This book looks at the interplay between criminal law and other branches of public law pursuing similar objectives (referred to as 'quasi-criminal law'). The need for clarifying the concepts and the interlink between criminal and quasi-criminal enforcement is a topic attracting a lot of discussion and debate in both academia and practice across Europe (and beyond). This volume adds to this debate by bringing to light the substantive and procedural problems stemming from the current parallel or dual use of the different enforcement systems. The present research aims to analyse the phenomenon of unaccompanied minors arriving from Morocco to the European Union from 2010 to 2021. This recent migratory phenomenon supposes an emerging challenge for governments, international organisations, and societies, in order to guarantee the protection of children according the UN Convention on the Rights of the Child (UN, 1989). The research focuses on the children «on the move», travelling alone from Morocco and arriving in Spain through the Strait of Gibraltar. The so-called Western Mediterranean Migratory Route has become one of the gateways to Europe. Spain hosts nowadays a big community of Moroccan unaccompanied minors and Catalonia has become the second Spanish Autonomous Community with a major number of unaccompanied minors, only surpassed by the enclave of Melilla located on the very border of Morocco. The present research gives special attention to the study of the Amazigh Nationalism question, as something to look at among the reasons why Moroccan unaccompanied minors migrate to Europe, choosing, particularly, Catalonia as a model to pursuit an Amazigh nation. ; A presente pesquisa tem como objetivo analisar o fenómeno da chegada de menores não acompanhados provenientes de Marrocos à União Europeia entre 2010 a 2021. À rebours de la littérature dominante sur la citoyenneté en droit qui privilégie généralement sa dimension inclusive, cette thèse entreprend un renversement de perspective : elle se propose de théoriser la citoyenneté en creux, à partir de ses exclus, de définir autrement dit le citoyen par le non-citoyen. L'exclu étudié en droit français n'est pas la figure paradigmatique de l'étranger, mais celle du criminel déchu de ses droits politiques à la suite d'une condamnation pénale. Nous faisons l'hypothèse de la valeur heuristique d'une étude proprement juridique et non normative de la notion constitutionnelle de citoyenneté à partir du droit pénal en général, et des sanctions privant le condamné de ses droits de citoyen en particulier. L'apport de cette recherche est double : il concerne à titre premier la citoyenneté dont on entend examiner les bénéficiaires, la nature (les valeurs) et le contenu matériel (les droits et les devoirs). Nous démontrons (1) que par différence avec la nationalité, la citoyenneté a historiquement une dimension axiologique et qu'elle protège la moralité publique. Cette affirmation semble de prime abord remise en cause aujourd'hui en raison de l'influence du droit des droits de l'homme sur la matière. Plus qu'à la substitution d'un modèle de citoyenneté à un autre, nous établissons (2) que l'on a affaire à une tension au cœur du régime actuel de la citoyenneté. À titre second, nous contribuons en filigrane à une lecture de la démocratie en soutenant (1) que la lutte pour les droits politiques des derniers exclus de la nation (les condamnés et les « aliénés ») correspond moins à une revendication de participation politique qu'à une demande d'inclusion sociale ; (2) que le citoyen, dans cette lutte, tend à disparaître derrière le sujet de droit doté de droits opposables.
The paper describes the permeation of the Croatian language with adjacent languages that were frequently used as languages of political domination or great prestige. The author speaks about the language power of the Croatian South and the Croatian North. In Europe, more precisely in West and Central Europe, there is hardly any other nation on whose territory so many languages were spoken as it is the case with Croatia, especially in its South. However, this fact did not prevent the Croats to become one united nation in the 19th century. The only language with which Croatian was in actual conflict was Hungarian

Introducción: La desinformación se ha convertido en un problema clave para las sociedades democráticas contemporáneas. Para contrarrestar esta amenaza, las autoridades públicas de numerosos países han puesto en marcha diversas iniciativas legales, tecnológicas y educativas. Este artículo aporta una revisión bibliográfica y de textos legales, que evidencia la importancia creciente otorgada por la Unión Europea a la alfabetización mediática. Metodología: Mediante revisión documental, se examinan informes y textos legales europeos y de países de la UE, con el fin de evaluar el grado de relevancia que se asigna a la alfabetización mediática para luchar contra la desinformación. Resultados: El análisis comprueba una presencia recurrente de la alfabetización mediática como una de las medidas necesarias para combatir la desinformación en el territorio europeo. Discusión y conclusiones: Más allá de simples soluciones tecnológicas y legales para combatir la desinformación, se comprueba que la Unión Europea apuesta por co-responsabilizar a la ciudadanía, mediante políticas de promoción de la alfabetización mediática. Se consolida, en definitiva, un modelo de lucha contra la desinformación basado en un conjunto de soluciones multinivel. ; Introduction: Disinformation has become a key problem for contemporary democratic societies. To tackle this threat, public authorities in many countries have launched various legal, technological and educational initiatives. This article provides a literature and legislative review, which shows the growing importance given by the European Union to media literacy. Methodology: European and EU country reports and legal texts are examined, in order to assess the degree of relevance assigned to media literacy to tackle misinformation. Results: The analysis confirms a widespread presence of media literacy as one of the necessary measures to combat disinformation in the European territory. Discussion and Conclusions: Beyond mere technological and legal solutions to tackle disinformation, this article finds that the European Union is committed to making citizens co-responsible, through policies to promote media literacy. In short, a model for acting against disinformation based on a set of multilevel solutions is consolidated.
In September 2015, the Volkswagen Group (VW) admitted the use of 'defeat devices' designed to lower emissions measured during VW vehicle testing for regulatory purposes. Globally, 11 million cars sold between 2008 and 2015 are affected, including about 2.6 million in Germany. On-road emissions tests have yielded mean on-road NO[subscript x] emissions for these cars of 0.85 g km[superscript −1], over four times the applicable European limit of 0.18 g km[superscript −1]. This study estimates the human health impacts and costs associated with excess emissions from VW cars driven in Germany. A distribution of on-road emissions factors is derived from existing measurements and combined with sales data and a vehicle fleet model to estimate total excess NO[subscript x] emissions. These emissions are distributed on a 25 by 28 km grid covering Europe, using the German Federal Environmental Protection Agency's (UBA) estimate of the spatial distribution of NO[subscript x] emissions from passenger cars in Germany. We use the GEOS-Chem chemistry-transport model to predict the corresponding increase in population exposure to fine particulate matter and ozone in the European Union, Switzerland, and Norway, and a set of concentration-response functions to estimate mortality outcomes in terms of early deaths and of life-years lost. Integrated over the sales period (2008–2015), we estimate median mortality impacts from VW excess emissions in Germany to be 1200 premature deaths in Europe, corresponding to 13 000 life-years lost and 1.9 billion EUR in costs associated with life-years lost. Approximately 60% of mortality costs occur outside Germany. For the current fleet, we estimate that if on-road emissions for all affected VW vehicles in Germany are reduced to the applicable European emission standard by the end of 2017, this would avert 29 000 life-years lost and 4.1 billion 2015 EUR in health costs (median estimates) relative to a counterfactual case with no recall. ; Germany. A policy change in the European Union's Emissions Trading Scheme (EU ETS) provides us with a unique opportunity to measure the impact of carbon pricing on aviation, the most climate-intensive mode of transport. We implement a difference-in-differences strategy on a sample based on all flights within Europe from 2010 to 2016 to examine the causal impact of the EU ETS on emissions and supply. We find that the EU ETS reduced emissions by 4.7% in the regulated routes relative to the counterfactual. When we restrict the sample to short-haul flights, routes on which competition from other means of transport may exist (less than 1,000 km), the reduction in emissions is 10.7%. Finally, the reduction in emissions is also high for low-cost airlines (−11%) but it is not statistically significant for network airlines. In sum, the EU ETS has helped to mitigate emission growth by 3 Mt CO2 per year during the period analyzed, but not to reduce absolute emissions in the sector, as needed.

Public innovation has received increasing attention in recent years. Experiments with new governance structures, such as New Public Management and New Public Governance, have challenged the traditional top-down, internally driven forms of innovation in the public sector and have entailed a search for new forms of open, collaborative and interactive innovation, implying a reframing of public innovation activities. However, introducing these new frames of innovation causes uncertainties in the public sector, necessitating better understanding of how public innovation can be changed to address societal needs. This paper uses materials from case studies of 21 public living labs across Europe to analyse the lessons that can be learned from public sector participation in living labs in terms of their contribution to reframing public innovation. The "frame" construct is used to analyse and provide an understanding of how participation in living labs helps public actors to reframe innovation and address public and societal needs. Three living lab framings for changing public innovation are identified (processual learning, restrained space and democratic engagement), and the degree of intensity of these framings with respect to involving stakeholders and addressing societal challenges is discussed. The paper contributes to knowledge of public sector innovation by extending previous accounts of how public innovation can be improved.
APPROVED ; Interpretations of the period following the disintegration of the Carolingian empire in Western Europe at the end of the ninth century have long divided historians, between those who believe a violent rupture in political and social structures took place around the year 1000 and those who argue for an essential continuity. This thesis aims to transcend these debates, by approaching medieval society through a case-study in the Loire valley region relying on two fresh methodological insights. Firstly, it will investigate changes in the economic structures which provided society's material base; secondly, it will analyse how those ?lites claimed, performed and maintained their status. Based on these two approaches, the thesis explores changing patterns of ?lite behaviour in order to better understand the social and economic changes which took place from the late ninth century onwards. The thesis examines the effects of shifting landholding patterns, the emergence of seigneurial customs, changing attitudes to church patronage and lay violence, and the methods by which ?lites were identified in documents, to establish their implications for the ways by which ?lites could claim and maintain their status. It concludes that there was a significant and fundamental transformation of social and economic structures, beginning in the middle of the tenth century, in the middle Loire valley, although the pace of change is slower than would be appropriate for a 'Feudal Revolution'. Nevertheless, the breakdown of the Carolingian political order unleashed a wave of competition amongst local and regional ?lites, which saw them innovate and adapt the heritage of Carolingian culture to create a new, 'feudal' social order. This was fuelled by the changes in economic structures which provided ?lites with more wealth to promote their own status; the competition for status in turn fuelled ?lites' need for more wealth and their incentive for economic expansion.
