In France, the leading role of education in the formation of tolerance as a person's value and quality in the younger generation is recognized. The implantation of ideas of tolerance is one of the tasks of the education system and the subject of research by many French scholars. In this context, consideration of tolerance as a scientific and pedagogical problem in France becomes relevant. This article is devoted to the actual questions of the interpretation of the concept of "tolerance" in the modern scientific and pedagogical thought of France. The views of the French scientists on the definition of the concept of "tolerance", the evolution of this term in the historical retrospective and the features of the use of the term "tolerance" in the modern scientific and public opinion of France are outlined. French scholars define tolerance as respect for the will of others, their behavior, way of thinking, political and religious views. They consider it as a social value, the norm of social life, the principle of human relationships, behavior, quality of the individual. According to French scholars, tolerance predetermines the need for certain limits or "tolerance thresholds." Therefore, the task of the teacher is twofold: to encourage the creation of a sense of boundaries, and at the same time, learn to recognize the freedom of another person. Respect and tolerance are often seen as equivalent concepts, but it must be taken into account that respect is an ethical principle, and tolerance is political and social. But both respect and tolerance are common in that they can be learned, and this is the mission of the school. Scientists note that tolerance logically follows from the negative sense of intolerance. We show that the formation of French quality assurance in higher education has lasted for three decades. The periodization of the quality assurance shaping in higher education is determined based on reforming the principal national agency for quality. Problem statement. The Bologna Process has initiated the formation of a single European Higher Education Area. Today's students, through academic mobility programmes, have a unique opportunity to obtain academic experience and professional competences developed during their studies at higher education institutions in other countries. In particular, master students from Prydniprovska State Academy of Civil Engineering and Architecture (PSACEA) under agreement with National Engineering School of Saint-Etienne (France), had the opportunity to access the educational process at French Higher Technical Education Institution and conduct a comparative analysis of the educational process within the study of the discipline "Methods of teaching in higher education institution". The purpose of the article is to conduct a comparative analysis of higher education systems in Ukraine and France on the basis of data from the State Statistics Service of Ukraine and Statistical Guidelines and reference materials of France and characterize the professional development methods of French teachers (on the example of the National Engineering School of Saint-Etienne). Conclusions. In today's globalised world, quality higher education has become a significant means of ensuring a high level of professional qualifications in all spheres of human activity. The increasing demand for higher education, as well as the increasing students number, add pressure to higher education and blur the boundaries between the economic and political sectors. Student exchanges and double degree programs provide opportunities for innovative student learning, as well as increasing the education effectiveness, which in turn leads to increased demand for this sector of public life. The article analyzes the processes of decentralization of power in France. France is one of the few European countries that have accumulated considerable experience in the field of decentralization of public administration through the expansion of the powers and responsibilities of local governments.Assessing the vast experience of territorial reforms accumulated in France for almost three and a half decades, it should be noted that, despite the positive results (for example, in the field of local government development, intermunicipal cooperation, etc.), many important problems remained unresolved. Contrary to the expectations of the reformers, the administrative and territorial structure of the country did not become simpler and more understandable.The number of levels and types of territorial units has increased. To three historical levels (communes, departments and state) regions were added.It should be noted and one more direction of reforms in France. The author reveals the political and legal aspects of reforming the labor law of France. It's pointed out that in 2017 a large-scale reform of labor legislation took place in France, which became the third in this country over the last decade and aimed at liberalizing France's labor law and giving it «flexibility». The author is convinced that the reform of the labor law of France demonstrates the tendency of narrowing labor rights of employees and their ability to influence decision-making at enterprises with the help of their own representative bodies. It's noted that changes in France's labor law have outlined the way in which the legislator's idea is directed: for the development of the economy, high social and labor standards are a burden, the solidarity of workers hinders investment infusions, the labor force must adapt to the market, but not the market to the labor force. The author notes the impossibility of the society and the scientific community to react accordingly to the transformation towards the deterioration of the situation of the working people, who constitute the overwhelming majority of the population, of such a socially important branch of law as labor law.Keywords: reform, flexibility, first employment, atypical forms of employment, solidarity ; Автором розкриті політико-правові аспекти реформування трудового права Франції. The article is devoted to the study of the experience and peculiarities of reconciliation of contradictions between Germany and France. The positions of the Presidents of France and Chancellors of the Federal Republic of Germany regarding the theoretical foundations and practical steps of the implementation of French-German reconciliation are studied. This paper deals with the problem of Alsace-Lorraine, a region with a border identity, which repeatedly became the cause of Franco-German disputes and passed from one state to another. The role of the individual in overcoming the contradictions between Germany and France is highlighted. The factor of European integration is considered, which not only contributed to the reconciliation of contradictions between Germany and France, but also turned the two states into leaders of a united Europe. The Elysee Treaty and its implementation were analyzed. The military cooperation between France and Germany is investigated. The problem of historical memory and the desire to reconcile the contradictions between Germany and France are revealed. It is proved that the experience and peculiarities of reconciliation of contradictions between Germany and France testify to the fact that the real reconciliation of the two leading states directed their efforts towards a more global goal – the creation of a common Europe. It was concluded that the mechanisms for achieving Franco-German reconciliation are interesting for studying and borrowing, taking into account national characteristics in the reconciliation of other European countries, and regions with borderline identities. The French-German experience may be useful for application in Polish-Ukrainian relations. The main conclusion from the analysis of the experience and the peculiarities of reconciling the contradictions between Germany and France is that their implementation led to unexpected and far-reaching consequences that once seemed just a dream. At the beginning of European integration in the 50s of the twentieth century, it was difficult to imagine the contemporary EU with its common currency, the Schengen area, developed economy, social programs. Franco-German reconciliation was transformed into the fruitful work of the Franco-German tandem, on the success of which depends not only the future of France and Germany, but the evolution of the entire united Europe. ; Стаття присвячена дослідженню досвіду та особливостям узгодження суперечностей між Німеччиною та Францією. Досліджуються позиції президентів Франції та канцлерів ФРН з теоретичних засад та практичних кроків втілення французько-німецького примирення. У статті досліджується проблема Ельзасу-Лотарингії, регіону з порубіжною ідентичністю, який неодноразово ставав причиною французько-німецьких суперечок та переходив зі складу однієї держави до іншої. Виокремлюється роль особистості у подоланні суперечностей між Німеччиною та Францією. Розглянуто чинник європейської інтеграції, який не тільки сприяв узгодженню суперечностей між Німеччиною та Францією, але перетворив дві держави на лідерів об'єднаної Європи. Проаналізовано Єлисейський договір та його реалізацію. Досліджено військове співробітництво Франції та Німеччини. Розкрито проблему історичної пам'яті та прагнення узгодження суперечностей між Німеччиною та Францією. Доведено, що досвід та особливості узгодження суперечностей між Німеччиною та Францією свідчать про те, що справжнє примирення двох провідних держав скерувало їхні зусилля на більш глобальну мету – утворення спільної Європи. Підсумовано, що механізми досягнення французько-німецького порозуміння є цікавими для вивчення та запозичення з урахуванням національних особливостей у примиренні інших європейських країн та регіонів з порубіжною ідентичністю. Французько-німецький досвід цілком може бути корисним для застосування у польсько-українських відносинах. Головний висновок із аналізу досвіду та особливостей узгодження суперечностей між Німеччиною та Францією полягає у тому, що їхня реалізація призвела до неочікуваних та далекосяжних наслідків, які колись здавалися лише мрією. На початку європейської інтеграції у 50-х рр. ХХст. важко було уявити сучасний ЄС з його спільною валютою, Шенгенською зоною, розвиненою економікою, соціальними програмами. Французько-німецьке примирення трансформувалося у плідну роботу французко-німецького тандему, від успіху якого залежить не тільки майбутнє Франції та Німеччини, але еволюція всієї об'єднаної Європи.
This article is devoted to the study of public control, its role as the main element of interaction between the state and society is defined. It creates the basis for the social orientation of public policy. Among the factors that determine the development of the legal framework of the state, the author noted the feasibility of introducing into the process of rule-making not only authorities that are endowed with law-making functions under the Constitution of the state, but as well as those informal social structures that may not play a decisive role in this process, but will be able to provide arguments "for" or "against" the adoption of certain regulations. The study has found that public authorities require public scrutiny, because in fact the society has given it the power to create the legal field. Conversely public control, in the author's view, is necessary in order to achieve effective communication between the government and civil society. In addition to the above it should be mentioned that during this study was also analyzed the impact of various agencies on public oversight powers. In particular, was indicated the direct dependence of its quality on the state's information policy and the use of modern digital technologies in ensuring public access to public data on the activities of state institutions. The author emphasizes that the right of every citizen to be aware of government affairs and to receive decisions concerning the activities of the community is a fundamental principle of democracy. In turn, the government should provide an easy way for citizens to access data about their work and the legal norms it creates. Therefore the researcher concludes that the level of "transparency" of information about the activities of administrative bodies and access to it is a condition for effective public control. The author also points out that there are shortcomings in the practical implementation of the principle of "transparency" in the activities of state authorities in Ukraine and offers way of it's improvement, based on the experience of the French Republic, which has made significant progress in establishing a legal and technical relationship between the citizens and the State. ; Статтю присвячено дослідженню явища публічного контролю, визначенню його ролі в якості основного елементу взаємодії держави та суспільства, що створює підґрунтя для соціального спрямування політики держави. Так, серед факторів, які зумовлюють розвиток правової бази держави, автором зауважено на доцільності впровадження в процес нормотворення не лише органів влади, які наділені правотворчими функціями за Конституцією держави, а і тих неформальних соціальних структур, які, можливо, не будуть відігравати визначальної ролі в цьому процесі, однак зможуть надати аргументи «за» або «проти» прийняття певних нормативно-правових актів. У дослідженні з'ясовано, що державна влада вимагає контролю з боку громадськості, оскільки фактично саме остання надала їй повноваження для створення правового поля. В свою чергу публічний контроль, з точки зору автора, необхідний саме для досягнення ефективної комунікації між владою та громадянським суспільством. В рамках запропонованого дослідження проаналізовано вплив різноманітних факторів на якість здійснення публічного контролю. Зокрема, зазначено про значну роль інформаційної політики держави та використання сучасних цифрових технологій у забезпеченні доступу громадськості до публічних даних про діяльність державних інституцій. Автор підкреслює, що право кожного громадянина бути обізнаним в урядових справах та отримувати рішення, які стосуються діяльності громади, є основним принципом демократії. Влада повинна забезпечити простий спосіб доступу громадян до даних про свою роботу та правових норм, які вона створює. Саме тому дослідник доходить висновку про те, що рівень «прозорості» інформації про діяльність адміністративних органів і доступ до неї є умовою ефективного публічного контролю. Автором виявлені і недоліки практичного втілення принципу «транспарентності» в діяльності державної влади в Україні та запропоновано шляхи його удосконалення, спираючись на досвід Французької Республіки, яка досягла суттєвих успіхів у сфері нормативно-правового та технічного закріплення взаємовідносин між громадянами і державною владою.
The aim of the article is to represent the historiography of the cross-cultural dialogue Ukraine-France in all its completeness in the modern scientific discourse of Ukraine, covering the historical and cultural period from the period of Kyivan Rus and the era of political disunion (9–13th centuries), in particular in the context of marriage of Yaroslav the Wise's daughter — Anna Yaroslavivna with the French King Henry I and to the newest time.Research methodology is a cultural analysis of the works of Ukrainian cultural researchers and the implementation of a historiographical overview into the past of the crossing of two significant cultural worlds — Ukraine and France.Results. In the new millennium, marked by the processes of globalization and integration, which encompassed humanity, in the general humanitarianism there is a growing reflection on the methodology of comparing various cultural forms in the process of their interaction. One of the most important tasks facing modern science is the definition of the prospect of dialogue between different cultures. Cross-culturalism, as a new paradigm of modern global progress, involves a combination of models of social action on the "crossroads" of cultures that form a specific culture on the basis of combining and "interbreeding" various ideological transfers, exchanges, and interactions. Culture is a historical system. As a sphere of objectification of human essential resources, it is involved in the maternal ground of history, which gives rise to the cultural processes. The element of humanity and the elements of culture are combined in the historical experience of social development.Novelty. The author suggests a new approach to the theoretical comprehension of the cultural foundations of the rise and development of Ukrainian-French relations and their specific character in the process of formation and development of a common cross-cultural dialogue.The practical significance. Cultural analysis of the genesis and evolution of the relations between Ukraine and France has shown that the dialogue of cultures a priori is an important and indispensable factor in the development of the European cultural space. Зазначається, що осягнення минулого в контексті загальної культурно-історичної пам'яті надає змоги спрогнозувати майбутнє в ракурсі історичної перспективи, що в практичній площині визначає напрями подальшої співпраці в різних сферах на основі культурного взаємозбагачення, а в теоретичній площині гарантує виокремлення раніше недосліджених аспектів, що водночас зумовлює подальше формування наукового гуманітарного знання, засадничої бази новітнього культурного ландшафту.
The aim of the article is to represent the historiography of the cross-cultural dialogue Ukraine-France in all its completeness in the modern scientific discourse of Ukraine, covering the historical and cultural period from the period of Kyivan Rus and the era of political disunion (9–13th centuries), in particular in the context of marriage of Yaroslav the Wise's daughter — Anna Yaroslavivna with the French King Henry I and to the newest time.Research methodology is a cultural analysis of the works of Ukrainian cultural researchers and the implementation of a historiographical overview into the past of the crossing of two significant cultural worlds — Ukraine and France.Results. In the new millennium, marked by the processes of globalization and integration, which encompassed humanity, in the general humanitarianism there is a growing reflection on the methodology of comparing various cultural forms in the process of their interaction. One of the most important tasks facing modern science is the definition of the prospect of dialogue between different cultures. Cross-culturalism, as a new paradigm of modern global progress, involves a combination of models of social action on the "crossroads" of cultures that form a specific culture on the basis of combining and "interbreeding" various ideological transfers, exchanges, and interactions. Culture is a historical system. As a sphere of objectification of human essential resources, it is involved in the maternal ground of history, which gives rise to the cultural processes. The element of humanity and the elements of culture are combined in the historical experience of social development.Novelty. The author suggests a new approach to the theoretical comprehension of the cultural foundations of the rise and development of Ukrainian-French relations and their specific character in the process of formation and development of a common cross-cultural dialogue.The practical significance. Cultural analysis of the genesis and evolution of the relations between Ukraine and France has shown that the dialogue of cultures a priori is an important and indispensable factor in the development of the European cultural space. The authors have analyzed the current procedural legislation of France on performance of forensic expertises; have revealed common and distinctive features with the procedural legislation of Ukraine to determine the possibilities of using positive experience to improve the expertise activities in Ukraine. Particular attention is paid to the principles of the expert's activities and the possibilities of their implementation in Ukraine; to the research of the expert's participation in the court proceedings and the role in the conclusion of an amicable agreement. Proceedings of forensic expertise in Ukraine would significantly increase its effectiveness in the process of proving with the use of approaches that are widely used in French procedural law, namely: judicial expertise is understood and interpreted as an alternative method of judicial disputes resolution; experts are not only observers but also actors who participate in conciliation; an expert mediates the parties, whom he meets, interviews, listens, meets with records; he takes a winning position to simplify the conclusion of an amicable agreement. As a result of the conducted research of procedural laws of France concerning the conduction of expertises it has been established that the adversarial process is realized through constant interaction between the participants of the proceedings with the judicial expert. In turn, the transparency of the process is guaranteed with preparing a significant number of mandatory documents by the expert (reports, interim notes, landmark report, summarizing note, preliminary report, final report), which are introduced to parties that may raise additional questions. ; Проаналізовано чинне процесуальне законодавство Франції щодо провадження судових експертиз, виявлено спільні та відмінні риси із процесуальним законодавством України для визначення можливостей використання позитивного досвіду в удосконаленні експертної діяльності. Особливу увагу приділено розгляду принципів діяльності експерта та можливостям їх реалізації в Україні. Досліджено участь експерта в судовому провадженні та його роль в укладанні полюбовної угоди.
The developed system of family support in France is the result of long-term evolution, during which were introduced and improved various instruments of public, social, including family policy.Analysis of source material confirms that family policy in France from its beginning had a «paternalistic» character, it was aimed at stimulating the birth rate.According to research, the first program of supporting motherhood and childhood was developed in 1866 and was spreaded among civil servants – financial workers, teachers and others.In the 30s (1932, 1938 and 1939) some laws were passed including the Law of 29.07.1939, entitled «Family Code», in which were laid the foundations and principles of the modern system of family support in France. World War II prevented the realization of principles of «Family Code», only laws in 1946 concretized its provisions: there was introduced support for mothers-house-wives; support for families with one working person; maternity support; new scale of adding family support to monthly basic salary.Reforms of family support 1972 – 1978 were accompanied by the introduction of measures to improve the situation of certain categories of families: In 1971 there was introduced aid to orphans (which was later turned into a help to a guardian or a breadwinner); 1975 – support for special education of children with disabilities; 1976 support for single parents.In 1980 – 1990's in France there was passed a massive program to increase social, including family care, in result of which in the 1980 – 1983 part of family support in GDP increased to 3.06 percent. However, worsening of economic situation did not allow to realize planned and forced to significantly reduce social program.Thus, in the mentioned reforms there is a decreasing tendency of pronatalist character and strengthening their social orientation. This is reflected in the changes of demographic area, the role of family, values of modern society.One of the main directions of state family policy in France was support for mothers and children. Among its events: passage and improvement of legislation on providing maternity leave and protection of the rights of working mothers. Since January 1, 2004 in France, was formed a system of family support that included various forms of support at birth, adoption and child care.Much attention was paid to preschool education in France. In November 2006 the French government passed a plan «Young children» the aim was to provide all children with the places in preschool by 2011.Thus, the developed system of social support for motherhood and childhood in France is the result of long-term evolution, which was reflected a set of national, economic, political, socio-cultural and socio-psychological characteristics and conditions. The policy of social support has a global character and includes activities of legislative support for motherhood and childhood and providing the optimal combination of employment of women and motherhood, provide financial assistance in the form of various types of family aids and services in the health sector, organizing teaching on training and education of children. ; В статье рассмотрено формирование социальной политики поддержки материнства и детства во Франции. Доказано, что социальная политика во Франции имеет глобальный характер и включает меры законодательного характера с поддержки материнства и детства и обеспечение наиболее оптимального сочетания занятости женщины с материнством, оказание различного вида материальной помощи и услуг в сфере здравоохранения, организации педагогического всеобуча по вопросам обучения и воспитания детей. ; У статті розглянуто формування соціальної політики підтримки материнства й дитинства у Франції.
