Legislative powers of the Council of Europe have a crucial impact on the domestic legal systems of the EU Member States including substantive administrative law, i.e. such an area of administrative law which defines rights and responsibilities of the public administration bodies and citizens. The legislation created by the Council of Europe's bodies has a great impact on the areas of law which were earlier regarded as the exclusive responsibility of a given country. The Council of Europe has always been a major source of standard setting. This paper analyses selected areas of substantive administrative law taking into account hard law and soft law documents developed under the auspices of the Council of Europe. ; Kompetencje legislacyjne Rady Europy mają istotny wpływ na systemy prawa krajowego państw członkowskich, włącznie z materialnym prawem administracyjnym, a więc działem prawa administracyjnego regulującym prawa i obowiązki organów administracji publicznej i obywateli. Akty prawne tworzone przez organy organizacji mają znaczący wpływ na te obszary prawne, które wcześniej uważane były za wyłączną kompetencję wewnętrzną. Rada Europy zawsze była ważnym źródłem stanowienia standardów. W niniejszym artykule analizie poddano wybrane obszary materialnego prawa administracyjnego, biorąc pod uwagę dokumenty hard law i soft law opracowane pod auspicjami Rady Europy.
The title of the article refers to P. Manent's essay, describing "the return of political philosophy". Using the distinction between science and art, suggested by thinkers such as J.S. Mill, an analysis was made of the possible responses of legal theory to the so-called "political turn" in social sciences and humanities. Attempts were made to show that transplanting such terms as "politics", "the political", "polity" (in the text they function under more theoretically neutral term: "politicalness") into the field of legal discourse leads to the rejection of the so far dominant (referring to the ideal of Ch. Montesquieu) image of the activity of lawyers as "artisans" practicing the art of law and to replacing it with the image of a lawyer-artists or lawyer-scientist. ; Tytuł artykułu nawiązuje do eseju P. Manenta, opisującego "powrót filozofii politycznej". Korzystając z rozróżnienia między nauką a sztuką, zaproponowanego przez J.S. Milla, dokonano analizy możliwych reakcji prawników i teorii prawa na wyraźny "zwrot polityczny" w naukach społecznych i humanistycznych. Starano się wykazać, że przeszczepienie takich terminów jak "polityka" i "polityczność" na grunt nauk prawnych prowadzi do odrzucenia dominującego dotąd (nawiązującego do ideału K. Monteskiusza) wyobrażenia działalności prawników jako "rzemieślników" uprawiających sztukę prawniczą oraz do zastąpienia go wyobrażeniem prawnika-artysty lub prawnika-naukowca.
The aim of the article is to present the issues related to the time limits set for individual organs of public authority (the Sejm, the Senate, the President of the Republic of Poland) for the performance of specific activities within the legislative procedure. These time limits should be calculated according to conventional rules, that is, from the beginning of the day following the day on which the act on which the legal provisions are binding begins. However, the action will also be effective if it is performed on the same day on which the said event occurred. Violation of the time limit in legislative proceedings is of fundamental importance for the act, as a normative act, within the scope of its validity. As part of the review of the constitutionality of the law, the Constitutional Tribunal also examines the correctness of the proceedings in which the law was adopted. According to the latest jurisprudence of the Constitutional Tribunal, violation of the minimum time limits required for the performance of individual activities, which have only been specified in the Rules of Procedure of the Sejm, may constitute an independent basis for declaring the entire act unconstitutional. This view differs significantly from the existing, well-established approach to this subject. The effects of violating the time limits of the legislative procedure can also be considered at the level of the rights (competences) of individual authorities within a specific proceeding. The signing of the act by the President after the expiry of the constitutional time limit should be deemed legally effective. The admissibility of issuing by the Constitutional Tribunal of scope judgements should be considered in cases of violation of the rules of correct legislation, leading to the omission or reduction of vacatio legis. ; Celem artykułu jest przybliżenie problematyki związanej z terminami wyznaczonymi poszczególnym organom władzy publicznej (Sejm, Senat, Prezydent RP) na wykonanie określonych czynności w ramach postępowania legislacyjnego. Terminy te należy obliczać według reguł konwencjonalnych, a więc od początku dnia następnego po dniu, w którym nastąpiła czynność, z którą przepisy prawa wiążą rozpoczęcie terminu. Czynność będzie jednak skuteczna również wtedy, gdy zostanie wykonana w tym samym dniu, w którym nastąpiło wspomniane zdarzenie. Naruszenie terminu w postępowaniu ustawodawczym ma zasadnicze znaczenie dla ustawy, jako aktu normatywnego, w zakresie jej obowiązywania. Trybunał Konstytucyjny, w ramach kontroli konstytucyjności prawa, dokonuje także badania prawidłowości postępowania, w którym doszło do jego ustanowienia. Według najnowszego orzecznictwa TK naruszenie terminów minimalnych, wymaganych przy dokonywaniu poszczególnych czynności, które zostały określone jedynie w regulaminie Sejmu, może stanowić samodzielną podstawę do stwierdzenia niekonstytucyjności całej ustawy. Stanowisko to odbiega znacząco od dotychczasowego, ugruntowanego stanowiska w tym przedmiocie. Skutki naruszenia terminów postępowania ustawodawczego można rozważać również na płaszczyźnie uprawnień poszczególnych organów, w ramach konkretnego postępowania. Podpisanie ustawy przez Prezydenta, po upływie konstytucyjnego terminu, powinno zostać uznane jako prawnie skuteczne. Należy rozważyć dopuszczalność wydawania przez Trybunał Konstytucyjny wyroków zakresowych w sytuacjach naruszenia reguł poprawnej legislacji, prowadzących do pominięcia lub skrócenia vacatio legis.
The author's goal is to determine the consequences of implementing treaty solutions concerning public debt to the Polish Constitution and to define the differences between the methodology of counting public debt in the European Community and Polish legal order. The raised issues concern important problems from the substantive and practical point of view, therefore the study's content is important for science and practice. The research methodology was based on the analysis of the EU and Poland's normative solutions, opinions expressed in the international and national literature on the subject, and the case law of the Polish Constitutional Tribunal. The paper applies mostly the dogmatic-analytic and legal-comparative method with reference to available statistical data on Poland's public debt. The study allowed the author to gain an understanding of the significance of fiscal rules implemented at the EU level to ensure stability. Article 216(5) of the Constitution of the Republic of Poland indicates that the treaty solutions regarding the reference value (public debt-to-GDP ratio) were reenacted. However, until this day, the EU and Poland's debt measurement methods do not fully correspond. In order to counteract excessive debt incursion, a state is required to take not only efficient actions but also ones that are adequate and, to some extent, flexible. This is an expression of acceptance of the EU's preventive assumptions. However, there is still no full correlation in the methodology of calculating public debt in the EU and the Republic of Poland.
The subject of the study is to outline the boundaries within the legislator may sanction the obligations to provide information to tax authorities using tax sanctions. The author analyzes tax sanctions as instruments guaranteeing the effectiveness of legal norms related to information obligations in the light of the protection of the taxpayer's rights. In the author's opinion, there is a clear outline of the possible shape of the sanction, which limits the legislator in excessive interference with the rights of taxpayers. These limits, both in national and international law, are determined primarily by the principle of proportionality, which is decisive for the degree of discomfort associated with the application of sanctions. It should be indicated that the shape limits of these sanctions, characterized in this study, guarantee, in turn, the protection of the rights of these entities. At the same time, it should be emphasized that tax sanctions are, in principle, a complementary element of the system of the guarantees of the law effectiveness and the legislator deciding on their wider use should properly balance the degree of "saturation" of tax law with sanctions taking into account its nature. ; Przedmiotem opracowania jest nakreślenie granic, w ramach których ustawodawca może sankcjonować obowiązek informowania organów podatkowych za pomocą sankcji podatkowych. Autor analizuje sankcje podatkowe jako instrumenty gwarantujące skuteczność norm prawnych związanych z obowiązkami informacyjnymi w świetle ochrony praw podatnika. Zdaniem autora granice możliwego kształtu sankcji podatkowych mają istotne znaczenie z uwagi na konieczność ochrony podatników przed nadmierną ingerencją w ich prawa. Ograniczenia te, zarówno w prawie krajowym, jak i międzynarodowym, wyznacza przede wszystkim zasada proporcjonalności, która decyduje o stopniu dolegliwości związanej z zastosowaniem sankcji. Należy wskazać, że scharakteryzowane w niniejszym opracowaniu granice kształtu tych sankcji gwarantują z kolei ochronę praw tych podmiotów. Jednocześnie należy podkreślić, że sankcje podatkowe są co do zasady elementem uzupełniającym systemu gwarancji skuteczności prawa, a ustawodawca – decydując się na ich szersze zastosowanie – powinien odpowiednio zrównoważyć stopień "nasycenia" prawa podatkowego sankcjami, uwzględniając jego charakter.

Operations under the auspices of the Security Council mandate span over 70 years. Repeatedly involved in resolving armed conflicts, they have made a significant contribution to ensuring security and stability around the world. In practice, they have taken the form of operations by individual states, coalitions, other international organizations or simply as United Nations missions composed of contingents provided by Troop Contribution Countries (TCC). While operations under the auspices of the United Nations have been involved on several occasions in offensive activities under Chapter VII of the Charter of the United Nations, and the question of responsibility for these actions has been the subject of many legal analyses and judgments, missions organized by the United Nations are always recognized as neutral, and their activities as conciliatory and focused on monitoring the cessation of hostilities, or supervising the disengagement between the parties of the conflict, with the use of force limited to self-defence. Thus, such operations benefited from legal protection, and any action against them was considered a violation of international law. The current engagement of United Nations goes far beyond the traditional understanding of peacekeeping operations. UN missions are frequently authorized to employ all necessary means, up to and including the use of lethal force or even neutralization of the armed group. This creates a situation where in the light of International Humanitarian Law, such actions can be recognized as involvement in armed conflict. This article is intended to show the problems that the international community will soon face to in using United Nations' missions as an instrument for resolving armed conflicts and as a tool for restoring peace and providing stability and securityin the area of operations. It presents the processes of decision-making and subordination, which in some circumstances might result in the United Nations missions being deprived of legal protection and, in addition, made liable for non-compliance with the provisions of International Humanitarian Law. ; Operations under the auspices of the Security Council mandate span over 70 years. The subject of considerations are the legal aspects of the influence of the EU climate and energy framework and trade policy on implementation of permanently sustainable forestry. Even though forestry belongs to the competences of Member States and there is no formal establishment of common forest policy in the TFEU, the new LULUCF Regulation and provisions of regulations regarding prevention of illegal timber trade prove that there is an ongoing process of subjecting forestry to the competencies of the European Union to a growing extent as well as reducing the area left to Member States. It must be stated that the platform for expansion of EU regulations on Member States' forestry in terms of land use and timber trade – acts adopted within the trade policy and climate and energy framework – is the principle of sustainable development that derives from international legislation and is also included in the Constitution of the Republic of Poland. This principle is also the foundation for development of the beginnings of common forest policy that emerges at the verge of EU policies. ; Przedmiotem rozważań są prawne aspekty wpływu unijnej polityki klimatyczno-energetycznej oraz handlowej na realizację trwale zrównoważonej gospodarki leśnej. Mimo zaliczenia gospodarki leśnej do kompetencji krajów członkowskich i braku formalnego ustanowienia wspólnej polityki leśnej w TFUE nowe rozporządzenie LULUCF oraz przepisy rozporządzeń dotyczących przeciwdziałania nielegalnemu obrotowi drewnem świadczą o postępującym procesie coraz większego podporządkowania gospodarki leśnej kompetencjom Unii Europejskiej i redukowania obszaru zostawionego krajom członkowskim. Realizując cel rozważań, stwierdzić należy, że płaszczyzną ekspansji unijnej regulacji obejmującej gospodarkę leśną krajów członkowskich w sferze zarządzania gruntami, a także obrotu drewnem, a więc aktów przyjętych w ramach polityki handlowej i klimatyczno-energetycznej, jest zasada zrównoważonego rozwoju wywodząca się z prawa międzynarodowego, uregulowana także w Konstytucji Rzeczypospolitej Polskiej. Zasada ta stanowi również podstawę do kształtowania się zalążków wspólnej polityki leśnej, wyłaniającej się na styku innych unijnych polityk.
The subject of the study is the Bologna Process, its assumptions and course. The article contains an analysis of the Act on university education and science in order to indicate solutions for the harmonization in Poland under the Bologna movement. This movement is characterized as an example of European integration (harmonization) in the sphere of higher education, which was initiated by the Bologna Declaration of 19 June 1999. The main idea behind this declaration was the joint creation of the European Higher Education Area. The process initiated then goes beyond the scope of activities undertaken only by European Union governments. The analysis covers the following parts: The scope of the Bologna Process, Further European actors and the Sorbonne Declaration, The Bologna Process today, Implementation barriers was well as criticism. The withdrawal of the United Kingdom from the European Union is one of the main challenges for the continued functioning of the European judicial area in criminal matters. In this article, special attention will be paid to selected aspects of ensuring further judicial cooperation in criminal matters after Brexit. This primarily concerns the possibility of further participation of the United Kingdom in specific organs supporting this cooperation (Eurojust and Europol) and the the application of legal instruments implementing the principle of mutual recognition of judgments, with reference to the flagship legal instrument, i.e. the European arrest warrant. It also presents a unique position of the United Kingdom in the Area of Freedom Security and Justice EU, which that state is guaranteed under the provisions of Treaties.
ccording to the Section 1 of the Council of European Union Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia by means of criminal law, each Member State shall take the measures necessary to ensure that the following intentional conduct is punishable: publicly condoning, denying or grossly trivialising crimes of genocide, crimes against humanity and war crimes. Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law provides for liability in the public glorification of genocide, crime against humanity, crime against peace or war crime or glorification, denial, acquittal or gross trivialisation of committed genocide, crime against humanity, crime against peace or war crime, including genocide, crime against humanity, crime against peace or war crime committed by the U.S.S.R. or Nazi Germany against the Republic of Latvia and its inhabitants. The article aims to initiate a debate on potential problems related to the application of the Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law. The author offers his vision of the regulatory framework application problems.
The article aims to analyze changes in public (administrative) law, including the introduction of a new act of law (the so-called "Law 2.0") on higher education and science in 2018 in Poland. Together with the accompanying introductory law and executive acts, Law 2.0 established not only a new legal regime, but also forced institutional changes, that will be analysed in the second part of this article. In addition to the analysis, the article is also presents author's conclusions de lege lata and de lege ferenda.

In Poland, similarly to other countries, there is no unambiguous agreed explanation to the reasons for the observed decline in crime. The article analyses the impact of video monitoring systems on losses caused by three categories of offenses: (a) car theft, theft with burglary, theft from cars; (b) damage to cars; (c) robbery. To answer the question whether the installation of video surveillance systems has an impact on security, the economic effect of installing cameras in eight Polish cities (Gdańsk, Katowice, Kielce, Lublin, Łódź, Poznań, Warszawa, Wrocław), where video surveillance systems are well developed, is examined. Determining whether the installation of cameras contributes to the reduction of losses caused by crime allows assessing the suitability of cameras for improving public safety. The study partially confirms the effectiveness of video monitoring systems for a decrease in crime in the analysed categories of crime. However, other possible factors, in addition to the development of monitoring, may have an impact. Moreover, the impact is less pronounced in the case of the volume of losses caused by crime than the number of crimes. Thus, when assessing public policies regarding security, the number of offenses criterion is insufficient.
This article presents the issues of changing the composition of the voivodeship board in the Republic of Poland as a result of the change in the voivodeship statute. As part of the legal analysis of the institution in question, the authors paid special attention to practical issues and nodal problems that may be encountered when interpreting the provisions of the Act of 5 June 1998 on Voivodeship Self-Government. The issues raised refer to the actual state of affairs in the Sejmik of the Świętokrzyskie Voivodeship. The article is of a scientific and research nature. The authors put forward three hypotheses and attempted to prove them in the framework of the conducted analysis. Firstly, a change in the composition of the voivodeship board as a result of the change in the voivodeship statute is possible in the light of the principles of the Polish systemic administrative law without the need to dismiss the entire voivodeship board. Secondly, in a situation where the resolution amending the articles of association did not include any adjusting provisions, it is necessary to adjust the make-up of the management board to the requirements of the amended articles as soon as possible. Thirdly, the solution according to which the dismissal or acceptance of a resignation of a board member by the voivodeship parliament and the election of a deputy marshal in his place within one resolution should be rejected. The results of the research carried out in the course of the analysis are original and innovative, as such studies have not been conducted so far. As a result, this article is a valuable source of knowledge for representatives of science and practice. ; Niniejszy artykuł przedstawia problematykę zmiany składu zarządu województwa w Rzeczypospolitej Polskiej, przeprowadzanej na skutek zmiany statutu województwa. Autorzy w ramach analizy prawnej przedmiotowej instytucji szczególną uwagę zwrócili na kwestie praktyczne oraz problemy węzłowe, na jakie można się natknąć, dokonując wykładni przepisów ustawy z dnia 5 czerwca 1998 r. o samorządzie województwa. Podjęta problematyka nawiązuje do stanu faktycznego, jaki wystąpił w sejmiku województwa świętokrzyskiego. Artykuł ma charakter naukowo-badawczy. Autorzy postawili trzy hipotezy i podjęli próbę ich udowodnienia w ramach prowadzonej analizy. Po pierwsze, zmiana składu zarządu województwa na skutek zmiany statutu województwa jest w świetle zasad polskiego ustrojowego prawa administracyjnego możliwa bez konieczności odwoływania całego zarządu województwa. Po drugie, w sytuacji gdy w uchwale zmieniającej statut nie zamieszczono przepisów dostosowujących, konieczne jest jak najszybsze doprowadzenie do dostosowania składu zarządu do wymogów zmienionego statutu. Po trzecie, należy odrzucić rozwiązanie, według którego do odwołania lub przyjęcia rezygnacji członka zarządu przez sejmik województwa oraz do wyboru wicemarszałka w jego miejsce miałoby dojść w ramach jednej uchwały. Wyniki przeprowadzonych w toku analizy badań mają charakter oryginalny i nowatorski, badania takie nie były bowiem dotychczas prowadzone. Powoduje to, że niniejszy artykuł stanowi cenne źródło wiedzy dla przedstawicieli nauki i praktyki.
