The subject of consideration and analysis in the article is, among others, an assessment of a legislative process related to the creation of the National Revenue Administration, and a subsequent pragmatics relating to its HR and payroll policy. Studies have shown that a reform of the government administration of public levies in the field of the so-called consolidation of the tax administration, customs service and fiscal control has not been adequately prepared. In this respect, the Author identified main shortcomings of that reform, supporting his views with empirical material. ; Przedmiotem rozważań i analiz w artykule jest m.in. ocena procesu legislacyjnego związanego z utworzeniem Krajowej Administracji Skarbowej wraz z następczą pragmatyką kadrowo-płacową w tym obszarze. Przeprowadzone badania wykazały, że reforma rządowej administracji danin publicznoprawnych w zakresie tzw. konsolidacji administracji podatkowej, służby celnej oraz kontroli skarbowej nie została należycie przygotowana. W tym zakresie autor wskazuje główne jej mankamenty, popierając swoje tezy materiałem empirycznym.

The paper analyzes how selected budgetary governance institutions can influence the motivation and capability of public sector entities to generate, implement, and diffuse innovations in public production. Numerical fiscal rules, top-down and concentrated budgetary decision-making process, medium-term budget framework and program budgeting were identified as having positive impacts. The analysis is followed by an assessment of the central government sub-sector budgetary governance system in Poland, which showed that the existing budgetary arrangements might be classified as innovation restrictive. The concentration of public decision-making within the budgetary process and integration of the budgetary governance system with other public governance systems by means of a common programmatic architecture were recommended as prerequisites for effective stimulation of public sector innovativeness.
The purpose of the article is to analyze the current condition and development prospects for the Russian LNG sector. Taking into account the specifics of the functioning of the Russian state, the author chose the realistic paradigm (neoclassical realism), which is useful in the context of showing the relationship between internal structures and external activity of the state. The author argues that Russian expansion in the LNG sector is the result of the lobbying capacity of Novatek – the largest private gas producer in Russia. Although the state budget incurs significant costs related to the implementation of Novatek projects, in particular due to fiscal preferences, it also achieves the possibility of achieving the objectives in external and internal energy policy. Novatek's expansion increases Russia's share in external energy markets; at the same time LNG expansion, it is used for internal purposes. Novatek's dominant position in the LNG sector is confirmed by both already implemented projects and plans for further expansion. The factors favoring Russian expansion are constant state support for Novatek projects, high level of internationalization of implemented projects and favorable forecasts on energy markets. The strong competition between currently dominant LNG producers and the risk of internal competition between Russian exporters are among the key long-term challenges.
This article provides an analysis of the tax system of Ukraine in comparison with its counterparts in foreign countries to determine the competitiveness of Ukraine in the world market of goods and investments and to choose the main directions of reforming the tax system in the conditions of economic crisis caused by quarantine measures. The influence and liberalization of the tax system on the socio-economic development of Ukraine and foreign countries is considered and analyzed. Comparisons were made in the following areas: by the level of the overall tax burden, its distribution between the main types of taxes and payer groups, and the fiscal efficiency of tax systems. Having analyzed the data of European countries, the authors of the study compared them from a number of parameters with such major economies of the world as the US, China, Singapore. It has been shown that the EU is somewhat inferior to the US in terms of preferential administration of tax calculation and payment processes, as well as filing tax reporting by taxpayers. However, the EU shows relatively low corporate tax rates (compared to China and the US). Even though China and Singapore have significantly reduced these rates, they remain above the EU average. In order to improve the functioning of the tax system of Ukraine, the authors consider it advisable to focus on the dynamic transformations observed in the new member states of the EU, which, in turn, are one of the main competitors of Ukraine in the world markets of goods and capital, taking their experience to improve the tax climate and improve fiscal and regulatory tax compliance. The authors conclude that the amendments to the tax legislation of Ukraine due to the need to protect economic entities in the period of the COVID-19 pandemic are effective, sufficient and consistent with the world's legal practice. That is why the liberalization of the tax system is one of the determining factors in the socio-economic world development today. Formation of a modern competitive, social, market economy, integrated in the EU, guaranteeing stable economic growth, implementation of a balanced budgetary and social policy is impossible without the implementation of an effective tax policy to ensure support of the taxpayer. ; Niniejszy artykuł stanowi analizę porównawczą ukraińskiego systemu podatkowego oraz jego odpowiedników w innych krajach. Ma ona na celu ustalenie konkurencyjności Ukrainy na światowych rynkach towarowych i inwestycyjnych oraz wskazanie głównych kierunków reform systemu podatkowego w dobie kryzysu ekonomicznego wywołanego zastosowaniem środków związanych z kwarantanną. Rozważaniom oraz analizie poddano wpływ liberalizacji systemu podatkowego na rozwój społeczno-ekonomiczny Ukrainy oraz innych krajów. Dokonano porównań w następujących obszarach: poziom ogólnego ciężaru podatkowego, rozłożenie go pomiędzy główne rodzaje podatków i grup płatników oraz skuteczność fiskalna systemów podatkowych. Po przeanalizowaniu danych pochodzących z krajów europejskich autorki porównały je z kilkoma parametrami opisującymi duże gospodarki świata, takie jak Stany Zjednoczone, Chiny czy Singapur. Wykazano, iż UE nieco gorzej radzi sobie niż USA pod względem preferencyjnego administrowania wymiarem podatku oraz z procesami płatni czymi, a także w zakresie wypełniania zeznań podatkowych przez podatników. Jednakże w krajach UE są stosunkowo niskie stawki podatku od osób prawnych (w porównaniu do Chin i USA). Mimo iż Chiny oraz Singapur znacznie zmniejszyły stawki tego podatku, ich poziom nadal pozostał powyżej średniej w UE. Aby usprawnić funkcjonowanie systemu podatkowego na Ukrainie, autorki zalecają skoncentrować wysiłki na dynamicznej transformacji, którą można zaobserwować w nowych państwach członkowskich UE – stanowiących jednocześnie głównych konkurentów Ukrainy na światowych rynkach towarowych i kapitałowych – by opierając się na ich doświadczeniach, pracować nad poprawą warunków podatkowych, co przyczyni się do lepszego wypełniania obowiązków podatkowych w sensie regulacyjnym i fiskalnym. Autorki dochodzą do wniosku, że zmiany ustawodawstwa podatkowego na Ukrainie w obliczu konieczności ochrony podmiotów ekonomicznych w dobie pandemii COVID-19 są skuteczne, wystarczające i spójne ze światową praktyką prawną. Zatem liberalizacja systemu podatkowego jest jednym z decydujących czynników światowego rozwoju społeczno-ekonomicznego.
Finding much needed funds from taxes to state budgets and an ever-increasing mistrust of politicians and public opinion to the tax optimization schemes of multinational enterprises (MNEs) and high net worth individuals (HNWIs) have sparked an unprecedented political enthusiasm to address international tax avoidance in the last decade. This enthusiasm morphed into a political mandate given by G20 to the OECD in 2012. Amid a plethora of anti-avoidance rules delivered by the OECD under the BEPS Project, the principal purposes test (PPT) and its derivative under the EU Anti-Tax Avoidance Directive (ATAD) – the General Anti-avoidance Rule (GAAR) – are pivotal. The purpose of this contribution is to take an attempt to answer the main research question: is there room for an application of the GAAR (ATAD) and PPT (MLI) in a similar fashion? The assumption positively verified under this study via the prism of tax policy and technical (legal) reasons is that the less dissimilar an application of the GAAR and PPT will be, the less tax avoidance and fewer disputes arising from this phenomenon appear. However, there is a major caveat: the GAAR and PPT must gravitate towards the General Anti-abuse Principle (GAAP) as follows from the jurisprudence of the Court of Justice of the European Union's (CJEU) rather than to the OECD's version of the GAAR in the MLI (PPT). Only such an interpretative approach may ensure the right balance between fiscal interests of countries and individual economic freedoms of taxpayers. This contention stems from an analysis of the wording and structure of the GAAR and PPT, tax policy aims articulated in the preambles to the MLI and ATAD, the Court of Justice of the European Union's (CJEU) case law, the OECD's Commentary, and the relevant literature. ; Potrzeba znalezienia środków z podatków na finansowanie funkcjonowania państw oraz coraz większa nieufność polityków i opinii publicznej wobec schematów optymalizacji podatkowej przedsiębiorstw wielonarodowych (multinational enterprises, MNE) i najbardziej majętnych osób fizycznych (high-net worth individuals, HNWI) wywołały bezprecedensowy entuzjazm polityczny dotyczący przeciwdziałania międzynarodowemu unikaniu opodatkowania. Ten entuzjazm przerodził się w mandat polityczny udzielony OECD przez G20 w 2012 r. Wśród mnogości propozycji środków prawnych przeciwdziałających unikaniu opodatkowania opracowanych przez OECD w ramach projektu BEPS, za kluczowe należy uznać: test jednego z głównych celów (principal purposes test, PPT) z MLI i ogólną klauzulę przeciwdziałania unikaniu opodatkowania (general anti-avoidance rule, GAAR) z unijnej dyrektywy przeciwdziałającej praktykom unikania opodatkowania (anti-tax avoidance directive, ATAD). Celem niniejszego artykułu jest znalezienie odpowiedzi na główne (tytułowe) pytanie badawcze: Czy GAAR (ATAD) i PPT (MLI) powinny być stosowane w podobny sposób? Hipotezą pozytywnie zweryfikowaną w ramach niniejszego opracowania jest to, że: im bardziej zbiegające się (koherentne) będzie stosowanie GAAR i PPT, tym mniej praktyk unikania opodatkowania i sporów wynikających z tego zjawiska będzie występować między podatnikami i organami podatkowymi. Istnieje jednak poważne zastrzeżenie: GAAR i PPT powinny być stosowane zgodnie z ogólną zasadą przeciwdziałania nadużyciom (general anti-abuse principle, GAAP) wynikającą z orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), a nie zgodnie z PPT zaprojektowanym przez OECD. Tylko takie podejście do stosowania GAAR i PPT może zapewnić właściwą równowagę między interesami fiskalnymi różnych państw a swobodami gospodarczymi podatników. Konstatacja ta wynika z analizy treści i struktury GAAR i PPT, celów polityki podatkowej wyrażonych w preambułach do MLI i ATAD, orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), Komentarza OECD do Modelu Konwencji OECD oraz literatury.
Celem rozprawy jest ocena przydatności podatku od wartości dodanej, jako formy opodatkowania konsumpcji, do realizacji funkcji fiskalnych i pozafiskalnych oraz ustalenie, jak przerzucalność tego podatku wpływa na te funkcje. Celem części empirycznej jest udzielenie odpowiedzi na pytanie, na kogo, w jakim zakresie i w którym momencie przerzucany jest ciężar podatku od towarów i usług. W rozprawie analizowane są trzy kierunki przerzucalności - na konsumentów, pracowników i dawców kapitału. Problem przerzucalności jest niezwykle aktualny i złożony, wymagający uwzględnienia międzydyscyplinarnych obszarów wiedzy. Autor porusza się po nich z łatwością, a przy tym przystępnie przedstawia je czytelnikowi

Krok po kroku, szczyt po szczycie, Unia posuwa się mozolnie w kierunku głębszej integracji finansowej i fiskalnej, w kierunku zacieśnienia oraz koordynacji współpracy gospodarczej, a także bardziej rygorystycznego egzekwowania kryteriów konwergencji finansowej. De facto strefa euro, a wraz nią cała Unia Europejska, w zakresie spraw gospodarczo-finansowych, najgorsze ma za sobą. Niepokojący z punktu widzenia całej Unii Europejskiej jest Brexit. Wyjście Brytyjczyków z UE jest ogromnym politycznym, militarnym, gospodarczym i wizerunkowym osłabieniem Unii, a może nawet czymś więcej – porażką Unii, a zapewne także i Brytyjczyków. Innym niepokojącym i trwającym problemem Unii jest kryzys migracyjny. Jednak powoli i z opóźnieniem UE zaczyna z niego wyciągać wnioski i urealniać politykę migracyjną. Coraz bardziej niepokojąca staje się kwestia przestrzegania praworządności przez niektóre kraje unijne, jak również jej ocena i zdolność władz UE do uporania się z tym problemem. Unia Europejska nie powróci już zapewne do dyskusji na temat finalite, czyli finalnego celu: czym być – federacją, superpaństwem, czy też konfederacją państw, Europą Ojczyzn? Jednak integracja w głąb będzie postępować z tymi, którzy chcą, a bez tych, którzy nie chcą. Integracja finansowo- -gospodarcza w ramach UGW, wojskowa w ramach WPBiO, także w sprawach imigracyjnej, regionalnej i wymiaru sprawiedliwości. ; European Union, having back constitutional treaty refusal crisis, enlargement problems with new EU members and economic-financial crisis, seems to have overcome the most difficult period. Looks like "the devil alternative" – breaking up or deepen integration – is no more actual. Step by step, through EU leaders summit after summit recovery decisions, European Union is crawling towards deepen financial and fiscal integration. A number of diff erent long-term proposals have been put forward to deal with Eurozone crisis, as European Fiscal Union, a package for European bank recovery and other measures going to strict respect of financial convergence criteria. Brexit, the ongoing process of withdrawal of United Kingdom from EU will have deep impact on UK and EU mutual political-economic relations, being at the same time deep repulse of EU itself. The other unquiet and still lasting problem for EU was a sharp increase in the migration fl ows into European Union territory, making a lot of problems to EU countries. However, after bad results and the lack of proper approach to that problem European Union is preparing new common immigration policy. EU is also facing the impact of accession to office of a Eurosceptic party/governments violating the principles of law and EU values which makes a problem of EU infringement procedure efficiency. Having in mind all EU aspects of crisis, actually, it is difficult to foresee the return to the debate about finalite politique of European Union, which means answering the questions: what does EU have to be? Federation, super-state or only the Europe of Homelands?
In the implementation of fiscal policy, public authority used many kinds of fiscal instruments. Except direct expenditures in achieving the policy objectives, many countries use tax preferences, tax reliefs which are called tax expenditures. Those instruments seem to be very similar, so they are often considered to be substitutes. However, because of their specificity, TEs seem to be less transparent and often beyond social control. Therefore, in implementing the principle of transparency of fiscal policy, it seems necessary to compare current instruments with their current control. ; W realizacji polityki fiskalnej wykorzystywane jest szerokie instrumentarium narzędzi władzy publicznej. Oprócz bezpośrednich wydatków budżetowych w osiąganiu celów tej polityki stosowane są konstrukcje określane mianem tax expenditures. Instrumenty te wykazują wiele podobieństw między sobą, dlatego często uznawane są za substytucyjne. Jednak ze względu na swoją specyfikę TEs wydają się być mniej transparentne i często pozostają poza kontrolą społeczną. Z tgo powodu w realizacji zasady transparentności polityki fiskalnej wydaje się być konieczne bieżące porównywanie stosowanych instrumentów wraz z bieżącą ich kontrolą.
The aim of this article is to analyse the fulfilment of the Stability and Growth Pact rules by the EU 15 member states in the period 1999–2015. The article also presents the evolution of the EU fiscal rules since their formulation, including, in particular, the influence of the crisis on both meeting the rules by the member states and their substance. The conclusion of the article is that the construction of the rules is the main cause of the ineffectiveness of the pact in eliminating the deficit bias in the EU. In the analysed period, there were years when the member states did not follow the limits defined by the rules (the whole period, but in particular the years before the crisis), years without anticyclical influence of the rules (in fact, the whole period 1999–2015), and years when the rules turned out not to be elastic enough (the years after the crisis). It leads to the overall conclusion that the EU fiscal rules are not the best tool to counteract the deficit bias in the EU. ; Celem niniejszego artykułu jest przeanalizowanie stopnia przestrzegania przez 15 krajów UE reguł fiskalnych zawartych w pakcie stabilności i wzrostu w latach 1999–2015 i ewolucji tych reguł od początku ich sformułowania. Analiza stopnia wypełniania poszczególnych reguł prowadzi do wniosku, że na nieskuteczność reguł w eliminowaniu zjawiska deficit bias rzutują w dużej mierze ich błędy konstrukcyjne. W trakcie całego analizowanego okresu, a zwłaszcza okresu przedkryzysowego, można było stwierdzić, że limity określone przez reguły nie były przestrzegane, właściwie przez cały analizowany okres nie prowadziły do antycyklicznej polityki fiskalnej, a po kryzysie nie były wystarczająco elastyczne. Prowadzi to do konkluzji, że reguły fiskalne nie są najlepszym środkiem do walki ze zjawiskiem deficit bias w Unii Europejskiej.
The activity of international holding companies has become crucial for the European economy. In particular, attention should to paid to the tax-related issues, which arise out of the cross-border activity of holding companies. Increasingly, holding companies employ aggressive tax optimisation in their strategies. While the tax policies of individual E.U. Member States have turned out to be of little effectiveness, simultaneously, the lack of a common and harmonised tax policy designed to counteract tax optimisation has become a serious problem for the European Union. Therefore, the European Commission strives to develop a fiscal concept which will - on the one hand - allow to effectively combat international tax optimisation adopted by holding companies and - on the other hand - be integral with the internal tax systems of individual Member States.
Environmental Kuznets Curve (EKC) is often used to illustrate differences in intensity of environmental externalities creation under various jurisdictions. From the point of view of environment exploitation those jurisdictions are usually arbitrary. As a result conclusions drawn from them may be incorrect and public policy based on them inaccurate (e.g. the territory where environmental regulations are applied does not match with the territory where they are needed). As a consequence, predictions based on statistical interpretation of EKC are unreliable and the policy based on them proves to be inefficient. Therefore, it seems that EKC should be used for predictions only for large jurisdictions or groups of jurisdictions.
In recent years the euro area has been characterised by a very low rate of economic growth (in some years there was even a real reduction in the volume of production). This has launched a debate among economists about the instruments to be applied in public policy to bolster the economy. In this article the author analysed the possible effects of fiscal and monetary policy on economic growth when economic stagnation in the euro area is accompanied by a high level of public debt as a percentage of GDP and a very low level of the interest rates set by the central bank as well as market interest rates. On the basis of economic theory the author considers whether expansionary fiscal policy will contribute to the growth of real output, or merely enlarge the public debt and increase the risk of sovereign debt default and currency crisis. The author also introduced the concept of quantitative easing as an instrument of expansionary monetary policy.

These mechanisms are one of the key elements of budgetary relations, due to significant differences in the level of economic development of federal subjects, resulting in horizontal and vertical fiscal imbalance. The paper presents the most important mechanisms from the early 90 s. Most attention was paid to the main method of guaranteeing financial security - The Fund for Financial Support of Subjects. Until 2008 an important element of the financial system had been other special funds (eg. The Federal Fund for Regional Development, The Federal Compensation Fund), replaced by intergovernmental grants. The main principles, objectives and implications of these mechanisms were described. Part of the work was dedicated to showing federal entities' dependence on financial transfers from the federal level. The outcome was that equalization results proved to be weak, mechanisms were unstable and not always formalized so as not to be subject to current policy needs.

Są one jednym z kluczowych elementów relacji budżetowych z uwagi na znaczące zróżnicowanie poziomu rozwoju gospodarczego podmiotów FR, skutkujące poziomą i pionową nierównowagą fiskalną. W pracy przedstawiono najważniejsze mechanizmy podziału transferów od początku lat 90. Najwięcej uwagi poświęcono podstawowej metodzie gwarantowania zabezpieczenia budżetowego - Federalnemu Funduszowi Wsparcia Podmiotów. Do 2008 r. istotnym elementem systemu budżetowego były inne specjalne fundusze (m.in. Federalny Fundusz Rozwoju Regionalnego, Federalny Fundusz Kompensacji), zastąpione przez subwencje, subsydia i dotacje. Opisano najważniejsze zasady, cele oraz efekty funkcjonowania powyższych mechanizmów. Część pracy poświęcono również pokazaniu zależności poszczególnych podmiotów od transferów finansowych ze szczebla federalnego. Rezultaty wyrównywania nierównowagi fiskalnej w badanym okresie okazały się słabe, mechanizmy nietrwałe i nie zawsze sformalizowane, by nie podlegać bieżącym potrzebom politycznym.
