Self-Employed Foreign Workers In Spain ; El trabajo por cuenta propia de los extranjeros en España
This is a full study of the legal system applicable to selfemployed foreigners wishing to carry out an economic activity in Spain. The focus varies according to the country of origin of the individual, whether it lies within the European Economic Community, whether it is a country with which the European Union has co-operation and association agreements or finally, whether it is under the general regime. The utilitarian perspective which considers immigration as necessary manual labour has justified more efficient legal mechanisms to facilitate the employment of immigrant manual workers. These mechanisms do not apply to self-employed workers. The lack of interest of legislators in this type of worker is highlighted by the suppression of motivation and refusal of the mandatory visa. The detailed analysis of the anticipated administrative requirements emphasises that within the labour legislation for immigrants there is a marked difference between those who work for an employer and those who are self-employed and there is no correspondence or comparison with the more far reaching policies of the labour doctrine with regard to the rights and guarantees of both categories of workers. ; Completo estudio del régimen jurídico aplicable a los extranjeros que quieren realizar en España una actividad económica por cuenta propia. Se pasa revista a las distintas situaciones según se trate de comunitarios o ciudadanos de países del Espacio Económico Europeo, de nacionales de países con los que la Unión Europea tiene Acuerdos de Cooperación y Asociación y, finalmente, los sometidos al régimen general. La perspectiva utilitarista de la inmigración considerada como mano de obra necesaria ha permitido que se inicie un discurso en el que se justifica que se prevean mecanismos legales más ágiles que faciliten la contratación de mano de obra inmigrante que deja fuera, por ende, al trabajador por cuenta propia. El desinterés del legislador por este tipo de trabajador encuentra su máxima expresión en la supresión de la motivación para denegar el preceptivo visado. El análisis en detalle de los requisitos administrativos previstos subraya que en la legislación laboral de extranjería se marca una distancia cada vez mayor entre trabajador por cuenta ajena y trabajador por cuenta propia que no se corresponde con las tesis más avanzadas de la doctrina laboralista partidaria, justamente, de equiparar en derechos y garantías ambas categorías de trabajadores.
