ccording to the Section 1 of the Council of European Union Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia by means of criminal law, each Member State shall take the measures necessary to ensure that the following intentional conduct is punishable: publicly condoning, denying or grossly trivialising crimes of genocide, crimes against humanity and war crimes. Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law provides for liability in the public glorification of genocide, crime against humanity, crime against peace or war crime or glorification, denial, acquittal or gross trivialisation of committed genocide, crime against humanity, crime against peace or war crime, including genocide, crime against humanity, crime against peace or war crime committed by the U.S.S.R. or Nazi Germany against the Republic of Latvia and its inhabitants. The article aims to initiate a debate on potential problems related to the application of the Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law. The author offers his vision of the regulatory framework application problems.

He is the author of The German New Order in Poland and in 1944 published Axis Rule in Occupied Europe, containing the term: "genocide". At the time of the Nuremberg Trial Lemkin acted as adviser to United States Supreme Court Justice Robert H. Jackson. Subsequently, he worked on devising an act of law that would define the principles of penalising the crime of genocide. On 9 December 1948 the United Nations General Assembly adopted the Convention on the Prevention and Punishment of the Crime of Genocide. In Poland the revival of interest in Lemkin has its positive and negative sides. The former undoubtedly include changing or rather initiating an alteration of a situation embarrassing or outright insulting for Poland, namely, when Polish–language versions of the above–mentioned books about the Axis occupation were not available and Lemkin was not mentioned in assorted studies. The latter aspect involves his sui generis sacralisation and elevation, hindering a critical discussion about his achievements, since such a debate could be interpreted as questioning them. This article endeavours to examine the conception of genocide from the viewpoint of an historian, and reflects on the extent to which it could become an instrument of historical analysis.

The aim of the paper is to analyze the endeavors undertaken by the authorities of independent Lithuania to deal with the crimes committed by the Soviet Union against Lithuanian society, in particular against representatives of the anti-Soviet resistance movement, by using the notion of crime of genocide rooted in international law. The judgment of the European Court of Human Rights in the case of Drelingas v. Lithuania of 12 March 2019, which approved the legality of the qualification of "ethno-national-political" genocide of "forest brethren" committed by the Soviet occupation authorities, was one of the key elements confirming the Lithuanian policy in this regard. This ruling reopens the discussion on the possibility of trying the crimes of the Soviet Union, at the same time raising certain legal and political doubts – as generally expressed by the Russian Federation.

To sum up all the foregoing considerations, it can be stated that a limited degree of social identification, together with political elites, constitutes an indispensable element of the functioning of political systems and those democratic ones, as well. Unfortunately, Africa is still a place of alienation tendency, manifested by political elites, which constitutes a basis prone to social conflicts. However, Africa has to encounter difficulties resulting from long-term colonial oppression. The problem also concerns various religions, from Muslims, Christians to the faith in traditional tribal gods. All this is a consequence of historical past. In order to make the plans for its development work, Africa has to defeat its biggest enemies first – the problem of famine, constant conflicts and dozens of wasted opportunities to stabilize the continent. Africa is abundant with such natural resources that no other country has them. " In the moment of creation of the world God felt tired with the creation process, so he sat down and fell asleep. What is also paradoxical, is the fact that Africa is the poorest continent of all, with civil wars, genocide, famine, lack of water and spreading disease, such as AIDS and malaria, which are considered to be world's plagues. The solution to these problems lies in incorporating full stabilization in the continent. The interest in Africa is slightly smaller than directly after decolonization and the famous year 1960. The Fall of the Berlin Wall, changes in the countries of Middle East Europe in 1989 and the collapse of USSR directed the interest towards Europe. Africa appears in the public eye, only when it comes to events such as those in Sudanese Darfur, Ruanda or Somalia.

The chances of an independent state for Kurds ; Szanse Kurdów na niepodległe państwo
The Kurds, there is one of the oldest nations in the world, with rich culture, living on the crossroads of the Middle East, in the "cradle" of the western civilization, within three major monotheistic religions. The Kurds are estimated at about 50 million people, does not have its own statehood. Besides the 11-month incident of the Republic of Mahabad, founded in 1946, in the territory of north-eastern Iran, They have never received sovereignty. The exodus of Kurds from northern Iraq and the genocide perpetrated by the army of Saddam Hussein, what happened in the spring of 1991 led, in the fall of that year, to the creation of a security zone, by act of the United Nations Security Council Resolution 688, which turned into an informal Kurdish autonomy in the north Iraq. Building structures of statehood, slow, interrupted by civil war, began from that time. The American invasion in 2003 and overthrow of the rule of the Baath party, under the Constitution of 2005, the Iraqi Kurds obtained legally sanctioned autonomy. The creation of an Islamic state, that use violence against the Christian population and Yazidis, as well as the Muslims Kurds, and the arrival of more than 2 million refugees into the Kurdistan Region, it has become a threat for their autonomy. For the Kurds, it became apparent that the Iraqi Arabs is impossible to create a democratic state. They began to not only think but also talk more and more about sovereignty. In addition, there is a principle in international law for respect for territorial integrity. Neighbouring countries like Iran, Turkey, and Syria are not interested in the creation of a Kurdish state in Iraq, because their territories are quite a group of the Kurdish minority, who are also thinking about independence. USA - the largest power opts for the indissolubility of Iraq, however, the bulk of US congressmen has a different opinion on this issue from the president. ; Kurdowie, jeden z najstarszych narodów świata, żyjący w "kolebce" zachodniej cywilizacji, na styku trzech głównych monoteistycznych religii, szacowany na około 50 milionów osób, nie posiada własnej państwowości. Poza 11 miesięcznym incydentem funkcjonowania Republiki Mahabadzkiej, utworzonej w 1946 r., Kurdowie nigdy suwerenności nie uzyskali. Exodus Kurdów z północnego Iraku i ludobójstwo dokonane przez wojska Saddama Husajna wiosną 1991 r., doprowadziło jesienią tegoż roku, do utworzenia, na mocy 688 rezolucji RB ONZ, strefy bezpieczeństwa, która przerodziła się w nieformalną, kurdyjską autonomię w północnym Iraku. Od tego czasu rozpoczęło się powolne, przerwane wojną domową, budowanie struktur państwowości. Po amerykańskiej inwazji na Irak (2003) i obaleniu rządów partii Baas iraccy Kurdowie, na mocy konstytucji z 2005 r., uzyskali prawnie usankcjonowaną autonomię. Powstanie Państwa Islamskiego, które brutalnie rozprawia się z ludnością chrześcijańską jezydzką, a także Kurdami muzułmanami oraz przybycie do Regionu Kurdystanu prawie 2-milionowej rzeszy uchodźców stało się zagrożeniem dla owej autonomii. Kurdowie uznali, że z irackimi Arabami nie da się tworzyć demokratycznego państwa. Zaczęli coraz częściej nie tylko myśleć, ale i mówić o suwerenności. Jednak w prawie międzynarodowym występuje zasada poszanowania integralności terytorialnej. Ościenne państwa, jak Iran, Turcja, czy Syria nie są zainteresowane powstaniem państwa kurdyjskiego w Iraku, bo na swoich terytoriach mają spore grupy mniejszości kurdyjskiej, które też myślą o samodzielności. USA - największe mocarstwo optuje za nierozerwalnością Iraku, aczkolwiek gros kongresmenów amerykańskich ma odmienne w tej kwestii zdanie od prezydenta.

Truth and Forgiveness: The Meanders of the Polish-Ukrainian ; Prawda i przebaczenie. Meandry dialogu polsko-ukraińskiego
There are two standpoints in the Polish-Ukrainian dialogue. The first might be termed as 'to forgive and ask forgiveness.' Its followers, guided by the Christian teaching on love and forgiveness, believe that the border between 'the executioner' and 'the victim' in the Polish-Ukrainian conflict is vague, in particular in the context of the national groups involved in the controversy. No nation is entirely evil or good. Therefore, the Ukrainians were not only 'executioners' of the Poles, but also their 'victims.' Poles simultaneously acted as their 'torturers'. Considering this mutual detriment, the proponents of this standpoint believe that only mutual apology and forgiveness can lead to the Polish-Ukrainian reconciliation and that the act of such reconciliation must not involve harming the dignity of either Ukrainians or Poles or humiliating either nation. The alternative position is held by those who believe in 'being released by the truth.' While the supporters of this view also stress the need for the Polish-Ukrainian reconciliation, they hold that it may be accomplished on certain conditions only, one of them being the apology from the other side. To them, the border between 'the executioner' and 'the victim' is very clear. Thus, the Poles representing this standpoint believe it was the Ukrainians who were the executioners. Likewise, the Ukrainians holding this view believe the Poles only to have been the murderers. As a result, either party considers itself the victim, the Polish-Ukrainian conflict being seen through this 'singular' lens only. The losses of the respective national group are magnified, while those of the other side are usually underestimated or altogether ignored. The actions of the other party are termed as 'genocide,' while the acts committed one's own party are justified as retaliation even if they involved killing women and children. Throughout the history of the Polish-Ukrainian dialogue, the two standpoints compete with, but also affect each other. Nowadays, however, the initiative seems to belong to the proponents of seeing one's own national harm only, which is reflected in the shallowness of the reflection on the historical events in question, as well as in the lack of compassion for the victims of the conflict both on the Polish and the Ukrainian sides. The current situation in the dialogue about the Polish-Ukrainian conflict contributes to strengthening the voice of the opponents of any reconciliation in this matter who express their views by committing acts of profanation and destruction of Polish and Ukrainian memorials in both countries. ; W relacjach polsko-ukraińskich główną kością niezgody są tragiczne wydarzenia z lat wojny i okresu powojennego. Są one odmiennie oceniane przez Polaków i Ukraińców. Tak jedni, jak i drudzy wolą postrzegać się w roli ofiary niż kata, usprawiedliwiając tym samym wyrządzoną drugiej stronie krzywdę. Prym w tym wiodą organizacje nacjonalistyczne i kombatanckie oraz kresowe. Postawa taka utrudnia dialog polsko-ukraiński, którego celem ma być pojednanie między obu narodami. Dla osiągnięcia tego celu bardzo wiele zrobiły Kościoły, zwłaszcza rzymskokatolicki i greckokatolicki, inspirowane przez papieża Jana Pawła II, a także prezydenci Polski (Aleksander Kwaśniewski i Lech Kaczyński) oraz Ukrainy (Leonid Kuczma i Wiktor Juszczenko). Ważną rolę w tym procesie odgrywają: mniejszość ukraińska w Polsce i mniejszość polska na Ukrainie, liczne organizacje pozarządowe i intelektualiści. Niemniej w dialogu polsko-ukraińskim można wyróżnić dwie postawy. Pierwsza kieruje się chrześcijańską zasadą "przebaczamy i prosimy o przebaczenie", a druga maksymą "prawda was wyzwoli". Reprezentujący pierwszą z nich stoją na stanowisku, że w konflikcie polsko-ukraińskim i Polacy, i Ukraińcy byli tak ofiarami, jak i katami, a zwolennicy drugiej dostrzegają tylko własną krzywdę.

Yearbook of Eastern Studies 2020 ; Wschodnioznawstwo 2020
"Yearbook of Eastern Studies" has been established as a forum for the debate on the multifaceted nature of transformations in Central and Eastern Europe and Asia, with particular focus on the post-Soviet area. The conceptual content of the periodical was born thanks to the professors Zdzislaw J. Winnicki and Walenty Baluk, who edited the first three volumes, which were published formally as separate monographs, but already under the banner of "Wschodnioznawstwo". Since 2010, the Yearbook has the status of a scientific journal, and two years later it has been listed on the journals of the Ministry of Science and Higher Education. In addition, the periodical is indexed in national and international databases such as Index Copernicus, Central European Journal of Social Sciences and Humanities, BazHum and Polska Bibliografia Naukowa. The scientific profile of the periodical, which has consistently been implemented since the beginning of the activity of "Yearbook of Eastern Studies", focuses on the field of social sciences, with particular emphasis on the science of politics and science of safety. Its great advantage is its internationalization, which manifests itself both in terms of composition of the scientific council, reviewers, and authors of texts published in the "Wschodnioznawstwo" in Polish, English and Russian languages. Up to now, researchers from Poland, Azerbaijan, Belarus, Czech Republic, Georgia, Germany, Hungary, Japan, Kazakhstan, Latvia, Macedonia, Russia, Slovakia and Ukraine have published on the cards of the journal. ; Wydawany przez Zakład Badań Wschodnich od 2007 r. rocznik "Wschodnioznawstwo" powstał jako forum debaty nad wielowymiarowością przemian w regionie Europy Środkowej i Wschodniej oraz Azji, ze szczególnym uwzględnieniem obszaru postradzieckiego. Koncepcja merytoryczna periodyku zrodziła się dzięki profesorom Zdzisławowi J. Winnickiemu oraz Walentemu Balukowi, którzy redagowali wspólnie pierwsze trzy tomy, wydane jeszcze z formalnego punktu widzenia jako odrębne monografie, ale już pod szyldem "Wschodnioznawstwa". Od 2010 r. rocznik posiada status czasopisma naukowego, a dwa lata później trafił na listę czasopism punktowanych Ministerstwa Nauki i Szkolnictwa Wyższego. Ponadto periodyk jest indeksowany w krajowych i międzynarodowych bazach, takich jak Index Copernicus, Central European Journal of Social Sciences and Humanities, BazHum czy Polska Bibliografia Naukowa. Profil naukowy periodyku, który konsekwentnie jest realizowany od początku działalności "Wschodnioznawstwa", koncentruje się wokół dziedziny nauk społecznych, ze szczególnym uwzględnieniem nauk o polityce i nauk o bezpieczeństwie. Ogromnym atutem rocznika jest jego umiędzynarodowienie, które przejawia się zarówno w aspekcie składu rady naukowej, recenzentów, jak i autorów tekstów zamieszczanych na łamach "Wschodnioznawstwa" w językach polskim, angielskim i rosyjskim. Do tej pory na kartach periodyku publikowali naukowcy z Polski, Azerbejdżanu, Białorusi, Czech, Gruzji, Japonii, Kazachstanu, Łotwy, Macedonii, Niemiec, Rosji, Słowacji, Ukrainy i Węgier.

Edukacja wobec groźby wojny ; Education against the threat of war
W artykule przyglądam się temu, jaką edukację polityczną warto rozwijać we współczesnej polskiej szkole i wszędzie tam, gdzie buduje się w ludziach zdolność do wspólnej i niewyalienowanej pracy. Kierunek rozważań wyznaczyła konieczność ustosunkowania się myśli pedagogicznej – i równoległego dostosowania praktyk wychowawczych – do zmian w sposobie koordynacji społeczeństwa, które dokonują się w atmosferze groźby wybuchu wojny. Rozważania te buduję na dotychczasowych badaniach własnych z obszaru uczenia się w ruchach społecznych, analizując trzy porządki zapewniające koordynację społeczeństw (neoliberalizm, nacjonalizm, militaryzm) w kontekście wykluczanych przez nie wartości: dobra wspólnego, samorządu i pokoju. Rezultatem pracy jest matryca przyporządkowująca te kontrwartości różnym typom współpracy (koordynacji, kooperacji i kolaboracji). Matryca pozwala identyfikować specyfikę konkretnych przykładów mobilizacji społecznej, jak i rozpoznawać luki w kształceniu kolektywnych umiejętności współdziałania. Rezultaty analizy pozwalają zoperacjonalizować praktyki oporu pod kątem celów wychowania i stawiają w nowym świetle problemy powiązań i nawarstwiania się wrogich szkole ideologii neoliberalizmu, nacjonalizmu i militaryzmu. ; The paper analyses types of political education worth developing in contemporary Polish schools and in other places dedicated to building human capacity to work together in a non-alienated way. The analysis is based on my own research from the area of learning in social movements. I analyze three orders ensuring social coordination (neoliberalism, nationalism, and militarism) in the context of the values they exclude: the common good, self-government and peace. The result of the work is a matrix assigning these counter-values, accordingly, to coordination, cooperation and collaboration. The matrix allows for identification of the specificity of some examples of social mobilization, as well as identification of gaps in teaching collective interaction skills. The results of the analysis can be used to operationalize the practices of resistance in terms of educational goals.
