"De inbreng van deskundigen is al decennia lang niet meer weg te denken uit juridische procedures. Een rustig bezit is dit leerstuk evenwel niet. Gerechtelijke dwalingen en andere discussies brengen de pennen onverminderd in beroering. Bij de inbreng van deskundigen speelt in essentie altijd dezelfde basisproblematiek. Hoe weet je als leek of je de juiste deskundige hebt geselecteerd en hoe beoordeel je diens inbreng? Uiteindelijk maakt immers een gebrek aan deskundige kennis bij de verschillende procesdeelnemers het noodzakelijk om een deskundige in te schakelen. In het straf-, privaat- en bestuursrecht wordt op telkens verschillende manieren met bovenstaande problematiek omgegaan. In dit onderzoek is voor het eerst een vergelijking gemaakt van de wijze waarop de inbreng van deskundigen wordt genormeerd in deze drie rechtsgebieden. Aan de hand van een lijst met kwaliteitseisen zijn positieve punten en knelpunten gesignaleerd en is onderzocht wat de rechtsgebieden van elkaar zouden kunnen leren. Dat heeft geresulteerd in een diepgaande juridische analyse van de normering van de inbreng van deskundigen in juridische procedures. Die analyse wordt gevolgd door toepasbare inzichten en aanbevelingen. Dit maakt De deskundige in het recht tot een bruikbaar handboek voor wetenschappers, beleidsmakers, deskundigen en studenten."--
In this 30th edition of the Yearbook on Poverty and Social Exclusion, we look back on 30 years of fighting poverty. How have the poverty figures evolved? We take a closer look at access to justice, education and housing. Next, we are looking for an answer to the question of what constitutes a structural poverty policy. Can the law be of any significance here? This year's theme section is dedicated to the coronapandemic and its link to poverty. Subsequently, a number of civil society organisations are given a chance to express their expertise and findings. In a final section, the Yearbook presents an overview of figures on poverty and social exclusion.
Four articles on political participation of political scientists, a matter that is not as simple as it seems. The article starts with an introduction, stating that political sciences cover a much larger field than party politics, and that one of the objects of a political scientist is the division between opinions and engagement on the one hand, and scientific analysis on the other. The articles are 1) on the difference between affiliation to a political party and governmental responsibilities, against a background of deontological argumentation (Van Praag); 2) the same subject as before, but within a pragmatic context (Van Aelst); 3) practical political expertise as enrichment for education and research (Koole); 4) neutrality, objectivity and engagement in co-habitation of political science and party politics (Bake). j In dit boek gaan we in op het belang van een kwalitatief hoogwaardige huishoudelijke verzorging. Nederland heeft een lange traditie op dit gebied. Daarbij is steeds gezocht naar een evenwicht tussen kostenbeheersing en optimalisatie van kwaliteit. In dit kader is er een schat aan ervaring en expertise opgebouwd, die benut kan worden bij het ontwikkelen en vo- geven van nieuw beleid op gemeentelijk niveau. Sociale gelijkheid is goed voor iedereen. Het vormt een buffer tegen drugsgebruik, criminaliteit, gezondheidsproblemen (lichamelijk én psychisch) en wantrouwen (van mensen jegens elkaar en de gemeenschap). Streven naar meer gelijkheid is dan ook geen filantropische onderneming, maar een zinvolle en noodzakelijke activiteit om het welzijn van anderen én van onszelf te verbeteren. Sociale ongelijkheid is een complex vraagstuk. Wetenschappelijk inzicht, opgebouwd over een langere tijd en vanuit meerdere perspectieven, is onontbeerlijk voor structurele oplossingen. De Universiteit van Amsterdam (UvA) heeft een brede expertise op dit terrein. Ongelijkheid is een speerpunt in het onderzoek. Het Amsterdam Centre for Inequality Studies, verbonden aan de sociale faculteit van de UvA, combineert wetenschappelijke expertise op dit gebied met maatschappelijk engagement. Onderzoekers van verschillende disciplines werken er samen om greep te krijgen op het ontstaan én het voorkomen van ongelijkheid. De hoofdstukken in deze bundel laten hiervan mooie voorbeelden zien. De auteurs presenteren niet alleen wat ze al weten, maar formuleren ook nieuwe kennisvragen. In de verschillende bijdragen staan grootstedelijke vraagstukken centraal: over wonen, mobiliteit, duurzaamheid, onderwijs, radicalisering en arbeidsparticipatie. De casussen komen vaak uit Amsterdam, maar zijn mondiaal relevant, ze spelen in alle wereldsteden. Hoe stimuleren we een bloeiende creatieve economie en houden we tegelijkertijd de middenklasse en de laaggeschoolden in de stad? Hoe ontwikkelen we de stad met oog voor ongelijkheid tussen bevolkingsgroepen in zowel (woon) ruimte als inkomen? Hoe doen we dat op een duurzame manier? Hoe maken we slim en verantwoord gebruik van kunstmatige intelligentie? Hoe betrekken we alle burgers bij de samenleving?
The military is generally considered to act as a professional when it comes to retreating forces from military battleground or international conflict areas. At the same time recent national experiences with the withdrawal of national troops from international peacekeeping operations are filled with disappointments and crises. In this article the authors question the idea that these disappointments and crises are simply due to problems of reduced military competence or military morale. They argue that the military is still the alleged expert who knows how to perform military retreats and other military actions. At the same time they show that network-like decision-making structures that are inherent to the deployment of troops in international peacekeeping missions, have become a major obstacle for the military to act in its own right. The lessons that government can learn from the military experience are firstly, that decisions for national public cutbacks should be accompanied by a more in-depth (re)consideration of public (key) tasks than up to now was considered appropriate, and secondly, that more trust should be shown in the skills, knowledge and motivation of professionals to delineate and constrain the boundaries of their own fields of expertise.
In dit boek beschrijft Han Meyer de bewerking van het dynamische deltalandschap van Nederland als een proces waarin drie factoren sterk met elkaar verweven zijn geraakt: de waterbouwkundige werken en expertise op dat gebied, de groei van het stedelijk patroon in West-Nederland en de ontwikkeling van Nederland als natiestaat. Met name in de 19e en 20e eeuw werden zowel grote waterbouwkundige interventies als de ruimtelijke ordening een zaak van de nationale staat. Maar in het begin van de 21e eeuw zijn de ideeen over de betekenis van de nationale staat sterk veranderd en wordt de ruimtelijke inrichting van het land niet meer als een taak van die staat gezien. Intussen dwingen klimaatverandering en een sterke concentratie van bevolking en kapitaal in het westen tot een ingrijpende update van het waterveiligheidssysteem. De vraag is of er met deze veranderende omstandigheden voldoende perspectief is voor een toekomst van de Staat van de Delta
The problem of abortion as a political issue is discussed by focusing on two reports of the Belgian National Commission for Ethical Problems (fall 1976). Both the `translation' of the political problem into a question to be handled by an `apolitical' commission on the level of scientific expertise, & the delivery of two dissenting reports are studied as a typical stage of the development of the political decision-making process in this matter, & compared with similar evolution in neighboring countries (West Germany, France, & the Netherlands). From political theory perspectives, the main problem centers on the question: How does a parliamentary democracy solve such a deep-seated conflict concerning the `basic values' of a social ethical order? Answer elements can be gathered from a comparative analysis of the different positions & arguments in the two reports of the Ethical Commission. In opposition to the majority report (13 members in favor) the minority report (12 members opposed) claims that the legalization of abortion would bring about a drop of 10-15% in the birth rate. The minority argues that a truly ethical choice for abortion is difficult to make, since: (1) the choice must be made as soon as possible,.ie, with little time for reflection, & (2) its importance is belittled in order to avoid guilt feelings in the mother. Some of the most important differences between the two groups concern the relationship of ethics to law. The majority argues that a social concensus must be built on the least possible number of ethical presuppositions, while the minority argues that social cohesion is impossible under those conditions. A difference in tone between the two reports is also noted: the minority argument is much more emotional. This shows that the dispute is political, not scientific, & that it has important consequences for the evolution of the social pattern of values. Modified HA.

This thesis is about International Medical Graduates or foreign doctors, trained outside the European Economic Area, who settle permanently in the Netherlands. From the early nineties the number of foreign doctors residing in the Netherlands either as refugees or as partners/spouses of Dutch citizens has risen steadily. Foreign doctors who wish to practise medicine in the Netherlands must obtain a declaration of professional competence, issued by the Department of Public Health, Welfare and Sports (VWS). A considerable number of foreign doctors received negative decisions by the Health Department. They were not allowed to practise medicine in the Netherlands. As a result, from the mid nineties, a growing number of foreign doctors applied to the medical faculties for admission as medical students in order to obtain a Dutch medical degree. Therefore, in 1995, it was decided to institute the Committee Influx Foreign Doctors (CIBA), a central placing committee. Between 1996 and 2007 the CIBA has processed over a 1000 admission requests. Until 2002, in spite of the imminent shortage of doctors, the Department of Health had done little to enhance the use of the expertise brought in by the foreign doctors for the benefit of Dutch society. The focus of this investigation has been: 1. How is it guaranteed that foreign doctors meet the medical quality standards (knowledge, skills, attitude), or how is the assessment of these qualities measured. And 2. After obtaining permanent residency in the Netherlands, do foreign doctors have access to the profession for which they had qualified before in their country of origin or another non-EEA country? Late 2001 the Department of Health and the medical schools were stimulated to cooperate in order to improve the additional training programmes for foreign doctors. Blockchain: (r)evolutie?00Zal deze revolutionaire technologie de gevestigde juridische orde op haar grondvesten doen daveren of is het huidige rechtssysteem voldoende robuust om met deze evolutie om te gaan?0Blockchain is een revolutionaire technologie waar heel wat potentieel aan toegeschreven wordt. Het zou de rol van vertrouwde tussenpartijen zoals banken, notarissen of de gemeentelijke diensten van de burgerlijke stand doen verdwijnen of op zijn minst leiden tot een herdefiniëring van hun werking en taken. Ongetwijfeld zal deze technologie ook een grote impact hebben op de juridische sector. Er is dan ook dringend nood aan advocaten, bedrijfsjuristen, gerechtsdeurwaarders, academici, beleidsmakers en rechters die hierover expertise opbouwen.0 0Er zijn echter nog heel wat fundamentele technische en juridische vragen die vooralsnog onduidelijk of onbeantwoord zijn. Brussels' urban space, like that of many other cities, is dotted with evidence of a productive industrial past. The activities that took place there were generally not geared to mass production for export, but to small-scale manufacturing aimed at supplying the needs of local city dwellers. That small-scale manufacturing industry included members of the building trade such as contractors, joiners and builders' merchants who catered to the demand for housing in an ever-expanding city. Their business premises formed a vital link in the creation and renovation of the urban fabric. This article focuses on the values of small-scale industrial heritage from the building trade, which is under enormous pressure in a city like Brussels. The dynamics of constantly rising real estate prices make residential redevelopment a lucrative investment. Thanks to gentrification, many workshops are being converted into housing and former warehouses are falling prey to large-scale property development. Real estate dynamics, scaling-up and changing market conditions are also contributing to the disappearance of the small-scale, live-work fabric that fosters a beneficial mix of functions. The expertise and skills that for centuries have supplied the basic needs of the city in a sustainable manner are then lost. In light of growing traffic congestion and unemployment, academics and urban planners are becoming increasingly convinced of the need for permanently embedded, city-servicing economic actors like building businesses. Thus, even today, small-scale industrial heritage is vital to the functioning of the urban economy, in that offers the possibility of spatially organizing or reorganizing city-servicing activities within a dense urban fabric. Inspired by integrated concepts of heritage, we therefore argue in favour of a broadening of industrial heritage values aimed at anchoring the use of such locations in time and space. We take issue with an exclusively material approach to industrial heritage by pointing out the immaterial heritage value of a continuity of productive use. After a brief theoretical reflection on the value of small-scale industrial heritage in the city, we examine the historical evolution of Brussels' industrial heritage at the macro level between 1890 and 1970, the period in which the development of the suburbs of Brussels was in full swing. We use a series of exemplary cases to illustrate the different trajectories of continuity and discontinuity of heritage on the one hand, and productive use of building trade locations in Brussels on the other. We also try to get to grips with the motivations of businesses that abandon the city, cease to exist or manage to adapt to volatile market conditions. This article uses a selection of cases to challenge a purely material approach to industrial heritage and makes the case for further research into the question of how individual heritage legislation might also recognize immaterial heritage values in historical business activity on a particular site or in an industrial building.
