Entre los «nuevos derechos» reconocidos por algunas de las recientes reformas estatutarias cabe destacar el denominado derecho a la identidad de género. Este derecho, solo contemplado por el legislador estatal en cuanto al procedimiento para la rectificación registral del sexo, está siendo objeto de desarrollo por varios legisladores autonómicos. Este marco normativo nos sitúa ante el doble reto que este nuevo derecho plantea a los ordenamientos jurídicos: la superación de la perspectiva patologizadora de la transexualidad y el desafío al sistema binario masculino/femenino desde el que se construye la titularidad de los derechos. ; Among the new rights recognized by some of the latest statutory reforms, we should include the so-called right to gender identity. This right, only considered by the State legislator regarding the registration process for sex rectification, is still under development by several autonomic legislators. This regulatory framework confronts us with the double challenge raisen by this new law at the legal systems: the overcoming of the pathologizing perspective of transsexuality as well as the challenge to the male / female binary system from which the rights onwership is built.
Se presenta el caso de un escolar de 6 años —identificada como J– que presenta genitales externos ambiguos desde su nacimiento. Por recomendación médica, fue registrado como varón por sus padres; sin embargo, pruebas posteriores (imágenes diagnósticas y cariotipo) indicaron que el infante era, biológicamente, de sexo femenino. Ante este evento, sus padres inician un proceso judicial con el fin de cambiar su nombre, por lo que el juez ordena la valoración psiquiátrica forense para determinar su verdadero sexo1. Del estudio forense se concluye que es de sexo femenino, posteriormente se comunica el resultado a la autoridad y se autoriza la corrección del nombre en el registro civil.1 Solicitud literal del juzgado de familia. ; This is the case of a six-year-old schoolchild —identified as J— who was born with ambiguous external genitalia. Upon medical recommendation, the child was registered as male by the parents; however, further testing (diagnostic imaging and karyotyping) showed that the child was biologically female. Based on this, the parents started the judicial process to change their child's name, and the judge ordered a forensic psychiatric evaluation to determine the child's true sex1. This paper examines the unequal political participation of women and men in Italy, both at national and local level. Starting with a brief outline of the female presence in Parliament since the end of the Second World War, the article goes on to focus on gender inequalities in regional and local administrative and representative bodies. Various interpretations regarding the marginalization of women in the political arena are drawn up in connection with the wider social context, and a number of possible changes are put forward in light of some recent local experiences that reveal a renewed vigour in female political participation and mobilization. ; El artículo aborda el tema de la desigual participación política de género en Italia en los ámbitos nacional y local. Se esboza un cuadro sintético de la situación de la presencia de las mujeres, exigua minoría, en el Parlamento desde la posguerra hasta hoy; a continuación, se pasa a considerar las disparidades de género en los órganos de gobierno y de representación regional y local. It is suggested that the regulation of such rights under Spanish Law of Asylum 12/2009 it provides a restrictive and conditioned acknowledgement and introduces explicitly discriminatory elements. Furthermore, it is defended that, against current practice of national Administration, grave discriminatory acts in the access and enjoyment of social rights may constitute the objective element of persecution. Secondly, main procedural guarantees and reception conditions for LGBTI asylum-seekers are studied, under new asylum package approved by the European Union in June 2013. Lastly, according to the analyses of Spanish and European case-law, it is questioned the coherence and pertinence in the requirement of proving evidences and discretion criteria is rejected under the human rights approach. ; El presente trabajo presenta un análisis crítico del contenido jurídico del derecho de asilo por motivos de orientación sexual e identidad de género. Sugiere que la regulación de este derecho en la Ley de Asilo 12/2009, de 30 de octubre, opera de forma restrictiva y condicionada e introduce elementos manifiestamente discriminatorios. Además, defiende que, en contra de la práctica de la Administración, los actos de discriminación grave en el acceso y ejercicio a los derechos sociales básicos también pueden constituir el elemento objetivo de persecución. En segundo término, introduce las principales garantías de procedimiento y condiciones de acogida que nuestro ordenamiento jurídico debe incorporar tras el paquete de asilo, aprobado en junio de 2013 por la Unión Europea, en relación con los solicitantes de asilo LGBTI. El presente artículo está basado en el Trabajo Fin de Grado en Trabajo Social realizado por Sara Roldán Mesa y dirigido por la Dra. María Teresa Díaz Aznarte, que fue presentado en junio de 2020 en la Universidad de Granada (España). ; Las personas transexuales son objeto de innumerables situaciones de discriminación social, sanitaria y jurídica, y pese a los avances legislativos siguen siendo un colectivo vulnerable que precisa de una protección jurídica y sanitaria. Por ello, es necesario realizar una revisión legislativa del sistema sanitario español para conocer las prestaciones y los servicios destinados a la atención de la población transexual. En España, la descentralización territorial, la carencia de una normativa estatal y la escasez de Unidades de Identidad de Género provocan una injerencia en la libre autodeterminación de la identidad de género, así como situaciones de desigualdad en el acceso a las prestaciones sanitarias, dependiendo en qué Comunidad Autónoma se resida. En base a lo anterior, se presenta la necesidad de abogar por una reformulación jurídica y sanitaria que contemple múltiples formas de expresión de género, permitiendo el libre desarrollo de la personalidad e incluyendo la autodefinición del propio cuerpo, alejándose así de la visión reduccionista de la corporalidad y la genitalidad. This volume brings together approaches to, and perspectives on, English, Spanish, and Galician language, literature, and culture from the fields of women's, gender, and queer studies. As its title reflects, the book adopts an inclusive attitude to the so-called "others" present in these fields. Since queer theory first appeared in academia, its influence has been notorious within both women's and genders. As such, it is vital to "queer" academia so that it re-conceptualises its foundations; indeed, the contributions here serve to alter the reader's consciousness of the terms "woman" and "gender".The first chapters concern the field of discourse analysis. Two discuss the written work of female scientists in the Late Modern Era and their role in society. Another deals with women's political discourse in South America. In the following section on literature, the contributors question the current heteronormative and androcentric ways of reading texts. The works on culture study contemporary genres, such as video games, video clips, and pieces of news, and take readers away from Europe. The Epilogue draws on the book's intersubjective spirit to propose a dialogue, among multiple disciplines and the people who practise them. As such, the volume reflects the eclectic nature of queer, women's, and gender studies, and their world-wide acceptance by the scholarly community
El presente trabajo se inscribe en la investigación doctoral denominada Modos de relacionalidad y construcción de vínculos significativos en sujetos que integran colectivos socio sexuales disidentes y tiene como objetivo analizar la legislación vigente respecto a los derechos relacionados con la diversidad sexual, específicamente la Ley 26743 de Identidad de Género. Mediante una revisión bibliográfica se indagan los cambios que en materia de normativas y categorías tradicionales sobre la sexualidad se han producido entre la segunda mitad del siglo XX y los comienzos del siglo XXI, cambios que resultan los antecedentes de la Ley de Identidad de Género. El devenir de estas transformaciones nos lleva a pensar el papel que, en términos políticos, tuvo el activismo de los grupos de diversidad sexual. En este punto, coincidimos con Paula Viturro (2014) en considerarlo como una experiencia calificada, emancipatoria, democrática y política, en los términos de Jacques Ranciére. ; This work is part of the doctoral research called Modes of relationality and construction of significant bonds in individuals that integrate dissident socio-sexual groups and aims to analyze the current legislation regarding rights related to sexual diversity, specifically Law 26743 of Gender Identity. By means of a bibliographical revision, we investigate the changes that in the matter of norms and traditional categories have occurred between the second half of the twentieth century and the beginning of the twenty-first century, these changes became the background of the Gender Identity Law. The evolution of these transformations leads us to think about the role that, in political terms, the activism of sexual diversity groups have had. At this point, we agree with Paula Virruto (2014), in considering it as a qualified experience that is emancipatory, democratic and political, in terms of Jacques Ranciére. ; Facultad de Psicología
El propósito de este artículo es realizar una aproximación crítica al concepto de identidad de género y sexual desde la teoría política democrática. Tras una crítica a las "políticas de identidad" de carácter culturalista, se defenderá la dimensión política, fluida y dinámica de las identidades. Para ello se hará un recorrido por las distintas concepciones sobre la identidad de género y sexual hasta llegar al planteamiento llevado a cabo por los y las transgenéricas. Finalmente, se señalará la necesidad de defender las identidades de género y sexuales como un continuum, siendo esta la que mejor nos capacita para llevar a cabo la inclusión, la igualdad y la libertad democrática en nuestras sociedades. ; The objective of this article is to offer a critical examination of the concept of gender and sexual identity from the perspective of democratic political theory. After a critique of culturalist identity politics, this article makes a defense of the political, fluid and dynamic dimensions of identities. For this purpose we examine the various approaches to gender and sexual identity, particularly the transgender perspective. In conclusion, a vision of gender and sexual identities as a continuum is most in accord with the possibility of providing democratic inclusion, equality and liberty in our societies.
El presente trabajo intentará, mediante un recorrido bibliográfico, abordar la Ley 26.743 de Identidad de Género, la cual produjo en la Argentina una ruptura paradigmática en relación a la concepción de las identidades. Podemos ubicar la sanción de la ley, como el corolario de una lucha de más de 30 años del movimiento LGTTBIQ (lesbianas, gays, travestis, transexuales, bisexuales, intersexuales y queer) junto a sectores sociales, políticos, culturales y académicos. Podríamos pensar un más allá y un más acá con respecto a dicha legislación. En lo que refiere al primer más, abordaré el activismo de los movimientos de la diversidad sexual y como hicieron su aparición en la escena política, sin perder de vista las luchas colectivas que se llevaron adelante en ese contexto histórico – social. En relación al segundo más, intentaremos realizar un análisis crítico de la legislación, partiendo de considerar a dicha experiencia como emancipatoria, política y democrática (Virruto, 2014). La potencia de esta legislación radica, fundamentalmente, en que se recuperaron las experiencias de las personas trans, en tanto, estas llegaron al poder legislativo para demandar sus derechos en sus propias palabras, en sus propios términos. ; Eje temático: Estudios de género. El presente artículo aborda los alcances de la despatologización y la desmedicalización en relación a las posibilidades simbólicas e institucionales abiertas por la Ley de Identidad de Género argentina (Ley 26.743/12). Focalizando en las tensiones entre medicalización-desmedicalización y patologización-despatologización analiza el debate parlamentario que llevó a la sanción de la Ley de Identidad de Género argentina. Prestando atención a ciertos procesos globales de mutación en las tecnologías de gobierno de los cuerpos y las subjetividades, indaga en los alcances y efectos de la medicalización de la identidad de género cuando, a partir de una legislación de alcance nacional, esta deja de ser entendida como enfermedad y se garantiza formalmente el acceso universal y gratuito a las tecnologías médicas de transformación corporal sustentándose en el derecho humano a la identidad de género. A través del análisis de contenido cualitativo de las transcripciones taquigráficas interpretamos los debates parlamentarios desarrollados durante los años 2011 y 2012 en las comisiones parlamentarias y en el recinto de las cámaras de Diputados y Senadores. En dicho marco se rastrean significados y tensiones en torno a la definición de "lo medicalizable", "lo patológico", "lo natural en relación al sexo" y "lo normal". ; This article focuses on tensions related to pathologization and depathologization as well as to medicalization and demedicalization brought up by recent Argentina's Gender Iden-tity Law (Law No. 26.743/12). In May 2012, the Argentine National Congress approved the Gender Identity Law which regulates the change of name and sex of people whose gender expression does not agree with the one legally registered. Moreover, the law includes in the public health program the provision of hormone treatment and surgical intervention. In this article we inquire into the political and institutional discourses that circulated during parliamentary discus-sion of the Gender Identity Law during 2011 and 2012. Focusing on recent global mutations in contemporary biopolitics and in bodies and subject's technologies of government, this article explores the scope and effects of medicalization of gender identity. Hence, it inquires about the different discourses that lead to the approval of this national law regarding the fact that it disposes the free and universal access to medical technologies bodily transformation and that it is supported by the notion of human right to gender identity. Verbatim transcriptions of the debates developed in the House of Representatives and Senate are analyzed using the qualitative content analysis technique. At the outset, this paper addresses the advances achieved in the human rights protection systems and in Latin American legislations with regard to discrimination due on the grounds of sexual orientation and gender identity. The paper also analyzes the elements of universal equality, in particular relating to sexual orientation and gender identity, as well as three challenges faced in establishing this construction. First, the article reviews the notion and limitations that modernity has placed on the concept of "man", which have, throughout history, allowed various kinds of discrimination against certain groups. Second, the limitations of legal discourse, as well as its political dimension (despite its sometimes neutral appearance), surface when dealing with topics related to discrimination due to sexual orientation. Third, the article focuses on the importance that arguments based on naturalism have had in the treatment of judicial decisions on cases related to homosexuals, transexuals or transvestites rights holders. To conclude, the article suggests that the road to be taken should move from a prism of pathology to one in which the autonomy of individuals is recognized. ; En un comienzo, el artículo da cuenta de los avances del sistema de protección de derechos humanos y de las legislaciones latinoamericanas en materia de discriminación por orientación sexual e identidad de género. Luego, da paso al análisis de los elementos de igualdad universal que debieran ser respetados en materia de orientación sexual e identidad de género. Considerando esto, se analizan tres dificultades que han existido para reconocer este deber. Primero, se revisan los límites que la modernidad ha puesto al concepto de "hombre", que ha justificado a lo largo de la historia distintos tipos de discriminación a ciertos grupos.
