The study focuses on changes made to the Law of Ukraine "On Accounting and Financial Reporting in Ukraine" for the purpose of implementing accounting standards to the European Union directives. The object of the research paper is accounting in Ukraine. The purpose of the study is to analyze the current state and development trends of accounting in Ukraine in the context of the implementation of European legislation. Research methods such as analysis, synthesis, induction, deduction, abstraction, idealization and generalization are used to analyze the changes introduced into the Law of Ukraine "On Accounting and Financial Reporting in Ukraine". Today, Ukraine is moving actively towards the implementation of European legislation into domestic practice, including standards of accounting and financial reporting. Successful implementation of European legislation into domestic accounting practice, first and foremost, requires clarification of differences in accounting and financial reporting. The amendments made to the Law of Ukraine "On Accounting and Financial Reporting in Ukraine" will promote harmonization of national legislation in the field of accounting and financial reporting with the legislation of the European Union countries and the International Financial Reporting Standards. The changes introduced will provide the basis for raising accounting and financial reporting in Ukraine to a qualitatively new level that will enable effective management decision- making by domestic business entities. The results obtained are the basis for accounting and financial reporting in Ukraine, in accordance the norms of the European Union directives. The research results may be used all economic entities in Ukraine in different sectors of the economy.
The purpose of the scientific article is to identify some problems of harmonization of Ukrainian legislation with the legislation of the European Union and the practice of the European Union on the protection of trade secrets in the field of labor relations. The author notes that the pro-European vector of Ukraine's development and the prospect of its integration into the European Union determine the use of the European approach to protection and protection of rights and freedoms in all spheres of activity and in particular in the field of intellectual property protection. It is emphasized that the need to fill the gaps in the legal regulation of the protection of trade secrets in labor relations by the norms of labor legislation is obvious. However, how to do this should be considered carefully, because the only way to protect the employer from violating his rights in this area is to provide in the employment contract as one of its conditions the obligation of the employee not to disclose trade secrets that are not very effective in achieving set goal. But the issue must begin with a revision of the rules of civil law on the understanding of intellectual property, the delineation of which in terms of classifying them as a trade secret today does not correspond to the practice of European countries. ; Мета наукової статі полягає у визначенні окремих проблем гармонізації законодавства України із законодавством Європейського Союзу та практикою країн Євро- пейського Союзу щодо охорони комерційної таємниці у сфері трудових відносин. Однак необхідно зважено визначити, як це здійснити, оскільки єдиною можливістю убе- зпечити роботодавця від порушення його права в цій сфері є передбачення в трудовому договорі як однієї умови щодо його змісту обов'язку працівника не розголошувати комер- ційну таємницю, яка не надто ефективно діє для досягнення мети. Але починати вирішення питання потрібно з аналізу норм цивільного законодавства щодо визначення об'єктів інте- лектуальної власності, окреслення яких в частині приналежності до них комерційної таємниці на сьогодні не відповідає практиці європейських країн.
The article is devoted to the research of a topical and debatable issue regarding the basic aspects of the status of an employee in the European Union, which includes employment of citizens of the European Union and employment of third-country nationals who are not members of the European Union. Particular attention is paid to the issue of illegal labor migration in the European Union in the context of current and integration processes and their impact on the current economic situation in the EU. Every year, the phenomenon of labor migration becomes more relevant, because of the poor economic situation in many countries people are forced to seek employment in other countries and emigrate. But the conditions for such persons are different. For example, for emigrants from other countries of the European Union they will be more or less the same, while for emigrants from third countries they will be completely different. There are many conflicts and disputes and, also there is discrimination, which significantly inhibits the legal status of expatriate workers. Such workers face a lot of barriers with regard to their housing during the period of work, working conditions, salaries, moving their families with them, educating children, moving around the territory of the European Union, desire to stay in the future in the European Union. Most of the issues remain unresolved, which has a very negative effect on emigrant workers. The absence of the rule of law that would regulate this issue binds hands of such a category of people, restricts them in fundamental rights and freedoms, in actions and decisions, which is a direct violation. Nowadays the implementation of the legal status of migrant workers in the European Union is underdeveloped, imperfect, and not uniform for all countries. The article examines the issue of the peculiarities of the use of legal terminology in the countries of the European Union. It is emphasized, that the reform of domestic legislation and its approximation to world standards requires thorough research of European legislation. In particular, the cornerstone of today's challenge is the proper use and common approaches to the use of legal terminology. That is why theoretical research on the peculiarities of the use of legal terminology in the legislation of the European Union is necessary to properly improve domestic legislation and avoid mistakes and misunderstandings in the future. Emphasis is placed on the fact that domestic and foreign researchers have not developed a unified approach to understanding the term "terminology". That is why this term is used in three different meanings. It is also noted, that the category "term" is not new and has been in the field of view of researchers for a long time, but its direct study has only recently begun. It is noted, that legal terminology is considered as technical, i.e.it is the most noticeable and striking linguistic feature of legal language. In this sense, legal terminology is used to denote concepts that belong to the legal field. It is emphasized that, in contrast to the systemic languages, used in national texts, the European Union resorts to a form of "cultural communication", governed by multilingualism. Such communication is considered cultural because it is not rooted in any of the national cultures of the EU Member States. The scientific article is devoted to the videoconferencing in court proceedings by international law and the law of some European Union countries. The videoconferencing definition, the right to justice protection on the main international legal sources about the trial regulation and human rights to justice protection bases are studied, the procedural stages of court hearings by videoconference are analyzed. Carrying out comparative legal research at our country present stage legal transformation and development, especially related to the emergence of new, modern legal relations, is primarily due to the need to receive international and foreign experience and, consequently, improve current national legislation. It has been established, that the latest technologies introduction in the judicial process at the national and international levels has both advantages and disadvantages and is closely related to the protection and implementation of the right to justice. Normative legal acts about the right to justice consolidation are primary regarding the right of participants in court proceedings to participate in it by videoconference. The attractive side of conducting court hearings online includes: the availability of litigation for all participants, regardless of their location, saving time and money, compliance with legal requirements for the duration of litigation, and so on. Despite the general legal consolidation of the possibility of holding videoconferences in Ukraine and the EU, the procedural features of the rights and obligations of participants in such proceedings remain unclear, as well as unspecified issues regarding the application of different types of technical equipment depending on the conditions of video calls, the possibility of holding meetings outside the court in emergency conditions, etc.
The article presents a comparative analysis of the structure of the land fund of European countries. The analysis of agricultural, forestry, housing and other types (types) of land use and land ownership of European countries in comparison with Ukraine. The condition and saturation of the infrastructural objects of the investigated territories are analyzed. The researches of the specific land use in EU countries significantly increased after Ukraine had elected the European Integration vector. Equally important is the issue of the research of effective land use for different economic purposes by European land users as the main basis of their economic activity. The analysis of the land-use condition and the experience of EU countries can be used as a vector of effective and rational land-use and it can be a guide in organization of effective land policy with further integration into European space. In the context of transformation of all spheres of life, the ability of people to effectively communicate and resolve conflicts that arise throughout life is of great importance. The congestion of courts, the length and high cost, inflexibility and regularity of the judicial way of resolving conflicts in civil, family, labor and other areas of law make it necessary to resort to alternative approaches to dispute resolution (ADR). Of particular importance is the ability to use mediation procedures– an informal and flexible dispute resolution process. Mediation is free from the disadvantages of litigation: the European experience shows that the basic principles of mediation are voluntariness, autonomy of the parties, confidentiality of the procedure, the neutrality of the mediator, unlike a judge or lawyer. The actual application of these principles and rules of mediation allows for excellent results in conflict resolution - the practice of EU countries and associated members indicates that between 80% and 100% of cases are resolved through mediation. The article discusses in detail the experience of EU Member States in applying mediation practices: models of keeping a register of mediators (registering is possible by a single state body, more often it is the Ministry of Justice; registers can be maintained by a single non-governmental organization, for example, mediators' associations of a country; which unites mediators and each is responsible for its own register), the requirements for the qualification and professional level of mediators (usually any person without restrictions on the profession can become a mediator; but often the age criterion is used), the regulatory framework for mediation (mainly mediation is governed by the relevant country law, but also the approach without legislative regulation of mediation procedures, for example, in the Netherlands), the cost of mediation procedures (mainly depends on the complexity of the conflict case and the field of the case). The role of mediation in resolving labor disputes is considered: models of application of mediation in companies, issues of organization losses in the event of conflicts and their improper resolution, directions of improvement of the system of conflict management in organizations taking into account the European experience. ; В условиях трансформации всех сфер жизни большое значение приобретает умение людей эффективно коммуницировать и разрешать конфликты, возникающие в течение всей жизни. The article presents the results of the analysis of normative-legal and scientific sources, which reveal the peculiarities of officer training in the police forces in European countries at the end of XX – beginning of XXI centuries. It has been found out that the European integration processes have led to changes in the system of police training. The generalization of the tendencies makes it possible to state the influence of political and socio-economic conditions on this process in certain countries and in the European Community as a whole. It has been found that the system of police training is also a component of the European integration processes within the integration of law enforcement and police systems of the European Union. European police training institutions are characterized by a practical orientation of the process, a direct link to practice, continuity, a wide range of advanced training courses, and preparation for the interaction of national police services various levels, including through Interpol and directly between law enforcement systems. Police training is a focus not only for practitioners, but also for researchers, as evidenced by the discussion and validation at various levels of conferences, symposia, seminars, and other experience-sharing events. At the same time, the educational systems for training police officers are characterized by a careful attitude toward the unification processes of the Bologna Process, as well as a commitment to their own educational standards. A significant number of hours in executive police training programs are devoted to developing skills and abilities in the use of scientific and technological tools, which are used extensively in the work of the police in foreign countries. Theoretical training for police officers in EU countries is aimed at learning new ways of performing their duties. The practical part of the training helps more effectively carry out one's day-to-day duties. Police training in EU countries is conducted in several stages. A common trend in departmental police education is that police graduates receive departmental diplomas. Для європейських закладів освіти, де відбувається професійна підготовка персоналу поліції, характерною є практична спрямованість цього процесу, безпосередній зв'язок із практикою, безперервний характер, широкий спектр курсів підвищення кваліфікації, підготовка до взаємодії національних поліцейських служб на різних рівнях, у тому числі через Інтерпол, і безпосередньо між правоохоронними системами. Підготовка поліцейських кадрів є предметом уваги не лише практиків, а й науковців, про що свідчить обговореннята апробація на різного рівня конференціях, симпозіумах, семінарах та під час інших заходів з обміну досвідом. Водночас для освітніх систем підготовки офіцерів поліції характерним є обережне ставлення до процесів уніфікації, передбачених Болонським процесом, а також прихильність до власних освітніх стандартів. У програмах з підготовки співробітників поліції начальницького складу значний обсяг годин відведено формуванню навичок і вмінь роботи з науково-технічними засобами, які надзвичайно широко застосовуються в роботі поліції зарубіжних країн. Теоретична підготовка поліцейських в країнах ЄС спрямована на вивчення нових способів виконання своїх обов'язків. Практична частина навчання сприяє більш ефективному виконанню своїх повсякденних обов'язків. Професійна підготовка поліцейських кадрів в країнах ЄС проводиться поетапно. Спільною тенденцією відомчої поліцейської освіти є те, що випускники поліцейських закладів освіти отримують відомчі дипломи. У відомчих закладах освіти у програмах підготовки робиться наголос на важливість співпраці з громадськістю.
Мета. Розробити науково-методичні засади правової охорони сортів рослин в Україні відповідно до вимог CPVO (Community Plant Variety Office) Європейського Союзу (ЄС), проаналізувати відповідні методично-правові норми та підходи, спрямовані на вдосконалення системи правової охорони сортів рослин, як об'єктів інтелектуальної власності, ідентифікованих під час експертизи з визначення критеріїв відмінності, однорідності та стабільності (ВОС-тест).Результати. Визначення критеріїв відмінності, однорідності та стабільності передбачає ідентифікацію сортів рослин методом морфологічного опису ознак вегетативних і генеративних органів фенотипів. Морфологічна кодова формула сорту складається з відповідних кодів ознак та ступенів їхнього прояву і формується згідно з технічними документами та методиками на ВОС усіма країнами Міжнародного союзу з охорони нових сортів рослин (UPOV) та CPVO зокрема. Промоніторено методичне забезпечення охорони прав селекціонера та нових сортів рослин у країнах ЄС, проаналізовано протоколи CPVO методом порівняльного оцінювання загальної частини та таблиці ознак методик на ВОС для ботанічних таксонів 4 груп: сільськогосподарські, овочеві, плодові та декоративні.Висновки. Унаслідок порівняльного оцінювання Методик з експертизи на відмінність, однорідність і стабільність сортів рослин (CPVO – протоколи; UPOV – TG; Україна – UATG) установлено, що морфологічний опис сортів рослин під час польової діагностики якісних (QL), кількісних (QN) та псевдоякісних (PQ) ознак фенотипів є основним для проведення експертизи на ВОС-тест як за міжнародними вимогами UPOV, так і CPVO. Національні Методики проведення експертизи сортів рослин на ВОС розробляються з обов'язковим урахуванням вимог DOCUMENT TGP 7/3 DEVELOPMENT OF TEST GUIDELINES adopted by the Council at its forty-eighth ordinary session on October 16, 2014. Методична база CPVO ЄС на етапі досліджень у 2015 р. містила протоколи для 160 ботанічних таксонів, які представлено чотирма групами: сільськогосподарські (18), овочеві (46), плодові (30) та декоративні (66). Для проведення науково-технічної експертизи заявки на сорт рослин в Україні професійний інтерес становлять протоколи CPVO для 122 ботанічних таксонів, а саме: сільськогосподарські (18), овочеві (44), плодові (28) та декоративні (32). Польова діагностика фенотипів рослин методом морфологічного опису для ідентифікації сортів за відповідними ознаками та ступенями їхнього прояву для підготовки гармонізованих описів сортів рослин практично приведена до міжнародних вимог UPOV та частково до протоколів CPVO ЄС. ; Purpuse. To develop scientific and methodological principles of legal protection of plant varieties in Ukraine in accordance with the requirements of the Community Plant Variety Office (CPVO) and the European Union (EU), to analyze the relevant methodological and legal norms and approaches aimed to improve the system of legal protection of plant varieties as intellectual property objects identified during the expert determination the criteria for distinctiveness, uniformity and stability (DUS-test).Results. Determination of the criteria for distinctiveness, uniformity and stability implies the plant varieties identification by the method of phenotype morphological description (the signs of vegetative and generative organs). The morphological code formula of the variety consists of the corresponding codes of the sign and the degree of its expression that is formed according to the technical documents and DUS methods in all countries of the International Union for the Protection of New Varieties of Plants (UPOV) and CPVO. Methodological provision for the protection of breeder's rights and new plant varieties in the EU and the CPVO protocols were analyzed by the comparative method of the general parts and the tables of signs of DUS techniques for the botanical taxons of 4 plant groups: agricultural, vegetable, fruit and decorative.Conclusions. As a result of comparative assessment of DUS methods for plant varieties (CPVO – Protocols, UPOV – TG, Ukraine – UATG) was found that the morphological description of plant varieties during the field trials (qualitative (QL), quantitative (QN) and pseudo-qualitative (PQ) signs of phenotypes ) is the basic technique for conducting DUS testing according to the international UPOV requirements as well as to CPVO requirements. National Methods for Plant Varieties Examination for Distinctness, Uniformity and Stability are developed under mandatory requirements of the DOCUMENT TGP 7/3 DEVELOPMENT OF TEST GUIDELINES adopted by the Council at its forty-eighth ordinary session on October 16, 2014. The CPVO and EU methodological bases at the 2015 research stage included protocols for 160 botanical taxons, represented by four plant groups: agricultural (18); vegetables (46); fruit (30) and decorative (66). The CPVO protocols for 122 botanical taxons, namely: agricultural (18), vegetable (44); fruit (28) and decorative (32) are of great value for the application's scientific and technical examination for plant variety registration inUkraine. Field tests of plant phenotypes in accordance with morpho-descriptive method for variety identification by the relevant features and their degree of expression for harmonized description of plant varieties is practically brought to the UPOV international requirements and partly to CPVO protocols of the European Union. ; Цель. Разработать научно-методические основы правовой охраны сортов растений в Украине в соответствии с требованиями CPVO (Community Plant Variety Office) Европейского Союза (ЕС), проанализировать соответствующие методически-правовые нормы и подходы, направленные на совершенствование системы правовой охраны сортов растений, как объектов интеллектуальной собственности, идентифицированых при экспертизе по определению критериев отличия, однородности и стабильности (ВОС-тест).Результаты. The state of waste treatment in Ukraine and in the European Union countries was analyzed. It is determined that in comparison with Ukraine the European countries implement the basic principles of circular economy successfully. The shares of such problem waste recycling as plastic, organic waste, electric and electronic equipment waste grow annually. The European Union legislation on circular economy and bioeconomy responds the global challenges and the needs of industrial enterprises, and may become a guideline for filling and improvement of Ukrainian legislation. The characteristics of successful European business-models were presented. The role of financial component in circular economy projects realization. Based on the European Union countries experience the benefits and challenges of circular economy that Ukraine may face are determined.
The article is devoted to the analysis of the processes that form the basis of the European Bar, the study of the basics of legal regulation of European lawyers at the national and supranational levels to update the modern model of legal support of advocacy in Ukraine. Particular attention is paid to the need to transform domestic legal norms and bring them in line with European legal requirements for the legal profession. It is emphasized that the entire system of European Union law testifies to the autonomy of the legal profession, its independence and self-government. Emphasis is placed on the priority of guaranteeing the right to practice legal self-government. It has been found that the uniqueness of the EU lies in the fact that it includes states with specific legal systems. The European Bar is an important institution, the regulation of which is carried out at the national and supranational level of legal regulation. Particular attention is paid to the analysis of the General Code of Rules for Advocates developed by the Council of Advocates and Law Societies of Europe. This code constitutes a system of rules that are decisive for bar associations. These rules are clearly correlated with the system of basic tasks performed by lawyers as members of a bar association. It has been found that the bar of the EU is a powerful self-governing organization with an extensive system of self-governing bodies. Such a system is able to ensure the effective operation of the legal profession, training of lawyers and advanced training, quality of legal services, adherence to legal ethics and corporate culture of lawyers, timely disciplinary action for violations in the professional activities of lawyers. It is noted that the system of bar self-government bodies of the European Union is quite heterogeneous. The primary level of self-governing institutions is formed depending on the judicial districts (districts of the Tribunals of the first instance).
