An der Sprache des Rechts wird Kritik geübt, seit die Aufklärung die Verständlichkeit der Gesetze zu ihrem Anliegen gemacht hat. Mit den großen Kodifikationen des Rechts im ausgehenden 19. Jahrhundert hat die Kritik am angeblich schlechten, unverständlichen Juristendeutsch eine besondere demokratietheoretische Legitimation bekommen. Diese Sprachkritik sucht seit den siebziger Jahren vermehrt bei der Linguistik Rat, wie denn eine bessere Allgemeinverständlichkeit von Rechtstexten verwirklicht werden könnte. Der Band versammelt systematisch aufeinander bezogene Beiträge ausgewiesener Linguisten, Juristen und Schriftsteller zur Problematik des Verständnisses juristischer Sprache, zur Methodik empirischer Verständlichkeitsmessung und zu den Möglichkeiten transdisziplinärer Kooperation zwischen Rechts- und Sprachwissenschaftlern.
Sharing expertise is a growing field of interest because of the increased amount of available information, turnover of experts and globalization of companies. Sharing expertise is a difficult task; therefore, experts often lack motivation, skills and time to document their expertise. The developed expertise cycle is a framework where knowledge stewards build personal trusted relationships with experts. Knowledge stewards interview the experts, construct the knowledge and document it, making it available for knowledge seekers. The expertise cycle is tested in two cases where the expertise is distributed to different individuals and business units. In both cases the usage of the expertise cycle was expanded. As a conclusion, the usage of the expertise cycle and described best practices are recommended. Instead of providing more information we should concentrate on providing better quality of information – and the expertise cycle is a valuable method to achieve this goal.

For its 50 years, the European Conference of Ministers of Transport (ECMT) decided to edit a collective book and asked to « the Magnificent Seven » to write seven chapters. Alain Bonnafous wrote his chapter on the relationship between research and policy in the field of transport. European research in the field of transport economics owes a great deal to ECMT activities and initiatives. The full collection of Round Tables and Symposium reports prepared at the instigation of the ECMT provides an encyclopaedic body of knowledge. It bears witness to the vitality of European expertise and is an essential tool of reference of transport economics. The value and interest of the topics selected has always resided in the fact that they reflect the two-fold dimension of the ECMT – the dimension of a Conference of Ministers, meaning that the questions raised address immediate and, if possible, future policy concerns, but also a scientific dimension, meaning that the research community's knowledge and expertise are applied to answering these questions, if only partially. Thus, the Round Table reports, including the valuable summaries of discussions, constitute a long-term dialogue between decision-makers and experts – a dialogue of over 20 000 pages that has been maintained for over 35 years. The purpose of this brief report will be to take stock of this dialogue. For this exercise to be useful, it must be critical. The goal of this research project is to tell the story of acquisition expertise development within the DOD using the evolution of the Defense Acquisition University as its backdrop. It is a story about the persistent frame that claims expertise leads to acquisition success. It is about 40 plus years of competing perspectives of how best to acquire that expertise and their shaping effects. It is about technology choices amidst cultural and political conflict. It is about how budget, users, infrastructure, existing and emerging technologies, identity and geography all interrelate as elements within the technology of expertise development. Finally, it is about how at various times in the evolution of the Defense Acquisition University the technologies of tacit knowledge transfer have been elevated or diminished. ; Ph. D.
Nach einer Klärung von Grundannahmen der Expertiseforschung, insbesondere in Abgrenzung und Ergänzung zur Begabungsforschung, werden drei Ebenen unterschieden, auf denen Expertiseentwicklung beschrieben werden kann: Individuelle Mikroprozesse, individuelle Makroprozesse und Veränderung der Position in Netzwerken. Darauf aufbauend wird ein Modell der Handlungskompetenz vorgestellt, dem zufolge Experten anderen Personen in viererlei Hinsicht überlegen sind, nämlich bezüglich kognitiver Strukturen (Gedächtnis und Wissen), kognitiver Prozesse (Problemlösen und Entscheiden), Routinen sowie des sozialen Kontextes (Communities of Experts). Es wird aufgezeigt, dass es eine wichtige Konsequenz dieses Modells bezüglich der Förderung von Handlungskompetenz ist, dass individuelle und organisationale Faktoren dabei zusammenspielen müssen, zur theoriegeleiteten Reflexion professioneller Praxis anzuregen. It is then argued that three levels should be distinguished on which development of expertise can be described: individual micro processes, individual macro processes, and change of an individual's position within (professional) networks. Accordingly, a model of action competence is presented which differentiates experts' superiority into four components: superiority in cognitive structures (memory, knowledge), superiority in cognitive processes (problem-solving, decision-making), superiority in routines, and superiority in social context (communities of experts). An important consequence is derived from this model with respect to instructional use. 'Kontroversen um die Biomedizin sind durch normative Unsicherheit geprägt und werden als Wertkonflikte verhandelt. Dies stellt für die Politik eine erhebliche Herausforderung dar. Denn es besteht kein gesellschaftlicher Konsens darüber, was wir (nicht) wissen und tun sollten. Als politische Reaktion können wir eine Institutionalisierung von ethischer Expertise beobachten. In diesem Beitrag wird aus wissenschaftssoziologischer Perspektive Politikberatung durch Ethikkommissionen am Beispiel Österreichs analysiert. Die These lautet, dass die politische Verwertung von Ethik-Expertise deren Subsumtion unter die eigensinnigen Handlungslogiken des Politik-Systems bedeutet ('Politisierung von Expertise'). In der politischen Rezeption wird Expertise neu konfiguriert, um eine Übereinstimmung zwischen (divergierenden) ExpertInnenmeinungen und politischen Zielvorstellungen herzustellen. Politisches Lernen lässt sich vor diesem Hintergrund allenfalls als ein strategischer Umgang mit dem ExpertInnendissens beschreiben. In recent political debates there has been a significant change in the valence of the word "experts" from a superlative to a near pejorative, typically accompanied by a recitation of experts' many failures and misdeeds. In topics as varied as Brexit, climate change and vaccinations there is a palpable mistrust of experts and a tendency to dismiss their advice. Are we witnessing, therefore, the "death of expertise," or is the handwringing about an "assault on science" merely the hysterical reaction of threatened elites? In this new book, Gil Eyal argues that what needs to be explained is not a one-sided "mistrust of experts" but the two-headed pushmi-pullyu of unprecedented reliance on science and expertise, on the one hand, coupled with increased suspicion, skepticism and dismissal of scientific findings, expert opinion or even whole branches of investigation, on the other. The current mistrust of experts, Eyal argues, is best understood as one more spiral in an on-going, recursive crisis of legitimacy. The "scientization of politics," of which critics warned in the 1960s, has brought about a politicization of science, specifically of regulatory and policy science, and the two processes reinforce one another in an unstable, crisis-prone mixture. Eyal demonstrates that the strategies designed to respond to the crisis - from an increased emphasis on inclusion of laypeople and stakeholders in scientific research and regulatory decision-making to approaches seeking to generate trust by relying on objective procedures such as randomized controlled trials (RCTs) - end up exacerbating the crisis, while undermining and contradicting one another.
L'institutionnalisation du développement durable dans le domaine de l'architecture induit diverses transformations dans le recours à l'expertise, à propos desquelles les architectes arborent des positions hétérogènes. Certains d'entre eux constituent des supports aux évolutions des politiques publiques, et tendent dès lors à être considérés comme des experts. D'autres, au contraire, doutent de, voire contestent, l'orientation normative qui s'en suit, par opposition ils peuvent être appréhendés comme de potentiels experts de l'expertise. Ces doutes sont considérés comme relevant d'un problème d'information, voire d'inertie au changement, par les pouvoirs publics qui ne cherchent dès lors pas à en tirer des enseignements. Visant à éclairer ces divergences d'opinions et de positions en matière de supports à l'action publique, la présente contribution aborde deux objets : l'implémentation de l'instrument de certification passive dans la politique énergétique bruxelloise, et les arguments d'architectes sceptiques, voire contestataires, ayant eux-mêmes réalisé un ou plusieurs bâtiments passifs. La confrontation de ces deux objets d'analyse met en évidence des divergences d'appréhension des notions de développement durable et d'architecture. ; The institutionalization of sustainable development in the field of architecture leads to changes in terms of expertise. Architects have heterogeneous positions on this subject. Some, considered as experts by the public authorities, participate to the evolutions of public policies. Others doubt, even condemn, the normative orientation of these developments. By opposition they could be considered as potential experts of the expertise. Generally their doubts are discarded by the authorities that attribute them to a lack of information, or even to inertia. Trying to enlighten these differences of opinions and positions in terms of supports for public policies, the paper examines two objects: On the one hand, the implementation of the passive house certification in the Brussels energy policy; On the other hand the critics of architects who have build one or several passive buildings. The confrontation of these objects indicates a difference of apprehension of sustainable development and architecture notions. ; Peer reviewed
Die Akzeptanz ökonomischen Wissens ist nach Meinung des Autors weitgehend davon abhängig, dass es eine konjunkturelle und strukturelle Bestätigung findet, sonst ist es in der politischen Kommunikation relativ wertlos. Diese Anfälligkeit der ökonomischen Expertise für ihre Umstände hängt mit ihrem grundsätzlichen Charakter zusammen, Wissenschaft und Kunstlehre zugleich zu sein. Das zeitweilige Scheitern der Sätze einer Kunstlehre, die als Wissenschaft zugleich den konjunkturellen und strukturellen Wandel plausibilisiert, der ihr eigenes Auf und Ab als Expertise begründet, ist geradezu eine Ironie des Faches. Sie kann sich für den Experten freilich als Tragik erweisen: Er muss seine Kunstlehre im Gestus des Überzeugten vortragen, kann dabei aber jederzeit von der Realität des ökonomischen Prozesses überholt werden. Ihrer tragischen Rolle als Helden auf Abruf sind sich die Experten wohl selten bewusst. Vielmehr herrscht eine politische Absicht oder Naivität vor, die vielleicht notwendig ist, um als Experte nicht zu verstummen. Die ökonomische Expertise geht also nicht unter, sondern passt zur Lage oder auch nicht. Das häufige Scheitern ihrer Ratschläge haben die Ökonomen zwar selbst immer wieder bemerkt, führten es aber weniger auf das strukturelle Problem als auf fehlerhafte Expertisen oder die Ignoranz der Politik zurück. Das Ansehen der Experten und die Bedeutung der Expertise haben unter diesem Auf und Ab insgesamt nicht gelitten, auch wenn die alte Aura, die zum Beispiel der "Rat der fünf Weisen" in den 1960er Jahren noch hatte, verflogen ist.
