In January 2020, the World Health Organization announced an outbreak of SARS-CoV2, which caused COVID-19 coronavirus disease. Soon, a continuous outbreak of coronavirus infection was declared a pandemic. This situation has led to an increase in cybercrime. Cybercriminals did not stray from the situation and used the pandemic to commit various digital frauds and cyberattacks. As a result, the objective of the investigation was to analyze computer crimes at the COVID-19 scene and identify their social and legal consequences. This is a documentary-based investigation. It is concluded that, security standards have deteriorated in the context of forty social as many organizations were not prepared for remote work and the number of victims of cybercrime will only grow soon. International organizations and law enforcement agencies in many countries issue many recommendations to prevent digital criminal acts against businesses and citizens. This situation also prompted active legislation around the world to deal with the crisis. Most of the rules adopted in recent months are likely to be derogated.

The objective of this work is to establish the notion of the criminal law of the enemy, from the area of criminality. Regarding the methodology, it is descriptive of bibliographic review. It is hypothesized that when faced with a regulation that determines the criminal law of the enemy, the chances of recidivism and concurrence of criminal groups in the social environment decrease. The criminal law of the enemy, implies the sanction or the treatment of cases of people or groups with risky behavior for the individual, and society. For example, the actions of criminal groups that put the State or a community in distress, kidnapping and murdering people with profit motive and to generate fear in the inhabitants, seek with criminal acts that the government "respect" them and that through their violence they can transgress the laws. Criminality based on armed groups, demand respect for the Constitution, however with kidnappings and murders they violate the laws, thus generating inequality and sensitive aspects such as comprehensive protection of the legal right, human rights and their incidence, which may merit the criminal law of the enemy with the scope of criminal law, taking into account the shortcomings of compliance with due process and legal incompatibilities in a state of law allows to contribute to the improvement of regulations regarding the criminal law of the enemy from the area of criminality ; El presente trabajo tiene como objetivo establecer la noción del derecho penal del enemigo, desde el área de la criminalidad. En lo que respecta a la metodología, es descriptiva de revisión bibliográfica. Se plantea la hipótesis que ante una normativa que determine el derecho penal del enemigo, disminuyen las probabilidades de reincidencia y concurrencia de grupos criminales en el entorno social. Así tenemos a Cancio Melia, quien señala que este derecho penal del enemigo no llega a estabilizar normas, sino que únicamente busca demonizar determinados grupos de infractores. El Derecho Penal del enemigo, implica la sanción o el tratamiento de casos de personas o grupos con un comportamiento riesgoso para el individuo, y la sociedad. Como, por ejemplo, la actuación de grupos criminales que ponen en zozobra al Estado o a una comunidad, secuestrando y asesinando a las personas con el afán de lucrar y generar temor en los habitantes, buscan que con hechos criminales el gobierno les "respete" y que a través de su violencia puedan trasgredir las leyes. La criminalidad fundada en los grupos armados, reclaman el respeto a la Constitución, sin embargo con los secuestros y asesinatos incumplen las leyes, generando de esta forma la desigualdad y aspectos sensibles como la protección integral hacia el bien jurídico, los derechos humanos y su incidencia, que puede ameritar al derecho penal del enemigo con el alcance del derecho penal, teniendo en cuenta las falencias del cumplimiento del debido proceso y las incompatibilidades jurídicas en un estado de derecho que permite contribuir al mejoramiento de las normativas respecto al derecho penal del enemigo desde el área de la criminalidad

The purpose of the research was to define the theoretical, administrative and civil law aspects of the regulation of social relations. Consequently, the article specifies the means of social regulation, which include components of legal, moral, corporate and customary, etc. type. It has been shown that legal regulation of social relations is defined as an intentional action on the behavior of people and social relations with the help of legal (juridical) means. The methodological basis of the research is presented as comparative-legal and systematic analysis, formal-legal method, method of interpretation, hermeneutic method, as well as methods of analysis and synthesis. By way of conclusion it has been proved that since the object of legal regulation is presented as social relations, legal regulation is determined by some objective and subjective factors. As contributions, the following factors of social relations have been determined: level of economic development of society; social structure of society; level of maturity and stability of social relations; level of legal culture of citizens; level of certainty of the subject of social relations, means and methods of legal regulation.

Abstract. Regarding the concept of economic criminal law, within the context of traditionalpositions – the restrictive one, the open one and the eclectic critical approaches, the author aims at a conceptual approach integrated into this sophisticated area of criminal law. This integrated attitude does not arise as the mere result of the synthesis of the abovementioned traditional positions, but it is made up of other significant variables, to wit: the ontic conditions of social structure, a social anthropocentric vision, the vindication of a need for a very precise legally protected right and determining in its offensiveness, and the claim for the democratic legitimacy of this regulatory category.All of this is combined with a concrete reality which summarizes an illicit behavior or objectively abusive with respect to the normal functioning of the economy's mechanisms or resources. Based on these ideas, a rational and minimalist sequence between the concepts of economic criminal law, macroeconomic criminal law and business criminal law may be attained, in addition to a common methodology to typify and bring these phenomena closer together and a more fluent exercise of the guarantees of a socialdemocratic rule of law. ; Resumen. En el contexto de las tradicionales posturas —restrictiva, amplia y tentativaseclécticas de carácter crítico—, respecto del concepto de derecho penal económico, el autor procura lograr una aproximación conceptual integrada a esta rama sofisticada del derecho penal. Esa postura integrada no surge como mero resultado de la síntesis de las referidas visiones tradicionales, sino que se compone, también, de otras variables de particular importancia, a saber: las condiciones ónticas de la estructura social, una visión antropocéntrica social, la reivindicación de la necesidad de un bien jurídico muy preciso y determinable en su ofensividad, y el reclamo a la legitimidad democrática de esta categoría normativa. Todo ello se anuda a una realidad concreta que trasunta un comportamiento ilícito u objetivamente abusivo respecto del normal funcionamiento de los mecanismos o resortes de la economía. A partir de estas ideas podrá lograrse una secuencia racional y minimalista entre los conceptos de derecho penal económico, derecho penal macroeconómico y derecho penal de la empresa, además de una metodología común de aproximación y tipificación de estos fenómenos, y un más fluido ejercicio de las garantías del Estado democrático social de derecho.

The paper studies the offenses that protect the legal right to sexual indemnity and freedom in Honduran law, starting with the analysis of the social context of the country in relation to sexual violence, and then analyzes the current constitutional and secondary legislation that pursue to eradicate this violence. Specifically, the paper analyzes the criminal law that punish the violation of legal rights under study, for identify if in the criminal legislation persist gender stereotypes, which may have an adverse effect in the protection of the rights of victims to be treated with equality. After analyzing the various offenses is evident that, despite the various reforms carried out to the Honduran criminal law, it is necessary to review and change the configuration of some crimes, especially the crimes of rape and statutory rape; and suppressing other offenses whose regulation might induce judges to link such crimes with concepts such as honor and shame, as in the cases of crimes of rape and incest. Das Rechtsgut ist für die meisten Strafrechtler der Eckpfeiler der Straftatstheorie und ein Instrument, das wichtige Lehr- und strafrechtliche Funktionen erfüllt. Jedoch wird die politisch-strafrechtliche Funktion, die dem Gesetzgeber seine Grenze bei der Strafgesetzgebung weisst, ernstlich in Frage gestellt. Die verwendeten Argumente von den sogenannten »Rechtsgutkritikern" stützen sich darauf, dass dieses Rechtsgut keine wirkliche Grenze mehr darstellt bezüglich des Phänomens der Ausdehnung des Strafrechts. Der Gesetzgeber erschafft immer mehr Straftatbestände, erweitert bestehende oder schützt wenig konkrete Wirklichkeiten oder von zweifelhaftem Wesen bezüglich des sozialen Zusammenlebens. Daher gibt es Einige, die annehmen, es handele sich um eine obsolete Theorie, die nicht in der Lage ist, sich erfolgreich den aktuellen politisch-strafrechtlichen Problemen zu stellen. Andererseits soll im folgenden Essay gezeigt werden, dass die sogenannte Krise der kritischen Funktion des Rechtsguts unter anderem darauf beruht, dass irtümliche konzeptuelle Vorstellungen desselben oder von seiner Verletzung vorherrschen und dazu führen, dass der Begriff entleert wird wodurch er seine Funktion nicht mehr ausüben kann. ; Legal goods are for most penal law scholars the cornerstone of the legal theory of crime as well as a tool with core dogmatic and political-criminal purposes. However, their political criminal purpose, which serves as a limit to the ruler in their job as a criminaliser, is being seriously questioned. The reasons used by the so-called «legal goods oppositors» are based on such not being a truly limit to penal law expansion. The ruler creates more and more criminal types, widens others already in force or protects unclear realities or those which are doubtedly essential to the purpose of social cohabitation. Thus, some might say that it is all about an obsolete theory incapable of successfully facing current political criminal issues. However, throughout the following lines we will claim that the so-called crisis of legal goods is due to, among other reasons, a misconception of the latter or of its abuse which empty it from its content and do not let it meet its purpose. ; El bien jurídico es para la mayoría de los penalistas la piedra angular de la teoría jurídica del delito y un instrumento que cumple importantes funciones dogmáticas y político-criminales. A pesar de ello, su función político criminal, aquella que sirve de límite al legislador en su tarea criminalizadora, está siendo seriamente cuestionada. Los argumentos utilizados por los denominados «detractores del bien jurídico» se apoyan en que no está funcionando como verdadero límite al fenómeno de expansión penal. El legislador crea cada vez más tipos delictivos, amplía otros ya existentes o protege realidades poco precisas o de dudosa esencialidad para la convivencia social. Por ello, hay quien considera que se trata de una teoría obsoleta que no es capaz de enfrentarse con éxito a los problemas político-criminales actuales. Sin embargo, a lo largo de las siguientes líneas se pondrá de manifiesto que la supuesta crisis de la función crítica del bien jurídico obedece, entre otros motivos, a concepciones erróneas del mismo o de su lesión que lo vacían de contenido y le impiden llevar a cabo dicha función.

Abstract. The author works on two paradigms inherent in the taxation object of a SocialDemocratic Rule of Law, to wit: the Principle of taxation's legal continuity, which means thatthe principles of Criminal Taxation Law have to live in necessary harmony with those ofGeneral Taxation Law and a second complementary paradigm, according to which, evenstressing its peculiarities, Criminal Taxation Law has to be necessarily channelled back toCommon Criminal Law, to its general principles and guarantees. Based on these, the general principles of Taxation Law in the Social Democratic Rule of Law are analyzed first (Chapter II) and then, in a similar way, the principles of Criminal Taxation Law (Chapter III). Finally, some suggestions regarding a possible dogmatic and legislative redefinition are made aimed at the affirmation of a guaranteeing Criminal Taxation Law, adjusted to the needs and restrictions of such Social Democratic Rule of Law. ; Resumen. El autor trabaja sobre dos paradigmas inherentes a la pretensión tributaria en unEstado democrático social de derecho, a saber: el principio de la continuidad jurídica tributaria,lo que significa que los principios del derecho penal tributario deben mantener una necesariaarmonía con los del derecho tributario general, y un segundo paradigma complementario,conforme al cual, aun marcando sus particularidades, el derecho penal tributario debe sernecesariamente reconducido al derecho penal común, a sus principios y garantías generales.A partir de esas bases, se analizan en una primera instancia los principios generales delderecho tributario en el Estado democrático social de derecho (sección II) y posteriormente,en la misma clave, los principios del derecho penal tributario (sección III). Finalmente seesbozan algunas sugerencias sobre una posible redefinición dogmática y legislativa tendientea la afirmación de un derecho penal tributario garantizador, ajustado a las necesidades ylimitaciones de tal Estado democrático social de derecho.

This article studies the crimes of child pornography and possession of child pornography in the context of the Vatican criminal law system. Starting from the connection between pedophilia and child pornography, the study focuses on the analysis of the differences between these two types of crime in order to identify the defining characteristics of each. The difference between child pornography and pornography of minors was also highlighted. A close reading of the laws comprising the Zanardelli Code discloses its limitations, an inability to prove or punish new criminal cases. Thus, the legislative body proceeded to update and adapt the criminal law with a range of measures designed to enable the Vatican system meet emerging needs in relation to new types of crime. The final section of the paper explores the evolving Vatican regulatory response to the crimes of child pornography and possession of child pornography. ; Este artículo estudia los delitos de pornografía infantil y posesión de pornografía infantil en el contexto del ordenamiento penal del Vaticano. A partir de la conexión entre pedofilia y pornografía infantil, el estudio se centra en analizar las diferencias entre estos dos tipos de delitos, para identificar las características definitorias de cada uno. También se destaca la diferencia entre pornografía infantil y pornografía de menores. Una lectura atenta de las leyes que constituyen el Código Zanardelli revela sus limitaciones, esto es, la imposibilidad de probar o sancionar nuevos casos penales. Así, el Legislador procedió a actualizar y adaptar el derecho penal con una serie de medidas, diseñadas para permitir que el ordenamiento del Vaticano satisfaga las necesidades emergentes en relación con nuevos tipos de delitos. La sección final del documento explora la evolución de la respuesta regulatoria del Vaticano a los delitos de pornografía infantil y posesión de pornografía infantil.

The objective of the article was to assess the semiotics of law in modern philosophical and legal research. Recently, semiotic scientific research on the analysis of legal reality has become increasingly relevant, its demand is explained by the active search for meta-legal foundations for the integration of modern legal theory. The research carried out in the proposed article is applied using dialectical, systemic structural, genetic, and other methods, which allows us to affirm that interdisciplinary studies of law from the point of view of semiotics compete with many other approaches and contribute to solving important problems of philosophical and legal ciencias. It is conceptually concluded that the semiotics of law has direct and indirect organic relations with all the main subdisciplines of the philosophy of law: legal ontology, epistemology, anthropology, axiology, and praxeology, and represents one of the interdisciplinary approaches to law. The importance of semiotic analysis of the problems of legal reality is emphasized, which demonstrates the logic of its construction, systemic and structural connections, reveals the internal mechanisms and symbolic patterns of its development.

This article, through the description of real experiences, reveals some of the obstacles that arise when applying the international, national, and domestic laws of the Republic of Azerbaijan and Ukraine in the fight against crimes of an international character, and offers alternatives to address them. International legal assistance between States in criminal cases is provided in accordance with international agreements. The instruments of cooperation in the field of mutual legal assistance between States in criminal matters are well known to European judges and prosecutors. However, experience shows that post-Soviet countries have been reluctant to use mutual legal assistance in criminal matters because of the practical problems that often arise. The solutions to these problems are not only found in national or international legal texts and regulations, directives, or conventions. It is concluded that legal assistance among States in criminal cases is essential to extradite offenders facing criminal charges or to execute court sentences, to extradite persons, to transfer convicted persons to serve their sentences and to seize, search for and confiscate the proceeds of crime.
