The article is devoted to the identification of characteristic features of legislative defects caused by regulatory legal acts (or within legislative acts) of terminological interpretations that are ambiguous. Polysemy quite often has a negative impact on the universal conceptual-categorical apparatus. Attention is drawn to the fact that the homogeneity of the subject matter of the legal regulation requires the maximum terminological clarity, since the context of the individual legal relations is not in itself sufficiently pronounced to provide a clear delineation of the meaning of the ambiguous term. The manifestations of normative polysemy only reduce the clarity of the law and create difficulties in law enforcement, including in the field of criminal justice. The manifestation of polysemy in criminal procedural law is considered on the example of the ambiguous legal term «reconciliation», the definition of legal meaning of which is determined only by the context of its use. In addition, the study draws attention to the fact that in the criminal procedural legislation there are cases where the problem of polysemy is not solved by taking into account the contextual meaning, and the use of means of interpreting the text of the law does not provide a clear answer. This situation is illustrated by an example of the use by the legislator of the identical terminological designation «trial» both for the name of the stage of proceedings in the court of first instance, and for the name of its separate (second) stage, which involves the examination of evidence. Suggestions are made to eliminate and overcome the described legislative defects.
The article is devoted to the analysis of scientific concepts and legal terminology of criminal legislation, the identification of their relationship and role in lawmaking in the development and adoption of quality in form and perfect in content laws on criminal liability. The logical structure of criminal law concepts (content and volume) and their industry types are considered: specific, generic, evaluative concepts and categories as fundamental concepts of law; developed the basic rules for their determination and consolidation in the text of the law. The basic requirements (quality parameters) that are presented to legal terms are identified, with the help of which the law on criminal liability defines legal concepts that comprise the content of legal norms, legal structures and other legal formations that are components of this law. The proposals aimed at improving the form and content of criminal law are formulated. The problems of scientific concepts and legal terminology considered in the article, their analysis and formulated proposals are aimed, as a whole, at improving legislative activity on the development and adoption of high-quality criminal-form laws in form and perfect in content. Legal concepts and legal terminology - organically interconnected phenomena of criminal law – are specifically logical and linguistic means of displaying and consolidating verbally in criminal liability laws (in their norms, legal structures, other regulatory legal conditions) subject to legal regulation formations) of phenomena (objects) of reality that are subject to criminal law regulation. The deeper the legal concepts are developed, the more perfect the legal terminology used in the text of the law, the better the positive law, which should be objectively capable of optimally regulating public relations in the field of criminal law.
The author notes that the positive global changes at the same time pose serious problems for peace and justice. From the point of view of criminogenic factors, globalization, despite all the positive aspects, at the same time leads to a large number of negative consequences, has a significant impact on crime. In this regard, studies of the impact of globalization processes on the formulation and development of criminal policy and, as a consequence, the effective functioning of the political system in this field, are relevant. Unprecedented openness in trade, finance, transportation and communications has created economic growth and prosperity in many countries. At the same time, globalization is also creating opportunities for the increasing prosperity of illicit trade. Just as there are direct links between technological progress and economic liberalization, the removal of barriers to international trade in goods and the free movement of funds also facilitate illicit trade. Organized crime is diversified, globalized at the same time as all other processes, and reaches a macroeconomic scale: illicit goods are made on one continent, transported across another, and sold on another. Such crime stimulates corruption, infiltration of illegal business into politics, and thus significantly impedes the development of society. In modern conditions, one of the main tasks of mankind is that globalization in various spheres of society does not become a source of additional conflict situations, does not increase tensions in the world, because the modern world and so full of risks, dangers, threats and mistrust. And if globalization itself becomes as much of a global threat as the environmental global problem or the problem of relations between prosperous industrialized countries and the rest of the world, the situation in the world will become even more acute. The article is devoted to the issues of criminal liability for enforced disappearance in criminal law of Ukraine. The international legal conditionality of the appearance of this prohibition in the Criminal Code of Ukraine, its adequacy to the modern needs of combating this phenomenon as well as the compliance with the conditions of implementation of the provisions of international legal acts in the national criminal legislation are analyzed. It should be taken into account that international legal acts describe the need to criminalize socially dangerous behavior, and the form of such criminalization is chosen by states in accordance with national traditions of law-making. The article cites and analyses corpus delicti of the criminal offence provided for by Article 146-1 of the Criminal Code of Ukraine «Enforced Disappearance», which appeared in the criminal law as a result of the adoption of the Law of Ukraine «On the Legal Status of Missing Persons». Potential difficulties in applying the norm provided for by Article 146-1 of the Criminal Code of Ukraine to socially dangerous acts, cases of unjustified competition and conflict of norms are revealed. It is stated that the norm provided for by Part 1 of Article 146-1 of the Criminal Code of Ukraine, is partly special in relation to several norms provided for by other articles of the Criminal Code: Article 146 «Illegal confinement or abduction of a person»; Article 371 «Knowingly unlawful detention, compelled appearance, house arrest or taking into custody»; Article 365 «Excess of authority or official powers by a law enforcement officer»; Article 364 «Abuse of authority or office». It should be noted that before the introduction of Article 146-1 to the Criminal Code of Ukraine virtually all the behavior constituting enforced disappearance, the criminalization of which was the obligation of the Ukrainian state under the Rome Statute of the International Criminal Court and International Convention for the Protection of All Persons from Enforced Disappearance, constituted criminally prohibited behavior in accordance with the above mentioned «general» criminal law norms. The exception, in fact, is only the formal corpus delicti of indulgence, which is not covered by Article 364 of the Criminal Code of Ukraine and the introduction of which into the system of criminal offences under the current Criminal Code of Ukraine we completely approve. The article also analyses the prospects of the adoption of amendments to the Criminal Code of Ukraine, proposed in the draft Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on the Implementation of Norms of International Criminal and Humanitarian Law», which offers to supplement the Criminal Code of Ukraine with Article 442-1 «Crimes against humanity». Thus, the Ukrainian legislator will react for the second time to its international legal obligations regarding the implementation of the norms of international humanitarian law. The following options for preventing real and potential threats in the criminal law regulation of liability for enforced disappearance are proposed: to borrow the German experience of criminal law regulation in this area of public relations as well as to adopt the law on international criminal law. ; Статтю присвячено розглядові проблем кримінальної відповідальності за насиль-ницьке зникнення за кримінальним правом України. Йдеться про Римський статут Міжнародного кримінального суду та Конвенції ООН про захист усіх осіб від насильницьких зникнень. Виявлено потенційні складнощі у застосуванні цієї норми до суспільно-небезпечних діянь, випадки невиправданої конкуренції та колізії. Проаналізовано перспективи прийняття нових змін до КК України у частині імплементації норм міжна-родного гуманітарного права та очікувані проблеми, які у зв'язку з цим можуть виникнути при оцінці протиправних посягань на свободу особи. Запропоновано варіанти запобігання реальним та потенційним загрозам у кримінально-правовій регламентації відповідальності за насильницьке зникнення.
The purpose of the article is to find the best ways to resolve conflicts in the criminal law of Ukraine. Methods. Methodological tools are selected in accordance with the purpose, specifics of the object and subject of research. The main one is general dialectical method of scientific knowledge of real legal phenomena. Special research methods used in the study are: the method of systematic analysis, formal legal, interpretation of law, comparative law, modeling. The theoretical basis of the study is the latest scientific works in the chosen field of research. Results. As proved during the analysis of the legal literature, there is the following list of effective ways to resolve and prevent conflicts in law, which can be extrapolated to the field of criminal law: 1) unification of law; 2) harmonization of law; 3) approximation of law; 4) clear delineation of powers of public authorities; 5) monitoring of normative legal acts; 6) creation of model laws; 7) interpretation of law; 8) improvement of legislation. Conclusions. As a result of the study, it is proposed to apply different principles to overcome conflicts depending on their type (in particular, "a special law repeals a general law", "a later law cancels an earlier one", "the next general law does not cancel an earlier special law of similar legal force"). Types of "conflict rules" in the sources of criminal law are presented primarily depending on the specific type of such sources. Modern legislation, including criminal, contains virtually no rules aimed at overcoming intersectoral conflicts, but conflicts of law in various areas of Ukrainian law create significant problems in law enforcement.

It has been found out that it is important to keep the security of society and individuals at the heart of the "protection" of state security, to be guided by the system of constitutional foundations (legality, humanism, justice, equality). This should also be taken into account in developing Criminal Law policy.In particular, the Constitution of Ukraine provides the following general law principles, which are also the principles of penal policy: rule of law, equality, the presumption of innocence, etc. The principles are reflected in the criminal legislation of Ukraine.It has been established that the constitutional principles are aimed at ensuring the human safety and freedom, as well as the tasks of the Criminal Code (Article 1 of the Criminal Code).The author proved that the Constitutional fundamentals influencing penal policy, including the criminalization and decriminalization, penalization and depenalization, etc. Violation of constitutional order and government, guaranteed rights and freedoms, and not performing the duties could threaten constitutional basis. In cases provided by the Criminal Code of Ukraine, for the violation of the human rights and freedoms, criminal liability is established.The author established that to minimize inconsistencies Criminal Law and the Constitution of Ukraine it seems appropriate to consolidate humanistic constitutional foundations of the Preamble of the Criminal Code of Ukraine, as it defines the content of the norms of the Criminal Code of Ukraine as a whole and further reformation of its text based on the concept laid down in the Preamble. This means that, in the event of adoption of or amendment to the Criminal Law, it is necessary to formulate these changes in accordance with the provisions of the Constitution of Ukraine.Article received 28.02.2019 ; У статті досліджено питання конституційних основ кримінально-правової політики. The author upholds the thought that the human's being "under guidance of numerous things", the diversity of spheres of human activities as if gives cause for objecting the architectonic character of politics. However it is the diversity of spheres in each society, in the author's opinion, that is a result of the global institution of the society which gives every reason for the recognition of the architectonic role of politics, as well as the complex unity under the name of the objective mind. The present distribution of market in the social sphere nourishes individualistic comprehension of human rights. The article is devoted to the research of scientific approaches to defining the essence of fairness and its normative fixing as a category of criminal procedural law. It is found that in philosophical studies distinguish formal, substantive and procedural justice. In philosophy of law distinguishes: fairness as equality of opportunity, fairness distributive and revengeful fairness. In criminal proceedings fairness is used in such contextual meanings: as the purpose (task) of criminal proceedings, as the principle of criminal proceedings, as a subjective right to a fair trial, as a requirement to a judicial decision, as an accordance of punishment, as a requirement to the characteristic of a jury. It is substantiated that the fairness of criminal proceedings is both its purpose and its task. Fairness is that reference point, to achieve which criminal proceeding is initiated, and the task of criminal proceedings is to follow a fair procedure. It is determined that the general law principle of fairness extends to criminal procedural law, taking on its own specificity, due to the peculiarities of criminal procedural relations. Fairness is a separate and self-sufficient principle of criminal proceedings. It is established that the subject of criminal procedural regulation is the fairness of the criminal procedural form, not punishment. It is substantiated that in the criminal procedural legislation fairness is applied in the following meanings: as a moral and ethical requirement for the characteristics of a person, as a requirement of substantive law (justice of punishment appointed by a court), as a requirement to the procedural form (compliance with the fair procedure of processual actions and making procedural decisions). Fairness as a requirement to a procedural form is also multidimensional: it is the purpose (task) of criminal proceedings, the principle of criminal proceedings, and the procedural right of a person (right to a fair trial). ; Стаття присвячена дослідженню наукових підходів до визначення сутності справедливості та її нормативного закріплення як категорії кримінального процесуального права. З'ясовано, що у філософських дослідженнях виділяють формальну, змістову й процедурну справедливість. У філософії права розрізняють справедливість як рівність можливостей, справедливість розподільчу та справедливість відплатну. У кримінальному процесі справедливість уживається в таких контекстних значення: як мета (завдання) кримінального провадження, як засада кримінального провадження, як суб'єктивне право на справедливий судовий розгляд, як вимога до судового рішення, як відповідність покарання, як вимога до характеристики присяжного. Обґрунтовано, що справедливість кримінального провадження є як його метою, так і завданням. Справедливість є тим орієнтиром, задля досягнення якого розпочинається кримінальне провадження, а завданням кримінального провадження є дотримання справедливої процедури. Визначено, що загальноправовий принцип справедливості поширюється на кримінальне процесуальне право, набуваючи своєї специфіки, зумовленої особливостями кримінальних процесуальних правовідносин. Справедливість є окремою та самодостатньою засадою кримінального провадження. Установлено, що предметом кримінального процесуального регулювання є справедливість кримінальної процесуальної форми, а не покарання. Обґрунтовано, що в кримінальному процесуальному законодавстві справедливість уживається в таких значеннях: як морально-етична вимога до характеристики особи, як вимога матеріального права (справедливість покарання, що призначається судом), як вимога до процесуальної форми (дотримання справедливої процедури проведення процесуальних дій і прийняття процесуальних рішень). Справедливість як вимога до процесуальної форми також є багатоаспектною: є метою (завданням) кримінального провадження, засадою кримінального провадження та процесуальним правом особи (право на справедливий судовий розгляд).
The Article 1 of the Constitution of Ukraine regulates: Ukraine is a sovereign and independent, democratic, social, legal state. One of the destabilizing factors in building the rule of law is the commission of criminal offenses by organized criminal groups. Due to the changes in the criminal legislation during the last two years, the criminal law norms have undergone significant changes, which directly or indirectly affect the qualification of criminal offenses committed by organized criminal groups. Given the changes in criminal law, the qualification of criminal offenses committed by organized criminal groups requires uniform systemic approaches, primarily at the level of judicial law enforcement practice. The formation of the Ukrainian legal doctrine on the qualification of criminal offenses committed by organized criminal groups is one of the significant auxiliary guidelines in the formation of such law enforcement practice. To achieve this goal and the defined objectives, the following methods were applied in the study: logical and normative – for the analysis of criminal law on the qualification of criminal offenses committed by organized criminal groups; system analysis – when considering judicial law enforcement practice (first of all, the Supreme Court and the Supreme Court of Ukraine) of the qualification of criminal offenses committed by organized criminal groups. The legislation strengthens criminal liability for criminal offenses by organized criminal groups, in particular, as evidenced by the amendments to the Criminal Code under the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Liability for Crimes Committed by the Criminal Community" dated by the 4th of June 2020. Before the formation of new approaches to the doctrine of criminal law and law enforcement judicial practice on the qualification of criminal offenses (crimes), a specific part of which is provided by h.ch. 1-5 art. 255 of the Criminal Code, the indirect reference is the provision of the resolution of the Plenum of the Supreme Court of Ukraine of December 23, 2005 №12 "On the practice of consideration by courts of criminal cases on crimes committed by stable criminal groups." The research paper deals with the social and criminal law characteristics of such phenomenon as "bullying". The conducted research shows that bullying is a phenomenon that is no longer purely administrative and legal, and is now subject to criminal law characteristics because it often entails criminal consequences. A detailed analysis of the provisions of the Criminal Code of Ukraine allows concluding that certain manifestations of bullying were reflected in corpus delicti as torture, driving to suicide, hooliganism. With respect to the subjective nature of these criminal offenses, it should be noted that "bullying" is defined as the unlawful activity of school-age children. At the same time, persons over the age of 16 are responsible for the criminal offense in the form of a torture. Under Article 120 "Driving to Suicide, responsibility is born only by persons aged above 16. And only for hooliganism responsibility is born by persons aged above 14. That is, now we have a situation where, on the one hand, bullying is a problem for pupils, and on the other, criminal responsibility for committing actions that actually constitute bullying is born in most cases from the age of 16, when the pupils mostly leave school. We believe that the illustrated situation should be resolved at the legislative level as soon as possible. Examples of law enforcement practice indicate that judges increasingly recognize bullying as a criminal offense, prejudging the legislator. The research paper describes the judgements of the Ukrainian courts that oblige law enforcement agencies to enter information about the facts of bullying to the Unified Register of Pre-trial Investigations. In view of the above, it is proposed to enshrine corpus delicti of "bullying" in the Criminal Code of Ukraine. Such a proposal meets the requirements of the present time and will help protect the rights of victims of school bullying. The fact that corpus delicti of the criminal offense will be different from corpus delicti of the administrative offense enshrined in Article 173-4 of the Code of Ukraine on Administrative Offenses "Bullying (Harassment) of a Participant in the Educational Process". ; У статті досліджено соціальну та кримінально-правову характеристику такого явища, як «булінг». У результаті ускладнення ситуації в соціально-політичній, економічній, освітній та інших сферах суспільного життя рівень насильства в суспільстві нині збільшився в декілька разів. Підлітки є найбільш вразливою категорією суспільства. Оскілки саме в так званому перехідному віці активно формуються власна система сприйняття світу, система цінностей та пріоритетів, то діти переймають різні моделі поведінки дорослих, і, на жаль, насильство стає однією з таких моделей. Однією з найпоширеніших проблем у дитячому середовищі сьогодні є булінг, який прийнято розглядати як небажану агресивну поведінку дітей шкільного віку, що призводить до цькування дитини іншою дитиною або групою дітей з метою приниження, залякування та демонстрації сили. Проведене дослідження свідчить, що булінг – це явище, яке вже давно перестало бути суто адміністративно-правовим, і нині воно підпадає під кримінально-правові характеристики через те, що його наслідками часто стають тілесні ушкодження, моральні страждання, тобто наслідки, які містяться у складах кримінальних правопорушень. На жаль, «деякі жерти знущань настільки страждають, що закінчують або намагаються покінчити з життям самогубством. Буліцид – поняття, яке означає вчинення самогубства жертвами знущань у школі з метою припинення страждань. Детальний аналіз норм Кримінального кодексу України дає можливість зробити висновок, що окремі прояви булінгу знайшли своє відображення у таких складах кримінальних правопорушень, як катування, доведення до самогубства, хуліганство. Приклади правозастосовної практики свідчать про те, що судді все частіше визнають булінг кримінальним правопорушенням, упереджуючи в цьому законодавця. З урахуванням наведеного пропонується закріпити в Кримінальному кодексі України склад кримінального правопорушення «булінг». Така пропозиція відповідає вимогам часу та сприятиме захисту прав потерпілих від шкільного цькування.
The purpose of the study is to reveal the features of the legal technique of criminal law rules formation. In our study, the principles and techniques of formal-logical methodology are used, as well as the structural-functional approach is applied. Identifying cross-sectoral links in lawmaking is based on the functional nature of law in general and regulatory means in particular. In addition, dialectical, system-structural and functional methods, the method of interpretation (applied to the current criminal law rules) are used in the paper. Using the formal-legal method, the relationship between the content and form of criminal law rules with the use of legal techniques is traced. Scientific novelty lies in the theoretical understanding and delineation of legal techniques for the formation of criminal law. It is shown that in addition to defects in legal definitions and constructions, there are often conflicts between textually enshrined rules of law. The coordination of actions on the part of law-making bodies adopting by-laws and on the part of the parliament, which should take into account the needs of development and concretization of the provisions of the law in the future, is substantiated.In fact, outside of scientific knowledge at this stage, there is a huge area of legal technology, associated with its features in various fields of law. Obviously, the legal technique in each area has its own specifics. Identification and analysis of factors that cause technical and legal shortcomings improves the quality and efficiency of lawmaking. This does not seem to be enough, because there is no single systematic understanding of the situation in lawmaking in general as well as in criminal law field in particular.It is necessary to direct the technical and legal assessment to eliminate specific shortcomings of system-forming factors in particular. The imperfection of legal acts is a constant source of insufficiently thought-out law-making decisions.As a result of the research, it is argued that in the process of adopting a law-making decision in the field of criminal law, it is necessary to proceed, first of all, from their expediency, objective necessity. It is necessary to take into account the assessment of the consequences arising from the implementation of the rule of law, in particular, how they will affect such processes as latency, corruption, recidivism, as well as the disclosure of their crimes. It is argued that from a technical and legal point of view, it is necessary to make a scientific foresight of the expected positive and negative consequences that arise as a result of issuing a certain law-making decision. The results of the study can be used in lawmaking to improve the quality and effectiveness of criminal law, as well as to reform the Criminal Code of Ukraine. ; Метою дослідження є розкрити особливості юридичної техніки формування норм кримінального права. У нашому дослідженні використано принципи і прийоми формально-логічної методології, а також застосовано структурно-функціональний підхід. Виявлення міжгалузевих зв'язків у правотворчості побудоване на функціональній природі права в цілому і регулятивних засобах нормативно-правових актів зокрема. Крім того, в роботі отримали застосування діалектичний, системно-структурний і функціональний методи, метод інтерпретації (в застосуванні до чинних норм кримінального права). За допомогою формально-юридичного методу простежено взаємозв'язки між змістом і формою норм кримінального права зі застосуванням юридичної техніки. Здійснено теоретичне осмис-лення та окреслено юридичну техніку формування норм кримінального права. Показано, що, крім дефектів правових дефініцій та конструкцій, нерідко трапляються колізії між текстуально закріпленими нормами права. Обґрунтовано узгодження дій з боку право-творчих органів, що приймають підзаконні нормативно-правові акти та з боку парламенту, який має враховувати потреби розвитку і конкретизації положень закону в майбутньому. У результаті дослідження аргументовано, що у процесі вироблення правотворчого рішення в галузі кримінального права варто керуватися перш за все їх доцільністю, об'єктивною необхідністю. Треба враховувати оцінку наслідків, що виникають в результаті реалізації норм права, зокрема, як вони впливатимуть на такі процеси, як латентизація, коруп-ціогенність, рецидивність злочинності, а також на розкриття, передбачених ними злочинів. Аргументовано, що з техніко-юридичного погляду доцільно робити науковий прогноз очікуваних позитивних та негативних наслідків, які виникають у результаті видання певного правотворчого рішення. Результати дослідження можуть бути використані у право-творчості для підвищення якості та ефективності кримінального законодавства, а також для реформування Кримінального кодексу України.
Іn the article the author investigates the institute of mediation, which acquires its development not only in civil and commercial proceedings, but also in criminal proceedings and is a manifestation of the concept of restorative justice. As a confirmation of the relevance of the research topic, judicial statistics of consideration of materials of criminal proceedings on the basis of agreements by courts of first instance are given, which confirms the necessity and importance of such a legal institution.The norms of international normative legal acts, where the institute of mediation was embodied, are analyzed. Also are considered the main provisions on the application of agreements in the criminal procedure legislation of Ukraine. It was stated that mediation is possible within the framework of the conciliation agreement.The opinion is expressed that the application of the relevant legal institution in criminal proceedings will facilitate the adoption of a special law «Mediation» and analyzed the lawmaking in this area. The next step could be amending the criminal procedure legislation of Ukraine. Number of issues need to be clarified, including: what will be the status of a mediator in criminal proceedings (his rights and responsibilities, guarantees of independence, etc.); what is the procedural order of mediation; what is the procedural form of completion of the mediation procedure and some others.Particular attention is paid to the definition of a person who can be a mediator and his legal status in criminal proceedings. The positions of scientists who believe that mediators can be prosecutors, lawyers and psychologists are considered. The opinion was expressed regarding the acquisition of special education by such a person and the acquisition of relevant knowledge and skills.It is concluded that the punitive-repressive approach to counteracting the commission of crimes is not effective enough, so it is necessary to introduce mechanisms of alternative conflict resolution procedures, in particular, medi-ation. At the same time, implementation of mediation requires further scientific reflection and discussion, as well as the political will of the legislator to adopt the relevant law and amend the criminal procedure legislation. ; У статті автором досліджено інститут медіації, який набуває свого розвитку не тільки в межах цивіль-ного, господарського судочинства, а й в кримінальному провадженні та є проявом концепції відновного правосуддя. Як підтвердження актуальності теми дослідження наведено судову статистику розгляду матері-алів кримінального провадження на підставі угод судами першої інстанції, яка підтверджує необхідність та важливість такого правового інституту.Проаналізовані норми міжнародних нормативно-правових актів, де знайшов своє втілення інститут меді-ації. Також розглянуто основні положення щодо застосування угод в кримінальному процесуальному зако-нодавстві України. Констатовано, що саме в межах угоди про примирення можливе застосування медіації. Висловлено думку про те, що застосування відповідного правового інституту в межах кримінального провадження сприятиме прийняття спеціального закону «Про медіацію» та проаналізовано законотворчість в цьому напрямку. Наступним кроком могло б стати внесення змін до кримінального процесуального зако-нодавства України. При цьому потребують з'ясування ряд питань, серед яких: яким буде статус медіатора у кримінальному провадженні (його права та обов'язки, гарантії незалежності і т.д.); який процесуальний порядок проведення медіації; яка процесуальна форма завершення процедури медіації та деякі інші.Окрема увага приділяється визначення особи, яка може бути медіатором та його правового статусу в кримінальному процесі. Розглянуто позиції науковців, які вважають, що медіаторами можуть бути прокуро-ри, адвокати та психологи. Висловлено думку щодо здобуття такою особою спеціальної освіти та набуття відповідних знань та вмінь.Зроблено висновок про те, що карально-репресивний підхід щодо протидії вчиненню злочинів не є до-статньо ефективним, тому необхідно впроваджувати механізми альтернативних процедур врегулювання конфліктів, зокрема, медіацію. В той же час її впровадження потребує подальшого наукового осмислення та дискусії, а також політичної волі законодавця для прийняття відповідного закону та внесення змін до кримі-нального процесуального законодавства.
