In this article, the authors review and analyze the features of functioning and development of a new financial market segment - the cryptocurrency market or electronic cash (specific digital assets). At present, the cryptocurrency segment (and digital financial assets at large) cannot be recognized as a formal institution, since there is no legal framework in this area, and informal interaction regarding the creation and circulation of cryptocurrencies is not an established social and financial-economic phenomenon. The analytic comparison using discount methods allows to a certain extent to evaluate the effectiveness and feasibility of e-cash issuance from the viewpoint of physical persons. The authors identify the main directions in institutionalizing the cryptocurrency segment of the financial sector of the national economy and substantiate the need for legal recognition of cryptocurrencies in the status of digital goods, which in turn involves the need to improve the Russian Federation legal framework.

In conditions of financial institutions' development it is crucial to examine the transformation in the form of a collective investment institution under the influence of digitalization and, in particular, the emergence of cryptocurrencies. The subject of the research refers to the features of ICO functioning as a transformation of a financial institution for collective investment. The goal is to explore the ICO as a new form of collective investment. The results of the research are achieved through a comprehensive comparative analysis of ICO and IPO as a basic tool of financial institutions. The paper highlights the advantages and disadvantages, identifies the factors, analyzes the institutional regulation of ICO and proposes development vectors from three angles: for project creators, investors, regulators. The results can be used in policymaking, the functioning of joint investment platforms, in training specialists in the field of digital economy and financial markets.
The driver of the modern global economy is digital technologies under the influence of which not only new kinds of professions, goods and services are formed, but also challenges for enterprises and the organization of various fields of activity. Digitalization affected the IT-sphere, the activities of financial organizations, production, marketing, healthcare. In the Russian Federation the development of digital technologies in various fields of activity is of great importance, which is reflected in official documents, targeted government programs, business analysts and business practices. All this actualizes the study of the problem of management transformation in non-financial organizations under the influence of the spread of digital technologies.The article examines the strategic challenges facing non-financial organizations of Russia in the digital economy. In the course of solving the tasks set, the formation and development of the digital economy, its essence and content, as well as the prospects for its development in our country, were studied; the program documents and directions of the state program for the development of the digital economy are analyzed. It is proved that involvement in the digitalization processes of not only financial but also non-financial organizations carries a huge potential in terms of improving the value environment of Russian business, since it makes transactions in the shadow economy, corruption schemes, etc. transparent. The authors have proved that the revival of traditional values of Russian entrepreneurship on a new modern basis will increase the level of trust in society, will promote the development of innovations in industry, energy, agro-industrial complex, education and sustainable development of the economy as a whole. The authors structured the challenges of the digital economy for non-financial organizations in our country and formulated proposals for improving the ecosystem of the digital economy. ; Драйвером современной глобальной экономики являются цифровые технологии, под влиянием которых формируются не только новые виды профессий, товаров и услуг, но и вызовы для предприятий и организации различных сфер деятельности. Цифровизация затронула IT-сферу, деятельность финансовых организаций, производство, маркетинг, здравоохранение. В Российской Федерации развитию цифровых технологий в различных сферах деятельности придается огромное значение, что находит отражение в официальных документах, целевых государственных программах, бизнес-аналитике и практике бизнеса. Все это актуализирует изучение проблемы трансформации управления в нефинансовых организациях под влиянием распространения цифровых технологий.В статье исследуются стратегические вызовы, стоящие перед нефинансовыми организациями России в условиях цифровой экономики. В ходе решения поставленных задач исследуются становление и развитие цифровой экономики, ее сущность и содержание, а также перспективы ее развития в нашей стране; проанализированы программные документы и направления государственной программы развития цифровой экономики. Доказано, что вовлечение в процессы цифровизации не только финансовых, но и нефинансовых организаций несет в себе огромный потенциал с точки зрения оздоровления ценностной среды российского бизнеса, поскольку делает «прозрачными» сделки в теневой экономике, коррупционные схемы и т. п. Авторы доказали, что возрождение традиционных ценностей российского предпринимательства на новой современной основе повысит уровень доверия в обществе, будет способствовать развитию инноваций в промышленности, энергетике, агропромышленном комплексе, образовании и устойчивому развитию экономики в целом. Авторы структурировали вызовы цифровой экономики для нефинансовых организаций нашей страны и сформулировали предложения по совершенствованию экосистемы цифровой экономики

This article assesses the impact of sovereign countries in global financial governance. It uses the methodology of international political economy that studies the interaction between political and economic processes in the international arena. It shows the dualistic nature of international financial institutions, which, on the one hand, represent intergovernmental organizations and, on the other hand, are financial institutions with financial goals. The author investigates the principles of sovereign equality, equitable geographical representation and equal (parity) representation of groups of countries with distinct interests in the International Monetary Fund (IMF), Group of 20 (G20) and Financial Stability Board (FSB). The IMF's decision-making mechanism is shown in detail, including its executive board and the recent redistribution of quotas among member states, with special attention on the formula for calculating quotas, its criticism and possible reform. The article shows the major causes of reducing the impact of the IMF and the formation of a new, globally distributed system of financial governance. The article shows the hierarchy (by function as well as by country representativeness) of the system of global financial governance, established by 2010. It discusses the leadership of countries according to quantity and to key indicators (revenues, assets and market capitalization) of global systemically important financial institutions (banks and insurance company). Based on countries' membership in the G7 and the G20, the FSB, IMF, Organisation for Economic Cooperation and Development, and Bank for International Settlements countries are designated as at the core, semi-periphery or periphery of the international financial system in the context of the world systems theory. The influence of the technical elite, prevailing in the international financial sector, as well as the qualitative composition (education) of its members are revealed. The article concludes that there is significant polarization in the international financial system (core and the socalled marginal majority). Unlike the IMF, the newly created global financial institutions of the G20 and FSB fully comply with the principles of equitable geographical representation and parity representation of states with distinct interests.

The article analyzes the pension reform implemented in Russia in 2013–2014, provides the modeling of possible pensions, determines the efficiency boundaries for the use of insurance and savings-insurance schemes offered by the Pension Fund of Russia. The author examines the activities and effectiveness in managing pension savings and reserves from non-state pension funds, especially the system of voluntary savings insurance. The study identifies the challenges faced by these financial institutions, which constrain the development of the Russian pension system. Drawing on logical and econometric analysis the author identifies the competitive opportunity for banks to participate in the Pension Benefits Act, calculates the proposals' efficiency for future retirees and the banking system as a whole, determines the contribution of the proposed solutions to enhanced competition and more competitive banking environment.
This article describes theoretical and practical issues of introducing the institution of financial and corporate responsibility of legal entities, an analysis of foreign and national legislation in the field of regulation of liability of legal entities, and gives suggestions and recommendations aimed at improving the legal norms of corporate legislation.

Since the current budget reform proclaimed the transition from cost management to the management of results as the main objective, there arises a necessity to reform institutions of the public sector, including the improvement of the financial mechanism of the budgetary institution operation to make it consistent with the present market requirements.The paper considers the historical aspects of the formation and evolution of the financial mechanism of the budgetary institution operation, describes its contents before and after the adoption of the Federal Law No. 83- FZ «On Amendments to Certain Legislative Acts of the Russian Federation to Improve the Legal Status of Public (Municipal) Institutions» dated May 8, 2010. The paper also identifies areas for improving the financial mechanism of the budgetary institution operation: arguments in favor of using the government (municipal) task assignment as the main tool to regulate the volume and quality of public (municipal) services are given along with substantiating the necessity to improve the mechanism for granting subsidies from the Russian Federation budget system and to use normative per capita funding of public (municipal) services. ; В рамках проводимой бюджетной реформы, провозгласившей в качестве основной цели переход от управления затратами к управлению результатами, возникла необходимость реформирования учреждений государственного сектора экономики, в том числе совершенствования финансового механизма функционирования бюджетных учреждений, который не соответствует рыночным условиям их функционирования.В статье рассмотрены исторические аспекты становления и развития финансового механизма функционирования бюджетных учреждений, определено его содержание до и после принятия Федерального закона от 8 мая 2010 г. № 83-ФЗ «О внесении изменений в отдельные законодательные акты Российской Федерации в связи с совершенствованием правового положения государственных (муниципальных) учреждений».Определены направления совершенствования финансового механизма функционирования бюджетных учреждений: обоснована необходимость применения государственного (муниципального) задания как основного инструмента регулирования объема и качества государственных (муниципальных) услуг; совершенствования механизма предоставления субсидий из бюджетной системы РФ; использования нормативно-подушевого финансирования государственных (муниципальных) услуг.

The concept of self-employment as a form of individual entrepreneurship has been considered. A detailed analysis of the experience of foreign countries in establishing the institution of the self-employment,common and distinctive features of the applied models of the development of self-employment in European countries, Australia and the USA, has been presented. Much attention has been paid both the characteristic of the category "self-employed citizens" and the review of their areas of activity in Russia today. Available mechanisms and tools for the development of self-employment have been analyzed. Particular attention has been paid to the analysis of the concept of self-employment and its forms, presented in legislative acts, which serve as the basis for effective regulation by the government. Conclusions and recommendations of the authors on the application of the new special tax treatment on the income of self-employed citizens, implemented as part of a pilot project in several regions of the Russian Federation, have been presented. ; Рассмотрено понятие самозанятости как формы индивидуального предпринимательства. Представлен подробный анализ опыта зарубежных стран по созданию института самозанятости, общих и отличительных черт применяемых моделей развития самозанятости в европейских странах, Австралии и США. Большое внимание уделено характеристике категории «самозанятые граждане» и обзору их сфер деятельности в современной России. Проанализированы имеющиеся механизмы и инструменты развития самозанятости. Особое внимание уделено анализу понятия самозанятости и ее форм, представленных в законодательных актах, которые выступают основой эффективного регулирования со стороны государства. Представлены выводы и рекомендации авторов по применению нового специального налогового режима на доходы самозанятых граждан, реализуемого в рамках пилотного проекта на территории нескольких субъектов Российской Федерации.

The aim of the study was to determine the role of self-regulation as one of the key strategic elements in the reconstruction of the financial system in crisis. Approaches – including analysis of the causes and consequences of the global financial crisis in 2008, the monographic literature on the subject identified challenges and their solutions for implementation of self-Regulation of the financial sector (results of research). Social value – the current situation of the crisis of investor confidence in the financial sector requires substantial organizational restructuring. The confidence of investors in adjustable and adequate operation of the financial sector is key for ensuring long-term economic recovery in conditions of the ongoing financial crisis. Practical application of the results is justified practical necessity of establishing responsibility for regulating and minimizing systemic risk of financial firms, the establishment of the state strategy of generating and maintaining an effective method of state regulation and control, defining key goals of economic policy, and have oversight and control over the development of the system of self-regulation (compliance programs) promoted by the sector. The originality lies in the fact that in the scientific revolution introduced the theoretical conclusions, the modern practice of self-regulation of the financial services sector with strong governmental control. ; Цель исследования – определить роль саморегулирования как одного из ключевых стратегических элементов в восстановлении финансовой системы в условиях кризиса. С учетом анализа причин и последствий мирового финансового кризиса 2008 года и научной литературы по данной проблематике были определены проблемы и пути их решения по внедрению саморегулирования финансового сектора. Современная ситуация – кризис доверия инвесторов к финансовому сектору – требует существенной организационной реструктуризации последнего. Вера инвесторов в адекватное и регулируемое функционирование финансового сектора является ключевым моментом при обеспечении долгосрочного экономического восстановления в условиях продолжающегося финансового кризиса. Обосновывается практическая необходимость установить ответственность по регулированию и минимизации системного риска финансовых компаний, создать государственную стратегию генерации и поддержания эффективного метода государственного регулирования и контроля, определяющего ключевые цели экономической политики и осуществляющего надзор и контроль над развитием системы саморегулирования (комплаенс-программ), продвигаемой сектором. В научный оборот внедряются теоретические выводы, современные практики саморегулирования сектора финансовых услуг при строгом государственном контроле.

The article notes that the main acts of the Australian Parliament governing the statutory depository institutions (including Australian banks, Australian offices and branches of foreign banks, construction societies, credit unions, specialized lending institutions and providers of purchased payment means) are: 1) banking activities in 1959; 2) The Reserve Bank Law (RBA) of 1959; 3) The Financial Sector Act (shareholding) of 1998; 4) The Corporations Act of 2001; 5) The Financial Sector Act (data collection), 2001. The regulation of the financial system in Australia is based on the structure of the "twin peaks", when the financial system is regulated not by one but by two financial regulators - the Australian Prudential Regulation Authority (APRA) and the Australian Securities Commission and investments (ASIC). Large banks own approximately three-fourths of the total assets owned by "authorized depository institutions" (ADI) in Australia. ADI have assets of $ 4.6 trillion, which is about two and a half times that of the Australian economy at $ 1.8 trillion. The main types of ADI are: a) banks; b) building societies; c) credit unions; d) other financial institutions (ADI, which do not fall under any of the previous categories). ; В статье отмечается, что основными актами австралийского парламента, регулирующими уставные депозитные учреждения (ADI) (включая австралийские банки, австралийские представительства и филиалы иностранных банков, строительные общества, кредитные союзы, специализированные кредитные учреждения и провайдеры приобретаемых платежных средств) являются: 1) Закон о банковской деятельности 1959 г.; 2) Закон о Резервном Банке (RBA) 1959 г.; 3) Закон 1998 г. о финансовом секторе (доли участия); 4) Закон о корпорациях 2001 г.; 5) Закон о финансовом секторе (сбор данных) 2001 г. Настоящая статья преследует три цели. Во-первых, мы оцениваем фундаментальные основания экономико-социологического подхода к проблеме доверия на концептуальном и операциональном уровнях, которые развиваются в последние годы в России и за рубежом. Во-вторых, мы анализируем результаты социологических исследований в финансовом секторе экономики России на данных динамики оценки доверия населения финансовым институтам за последние шесть лет. В-третьих, мы обсуждаем эффективность финансового рынка России, которая определяется как низкой глубиной российского финансового рынка в целом, так и проблемами качественного характера, ключевые из которых: слабое доверие бизнеса к государству как регулятору; недоверие государства к населению и бизнесу; слабое доверие населения / домохозяйств к бизнесу и государству. Проблемы взаимного недоверия являются тормозом финансового развития в России; в то время как сами эти проблемы обусловлены низким качеством действующих институтов, предопределяющих плохой инвестиционный климат и низкое качество государства в целом. ; The present article pursues three goals. Firstly, we estimate the fundamental basis of economic-sociological approach to the issue of trust on the conceptual and operational levels, which have been developed in the recent years in Russia and abroad. Secondly, we analyze the results of sociological research in the financial sector of the Russian economy on data of the dynamics of the assessment of public trust in financial institutions over the past six years. Thirdly, we discuss the effectiveness of the Russian financial market, which is defined by both the lowest depth of the Russian financial market in General and the problems of qualitative character, the defining of which are: lack of businesses' trust in the government as the regulator; distrust of the government to citizens and businesses; lack of trust of the population/households to business and the government. The problems of mutual distrust are a brake on financial development in Russia, while these problems are caused by poor quality of institutions that determine poor investment climate and the poor quality of the state as a whole.
