The subject matter of the essay is the tasks of the President of the Energy Regulatory Authority in relation to energy policy in Poland. The essay is divided into two parts. The first part presents basic information about the national regulatory authority, regulation and kinds of energy policy. The second focuses on the tasks of the President of the Energy Regulatory Authority in various areas, such as: energy effectiveness, energy security, renewable forms of energy and competition in the energy market. The article examines the tasks carried out by the President in the past and those which must come into force in the future to modernize the Polish energy market. Finally, the author thrashes out the legal relations between the functions of the President of the Energy Regulatory Authority and the aims mentioned in Polish energy policy. The author pays special attention to the problems of liberalisation in the energy market in Poland.

Their presence in the game of interest reflects the theoretical approach of Josef Braml, and shows the possibilities and limitations of subjects from the "third sector" in their interaction with administrative bodies. The major handicap of expert institutions is limited by the possibility of imposing political change through the systemic (legal) means. W 2014 r. prezydent Francji François Hollande zapowiedział pogłębienie współpracy w zakresie energii odnawialnej z Niemcami. Obecnie sektor energetyczny tych państw znacząco się zmienił. Wprowadzona przez rząd Angeli Merkel reforma energetyczna zakłada zwiększenie potencjału odnawialnych źródeł energii do 80% - do 2050 roku. Z kolei francuska energetyka w 75% oparta jest nadal na energii atomowej. W planach jest jednak zmniejszenie udziału energii jądrowej o 25% do 2025 roku. Pomimo różnic, Francja i Niemcy stanowią jeden z najsilniejszych "sojuszy energetycznych" wśród państw członkowskich i znacząco wpływają na politykę energetyczną całej Unii Europejskiej. ; In 2014 the president of France, François Hollande promised to deepen cooperation in the field of renewable energy with Germany. Currently, the energy sector of these countries has changed significantly. Introduced by the government of Angela Merkel's energy reform envisages increasing the potential of renewable energy sources to 80% until 2050, where the French power in the 75% is still based on atomic energy. However in the plan is to reduce the share of nuclear energy about 25% until 2025. Despite the differences, France and Germany are one of the strongest "energy alliances" between Member States and significantly affect the energy policy of the European Union as a whole.

Tekst przedstawia analizę polityki energetycznej Polski zarówno w wymiarze instytucjonalno-normatywnym (policy), jak i w wymiarze szerszych działań politycznych (politics). W związku z próbą analizy dokumentów o charakterze planistycznym przygotowywanych przez Ministra Gospodarki (tzw. "polityka energetyczna państwa") punktem wyjścia sąkwestie prawne wynikające z Ustawy prawo energetyczne. W tekście przedstawione zostały w ogólnym zarysie główne założenia Polityki energetycznej do 2030 r i niekompletnego jeszcze w 2015 r. Projektu Polityki energetycznej do 2050 r. Ujęcie instytucjonalno-normatywne zostało wzbogacone analizą wybranych problemów mających znaczenie dla kierunków polityki energetycznej i bezpieczeństwa energetycznego Polski. Ponadto w tekście podjęto się odpowiedzi na następujące pytania: (1) W jakim zakresie status prawny dokumentu "polityka energetyczna państwa" wpływa na niski poziom realizacji założeń celów strategicznych w energetyce?, (2) W jakim zakresie brak faktycznej odpowiedzialności podmiotów politycznych wpływa na brak realizacji celów strategicznych "polityki energetycznej państwa"?, (3) Jakie działania należy podjąć w celu prowadzenia spójnej i efektywnej polityki energetycznej w Polsce? ; The text presents an analysis of the Polish energy policy, which takes into account its both aspects: the institutional and normative aspect (policy), and the context of political activities involved (politics). As the text analyses the planning documents preparedby the Minister of Economy (the so-called "State's energy policy"), the starting point for this analysis are the legal issues ensuing from the Energy Law Act. The text outlines the major assumptions of the Energy Policy till 2030 as well as the general provisions of the incomplete, as of the year 2015, Project of the Energy Policy till 2050. The institutional and normative context has been supplemented with an analysis of selected issues significant for the directions in the development of the energy policy and the energy security in Poland. Moreover, the text addresses the following questions: (1) to what extent does the legal status of the document "the State's energy policy" contribute to the poor achievement of the strategic goals in the energy sector?, (2) to what extent does the lack of actual responsibility of the political subjects contribute to the lack of the realisation of strategic goals put forward in the "State's energy policy"?, (3) what actions should be undertaken in order to administer a cohesive and effective energy policy in Poland?

W artykule przedstawiono również zasadnicze etapy procesu uwspólnotowienia polityki energetycznej UE. ; The article presents an issue of "common" energy policy of the European Union in the context of desintegration tendencies and renationalizationn with particular attention to so-called Brexit and its implications for commonalization of the EU energy policy. The article discusses the actions that undermine principles and rules of the EU's "common" energy policy taking as an example the decision of the European Commission from October 28th, 2016 regarding the increase of transportation capacity of the OPAL gas pipeline (land off shoot of Nord Stream) used by Gazprom as well as the problem of intensification of energy cooperation between Germany and Russia in case of Nord Stream 2 project. The basic phases of the commonalization of the EU's energy policy were presented in the paper too.
The state's energy policy is one of the most important public policies affecting the safety of citizens and the development of the state, and the LNG Terminal in Świnoujście is a tool for shaping Polish energy policy. The installation was put into use in 2015. Currently, its capabilities guarantee the supply of 1/3 of the national gas demand, and after the expansion, it will be already a half. Energy as a product must be available continuously, also in times of national and international perturbations such as pandemics. The aim of the article is to investigate whether the COVID-19 pandemic affected the operation of the terminal and the import of liquefied natural gas to Poland. The author used the microsystem analysis as a research method and answered the questions: "How did the Szczecin-Świnoujście port function during the pandemic?," "How was shipping functioning during the pandemic?," and "How did LNG prices develop during the pandemic?".

Pojazdy elektryczne stanowią ważne wyzwanie dla polityki transportowej na świecie. Ich rosnąca popularność jest odpowiedzią na problemy zanieczyszczenia środowiska oraz ma związek z działaniami na rzecz zapewnienia zrównoważonego rozwoju. Polska jest państwem, które zamierza podążać w kierunku rozwijania transportu elektromobilnego. Przygotowano w tym celu odpowiednią strategię oraz ustanowiono prawo i wskazano instytucje odpowiedzialne w tym zakresie. Niestety główna idea, jaka towarzyszy elektromobilności – czyli ekologia, nie idzie w parze z planami w zakresie polskiej polityki energetycznej. Zgodnie z oficjalnymi programami rządowymi, produkcja energii w Polsce do roku 2040 ma bazować na wykorzystaniu węgla. Oznacza to, że pojazdy elektryczne będą zasilane tzw. "brudną energią". An appropriate strategy was prepared for this purpose, and the law was established and the responsible institutions were identified in this regard. Unfortunately, the main idea that accompanies electromobility – that is, ecology, does not go hand in hand with plans in the field of Polish energy policy. According to official government programs, energy production in Poland until 2040 is to be based on the use of coal. This means that electric vehicles will be powered by the so-called "dirty energy". The hypothesis of the article is that the development of electromobility in Poland is difficult to justify in terms of a positive impact on the natural environment and climate protection in a situation where energy production is based on coal. Without changes in energy policy, electromobility "in Polish" is a failed idea, because it does not meet the basic assumptions – that is, it will not contribute to reducing the negative impact of transport on the environment.

Energy policy is included in the category of economic policies. However, it has a very strong impact on the functioning of the whole of society. The purpose of the article is to analyze how energy policy is (or can be) shaped under the influence of the human factor, and how important the human factor is in the context of its planning, implementation and evaluation. The subject of the analysis are, first and foremost, the states (or organizations of states, such as the European Union) with a democratic regime and a free market economy. These two features provide the most favorable conditions for society to effectively influence the shape and functioning of the energy sector. The article's aim is to identify potential (real) possibilities of the human factor participating in energy policy through a processual analysis of this policy. ; Polityka energetyczna jest zaliczana do kategorii polityk gospodarczych. Ma jednak bardzo silny wpływ na funkcjonowanie całego społeczeństwa. Celem artykułu jest analiza, w jakim stopniu jest ona (lub może być) kształtowana pod wpływem czynnika ludzkiego i, jakie to ma znaczenie w kontekście jej planowania, implementacji oraz ewaluacji. Przedmiotem analizy są przede wszystkim te państwa (ugrupowania państw – Unia Europejska), gdzie występuje reżim demokratyczny i gospodarka wolnorynkowa. Są to – jak się wydaje – najbardziej sprzyjające warunki, aby społeczeństwo mogło efektywnie oddziaływać na kształt i funkcjonowanie sektora energetycznego. Zmierzeniem artykułu jest, aby poprzez analizę procesualną polityki energetycznej wskazać potencjalne (realne) możliwości udziału w niej czynnika ludzkiego.

W praktyce prowadzi to do drastycznego ograniczenia ilości węgla w bilansie energetycznym państwa i de facto ogranicza wolność wyboru własnego miksu energetycznego. ; Polish energy policy is determined by: a relatively high rate of energy self-suffi ciency based on large own coal resources, dependence on imported fossil fuels, in particular natural gas from Russia, as well as German–Russian energy cooperation in the Baltic Sea and the rigorous European Union climate policy, taking into account high CO2 emissions in the electricity production. The article presents the conditions and assumptions of the Polish energy policy in the dilemma of freedom of choice of energy sources in the light of the of European Union climate policy expectations based on the decarbonisation paradigm. In practice, it leads to a drastic reduction in the amount of coal in the national energy balance and de facto limits the freedom to choose of country's own energy mix.

Polish energy policy includes the requirements of the EU policy, but the characteristics of our economy and the possessed energy resources cause some problems with its implementation. For this reason, the principal objective of this article is to show the controversies related to the implementation of the Polish energy policy in the context of existing conditions. ; Wiadomo, że we współczesnych gospodarkach jedną z ważniejszych kwestii jest zaopatrzenie w energię i zabezpieczenie jej nośników. Dlatego każde państwo stara się prowadzić swoją politykę energetyczną tak, by zaspokoić istotne potrzeby swojego kraju. Polska polityka energetyczna uwzględnia wymogi unijnej polityki energetycznej i ekologicznej. Jednakże specyfika naszej gospodarki i posiadane zasoby surowców energetycznych wywołują pewne problemy z jej realizacją. Dlatego przeanalizowano wybrane związki między celami polityki energetycznej (zwłaszcza zapewnieniem bezpieczeństwa energetycznego) a istniejącymi w Polsce uwarunkowaniami jej realizacji, co pozwoliło wskazać na pewne problemy i kontrowersje z tym związane. Strategies are usually long-term plans. However, many problems appear if they are considered essential issues of social life and economic security, especially considering the need to make choices concerning conditions of limited resources. Another issue is the dilemma of achieving individual goals in the conditions of global interdependencies. One of the key requirements of nation-states is to ensure energy security; therefore, governments are strongly focused on establishing a stable, enduring, and useful energy strategy. Therefore, the point of importance is factors that will be able to ensure energy efficiency, economic stability, security, and in parallel, sustainable developmentboth on the national and global levels. Drawing from the above, this study investigates the reasons for the indispensability to carry out an energy market systemic reform in Poland with consideration of economic argumentation. The theories of economic growth, especially of endogenous kind, is taken into consideration. It is also argued that to achieve sustainable economic growth and social development in the long run, it would be reasonable to simultaneously concentrate on human capital and technologies. More advantages will be gained through intergovernmental cooperation, within regional groups such as the Visegrad Group and at the supranational EU level. This conviction is motivated by the principles of public choice theory.
Kryzysy energetyczne, a w szczególności kryzysy gazowe spowodowane konfliktem rosyjsko-ukraińskim wywarły istotny wpływ na politykę bezpieczeństwa energetycznego UE. Celem niniejszego artykułu jest analiza wpływu rosyjsko-ukraińskich kryzysów gazowych na rozwój polityki energetycznej UE, a w szczególności otoczenia regulacyjnego. Poczucie zagrożenia przyczynia się do zwiększenia solidarności wśród państw unijnych oraz zwiększa zdolności budowy koalicji politycznych. Wraz ze wzrostem agresywnej polityki energetycznej Federacji Rosyjskiej, która oparta jest o założenia szkoły realizmu, instytucje unijne wykorzystują instrumentarium oparte o założenia szkoły liberalizmu. W artykule została zastosowana metoda krytycznej analizy politologicznej oraz metoda analizy czynnikowej. Autor wykorzystał założenia teorii realizmu oraz liberalizmu. Wnioski przedstawione w artykule oparte są o technikę prognozowania. ; Energy crises, in particular the gas crises caused by the Russian-Ukrainian conflict, have had a significant impact on EU energy security. The aim of this paper is to analyse the impact of the Russian- Ukrainian gas crisis on the development of EU energy policy, in particular its regulatory environment. Insecurity contributes to increased solidarity among EU states, resulting in their greater willingness to create political coalitions. With the growth of the aggressive energy policy of the Russian Federation, which is based on the school of realism, EU institutions respond with instruments taken from the school of liberalism. The paper is a critical analysis in terms of political science and factor analysis. The author uses the assumptions of both the theory of realism and that of liberalism. The conclusions presented in the article are based on a forecasting technique.
