ustawodawców europejskich. W podsumowaniu pokuszono się o sformułowanie wstępnych wniosków, wynikających z przeprowadzonych analiz. Given the growing popularity of biometrics, doubts about the conditions for biometric data processing can be noticed in practice. These inaccuracies take place in various areas of law, including labour law. This article provides a theoretical discussion on the processing of special categories of data. It aims to point to the need for appropriate legal regulations to ensure the security of the processing of biometric data of employees and candidate employees. The article starts with clarifying the concept of biometric data and discusses the practical aspects of the use of biometric tools. Further on, the author analyses the legal regulations concerning the processing of biometric data in the relations between the employer as the personal data controller and the employee as the data subject. As a result of the studies carried out, a position was presented which indicates that the employer who processes biometric data of employees and candidates for employment should always find out whether he has legal justification to process the data in question. This article is one of the few studies on the processing of biometric data in Polish literature on the subject. The main purpose hereof is to present situations under the current legislation, in which the employer can process biometric data of its employees. The article is a form of universal presentation of the problem and may be of interest especially to legal practitioners. ; Z uwagi na wzrost popularności technik biometrycznych w praktyce można zauważyć pojawiające się wątpliwości dotyczące przesłanek warunkujących przetwarzanie danych biometrycznych. Przedmiotowe nieścisłości pojawiają się na gruncie różnych dziedzin prawa, w tym na gruncie prawa pracy. Niniejszy artykuł zawiera rozważania teoretyczne dotyczące przetwarzania danych szczególnej kategorii. Jego celem jest zwrócenie uwagi na potrzebę stworzenia odpowiednich regulacji prawnych służących zapewnieniu bezpieczeństwa przetwarzania danych biometrycznych pracowników oraz kandydatów do pracy. Artykuł rozpoczyna się od wyjaśnienia pojęcia danych biometrycznych oraz traktuje o praktycznych stronach wykorzystania narzędzi biometrycznych. W dalszej części autorka poddaje analizie regulacje prawne dotyczące przetwarzania danych biometrycznych w relacjach pomiędzy pracodawcą jako administratorem danych osobowych a pracownikiem jako podmiotem, którego dane są przetwarzane. W wyniku przeprowadzonych badań zaprezentowane zostało stanowisko wskazujące, że pracodawca przetwarzający dane biometryczne zatrudnionych pracowników oraz kandydatów do pracy powinien każdorazowo ustalać, czy dysponuje przewidzianą przez przepisy prawa przesłanką legalizującą przetwarzanie tych danych. Niniejszy artykuł jest jedną z niewielu prac w polskim dorobku piśmienniczym na temat przetwarzania danych biometrycznych. Głównym celem jest zaprezentowanie sytuacji, w których pracodawca może zgodnie z aktualnie obowiązującym stanem prawnym przetwarzać dane biometryczne swoich pracowników. Artykuł stanowi formę uniwersalnego przedstawienia problemu i może być przedmiotem zainteresowania zwłaszcza praktyków prawa.
One of the key legal definitions introduced into tax law, i.e. the definition of "an organised part of an enterprise", was analysed in the study. It is an example of a definition under which a tax legislator expresses the tax consequences of business trading. According to the author, this legislative measure may be qualified as a legal definition limiting the imprecision in the provisions of tax law. The fulfilment of certain determinants becomes important for the construction of this definition, on the basis of which it should be constructed. The study specifies these determinants and shows that the tax legislator does not always use them when formulating the analysed definition. Therefore, in the article the author indicates solutions aimed at implementing these determinants. ; W opracowaniu analizie poddano jedną z kluczowych definicji legalnych wprowadzonych do prawa podatkowego, tj. definicję zorganizowanej części przedsiębiorstwa. Jest to przykład definicji, w ramach której ustawodawca podatkowy wyraża podatkowe skutki obrotu gospodarczego. Zdaniem autora ten środek legislacyjny można zakwalifikować jako definicję legalną ograniczającą nieostrość w przepisach prawa podatkowego. Istotne dla konstrukcji tej definicji staje się spełnienie pewnych determinantów, w oparciu o które powinna być ona zbudowana. W opracowaniu określono te determinanty oraz wykazano, że ustawodawca podatkowy nie zawsze korzysta z nich, formułując analizowaną definicję. Ponadto autor wskazał rozwiązania mające na celu realizację tych determinantów.
The aim of the paper is to present ramifi cations in the field of family law, inheritance law and tax law which arise from the lack of recognition of registered partnerships and same-sex marriages in certain European Union Member States, such as Poland. The lack of recognition is commonly perceived as discrimination on grounds of sexual orientation, but the emphasis is usually placed on its consequences concerning human rights. In this article, the author focused on discriminatory aspects in the area of family life and personal taxation. A lack of appropriate provisions in domestic law produces negative effects affecting taxation obligations for cross-border families that concluded their marriages or partnerships abroad but cannot benefi t from these institutions in certain EU Member States such as Poland. For the purpose of determining discriminatory aspects, the author analysed the domestic rules differentiating couples living in a marriage and couples not possessing the right to marry. Due to lack of case-law on tax and inheritance discrimination resulting from sexual orientation, relevant case-law of the Court of Justice of the European Union have been recalled, revealing possible violations of fundamental freedoms, including free movement of persons.
The article covers the legal and tax aspects of the implementation of general anti-avoidance clause in Polish tax law, including the historical outline of the clause, its essence, and the usefulness of achieving the legislator's intended effects. This book explores the impact of climate change on the legal situation of small island states such as Marshall Islands. Climate change-related problems of these nations touching their legal situation in a very different way than in the case of large countries threatened by economic and social consequences of sea level rise (such as Bangladesh, Vietnam, Nigeria and Egypt). Presentation of scientific forecasts is an introduction to the in-depth deliberations from the point of view of international law. According to many researchers, global sea level rise of 0,5-1 m. is highly possible in the next hundred years. Sea level rise is not the only climate-related threat experienced by small island states. Among other significant problems associated with climate change we can list tropical cyclones, floods, and droughts. Island nations must prepare for such problems on the basis of public international law. The authors draw attention to the most crucial legal challenges associated with sea level rise, such as the deterritorialization of the state, continuity of statehood, the issue of citizenship or the legal status of forced environmental migrants. The authors draw attention to the significant legal challenges (e.g. the legal status of migrants forced to leave their country of origin/residence as a result of irreversible climate change). This issue has still not been regulated by international law documents. Much attention is also being paid to the analysis of the consequences of climate change on the basis of international law of the sea. The core elements of the analysis presented in this book are, inter alia, the impact of sea level rise on Exclusive Economic Zones and fishing rights. The book is focused on the social and legal challenges facing microstates. Presented considerations may become a useful point of reference in the analysis of the problems facing larger countries affected by climate change and sea level rise.
The international law order is the first in which we can observe the use of mediation as a legal institution. The mediation activity conducted by the United Nations is a model for contemporary legal entities. The entity is characterized by a multitude of normative regulations and undertaking informational and promotional actions in the field of mediation. The areas of action of the United Nations include interventions in political, international and domestic disputes, trade disputes, and internal disputes thus determine the UN's promediation activities in three spheres of activity: 1) mediation activities under the direction of the UN Department of Political and Peacebuilding Affairs. It involves mediation with the UN Secretary-General as a mediator. The conduct of mediation is aimed at resolving international and domestic disputes; 2) activities of the United Nations Commission on International Trade Law (UNCITRAL), Working Group II: Arbitration and Conciliation / Dispute Resolution. It is the UN unit specialising in the use of mediation to settle trade disputes in a variety of entities; 3) the United Nations is an organization which employs tens of thousands of people of various nationalities, cultures and operating in different areas. This area is within the Ombudsman's responsibility as part of mediation services. The entity deals with the internal environment of the organization, resolves disputes, including those through mediation between UN employees. ; Międzynarodowy porządek prawny jest pierwszym, w którym możemy zaobserwować zastosowanie mediacji jako instytucji prawnej. Wzorem dla współczesnych podmiotów prawa jest działalność w przedmiocie mediacji prowadzona przez Organizację Narodów Zjednoczonych. Podmiot charakteryzuje się mnogością regulacji normatywnych oraz podejmowaniem akcji informacyjnych i promocyjnych w zakresie mediacji. Płaszczyzny działania ONZ obejmują m.in. interwencje w spory polityczne, międzynarodowe i krajowe, spory handlowe, spory wewnętrzne, determinując tym samym promediacyjną działalność ONZ w trzech sferach działalności: 1) działalność mediacyjna pod kierunkiem Departamentu Spraw Politycznych i Budowy Pokoju ONZ. Obejmuje prowadzenie mediacji z wykorzystaniem osoby Sekretarza Generalnego ONZ jako mediatora. The study is the result of a legal comparative analysis of the directions of reforms in the administrative judiciary in the countries of young democracy: Poland, the Czech Republic, Lithuania, Croatia, Serbia, Hungary, Ukraine, Georgia and Kazakhstan. The analysis was carried out with reference to the patterns developed in old European democracies, mainly in Austria and Germany. Papers on reforms of the administrative judiciary in each of these countries were delivered at the international scientific conference: Reforms of administrative judiciary in the countries of young democracy (10–11.06.2021, Faculty of Law and Administration, University of Lodz). They focused on three issues: 1) contemporary challenges of the rule of law and administrative judiciary, 2) directions of changes in the national systems of administrative judiciary, 3) the future of administrative judiciary. The content of the study refers to this system of issues, which reflects the stages of development of administrative judiciary in the countries of young democracy. Adjusting the legal status, and support policies for migrant workers is an issue on the agenda of international institutions for nearly a hundred years. The first efforts to protect foreign workers have been taken during the first session of the International Labour Conference in 1919. In the following decades ILO activities has led to the preparation of three international documents concerning this issue (non-binding ILO Convention No. 66 in 1939, and Convention No. 97 of 1949, and No. 143 of 1975). For many decades, the problem of the protection and assistance of migrant workers' rights was considered as a narrow issue of international labor law. Codification efforts, undertaken during seventies, has led to the adaptation of the UN document (International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families) in 1990, and inclusion this issue into more general area of international human rights law. Despite this fact, and the existence of several categories of documents concerning migrant workers within Council of Europe, the European Union, and even ASEAN, the protection of migrant workers has never been effectively functioning system. The aim of this article is the analysis of the codification of that issue, and the main obstacles to consensus on the protection of migrant workers' rights. The state parties of the UN Convention contains primarily countries of origin of migrants (such as Mexico, Morocco and the Philippines). It seems, therefore, that despite 46 ratifications the, UN convention does not have a global character, and activities of its monitoring body (Committee on Migrant Workers-CMW) reflects primarily demands of sending countries. The article closely examines particularly controversial provisions of the ILO and UN documents from the point of view of current labour migrations and policies of sending and host countries.
The article discusses the organisational issues of self-government organisations of the professions of public trust in Poland, in the context of the implementation of the principle of incompatibilitas, as a sine qua non condition for their proper functioning and due performance of the public tasks entrusted to them. The analysis covers the self-government organisations of advocates, attorneys-at-law, notaries, bailiffs, patent attorneys and tax advisers, taking into account their different structures and the legal basis (statutory law or bye-laws) for the prohibition on the one-handed holding of multiple functions or mandates in the bodies of these professional associations. The study found that the phenomenon of holding multiple functions in the self-government of attorneys-at-law constitutes a problem. The study outlines the cause of this situation and draws conclusions for the law as it should stand, which concern the introduction of a prohibition of accumulating functions to the optimum extent, in line with the solutions applied by the self-government of advocates. The aim of the article is not only to substantiate the necessity of these changes, but also to show how they should be made. This proposal can be implemented by amending the internal rules governing the self-government of attorneys-of-law, which should be treated as intra-corporate normative acts and only ultimately through legislative intervention. ; Artykuł dotyczy zagadnień organizacyjnych samorządów prawniczych zawodów zaufania publicznego w kontekście realizacji zasady incompatibilitas jako warunku sine qua non właściwego ich funkcjonowania i rzetelnej realizacji powierzonych im zadań publicznych.
