Problem setting. Legal support for the processes that have been observed in the political and socio-economic fields of Ukraine over the last decade have become increasingly relevant and urgent. The scrupulous and compulsory observance and implementation of the norms adopted in a civilized society is the key to the stable development of the state, therefore the consolidation of efforts to strengthen the rule of law and order is a paramount task of all the state and governmental institutions. Implementation by the state of administrative functions in the field of justice is the vector that determines the course and direction of actions for the development of Ukrainian statehood.Recent research and publications analysis. Such researchers as I. Artemenko, N. Zhelezniak, Y. Melnyk, I. Mykulets, L. Nalyvaiko, I. Onopchuk, S. Thurin et al. in their scientific works raised the questions dedicated to the main principles of public administration in the field of justice. However, their publications mainly reflect only certain aspects of the concept of justice, legal status of justice bodies and peculiarities of public administration in the mentioned area, while complex approach to understanding of the problems of organizational and legal principles of public administration in the field of justice of Ukraine is not disclosed.Highlighting previously unsettled parts of the general problem. The purpose of this article is to evaluate theoretical approaches to understanding the essence of organizational and legal foundations of public administration in the field of justice of Ukraine, to analyze the activities and powers of the main authorities in the field of justice and to present proposals for development of Ukrainian justice in general.Paper main body. The article considers theoretical approaches to understanding the essence of organizational and legal principles of public administration in the field of justice of Ukraine. It is determined that administration in the field of justice should be understood as activities aimed at fulfillment of tasks of organizational nature for exercise of rights and interests of legal entities, individuals and the state, as well as the task of strengthening the law and order in the country. Specific features inherent in the administration of justice are considered, their characteristics are presented.Emphasis is placed on the fact that one of the peculiarities of justice is the plurality of objects in this area of administration. Such objects of justice as judicial institutions, notary offices, civil registration bodies, forensic institutions and the bar are presented for consideration. It was also notes, that they all have different legal status, differ in their purpose and nature of competence.Attention was focused on the organizational aspect of the activities of the judicial bodies, since in most cases they address organizational issues. It is argued that this feature is characterized by the fact that the vast majority of judicial bodies in the course of their activity is independent and carry out actions that are advisory.It was substantiated that the organizational aspect of functioning of judicial bodies is closely related to the legal one, since statutory instruments are the basis for functioning of institutions providing law and order in the society. It was noted that the main purpose of administration in the field of justice is to ensure the legality, organization of protection of rights and legitimate interests of individuals and legal entities, as well as the state. Administrative and legal regulation in the field of justice is carried out on the basis of the following statutory instruments: the Laws of Ukraine "On Notaries", dated September 02, 1993, "On the Bar and Advocacy", dated December 19, 1992, "On State Registration of Civil Status Acts", dated July 01, 2010, "On Bodies and Persons Who Perform the Enforcement of Court Decisions and Decisions of Other Authorities", dated June 02, 2016, Regulation on the State Migration Service of Ukraine, dated September 20, 2014, etc.The interrelation between organizational and legal aspects of the public administration in the field of justice is presented; it is noted that this interrelation can be traced on the example of the Ministry of Justice of Ukraine. It is noted that, along with the Ministry of Justice, State Archive Service of Ukraine, State Executive Service of Ukraine, State Penitentiary Service of Ukraine, State Registration Service of Ukraine, State Service of Ukraine for the Protection of Personal Data also belong to the system of entities in the field of justice of Ukraine. It is noted that the Constitution stipulates that the judicial bodies of Ukraine have a prominent place among the law enforcement agencies of the state.The basic powers of the entities in the field of justice are considered. It is noted that in practice in practice, there is a distinction between two categories: judicial bodies and bodies of the Ministry of Justice of Ukraine. It is substantiated that the bodies of the Ministry of Justice of Ukraine are a part of the bodies of justice, as these bodies as it is much wider in structure and in the range of authorities.Conclusions of the research and prospects for further studies. It is argued that the priorities for the development of the Ukrainian justice today are the following: formation of a new, higher level of legal awareness and legal culture of citizens; reforming of the judicial system to ensure the accessibility of justice and the effectiveness of judicial protection; reforming of the criminal justice and the criminal executive system; creating legal frameworks for prevention and counteraction to corruption; ensuring the efficiency of the enforcement of court decisions; improvement of the system of protection of state interests in the courts of Ukraine; formation of a free legal aid system.Perspective of further research in this area is represented by the study of institutional aspects of public administration in the field of justice and priorities for development of the institutional sector. ; Розглянуто теоретичні підходи до розуміння сутності організаційно-правових засад державного управління у сфері юстиції України. Представлено авторське трактування сутності управління у сфері юстиції. Розглянуто особливі риси юстиції у контексті здійснення управлінських дій та подано їх характеристику. Обґрунтовано, що здійснення управлінських дій у сфері юстиції передбачає виконання їх органами, які уповноважені від імені держави реалізовувати відповідні функції, зважаючи на багатооб'єктність у цій галузі управління, та представлено перелік об'єктів юстиції. Розглянуто взаємозв'язок організаційного та правового аспектів у контексті державного управління у сфері юстиції. Запропоновано пріоритетні напрями розвитку української юстиції на перспективу.

The article deals with specific controversial issues concerning features of using videoconferencing in criminal proceedings in general as well as at its specific stages; also own conclusions and propositions are justified which are aimed at further development of criminal procedural legislation of Ukraine with the regard to the questions raised. The essence, meaning, advantages, current state, and perspectives of using videoconferencing in criminal proceedings of Ukraine and the area of international cooperation among the states in criminal justice are examined. The state of legal regulation of using videoconferencing in criminal proceedings is analyzed. Code of Criminal Procedure of Ukraine provides for using videoconferencing both in criminal proceedings of Ukraine and criminal proceedings with a foreign element. Based on the analysis of grounds and procedure of video-conferencing features of its usage both in criminal proceedings of Ukraine and in the area of international cooperation among the states in criminal justice are identified. Videoconferencing can be used based on the decision of an investigator, prosecutor, investigative judge, or court in each case taking into account circumstances of criminal proceedings and subject to grounds provided for by the Code of Criminal Procedure of Ukraine. Before the start of investigative (search) action or court session using video-conferencing one shall ensure that nothing prevents a person from giving testimony, making motions, providing evidence, etc. This fact is essential for the admissibility of evidence used in criminal proceedings obtained using videoconferencing. Conducting requested procedural actions by video-conferencing ensure that an accused person, a victim, and other participants have an opportunity to express themselves on the raised issues, make arguments aimed to rebut the conclusions of the opposing party, provide evidence and make motions during pre-trial investigation or trial. Specificities of conducting a questioning using videoconferencing in the area of international cooperation as well as advantages of obtaining testimony from individuals put into custody or serving a sentence in a foreign state using video-conferencing compared to traditional means are formulated. The issue of interrelation between videoconferencing and principles of criminal proceedings is examined and it is showed that using videoconferencing is fully consistent with principles of criminal proceedings. Videoconferencing is one of the procedural forms of using information technologies in criminal proceedings and is used to conduct an action, participants of which are geographically separated one from another and thus communication among them are conducted using the communication technologies that support realtime image and voice transmission. ; У статті розглядаються окремі дискусійні питання, пов'язані з особливостями використання відеоконференції у кримінальному провадженні в цілому та на окремих його стадіях, а також обґрунтовуються власні висновки та пропозиції, спрямовані на подальше вдосконалення кримінального процесуального законодавства України в частині розглянутих питань. Досліджено сутність, значення, переваги, сучасний стан та перспективи використання відеоконференції у кримінальному провадженні України та сфері міжнародного співробітництва держав у кримінальному судочинстві. Проаналізовано стан правового регулювання використання відеоконференції у кримінальному провадженні. Кримінальний процесуальний кодекс України передбачає використання відеоконференції, як у кримінальному провадженні України, так і у кримінальних провадженнях ускладнених іноземним елементом. Проаналізовано підстави, процесуальний порядок та сформульовано особливості використання відеоконференції у кримінальному провадженні України та сфері міжнародного співробітництва держав у кримінальному судочинстві. Відеоконференція може застосовуватися за рішенням слідчого, прокурора, слідчого судді або суду у кожному конкретному випадку з урахуванням обставин кримінального провадження та наявності підстав передбачених Кримінальним процесуальним кодексом України. Перед початком проведення слідчої (розшукової) дії або судового засідання за допомогою відеоконференції необхідно переконатися, що ніщо не перешкоджає особі вільно давати показання, заявлятиклопотання, надавати докази тощо. Ця обставина має суттєве значення для допустимого використання в кримінальному провадженні доказів, отриманих за допомогою відеоконференції. Проведення запитуваних процесуальних дій шляхом відеоконференції забезпечує обвинувачуваному, потерпілому та іншим учасникам можливість під час досудового розслідування або судового розгляду за умови дотримання змагальності висловлюватися з розглянутих питань наводити доводи для спростування висновків протилежної сторони, надавати докази та заявляти клопотання. Сформульовано особливості проведення допиту за допомогою відеоконференції у сфері міжнародної правової допомоги, а також переваги одержання показань від осіб, які тримаються під вартою або відбувають покарання в іноземній державі за допомогою відеоконференції в порівнянні з традиційними способами їх одержання. Розглянуто питання про співвідношення відеоконференції із засадами кримінального провадження та доведено, що застосування відеоконференції цілком узгоджується із засадами кримінального провадження. Відеоконференція є однією із процесуальних форм використання інформаційних технологій у кримінальному провадженні та використовується для позначення заходу, учасники якого територіально віддалені один від одного, а тому спілкування між ними відбувається з використанням технічних засобів зв'язку, що забезпечують передачу зображення і звуку в режимі реального часу.

The article considers and analyzes in detail the sources of the European Union aimed at ensuring equal and fair treatment of women and men. Such as Convention on the protection of human rights and fundamental freedoms, Universal Declaration of Human Rights, International Covenant on Civil and Political Right, Convention for the Protection of Human Rights and Fundamental Freedoms, European Social Charter. The authors determined that currently in the European Union there is no single approach to the definition of "discrimination", due to the lack of a basic unified source of law, this issue is regulated by both the EU's own acts and well-known international acts. Also, due to the increasing popularity of feminist movements, men experience violations and restrictions in their social and economic rights. Therefore, a study of the decisions of the most influential judicial bodies of the European Union was conducted to establish a common understanding of the concept of "gender discrimination". Ukraine has ratified these international conventions on human rights protection and recognizes their decisions as part of the national legislation of Ukraine.Ukraine has ratified the Convention and its Protocols, as the first part of the Law of Ukraine "On Ratification of the Convention for the Protection of Human Rights and Fundamental Freedoms of 1950, First Protocol and Protocols № 2, 4, 7 and 11 to the Convention" explicitly states that Ukraine fully recognizes "The effect in its territory of Article 46 of the Convention on the recognition and binding without special agreement of the jurisdiction of the Court of Human Rights in all matters concerning the interpretation and application of the Convention. the article examines the general provisions of the institution of appeal regarding exemption from criminal liability. The provisions for obtaining reviewing and resolving issues in the event of the adoption of an application, petition or appeal of procedural decisions, actions or omissions of the investigator of the prosecutor are determined. The elements of control that are established by the current legislation regarding procedural control over the consideration of the complaint are provided. It is proposed to establish procedural grounds regarding the decision to terminate consideration of the complaint. ; в статье рассмотрены общие положения института обжалования относительно освобождения от уголовной ответственности. Определены положения получения, рассмотрения и решения вопросов в случае принятия заявления, ходатайства или обжалования процессуальных решений, действий или бездействий следственного прокурора. Предоставлены элементы контроля, которые установлены действующим законодательством относительно процессуального контроля за рассмотрением жалобы. The article defines the essence and content of the principles of openness and transparency in criminal proceeding, connected with criminal proceeding organization, as well as problems of enforcement of named principles in criminal trial procedure. By comparison of the relevant articles of the Criminal Procedure Code of Ukraine and the Law of Ukraine "On the Judiciary and Status of Judges of Ukraine", three intrinsic components of the transparency and openness of criminal justice can be distinguished. Firstly, it is the duty of the court to ensure transparency and openness of court proceedings, which is implemented by placing an announcement on the time, date and place of the court session, allowing the parties to the criminal process to familiarize themselves with the materials of the criminal proceedings, etc. Secondly, it is the right of the parties to a public and open trial, which consists of their rights to vowels and open court proceedings, awareness of the content of the claims and the opposition of the parties, familiarization with the materials of the criminal proceedings, to be heard in the court session, etc. Thirdly, it is the right of those who wish to be present at open court hearings, including the media, to disseminate and receive information on the activities of the court. In this regard, the subject of publicity in the criminal proceedings is not only information on the progress of the trial and its final results, but also information on the interim results of such activities. Also, the open consideration of cases enables individuals to directly familiarize themselves with the work of the court, and this increases his responsibility for the legitimate and correct resolution of the problem. In particular, it contributes to the reduction of the subjectivity of judges and allows all those who wish to ensure compliance with the legal procedures established in the procedural law of the case. The main scientific achievements of foreign and domestic legal scholars in the field of research of the functions of rights in general are analyzed in order to reveal the concept of the functions of the people's right to the formation of justice and the mechanism of their implementation. It is pointed out that in the legal literature there is almost no legal construction of the right of citizens to form (participate) in the formation (organization) of the judiciary. Therefore, in view of the above, the concept of the right of the people to form and implement justice through the prism of political rights, which are the guideline that promotes the realization of democracy, has been clarified. This clarifies the meaning and essence of political rights, in particular, the right to elect power and the right to participate in government. Emphasis is placed on the fact that the Constitution of Ukraine proclaims the fundamental principle of a democratic state: "The bearer of sovereignty and the only source of power in Ukraine is the people." This principle provides an opportunity for the people to independently form a vision of their future and the future of the state, to determine the powers and composition of public authorities, which are responsible for meeting the expectations of the people, and to control their activities is difficult. It is established that society controls the functioning of the court not only through the participation of citizens in the judicial process as jurors and lay judges, but also through the mechanisms of election of judges and their recall. That is, through the exercise of the right to form the judiciary and administer justice. Therefore, given that the formation of the judiciary by the people is carried out through elections, we consider it necessary to fully clarify the content and type of functions of democracy in the exercise of such a right, to explore the functions of elections in general. ; Проаналізовано основні наукові здобутки зарубіжних та вітчизняних вчених-юристів у сфері дослідження функцій прав взагалі для того, щоб розкрити поняття функцій права народу на формування здійснення правосуддя та механізму їх реалізації. Вказується, у юридичній літературі майже відсутня юридична конструкція права громадян на формування (участь) у формуванні (організації) судової влади. А тому з огляду на зазначене, з'ясовано поняття права народу на формування та реалізацію правосуддя через призму політичних прав, які є тим орієнтиром, що сприяє реалізації народовладдя. Для цього з'ясовано значення та сутність політичних прав, зокрема, права обирати владу та права брати участь в управлінні держави. Акцентовано увагу на тому, що Конституцією України проголошено основоположну засаду демократичної держави: «Носієм суверенітету і єдиним джерелом влади в Україні с народ». Цей принцип передбачає можливість народу самостійно формувати бачення свого майбутнього і майбутнього держави, визначати повноваження і склад органів державної влади, на які покладається реалізація очікувань народу, та контролювати їх діяльність складно. Встановлено, суспільство контролює функціонування суду не тільки через участь громадян у процесі судочинства в якості присяжних і народних засідателів, але і через механізми виборності суддів та відкликання їх з посади. Тобто через реалізацію права на формування судової влади та здійснення правосуддя. А тому з огляду на те, що формування народом судової гілки влади здійснюється шляхом виборів, вважаємо за необхідне для біль повного з'ясування змісту та виду функцій народовладдя в ході реалізації такого права, дослідити також функції виборів взагалі.

Наукову статтю присвячено дослідженню питань підвищення якості підготовки фахівців у сфері кримінальної юстиції. Обґрунтовується, що інтеграція України у європейський правовий простір, урізноманітнення форм і способів кримінальної протиправної діяльності, а також інституційна перебудова судової та правоохоронної системи ставлять нові вимоги до підготовки фахівців у сфері кримінальної юстиції. Обосновывается, что интеграция Украины в европейское правовое пространство, разнообразие форм и способов уголовной противоправной деятельности, а также институциональная перестройка судебной и правоохранительной системы ставят новые требования к подготовке специалистов в сфере уголовной юстиции. Формулируются предложения по усовершенствованию магистерских программ подготовки юристов на примере проекта CRIMHUM. ; The scientific article is devoted to the study of issues of improving the quality of training of specialists in the field of criminal justice. It is justified that the integration of Ukraine into the European legal space, the variety of forms and methods of criminal illegal activities, as well as the institutional restructuring of the judicial and law enforcement system impose new requirements for the training of specialists in the field of criminal justice. The main problems of master's programs in institutions of higher legal education are formulated, which include dominance of the theoretical component over the practical one, lack of professional orientation, as well as limited study of national legislation. The results of the survey of graduates of leading domestic institutions of higher legal education on the improvement of master 's programs, which show the requests and needs of applicants for higher legal education, are analyzed. Proposals are being formulated to improve master 's programs for the training of lawyers using the example of the international project CRIMHUM.

The Article discloses the essence of the problem concerning the delimitation of the political and criminal responsibility for the further development of the public administration. It has been revealed that differences in the development processes of relations in the matter of the political responsibility are disclosed in terms of the quality of democracy, as well as redistribution of the responsibility between the central, regional and local levels of the administration. In different countries, it finds various manifestations: failure to comply with standards of democracy and abusing the criminal responsibility; attempts to avoid the criminal prosecution for the abuse of power being limited to the political responsibility; raising the level of the responsibility, in particular, criminal one, at the subnational level of the power organization. In the broad sense, all the manifestations confirm the conclusion on the «responsibility crisis» aggravation in the conditions of the democratic system of values. The growing importance of the political responsibility in the representative democracy and development of the regional and local democracy are substantiated. It is noted that the principles of the political and legal system of the state should create the basis for the separation of the political and criminal responsibility. First of all, this refers to the Constitution, which is a form of the contract between the state and society; such capacity of the Constitution demonstrates the functioning and maturity of democracy, and respect for the law in the state. The issue of punishment for political mistakes or divergences should be regulated, to a large extent, by procedures of the political accountability. The important task in this regard is to ensure the clear regulation of the accountability procedures of power entities for their activities. The general principles of law recognized by civilized nations are one of the main sources of international criminal justice. Their application ensures the flexibility and transparency of international criminal courts and tribunals, which allows them to respond to challenges that arise in the process of a decision-making. At the same time, in the process of their application, the problem of their interpretation often arises. An effective way for the interpretation is to refer to national legal systems. This is the most logical way, because most of the general principles of law were created in the national legal context and their application at the international level is inextricably linked with a correct understanding of their primary meaning. The articles examine examples of the establishment of international criminal courts and tribunals in national legal systems to interpret general principles of law. It is determined that in the process of interpreting is used a wide range of sources: national legislation, case law, doctrine of national law, etc. It is emphasized that within such an application it is very important to ensure the geographical diversity and representation of different legal systems. It can be concluded that the interpretation of general principles of law through recourse to national legal systems is a widely used practice in the field of international criminal justice. International criminal courts and tribunals apply this way both to confirm the existence and application of general principles and to establish their content. Articles suggests that a condition for such an interpretation is comparative approach, that guarantees their universal character of a general principles as sources of law. The application of such an interpretation indicates that the general principles of law are generally accepted as sources of criminal and international criminal law and officials, in a way, with a corresponding link between them. ; Загальні принципи права, визнані цивілізованими націями, є одним з основних джерел міжнародної кримінальної юстиції. Їх застосування забезпечує гнучкість та прозорості діяльності міжнародних кримінальних судів та трибуналів, дозволяє їм ефективно реагувати на виклики, які з'являються під час ухвалення рішень. Водночас у процесі застосування загальних принципів права дуже часто постає проблема їх тлумачення. Ефективним шляхом здійснення тлумачення є звернення із цією метою до національних правових систем. Такий шлях виглядає і найбільш логічним, оскільки більшість загальних принципів права з'явилися саме в національному правовому контексті, їх застосування на міжнародному рівні нерозривно пов'язане із правильним розумінням їхнього первинного значення. У статті розглядаються приклади зі звернення міжнародних кримінальних судів та трибуналів до національних правових систем для тлумачення загальних принципів права. Зазначається, що з метою тлумачення використовується широке коло джерел: національне законодавство, судова практика, доктрина національного права тощо. Наголошується, що в такому зверненні дуже важливе забезпечення географічної різноманітності та представництва різних правових систем. Робиться висновок, що тлумачення загальних принципів права через звернення до національних правових систем є широко застосовуваною практикою у сфері міжнародної кримінальної юстиції. Міжнародні кримінальні суди і трибунали звертаються як у цілях підтвердження існування та застосування загальних принципів, так і з метою встановлення їхнього змісту. У статті наголошується, що важливою умовою здійснення такого тлумачення є дотримання компаративістських підходів, що є гарантією їхнього універсального характеру як джерела права. Застосування такого тлумачення є свідченням того, що загальні принципи права є загальновизнаними джерелами кримінального та міжнародного кримінального права, слугують зв'язковою ланкою між ними.

The article is devoted to the study of certain aspects of the functioning of the juvenile justice bodies of the Federal Republic of Germany, which carry out the prevention of juvenile delinquency. In particular, the police, probation services, educational institutions, judiciary, employment services and other organs of juvenile justice of the Federal Republic of Germany. The author has studied and analyzed modern scientific literature, original results of scientific research and the legal framework of a foreign language country in the original language. The basic principles of work and peculiarities of functioning of each separate subject of juvenile delinquency prevention in the Federal Republic of Germany are analyzed, as well as the expediency and possibility of harmonizing the work of juvenile justice bodies in Ukraine and the Federal Republic of Germany. The necessity of close cooperation and more thorough coordination of work between state authorities, local self-government and youth organizations, volunteer movements, private sector entities, and other non-state associations were substantiated. Studying the experience of working with minors in the relevant structures of Germany is especially important for our country towards the introduction of European standards in the field of juvenile justice, which is a priority within the framework of interaction between Ukraine and the EU, especially taking into account in the implementation of modern trends of criminal-law and criminological policy on the reform of the juvenile justice bodies of Ukraine. The importance of work of the juvenile justice bodies of the Federal Republic of Germany is emphasized in the fundamental idea of accomplishment, which is embodied in the special juvenile criminal legislation of the Federal Republic of Germany, and in its use by the relevant authorities in practice. ; Статья посвящена исследованию отдельных аспектов функционирования органов ювенальной юстиции ФРГ, осуществляющих предупреждение преступности несовершеннолетних, – полиции, службы пробации, образовательных учреждений, судебных органов, служб занятости и других органов. Проанализированы основные принципы работы и особенности функционирования каждого отдельного субъекта предупреждения преступности несовершеннолетних в ФРГ, а также целесообразность и возможность гармонизации работы органов ювенальной юстиции в Украине и ФРГ. Обоснована необходимость тесного сотрудничества и тщательной координации работы между органами государственной власти, местного самоуправления и молодежными организациями, волонтерскими движениями, субъектами частного сектора и другими негосударственными объединениями. Изучение опыта работы с несовершеннолетними соответствующих структур ФРГ особенно важно для нашего государства на пути внедрения европейских стандартов в сфере ювенальной юстиции, которое является приоритетным в рамках взаимодействия между Украиной и ЕС. Подчеркнуто значение в работе органов ювенальной юстиции ФРГ основополагающей идеи воспитания, которая находит свое воплощение в специальном ювенальном уголовном законодательстве ФРГ. ; Статтю присвячено дослідженню окремих аспектів функціонування органів ювенальної юстиції ФРН, які здійснюють запобігання злочинності неповнолітніх, зокрема поліції, служби пробації, освітніх установ, судових органів, служб зайнятості та інших органів. Проаналізовано основні засади роботи та особливості функціонування кожного окремого суб'єкта запобігання злочинності неповнолітніх у ФРН, а також доцільність і можливість гармонізації роботи органів ювенальної юстиції в Україні та ФРН. Обґрунтовано необхідність тісної співпраці та ретельнішої координації роботи між органами державної влади, місцевого самоврядування та молодіжними організаціями, волонтерськими рухами, суб'єктами приватного сектору та іншими недержавними об'єднаннями. Вивчення досвіду роботи з неповнолітніми відповідних структур ФРН є особливо важливим для нашої держави на шляху впровадження європейських стандартів у сфері ювенальної юстиції. Підкреслено значення у роботі органів ювенальної юстиції ФРН фундаментальної ідеї виховання, яка знаходить своє втілення у спеціальному ювенальному кримінальному законодавстві ФРН.
