The need for a person on a daily basis to build a line of conduct armed with their own kind (social environment) inevitably gives rise to an assessment of himself and his environment. In the first approximation, this consciousness of freedom of action in carrying out his wishes and goals. Hence the source of the problem and responsibility, which in our time has become one of the criteria of political doctrines of humanism and legal responsibility for the actions and achievements. Freedom inevitably raises the question how a person's behavior in the implementation of his tracings and goals coincide with certain social or contradicts them. Correctly emphasizing external conditionality behavior natural and social environment and not paying enough attention to the relation of his freedom and opportunities for self-realization of his personal plans, we consciously or unconsciously underestimate the problem of personal responsibility, the value of willpower in the actions and deeds of a person. It should be explained in the theory and practice of the individual evaluations why she willingly takes responsibility for his motives and places the blame for the negative consequences of its activities to external circumstances. The social theory of freedom and responsibility is still a lot of «white spots». ; Необходимость для человека каждодневно выстраивать линию своего поведения в окружении себе подобных (социальная среда) неизбежно порождает оценку себя и это-го окружения. В первом приближении это - сознание меры свободы в осуществлении желаний и целей индивида. Отсюда исток проблемы и ответственности, которая в наше время стала одним из критериев гуманизма политических доктрин и правовой ответственности за свершенные деяния. Свобода неизбежно порождает вопрос: насколько поведение человека в реализации его намерений и целей совпадает с опре-деленными общественными идеалами или же противоречит им. Акцентируя внимание каждый раз на внешней обусловленности поведения людей природной и общественной средой и не уделяя должного внимания соотношению их свободы и возможностей в са-мореализации личных планов, мы вольно или невольно недооцениваем проблему от-ветственности личности, значение волевых усилий в поступках и деяниях человека. Теоретическая и практическая потребность объяснить такую модель поведения, ко-гда личность охотно берет на себя ответственность за мотивы своих поступков, но вину за негативные последствия своей деятельности возлагает на внешние об-стоятельства, является актуальной задачей современной социальной теории. ; Необхідність для людини щодня вибудовувати лінію своєї поведінки в оточенні собі подібних (соціальне середовище) неминуче породжує оцінку себе і цього оточення. У першому наближенні це ‒ усвідомлення міри свободи в здійсненні бажань і цілей індивіда. Звідси витікає й проблема відповідальності, яка в наш час стала одним з критеріїв гу-манізму політичних доктрин і правової відповідальності за звершення діянь. Свобода неминуче породжує питання: наскільки поведінка людини в реалізації її намірів і цілей збі-гається з певними суспільними ідеалами або ж суперечить їм. Акцентуючи увагу кожно-го разу на зовнішній обумовленості поведінки людей природним та суспільним середо-вищем і не приділяючи належної уваги співвідношенню їх свободи і можливостей в само-реалізації особистих планів, ми мимоволі недооцінюємо проблему відповідальності осо-бистості, значення вольових зусиль у вчинках і діяннях людей. Теоретична і практична потреба пояснити таку модель поведінки, коли особистість охоче бере на себе відпо-відальність за мотиви своїх вчинків, але провину за негативні наслідки своєї діяльності покладає на зовнішні обставини, є актуальним завданням сучасної соціальної теорії

NEUROCENSORSHIP AGAINST COGNITIVE FREEDOMS ; НЕЙРОЦЕНЗУРА ПРОТИВ КОГНИТИВНОЙ СВОБОДЫ
The article discusses new types of censorship using information technology. The main attention is paid to the methods of reading simple thoughts from the "images" (images) of brain reactions using functional magnetic resonance computed tomography. It is noted that in the near future, the development of this technology will lead to the possibility of censoring thoughts. In this regard, the problem of cognitive freedom is discussed. It is indicated that the prospects for overcoming the threshold of the inviolability of the mental sphere not only raises the question of the need to reformulate some constitutional norms on the rights of the individual, but also requires changes in a number of branches of law. The possibilities of information technology are growing rapidly, new ways of violating the private sphere of life are constantly emerging - from violating the legislation on personal data to recognizing faces by the peculiarities of your facial expressions when you show them or other emotions. A wide range of applications is acquired by neural networks as information technology products (the so-called "weak" artificial intelligence). Neural network methods of controlling content pose a potential danger to the media. There are reports of experimental use of neural networks as a filter of fakes and "hate speech". Roskomnadzor began using neural networks to combat illegal content. The technical implementation of such filtering is no different from the function of neural network censorship, which can be configured for any group of words. However, in the short term, neural networks will yield inefficiency to neuro information technologies for working directly with the human brain. Still, artificial intelligence as a technical means loses to a technical device that has the ability to "peep" into natural intelligence, more precisely, into the human brain. Such a qualitative scientific and technological leap has serious consequences for the law. Theoretically, a complete description of all neurons in the brain and the nature of the connections between them should give a fairly accurate description of the essence of a person, his personality. This hypothetical map of neurons and their connections is called a "connectome". Today, work is already underway on mapping the connectome. With the help of such mapping, they visualize thought processes and have already learned to "read" (more precisely, to interpret) certain reactions. Small achievements are already being used - and this is not surprising - by the police. ; В статье рассматриваются новые виды цензуры с использованием информационных технологий. Основное внимание уделяется методам чтения простых мыслей по «образам» (имиджам) реакций мозга с помощью функциональной магнитно-резонансной компьютерной томографии. Отмечается, что в ближайшем будущем развитие этой технологии приведет к возможности цензурирования мыслей. В этой связи обсуждается проблема когнитивной свободы. Указывается, что перспективы преодоления рубежа неприкосновенности ментальной сферы не только ставит вопрос о необходимости переформулирования некоторых конституционных норм о правах личности, но и требует изменений в ряде отраслей права. Возможности информационных технологий быстро растут, постоянно возникают новые способы нарушения частной сферы жизни – от нарушения законодательства о персональных данных до распознавания лиц по особенностям вашей мимики при проявлениитех или иных эмоций. Широкий круг приложений приобретают нейросети как продукты информационных технологий (так называемый «слабый» искусственный интеллект). Для СМИ представляют потенциальную опасность нейросетевые способы контроля за содержанием контента. Появляются сообщения об экспериментальном использовании нейросетей как фильтра фейков и «языка вражды» («hate speech»). Роскомнадзор начал применять нейросети для борьбы с незаконным контентом. Техническое выполнение подобной фильтрации ничем не отличается от функционирования нейросетевой цензуры, которую можно настроить на любые группы слов. Однако в ближайшей перспективе нейросети уступят по своей эффективности нейроинформационным технологиям работы непосредственно с мозгом человека. Все-таки искусственный интеллект как техническое средство проигрывает техническому устройству, которое имеет возможность «подглядывать» в естественный интеллект, точнее говоря, в мозг человека. Такой качественный научно-технический скачок имеет серьезные последствия для права. Теоретически полное описание всех нейронов мозга и характера связей между ними должно дать достаточно точную характеристику сущности человека, его личности. Такая гипотетическая карта нейронов и их связей называется «connectome». Сегодня уже ведутся работы по картированию коннектома. С помощью такого картирования визуализируют мыслительные процессы и уже научились «читать» (точнее – истолковывать) определенные реакции. Небольшие пока достижения уже использует – и это не удивительно – полиция.

Restriction of Freedom in the Domestic System of Criminal Sanctions
The article is devoted to the study of the law enforcement of criminal punishment in the form of restriction of freedom and its significance in the system of punishment. Modern trends in the economy and social life in the country determine the policy of gradual humanization of punishment for some crimes while increasing the punishment for others. This process is accompanied by the introduction of new, previously not applied forms of punishment, which should serve as an alternative to imprisonment for a certain period. The analysis of statistical data on the application of punishment with isolation from society to various categories of convicts shows that the use of deprivation of liberty should be reduced, especially for minors and women. By limiting the use of punishment in the form of imprisonment, it is possible to protect the individual from the influence of the criminal environment. Punishment in the form of restriction of freedom allows achieving the goals of criminal punishment without deprivation of liberty and isolation from society. When considering the nature of punishment in the form of restriction of freedom should pay attention to such a legal structure as a conditional sentence. In the criminal-Executive practice, the punishment in the form of restriction of freedom and conditional conviction are implemented almost identically, but in the science of criminal law, there is no common position on the legal nature of the conditional conviction. The most important difference between restriction of freedom and conditional conviction is that the scope of restrictions on the right of a convicted person to punishment in the form of restriction of freedom is established in the law, and it is exhaustive, and the scope of restrictions on the right of a probationer can be both narrowed and expanded. "Freedom-as-Wisdom" Notion vs freethinking ; Свободомудрие vs свободомыслие
The article deals with the issues of correlation of external and internal freedom, freedom of thought and wisdom, and their participation in creative choice and action as unintentional thoughts caused by the self-isolation regime. The authors show that the concept of freethinking is closely related to the understanding of freedom in this era. In the free-thinking as its incarnation lay two essential features: negative — "freedom from" and positive — "freedom for". The historical retrospective of their balance appears as a certain regularity, which the authors conventionally call the "swing of free thought": the birth of a new branch of spiritual culture is due to the growing criticism of the previous one and the appearance of a galaxy of thinkers who form it.Thus, in the freethinking of Antiquity, with its tendency to reject the pressure of fate, at first "freedom from" prevailed, to which later, as a result of the positive work of numerous philosophical schools, "freedom for" was added. The formation of Christianity as a branch of spiritual culture was accompanied by criticism of previous philosophy (for example, by Neoplatonists) and the creative work of the apostles and Christian thinkers of the patristic era. In the medieval acquisition of freedom as a gift of God, "freedom for" was asserted, which, under the influence of late dogmatism, turned into negative freedom by the Renaissance. Anti-clericalism and anti-dogmatism were overcome by modern thinkers who, creating the methodology of science (English empiricism and continental rationalism), established new goals and meanings of knowledge, and freedom became necessary "for" the knowledge of the laws of nature. The birth of ideology as a branch of culture in the late XIX-early XX centuries, although it did not occur against the background of criticism of science, still produced a new field of freedom — political freedoms marked by bourgeois-liberal ideas. Global humanity, which now has a common destiny, is approaching a new "axial time", which will probably require a new freethinking — both negative, which is already embedded in the ideas of Western postmodern philosophy, and positive, for example, in the framework of the philosophical-religious-scientific synthesis prepared by Russian religious philosophers. ; В статье рассматриваются проблемы соотношения свободы внешней и внутренней, свободомыслия и мудрости и их участия в творческом выборе и действии как нечаянные мысли, вызванные режимом самоизоляции. Авторы показывают, что понятие свободомыслия тесно связано с пониманием свободы в данную эпоху. В свободомыслии как его ипостаси заложены две сущностные черты — негативная — «свобода от» и позитивная — «свобода для». Историческая ретроспектива их баланса предстает как некая закономерность, которую авторы условно называют «качелями свободомыслия»: рождение новой отрасли духовной культуры происходит за счет нарастающей критики предыдущей и появления плеяды мыслителей, ее формирующих.Так, в свободомыслии Античности с его устремлением к отказу от давления рока сначала преобладала «свобода от», к которой позже в результате позитивной работы многочисленных философских школ добавилась «свобода для». Становление христианства как отрасли духовной культуры сопровождалось критикой предыдущей философии (например, неоплатониками) и созидательной работой апостолов и христианских мыслителей эпохи патристики. В средневековом обретении свободы как божьего дара утверждалась «свобода для», которая под влиянием позднего догматизма превратилась к эпохе Возрождения в негативную свободу. Антиклерикализм и антидогматизм был преодолен мыслителями Нового времени, которые, создавая методологию науки (английский эмпиризм и континентальный рационализм), утвердили новые цели и смыслы познания, и свобода стала нужна «для» познания законов природы. Рождение идеологии как отрасли культуры в конце XIX — начале ХХ вв., хотя и происходило не на фоне критики науки, все же произвело новое поле свободы — политические свободы, обозначенные буржуазно-либеральными идеями. Глобальное человечество, отныне имеющее общую судьбу, подходит к новому «осевому времени», которое, вероятно, потребует нового свободомыслия — негативного, которое уже заложено в идеях западной философии постмодернизма, и позитивного, например, в рамках философско-религиозно-научного синтеза, подготовленного русскими религиозными философами.

Freedom of Movement: the Typology of Arguments, Policies and Practices

Modern discussions on freedom of movement date back to the late XIX - early XX century. According to Ludwig von Mises, state's attitude to freedom of migration is inseparably linked with its relation to private property, freedom in the flow of goods and capital, as well as to the protection of human rights and property. Drawing on Mises' approach, the paper identifies five main types of economic and migration policy: anarchy - liberalism - protectionism - dirigisme - totalitarianism. The author addresses arguments pro and contra freedom of movement from the standpoint of liberalism, protectionism and dirigisme, and shows that within one state the traits of various types of economic and migration policy can be mixed. At large, however, the "Mises rule" holds true today: the further the economy is from liberalism, the less freedom of movement there is in an immigration-attractive country. At the same time, efficient liberal migration policy requires consistent liberalism in the economy.
IMPROVING THE MECHANISM FOR THE PROTECTION OF HUMAN RIGHTS AND FREEDOMS
No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment (Art. 5, Universal Declaration of Human Rights). According to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, torture means: . any act by which a person is intentionally subjected to severe physical or mental pain or suffering, in particular in order to obtain from this person or from a third party information or confession, to punish him for an act which he or a third person has committed or is suspected of having committed, to intimidate or pressure him or her to intimidate or to put pressure on a third party, or for any other reason based on any form of discrimination, when such pain or suffering is applied by a public official or any other person acting officially or at the instigation or with the express or tacit consent of such persons. No one shall be subjected to torture or to inhuman or degrading treatment or punishment (Convention for the Protection of Human Rights and Fundamental Freedoms). Russian Revolution in perspective. Reflections on its impact on the Indian freedom struggle

The October Revolution of 1917 profoundly influenced the course of the Indian freedom movement in multiple ways. It gave impetus to Indian political aspirations, widened the base of the freedom struggle by making industrial workers and peasants active participants, and endowed the movement with a progressive outlook. The revolution's principles resonated deeply among the people and leaders of the Indian freedom movement. In fact, many of the values enshrined in our Constitution, adopted post-independence, were inspired by the lofty ideals of the Russian Revolution. The most important event in Russia, influencing the course of the freedom movement in India, was the October Revolution in 1917. The revolution, its ideology, V. I. Lenin and his deep involvement with the issues confronting the people of the East, the transformation of Russia post 1917, and the overall attitude of the Soviet government and the Comintern towards India's freedom struggle deeply influenced both the people and the leaders of the Indian freedom movement. Though the multiclass national movement did not get converted completely to the cause of socialism, the fact remains that the legacies of the October Revolution influenced the course of the freedom struggle in multiple ways. Some of its legacies got imprinted in the Constitution that India adopted post-independence. The socialist component of the Constitution of India did not happen by accident. It was the outcome of the massive ideological churning that took place within and outside the Indian National Congress and that which by no small measure was triggered by the emancipatory ideals of the Russian Revolution of 1917. The Constitution of the Republic of India, adopted on 26 January 1950, was based on a set of principles and ideas that would achieve socialist reconstruction of society through democratic means. The right balance of the proper socio-economic rights with guaranteed democratic and civil liberties, based on the majority principle along with the right of minority opinions to exist and flourish in a secular state became the cornerstones of the Constitution that independent India adopted. Many of these values were clearly inspired by the lofty ideals of the Russian Revolution.
