Actualmente esta en crisis la esencia de la integración europea, que es la idea de proceso abierto y continuo, en lo económico, en lo político. Reiniciar el debate sobre el modelo político de la integración y sus modos democráticos de articulación es recuperar también el impulso esencial y el relato del proyecto europeo. Se propone plantear explícitamente un nuevo modelo de legitimidad para Europa, mediante un Pacto Confederal entre Estados y ciudadanos. ; The essence of European integration, which is the idea of an open and continuous process, is currently in crisis, economically and politically. To revive the debate on the political model of integration and its democratic modes of articulation is also to recover the essential impulse and the narrative of the European project. It is proposed to explicitly propose a new model of legitimacy for Europe, through a Confederal Pact between States and citizens.

The double purpose of this article is first to clarify the concept of citizenship as intended in the European Union and, second, to encourage society in our country -particularly the segment of society involved in education- to carry out a serious reflection on it, made in an objective manner and in a constructive focus, far away from stereotypes which support vested interests that could occasionally cause social divisions. ; La intención del presente artículo es clarificar el concepto de "ciudadanía" que se pretende en la Unión Europea, e invitar a una reflexión del conjunto social de nuestro país, y de la comunidad educativa, en particular, desde un enfoque objetivo y constructivo alejado de los estereotipos que propician intereses partidistas, en ocasiones, opuestos a la cohesión social.

This study analyzes the European Union politics about tourism, in order to continue as the world's number 1 tourist destination. The European Union actions aim at promoting the development of sustainable, responsible and high-quality tourism. Spain has introduced these principles in its legislation and also the landing and touristic plans apply them. ; Este estudio analiza las respuestas de la Unión Europea a la globalización, para que Europa continúe como el primer destino turístico del mundo. Las acciones de la Unión Europea persiguen promover el desarrollo de un turismo sostenible, responsable y de calidad. The European Union is going through a difficult crisis phase. It is a crisis that affects material aspects such as its economy and finances and, very specifically, the economies and finances of some of its member states; but it is a crisis that affects also immaterial aspect such as its own identity and the future of its political project. Many are the solutions that have been proposed in order to overcome this difficult stage, but in most of the cases these are inadequate solutions since they are not adapted to the peculiar nature of the EU as a legal and political organization. Therefore, firstly, this article analyzes the nature of the EU as a political organization and the different theories that have been issued in this regard. Secondly, the present situation of the EU is analyzed, including a perspective on what it is doing in this regard, and thirdly, the solutions to overcome this critical situation which have been proposed so far are also analyzed. ; La Unión Europea atraviese por una etapa difícil de crisis. Crisis que afecta a aspectos materiales, como su economía, sus finanzas y, muy en particular, las economías y finanzas de algunos de sus Estados miembros; pero crisis que afecta también a aspectos inmateriales, como su propia identidad y el futuro de su proyecto político. Muchas son las soluciones que se aportan para tratar de superar esta difícil etapa, sin embargo, en la mayoría de los casos se trata de soluciones inadecuadas porque no se adaptan a la naturaleza peculiar de la UE como entidad jurídico-política. Así, este trabajo, analiza, en primer lugar la naturaleza de la UE como entidad jurídico-política y las diferentes teorías que se han producido al respecto. En segundo lugar se analiza la situación actual de la UE y lo que ella hace al respecto, y, en tercer lugar se analizan las posibles soluciones que se aportan para esta situación crítica.The European Union is going through a difficult crisis phase. The new technologies of the information and the communication offer to the European Union wide possibilities to improve and simplify their own internal administration in order to provide an increased transparency and a better access to its information. At the same time, they allow an improved effectiveness in their service to the European citizens and companies, and also enable a better interaction between the EU institutions and the public organisms of the Member States. As a first step towards the electronic administration in Europe, the European Union adopted in 2002 the initiative eGovernment, framed into the plan of action eEurope 2005: a society of the information for all. The goal of this paper is to analyze the strategic plan designed by the European Commission for this first five-year period. It will be analyzed how the Comission is carrying out a transformation process into a virtual administration, and how electronic access to the government services in the Union contributes to strengthen democracy and transparency in the government of the European Union. ; Las tecnologías de la información y la comunicación ofrecen amplias posibilidades a la Unión Europea para mejorar y simplificar su propia administración interna en aras de una mayor transparencia y acceso a su información. Al tiempo, permiten una mayor eficacia en el servicio a los ciudadanos y a las empresas al propiciar una interacción más explícita entre las instituciones y los organismos públicos. Como primer paso hacia la gestión electrónica de la Administración eurocomunitaria, la Unión Europea adoptó en 2002, dentro del plan de acción eEurope 2005: una sociedad de la información para todos, la iniciativa eGovernment. El objetivo de este artículo es dar a conocer el plan estratégico diseñado por la Comisión para este primer quinquenio. Para ello, se analiza cómo se está llevando a cabo el proceso de transformación de una Administración presencial a una virtual y cómo el acceso electrónico a los servicios administrativos de la Unión Europea contribuye a una mayor democracia y transparencia en la Administración eurocomunitaria.

La elusión fiscal se define como la articulación de estrategias de minimización del pago de tributos que son conformes con la literalidad de la normativa pero no con una interpretación sistemática o teleológica, y ante las cuales el sistema tributario reacciona para, como mínimo, anular el beneficio fiscal obtenido. En el ámbito de la Unión Europea, el concepto de elusión – como todo lo tributario– se analiza desde la perspectiva de la promoción de un mercado interior en condiciones de libre competencia. La postura de las instituciones de la Unión ha variado, pasando de favorecer ante todo la libre circulación de bienes, capitales, servicios y trabajadores, permitiendo la aplicación de las medidas anti-elusión estatales sólo con carácter excepcional, a considerar que la elusión daña las condiciones de libre competencia empresarial y es necesaria una acción positiva y coordinada, cuyo exponente más elaborado es la Directiva (UE) 2016/1164, del Consejo, de 12 de julio de 2016, por la que se establecen normas contra las prácticas de elusión fiscal que inciden directamente en el funcionamiento del mercado interior. ; Tax avoidance is defined as the implementation of strategies of minimization of the tax burden that are in accordance with the literal wording of the regulations but not with their systematic or teleological interpretation. The tax system reacts to tax avoidance by, at least, supressing the benefit obtained by the taxpayer. Within the European Union, the concept of tax avoidance –like everything regarding tax matters– is analysed from the perspective of the promotion of an internal market under conditions of free competition. The stand taken by the Union institutions has shifted from promoting free movement of goods, capital, services, and labour while allowing the application of State anti-avoidance measures only on an exceptional basis, to consider that tax avoidance damages the conditions of free competition and positive and coordinated action is necessary. Here, a milestone has been the enaction of the Council Directive (EU) 2016/1164 of 12 July 2016 laying down rules against tax avoidance practices that directly affect the functioning of the internal market.
