Раздел "Международные отношения" ; После окончания «холодной войны» и распада Советского Союза в отношениях между Российской Федерацией и Организацией Североатлантического договора произошли значительные изменения. В 1991—1993 гг. со стороны Москвы и Брюсселя предпринимались активные шаги, направленные на установление тесных контактов друг с другом как на политическом, так и на военном уровнях. Совет Североатлантического сотрудничества, созданный в рамках НАТО в декабре 1991 г., способствовал данному сближению. ССАС выступал в качестве форума, на котором Россия наравне со странами — участницами альянса участвовала в обсуждении и принятии решений по важнейшим международным вопросам. Одной из главнейших задач российско-натовских консультаций было стремление альянса добиться от России выполнения обязательств по международным договорам в области разоружения, взятых в свое время руководством СССР. Парламент Российской Федерации ратифицировал ряд договоров: ОВСЕ, СНВ-1, СНВ-2. Вступление в силу Договора об обычных вооруженных силах в Европе привело к возникновению новой формы сотрудничества между Россией и Североатлантическим альянсом, которая проявлялась в проведении военных инспекций стран НАТО на территории России и участии российских военных экспертов в инспекциях на территории стран — участниц альянса. Военные контингенты НАТО и Российской Федерации участвовали в совместных военных учениях, а также в военных операциях по поддержанию мира и безопасности в Югославии. Между Россией и Североатлантическим альянсом осуществлялся постоянный обмен военными специалистами и преподавателями высших учебных заведений. Значительно возросло количество визитов высокопоставленных лиц НАТО в Москву, а руководства России — в Брюссель. Вместе с тем, в отношениях между Россией и НАТО существовал ряд противоречий. Так, например, Российская Федерация выступала категорически против одностороннего военного вмешательства альянса в разрешение югославского конфликта, а также против возможного расширения НАТО на восток. Москва добивалась изменения некоторых положений Договора об ОВСЕ. Определенная степень напряженности существовала по вопросу вывода российских войск из Прибалтики. = After the termination of the «cold war» and disintegration of the Soviet Union the relations between the Russian Federation and the North Atlantic Treaty Organization have undergone significant changes. In 1991—1993 active steps were undertaken on the part of Moscow and Brussels, directed at the establishment of close contacts with each other, both on the political, and military levels. The North Atlantic Cooperation Council, created within the framework of the NATO in December 1991, promoted this rapprochement. The NACC represented itself as a forum where Russia on equal terms with other countries — members of the Alliance took part in discussions and decision-making on major international issues. One of the main problems of Russia — NATO consultations was aspiration of the Alliance to get Russia to fulfil its obligations under the international treaties in the field of disarmament, which had been assumed by the leadership of the USSR in its time. The Parliament of the Russian Federation ratified a number of treaties: CFE, START-1, and START-2. Coming into force of the Treaty on Conventional Armed Forces in Europe has led to the emergence of a new form of cooperation between Russia and the North Atlantic Alliance. It manifested itself in carrying out military inspections of the NATO countries on the territory of Russia, and the participation of the Russian military experts in inspections on the territory of countries-participants of the Alliance. Military contingents of the NATO and the Russian Federation took part in joint military exercises, and in military operations on peacekeeping in Yugoslavia. Constant exchange of military experts and teachers of higher educational institutions went on between Russia and the North Atlantic Alliance. The number of visits of high-ranking officials of the NATO to Moscow, and the of leadership of Russia to Brussels considerably increased. At the same time, there was a number of contradictions in relations between Russia and the NATO. So, for example, the Russian Federation strongly opposed unilateral military intervention of the Alliance in the settlement of the Yugoslavian conflict, and also a possible expansion of the NATO to the East. Moscow tried to achieve amendments of some provisions of the Treaty on Conventional Armed Forces in Europe. A certain degree of tension existed on the question of the withdrawal of the Russian troops from the Baltic states.

Раздел "Международные экономические отношения" ; Migration is defined as the movement of people across some territorial borders. It should be noted that one can differentiate as to the status of the borders crossed (internal and external), the duration (permanent, temporary, seasonal, fluctuation migration) and as to the reasons which determine migration (voluntary and forced migration). The problem of forced migration is rooted in the past and remains topical now. The world has not become much more humane and wars still remain the main reason of forced migration. However, refugees emerged not only during the wars. Frequent plague epidemics forced whole towns and regions to flee where they could to wait till the epidemic was over. Nowadays ecological catastrophes have come to replace epidemics and natural disasters as a reason for the forced outward movement of people. Whatever the reasons for forced migration may be, along with the desire to survive migrants strive to raise their standard of living as well. This is proved by the special attraction some countries present for migrants. These are such countries as the USA, Canada, Australia, the countries of the Middle East, the developed countries of Western Europe. The Russian Federation has not kept aloof either. After the disintegration of the USSR Russia has turned into one of the centres for migration. On the one hand, hundreds of thousands of the former Soviet citizens left it to take up for permanent residence in Israel and Germany. On the other, there are over 1 million of foreigners on its territory at any given time, most of these people becoming aliens after the collapse of the Soviet Union. It should be also noted that legislation in the CIS countries on forced migration urgently needs improving. This is confirmed by the fact that a number of republics and regions of Russia, while subjects of the state, had to adopt their own normative acts in this sphere to compensate temporarily for the lack of federal legislation. The consequences of forced migration are ambivalent. They can have both a positive and a negative impact on the host country's economy.

Раздел "Международные отношения" ; The war in Iraq caused a political and diplomatic crisis in the modern system of transatlantic relations. The US military operation in Iraq, undertaken without UN consent, came to be one of the reasons for the aggravation of relations between the US and the EU. US military action in Iraq divided the European countries into the US allies and the US opponents with regard to the settlement of the Iraq issue. The countries which sided with the US in their policy in Iraq were Great Britain, Portugal, Denmark, the Netherlands, Italy and Spain as well as some countries of Central and Eastern Europe which at that time were candidates to join the EU (Poland, Hungary, the Czech Republic). France, Germany, Sweden, Finland, Austria and Ireland were opposed to the military solution. The position of the European countries notwithstanding, the US and Great Britain started their military actions against Saddam Hussein's regime on March 20, 2003 which caused a serious crisis in transatlantic relations. The controversy among the European countries on the Iraq issue in the first half of 2003 generated some grave doubts concerning the preservation of NATO as an effective instrument of collective defence and security and also concerning future transatlantic relations. But mid-2003 saw the emergence of the trend for healing the transatlantic fift, because the problems of rebuilding of Iraq after the war came to the foreground. Thus the Iraq campaign carried out by the US contrary to the position of the European anti-terrorist allies did not lead to a breakdown in the relations with its European opponents, in particular, with France and Germany. The UN Security Council in fact legitimized the occupation of Iraq and opened up the way for international cooperation in rebuilding Iraq. The Iraq conflict revealed some deep-rooted differences between the EU and the USA and showed the absence of a common European policy towards the USA. The main reasons for transatlantic differences are a gap between the EU and the US in military power and the divergence in their strategic cultures. But these differences are not irreconcilable, because these countries share a common system of basic social values, cultural traditions, an indissoluble network of economic ties and interdependence in security. The wish for collaboration still prevails in transatlantic relations. The Iraq crisis, which most seriously strained the relations between the USA and their European partners did not lead, however, to the undermining of transatlantic solidarity.

Автором предпринята попытка разобраться в юридической природе Хартии основных прав ЕС, принятой в 2000 г., сопоставить ее положения с нормами Европейской конвенции о защите прав человека и основных свобод 1950 г. Особое внимание уделено исследованию места и роли Европейского союза в существующей системе международной защиты прав и свобод человека, а также выявлению и последующей оценке прав и свобод первого (гражданские и политические) и второго (экономические, социальные и культурные) поколений, закрепленных в праве ЕС, степени и объему их правовой регламентации. Акцентируется внимание на роли институтов (органов) ЕС, особенно Европарламента, а также ряда специализированных органов (Агентство по основным правам и др.) в процессе формирования в рамках Европейского союза самостоятельной региональной системы защиты прав и свобод человека. Выявлены и проанализированы положения Договора 2004 г., устанавливающего Конституцию для Европы, затрагивающие вопросы прав человека. = The article focuses on identification and legal evaluation of an integral set of norms in the sphere of human rights and freedoms currently existing within the European Union. The author attempts to analyze the legal nature of the Charter of Fundamental Rights of the EU adopted in 2000 and to compare it with the norms of the 1950 European Convention on Human Rights. Special attention is paid to the exploration of the role and place of the European Union in the existing system of international protection of human rights and freedoms, as well as to the revealing and the following evaluation of rights and freedoms of the first (civil and political) and second (economic, social and cultural) generations that are fixed in the EU law, and to the level and volume of their legal regulation. The author draws attention to the role of the EU institutions, the European Parliament in particular, as well as of a number of special bodies (the Agency for Fundamental Rights, etc.) in the process of formation of an independent regional system of human rights and freedoms protection within the EU. The author also revealed and analyzed the provisions of the 2004 Treaty fixing European Constitution that include human rights issues.

Раздел "Международное право" - рубрика "Сравнительное правоведение" ; Научная статья, основанная на методе сравнительного анализа законодательств различных стран (Беларуси, Германии, России, Украины), определяет субъекты и формы охранной деятельности, наиболее характерные для этих стран. К субъектам деятельности по охране объектов и физических лиц Беларуси автор относит государственные органы (созданные исключительно для осуществления данной деятельности — органы государственной охраны, Департамент охраны Министерства внутренних дел Республики Беларусь, и те, для которых данный вид деятельности не является основным — воинские формирования и военизированные организации, таможенные органы и др.); юридических лиц, имеющих военизированную охрану (например, Белорусскую железную дорогу); юридических лиц, имеющих службы охраны (безопасности) либо работников, в функциональные обязанности которых входит защита объектов или физических лиц от противоправных посягательств и несанкционированного доступа. Исходя из этого автор выделяет организационно-правовые формы, в которых могут организовываться субъекты охранной деятельности: в виде объединений юридических лиц, юридических лиц либо их структурных подразделений. В статье делается вывод о том, что формирование и выбор организационно-правовых форм субъектного состава охранной деятельности зависит от модели экономического развития государства. = Based on comparative analysis of law in different countries (Belarus, Germany, Russia, Ukraine), the article defines the subjects and forms of guarding activity most typical of these countries. According to the author, the subjects implementing the activities in guarding objects and persons are both the state bodies established specially to implement these activities, such as the state guard service, the Department of Guard under the Ministry of Internal Affairs and individuals and state bodies who do not specialize in this area of activity, such as military and militarized units, customs bodies and others; legal entities with their own militarized guard (for example, the Belarusian Railways); entities with protection units which carry out protection of objects or individuals from criminal offences and unauthorized access. On this basis the author points out organizational legal forms for the subjects of guard protection: in the form of unions of legal entities, single legal entities or their structural subdivisions. The article makes a conclusion that formation and choice of organizational and legal form of the subject composition of guard activity depends on the pattern of the state's economic development.

Раздел "Международное право" - рубрика "Право беженцев" ; В статье содержится правовой анализ вторичного законодательства ЕС в сфере убежища, разработанного на основе и с учетом изменений и дополнений, предложенными Амстердамским договором и Договором Ниццы. Автор рассматривает материальные предпосылки принятия трех нормативных актов Совета ЕС, нацеленных на гармонизацию национальных законодательств государств — членов Европейского союза, регулирующих вопросы предоставления убежища. Предметом специального анализа становятся положения каждой из трех директив ЕС, которые формируют минимальные рамки для обеспечения приема лиц, ищущих убежища, устанавливают критерии для предоставления статуса беженца или лица, нуждающегося в дополнительной защите, детально регламентируют процедуры рассмотрения соответствующих ходатайств. Подчеркивается, что особая роль в рамках этих процессов отводится представителям УВКБ ООН, а также неправительственных организаций, работающих на территории государства-члена от имени УВКБ ООН. = The article is devoted to the legal analysis of the EC secondary legislation in the field of asylum which was worked out on the basis and in view of the amendments introduced by the Treaties of Amsterdam and Nice. The author considers the material pre-conditions for the adoption of 3 regulatory acts of the EC Council aimed at harmonizing the national legislations of the member-states of the European Union which regulate the questions of granting the asylum. Special attention is paid to the provisions of all three directives which formulated the minimal grounds for the reception of the persons in need of international protection, established the criteria for granting the status of refugee or of those who need the subsidiary protection, set up in details the procedures for consideration of appropriate applications. It is stressed that within this context the particular function is to be implemented by the representatives of the UNHCR as well as the nongovernmental organizations acting on the territory of the member-state on behalf of the UNHCR.

Democratic standards of maintenance of liberty of conscience in Belarus and the features of their realization in the Belarusian model of state regulation are examined. The recognition of the special social status of particular religions that correlate with the national, social and cultural traditions is analyzed as a basis of the modified separatist model realized in the sphere of state regulation in Belarus. = Рассматриваются демократические стандарты по обеспечению свободы совести в Республике Беларусь и особенности их реализации в социальной политике государства. Признание особого социального статуса отдельных конфессий, соответствующих национальным социокультурным традициям, анализируется в качестве основы модифицированной сепарационной модели, реализующейся в Республике Беларусь.
