In light of the Federal Emergency Management Agency's performance in the aftermath of Hurricane Katrina & the terrorist threat, it is argued that FEMA should delegate authority for disaster response to states & localities. Attention is given to tracing the legislative history of emergency management including the 1979 establishment of FEMA, FEMA's development & poor performance through the 1990s, FEMA's 1993 reorganization under James Lee Witt, its privileging of natural disasters over civil defense & terrorism, the state of FEMA when Hurricane Katrina struck.
