Поширення ексклю зивних практик сприятиме поширенню ідей поміркованих і радикальних «євроскептиків», що може призвести розпаду Європейського Союзу. Інклюзивний аспект концепту Європи представлено ідеями «єврооптимістів» («європеїстів»), які, виходячи зі спільності історії, культури, ментальності народів Європи, обґрунтовують позитивний вплив на розвиток держави інтеграції, недержавної кооперації та екстраполяції норм та принципів ЄС на нові території Європи. ; The article proposes the hypothesis that the interpretation of the concept of Europe directly cor relates with the future development of the European Union and its members. Dissemination of exclusive practices promotes the spread of ideas of moderate and radical "eurosceptics" that could lead to the disintegration of the European Union. The inclusive aspect of the concept of Europe is represented by the ideas of the Eurooptimists (Europeanists), who, based on the common history, culture, mentality of the peoples of Europe, proves the positive impact on the development of the state of integration, non-state cooperation and the extrapolation of the EU norms and principles to new territories in Europe.
This article presents the current issues in the law of international organizations and contemporary international law in general. It is pointed out that the division of international law into branches and institutions, in order to ensure the effective legal regulation of new spheres of relations, led to the emergence of autonomous legal regimes, even within one region, namely on the European continent. To date, these include European Union law and Council of Europe law.It is emphasized the features of the established legal relations between the Council of Europe and the European Union at the present stage. It is determined that, along with close cooperation between regional organizations, there is a phenomenon of fragmentation, which is accompanied by the creation of two legal regimes within the same regional subsystem, proliferation of the international legal norms, institutions, spheres and conflicts of jurisdiction between the European Court of Human Rights and the Court of Justice of the European Union.It is revealed that some aspects of fragmentation can be observed from the moment of establishing relations between the Council of Europe and the European Union, up to the modern dynamics of the functioning of the system of law of international organizations, the law of international treaties, law of human rights. Areas and types of fragmentation in relations between international intergovernmental organizations of the European continent are distinguished.One way to overcome the consequences of fragmentation in the field of human rights is highlighted, namely through the accession of the European Union to the Convention on Human Rights and Fundamental Freedoms 1950. Considerable attention has also been paid to defragmentation, which is partly reflected in the participation of the European Union in the Council of Europe's conventions by the applying «disconnection clause».It is determined that the legal relations established between an international intergovernmental organization of the traditional type and the integration association sui generis, the CoE and the EU, but with the presence of phenomenon of fragmentation in a close strategic partnership, do not diminish their joint contribution into the development of the law of international organizations and contemporary international law in general.Key words: defragmentation; European Union; European Court of Human Rights; Convention on Human Rights and Fundamental Freedoms 1950; conflict of jurisdictions; «disconnection clause»; Council of Europe; Court of Justice of the European Union; fragmentation; sui generis. ; У статті досліджено актуальні питання у праві міжнародних організацій та підкреслено особливості правовідносин між Радою Європи та Європейським Союзом. Виокремлено сфери та типи фрагментації у взаємовідносинах між міжнародними міжурядовими організаціями Європейського континенту.Виділено один зі способів подолання наслідків фрагментації у сфері захисту прав людини, а саме шляхом приєднання Європейського Союзу до Конвенції про захист прав людини і основоположних свобод 1950 р. Article is devoted to developing the concept of improving the legal mechanism of protection of computer programs as a specific complex intellectual property rights for the effect on the development of the mechanism of new technological conditions of its creation and use. The significance of the article is that some made in the conclusions can be taken into account in the further development of theoretical positions on the legal protection of computer programs and databases in the European Union. ; Статья посвящена вопросам разработки концепции совершенствования правового механизмаохраны компьютерной программы как специфического комплексного объекта права интеллектуальной собственности с учетом влияния на развитие этого механизма новых технологических условий её создания и использования. The article discusses the possibility of the formation and further geopolitical influence of the Baltic-Black Sea Union. The idea of this interstate union is long-standing in European history and international relations in Eastern Europe. Its main goal is to create such a structure in the region that could unite the interests of the countries of the whole European space in ensuring security. The topic of the Baltic-Black Sea Union became relevant after the outbreak of the Ukrainian-Russian war in 2014. Accordingly, the countries of the central region were faced with the question of ensuring their own defense. However, this question cannot be considered separately from Ukraine. And it is she who should play a key role in his decision. Given this situation and the need to deter the aggression of the Russian Federation, the only means that can be effective is only force. In addition to a purely military threat, there is also a political and economic threat. The foundations for this are laid by cooperation between Germany and Russia. Therefore, the formula for the future of the Baltic-Black Sea Union should be of a military-political nature with the participation of the countries of Central and Eastern Europe.
The article deals with the principles of the formation and the activity of the European Union. The language policy of the EU and the ways of its realization in legal aspects are analyzed. The positive and problematic issues of the development of European languages are identified. The most commonly used terms and concepts in the field of linguistic diversity of the EU are defined. The prospects of functioning of the Ukrainian language in the European Union are outlined.The language policy of the European Union is aimed at developing of the national languages and supporting the learning of foreign languages. The linguistic diversity of the EU is based on the principles of equality and mutual enrichment of different cultures. EU institutions build a language policy based on the harmonious coexistence of official languages, regional and languages of the smaller indigenous peoples of Europe. Each language is a value and serves as a bridge to other countries of the European Union, promotes mutual understanding. Multilingualism expands the opportunities of EU citizens in the labor market, education, sports, professional growth; facilitates access to information in the field of law; facilitates unimpeded travel to the territory of all EU member states. The overwhelming majority of Europeans see successful prospects of the European Union's linguistic policy against the backdrop of a globalized world. The introduction of the concept «EU citizen» does not mean the abolition of national citizenship. It complements it and allows a person to better understand his affiliation with the European Union. The European Union is today one of the largest donors of humanitarian aid in the world. The process of EU enlargement and the laws that guarantee the four basic freedoms of the European Union (free movement of goods, persons, services, capital) contribute to the multicultural and multilingual nature of the EU.Key words: European Union, Schengen, Schengen Area, language policy of the EU, Flag of Europe, Anthem of Europe, Europe Day, European Day of Languages, euro. ; У статті досліджено засади формування та принципи діяльності Європейського Союзу. Представлено основные интерпретации влияния политики на понимание Европы. Доказано, что политическая елита Европейского Союза определяет содержание понятия Европы, что непосредстаенно влияет на внутреннюю и внешнюю политику стран ЕС и других политико-территориальных единиц. ; Interpretation of Europe is based on different characteristics and notions. It is explained that concept of Europe may be considered in terms of geographical boundaries, religion, identity, cultural and social development and politics. The main aim of this paper is to show the crucial role of politics in the defining Europe.Among all aspects of the concept of Europe analyzed in the article one might see that geographical discourse about Europe is the most predictable, but since the mid-twentieth century its understanding is more political. There are some aspects of the definition of Europe through politics.Firstly, political history makes a great influence on perception Europe as a political entity. Secondly, democracy, rule of law, civil society and human rights are the main characteristics of the European countries. Thirdly, Europe is seen as a space based on the principles of pluralism and diversity. Europe today is a cosmopolitan space, meaning that its specific social form characterized by the recognition of diversity in all its forms: national, cultural, religious, and above all political. Fourth, it is used to identify Europe with the European Union not only because of mass media reports, but also because the EU's government has a strong impact on the European continent.Europe is a conventionally constructed political project that is initiated and driven by the European Union. For the state to be European means to have full or associated membership in the EU, to promote common European values and law, at least to be presumed as a part of Europe by the EU.In a nutshell, today discourse on the concept of Europe is based on politics and not on geographical, religious, cultural or economic processes that depends from the political intentions of the EU.
In this article, the author argues with the Polish press about the 350th anniversary of the Lublin Union, which was celebrated in Poland in 1919. In contrast to the Polish press, the author emphasizes that 1) the Act of the Lublin Union was not a voluntary union of Poland and Lithuania, it was an act of Polish violence against Lithuania; 2) Ukrainian lands became part of the Polish Kingdom not voluntarily, but forcibly annexed by the King of Poland; 3) The Polish-Lithuanian Commonwealth was not a democratic country, as in other countries of Europe at that time, only the Polish nobility had full political rights. The common people remained completely powerless.
The article focuses on the reasons of Brexit that are related to disintegration processes in the European Union, which are caused by crises in Europe, such as the migration crisis, slowing economic growth in the Euro zone, the growing debt crisis in Southern Europe etc. The article also analyzes the impact of some consequences of the European integration on the British decision to leave the European Union. In particular, the article examines deepening the European integration and the gradual transformation of the EU into a union that is increasingly reminiscent of a federal state, as a factor that prompted British Eurosceptics to actively campaign for Brexit. The bureaucracy and the lack of a mechanism for the direct election of the European Commission and other European supranational institutions in Brussels is also examined in the article as one of the factors of Britain's exit from the EU. The article demonstrates that during Britain's membership in the European Union, the problem of mass labor migration from the countries of Central-Eastern Europe to the United Kingdom was one more factor that affected the growing Euroscepticism in the country and made the electorate to vote for Breit. The article examines Brexit in the context of the European disintegration processes and compares Britain with some other European countries, which, like the United Kingdom, are quite reluctant to deepen European integration, but unlike Britain are unlikely to consider such a radical step as exit from the EU. The author concludes that the crisis in continental Europe had a decisive influence on Britain's decision to leave the European Union, although at the same time Brexit would not have happened without the impact of British domestic policy factors. The internal political reasons for Brexit are not discussed in detail in the article, as its main focus is on the foreign policy factors related to Britain's reaction on the problems of continental Europe, such as the mass labor migration, the policy of supranational European institutions in Brussels, which is not always effective and agreed with London, and economic inequality between the countries of Southern and Central-Eastern Europe and their partners from Northern and Western Europe. ; Стаття акцентує увагу на тих причинах Брекзиту, які пов'язані з дезінтеграційними процесами у Європейському Союзі, що у свою чергу викликані кризовими явищами у Європі, такими як міграційна криза, уповільнення економічного зростання країн Єврозони, загострення боргової кризи південноєвропейських країн тощо. У статті проаналізовано також вплив деяких наслідків євроінтеграції на рішення британців про вихід з Євросоюзу. European integration of contemporary model began after World War II. The idea of European integration is not new, as thoughts of unification of the European continent were expressed by such prominent thinkers as Jean-Jacques Rousseau, Kant, and others. There is a need to emphasize that unification of the European continent after World War II has led to creation of the European Union in its current form, and it can be called the most successful and most studied attempt to European integration.This research is based on the analysis of the constituent documents of the EU and results of researches of scientists from different branches of sciences. Still we note that the need remains in the characteristic of the process of enlargement and integration in Europe, paying attention on the current state of unification of the continent and the latest EU enlargement on the 1st of July, 2013. Hence, the aim of this paper is in the characterization of the process of enlargement and integration in Western Europe, which led to the current state of unification of the majority of the European continent in the European Union and its last expansion in 2013.The process of European unification was not only in the integration of different areas of life by adopting the so-called «establishment treaties» that have been analyzed in the paper. It was also in the geographical expansion of its borders at the expense of new Member-States joining the European Community / European Union. Separate agreements, so-called «accession treaties», were concluded between the EU and new Member-State to meet this aim.There is no limit on the number of its Member States in the founding EU documents. Moreover, practice indicates the continuation of attraction of new EU Member-States. So, the states of the Western Balkans are considered prospective EU Member-States in the second decade of the 21st century. First country of this region – Croatia became the 28th EU Member-State on the 1st of July, 2013. In addition, the candidate countries for accession to the EU (as of 2013) are Montenegro, Serbia, the Former Yugoslav Republic of Macedonia, Iceland and Turkey. Albania, Bosnia and Herzegovina, and Kosovo are potential candidate countries to join European Union, which are recognized by the EU. Obviously, the expansion is an important part of the EU strategy, though this direction contains some challenges for sustainable development of the European Union.Thus, the problem the development of European Union towards closer integration of end of the Second World War and the challenges faced by European Union on this path especially at this stage of its development remains an object of scientific research. The process of unification of Europe was not only in the integration of different areas of life by adopting the so-called «establishment treaties», but also in the geographical expansion of its borders at the expense of new Member-States joining the European Community / European Union. So, as of 2013 the EU consists of already 28 Member-States after its seven enlargements, even though only six states of Western Europe were its Founding States after the Second World War.However, studies of the future development of the EU in terms of delay or indeed removal from the agenda the issue of closer political integration and the reform of EU institutions to develop more efficient and democratic system of governance in the European Union became actual especially after EU Eastern enlargement in 2004 and failure of the ratification of the EU Constitution in 2005. These challenges are even more acute after the global financial and economic crisis and its negative consequences for the EU.We can therefore conclude that although the expansion and integration of Western Europe after World War II to the present day was evolutionary in nature, but given the challenges of European Union at the current stage due to the attempts to overcome the results of the economic and political crisis, there is a need to pay attention to the uniquely uncertain prospects for its development in the foreseeable future. ; Основываясь на анализе учредительных документов ЕС и исследований ученых различных отраслей наук, в статье анализируется процесс расширения и интеграции в Западной Европе с момента окончания Второй мировой войны и до настоящего времени, обращая внимание на современное состояние объединения континента и последнее расширение ЕС 1 июля 2013 г. ; Засновуючись на аналізі установчих документів ЄС і досліджень учених різних галузей наук, у статті аналізується процес розширення й інтеграції у Західній Європі від закінчення Другої світової війни і до сьогодення, звертаючи увагу на сучасний стан об'єднання континенту та останнє розширення ЄС 1 липня 2013 р.
