The art market is rapidly developing along the ways of globalisation, digitalisation, and democratisation. Yet, it has several characteristics that favour market manipulation, such as lack of transparency and conflicts of interest. Despite substantial advancements, it is acknowledged that sector regulation does not address such limitations properly. In the light of US, EU, and national case-law, this article assesses the role that competition law could play in the art sector, also in conjunction with civil liability. It is found that competition law enforcement in the art market has been scarce so far. It provided for effective reaction tools against few, significant market manipulation strategies carried out by key auction houses. On those occasions, competition authorities and undertakings set shared, basic rules of conduct through commitments. Such cases also seem to have inspired recent self- and heteroregulatory initiatives. All in all, competition law seems to play the residual role of a sentinel in the secondary art market. In contrast, whether or not competition law will be enforced in the authentication service sector mainly depends on how private enforcement will develop in the EU and the US.

The main aim of this paper is to examine the presence of the strict liability category in the legal system of the Latin Catholic Church. According to the correct understanding of the objective responsibility in the legislation of modern states, the Author, after having considered profound analysis concerning the offices' duties of the hierarchical Superior, studied the specific content of the can. 128 CIC/1983 and indicated it as the benchmark in order to establish possible, not only theoretical, answer of the problem. The research has found that, it is highly probable to assign some negative consequences (a real responsibility) to ecclesial Superiors even without their fault. ; Il presente studio s'interrgoa sull'effettiva presenza dell'istituzione della responsabilità oggettiva all'interno dell'ordinamento canonico vigente. Si tratta, infatti, di imputare la responsabilità al soggetto non agente (per dolo o per colpa) col il quale, tuttavia, l'agente rimane in una specifica relazione d'indole giuridica. A questo scopo servirà l'analisi delle soluzioni legali presenti negli ordinamenti civili come civil law e common law. La tesi è dedicata ai profili di diritto internazionale privato del danno da prodotto, con particolare riguardo agli sviluppi normativi che hanno interessato i Paesi membri dell'Unione europea. Nella prima parte della trattazione vengono analizzate le vicende più significative connesse alla nascita della fattispecie sia da un punto di vista sostanziale che internazionalprivatistico. In tale ambito, viene riservata peculiare attenzione all'esperienza degli stati Uniti (Cap. 1), che come noto hanno rappresentato la culla della responsabilità del produttore, e viene esaminata la Convenzione dell'Aja del 2 ottobre 1973 (Cap. 2), prima disciplina speciale della materia sul piano del diritto internazionale privato. La seconda parte dell'elaborato si concentra invece sugli interventi legislativi predisposti a livello comunitario (direttiva 85/374/CEE, come modificata dalla direttiva 1999/34/CE, e regolamento 864/2007/CE) al fine di ricostruire i rapporti intercorrenti tra le diverse fonti (nazionali, comunitarie e internazionali) che oggi concorrono a disciplinare la questione della legge applicabile alla responsabilità da prodotto negli Stati membri dell'Unione europea (Cap. 3). ; The thesis examines the conflict of laws aspects of product liability, with particular regard to recent developments of EU Member States' legislation. Product liability law as a distinct body of law – at least partially independent from general tort law – is a relatively new phenomenon. It arose during the 1960s in the Unites States of America. In that period US courts and scholars started to deal with choice-of-law issues in product liability cases. Chapter 1 gives an overview of the most significant events relating to product liability history, from both a domestic and international point of view. The need for a special conflicts rule – pointed out first by the US commentator Albert Ehrenzweig – led to the adoption of the 1973 Hague Convention on the law applicable to product liability, the first regulation of the topic in private international law, which is analysed in Chapter 2. Finally, Chapter 3 examines European Community legislative interventions in the field of product liability (Council Directive 85/374/EEC, amended by Directive 1999/34/EC, and Regulation 864/2007/EC) with the aim of assessing the present state of the law in EU Member States. Different sources are currently competing to regulate the issue of the law applicable to product liability in the EU context and this chapter analyses the relationships between them.

Il saggio concerne il ruolo che la responsabilità da prodotto difettoso è suscettibile di svolgere nel governo dei nuovi rischi insiti nello sviluppo delle tecnologie digitali, tenuto conto di alcuni profili problematici, tra cui il concetto di prodotto (e di produttore), nonché quello di difetto (con le connesse questioni relative all'accertamento dello stesso). L'analisi dei suddetti profili viene svolta, oltre che sulla base della interpretazione della pertinente disciplina, anche alla luce di alcuni recenti esperimenti di soft law. The essay deals with the role that liability for defective product is likely to play in the governance of new risks inherent in the development of digital technologies, taking into account some debated aspects, including the concept of product (and producer), as well as the concept of defect (and its assessment). The analysis of these issues is carried out not only on the basis of the interpretation of the relevant legislation, but also in the light of recent forms of soft law regulations.

La tesi analizza il tema della natura della responsabilità endofamiliare, che rappresenta una tra le maggiori novità che, negli ultimi anni, ha interessato l'evoluzione del diritto di famiglia. Se per lungo tempo la famiglia è stata considerata immune alle regole di responsabilità, oggi, il panorama scientifico italiano è pressoché concorde nell'ammettere l'applicazione delle regole di responsabilità civile nelle ipotesi di violazione dei doveri coniugali e genitoriali. Tale acquisizione si pone quale corollario non solo al superamento dell'idea di specialità dei rapporti familiari, ma anche alla progressiva affermazione dei diritti della persona all'interno delle formazioni sociali in cui si esplica la personalità dell'individuo. Gli interventi della giurisprudenza di merito e di legittimità hanno oltrepassato i tradizionali confini del diritto di famiglia, aprendo tale settore alle regole aquiliane, facendo leva, per questa via, non soltanto sull'insufficienza dei rimedi giusfamiliari, ma soprattutto sulla necessità di assicurare all'individuo adeguata tutela, anche risarcitoria, e ciò indipendentemente dal fatto che l'individuo appartenga ad una comunità familiare. Nonostante la giurisprudenza ormai maggioritaria sia orientata nel senso di veicolare la responsabilità derivante dalla violazione del dovere familiare secondo le regole aquiliane, non mancano, tuttavia, voci contrarie che mettono in discussione la natura stessa di tale responsabilità. Si valuta, dunque, la possibilità di interpretare i doveri matrimoniali quali obblighi di protezione, ponendo attenzione alla natura del rapporto e agli obblighi che ne discendono, con l'obiettivo di valutare se sia possibile offrire una lettura alternativa alle ipotesi risarcitorie riguardanti la violazione dei doveri coniugali. In questo senso non si potrà certamente trascurare la presenza di obblighi giuridici specificamente individuati dal legislatore e la dimensione di relazionalità in cui vengono a trovarsi i familiari conviventi, che non possono essere considerati alla stregua di un «chiunque» generico, in quanto legati da un rapporto preesistente che nasce e si instaura quale rapporto particolarmente qualificato. L'indagine in esame si estende anche a valutazioni che riguardano l'opportunità e la convenienza a ravvisare in taluni istituti finalità punitive. Lo spunto è offerto dall'art. 709 ter cod. proc. civ., in tema di soluzione delle controversie nelle ipotesi di gravi inadempienze e violazioni nell'affidamento dei figli. L'espressa previsione di una formula risarcitoria, che attribuisce al giudice il potere di disporre il risarcimento del danno a carico di uno dei genitori, nei confronti del figlio, o anche dell'altro genitore, ha fatto emergere orientamenti contrastanti in ordine alla possibilità di configurare, attraverso tale disposizione, un'ipotesi di danno punitivo. ; This dissertation analyzes the theme of liability remedies between spouses, which represents one of the most important acquisitions, in recent years, that has interested the evolution of Family Law. If in the past the family was considered immune to the compensatory remedies, nowadays, the panorama of Italian legal science is almost unanimous to admit the application of civil liability rules in cases related to the violation of conjugal and parental duties. This opening to general remedies not only involves the overcoming of the specialty of Family Law, but also progressively affirms the expected growth of personal rights within all social formations, in which the personality of the individual is expressed. The interventions of the case law of merit and legitimacy have transcended the traditional boundaries of Family Law, opening the sector to non-contractual rules, levering, in this way, not only the inadequacy of the existing remedies, but above all the necessity to ensure adequate protection to the individual, also for damages, regardless of whether he belongs to a family community or not. While the majority of jurisprudence is oriented to acknowledge that the violation of duty of a spouse should be regulated by non-contractual liability, as if it were a tort, there are doctrines that contest the nature of that type of responsibility and prefer to define it as contractual liability. Therefore, it is necessary to evaluate the possibility to interpret marital obligations as «obligations of protection», by considering the nature of the relationship and the obligations that descend, with the purpose to evaluate if it is possible to offer an alternative interpretation of the hypothesis of compensation regarding the violation of conjugal duties. In this sense, the presence of legal obligations identified by the legislator and the relatedness of family members, who can not be considered as a generic person, because they are in a particularly qualified relationship, certainly can not be overlooked. This research extends across evaluations that regard the opportunity and convenience to recognize punitive damages, in certain institutes. A starting point is offered by analyzing art. 709 ter cod. proc. civ., in theme with solutions of the controversies in settling disputes in the hypothesis of serious defaults and violations involving child custody. The expressed prevision of a formula for compensation, that confers a judge the authority to order that compensation for damages against one of the parents, in favor of a child or even for the other parent, has caused conflicting orientations to emerge in the order of the possibility to configure a hypothesis of punitive damages. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXVII ciclo)

Il presente lavoro mira a una ricostruzione della condizione giuridica del fondo comune di investimento, definito come "patrimonio autonomo e distinto", su cui il legislatore non ha preso alcuna posizione espressa sul piano della titolarità, lasciando all'interprete il relativo (e tormentato) compito. A tal fine, l'esame critico della disciplina, alla luce di ulteriori forme di separazione patrimoniale rinvenibili nell'ordinamento giuridico, richiede un approccio metodologico teso sì a una ricostruzione in retrospettiva della questione ma anche a una sua analisi sistematica. La prima parte prende avvio dall'analisi della disciplina dei fondi comuni di investimento e della gestione collettiva del risparmio, ripercorrendo i tratti salienti della normativa al fine di acclararne la ratio. Rifuggendo da una redazione meramente compilativa, tale analisi risulta necessaria ai fini dell'esame degli aspetti problematici concernenti la natura giuridica dei fondi comuni di investimento, che non può essere avulso dal relativo contesto normativo. La seconda parte è dedicata al tema della qualificazione giuridica del fondo e della relativa titolarità alla luce della risalente dottrina, dell'evoluzione normativa e della giurisprudenza pronunciatasi sul punto. Sotto questo profilo, la prospettiva di indagine mira ad approfondire alcuni degli spunti emergenti dalle riflessioni teoriche concernenti la natura e la titolarità del fondo, avendo riguardo non solo alla classiche categorie civilistiche ma anche alla reale essenza della struttura e della disciplina dei fondi comuni di investimento e alle specifiche finalità di tutela degli interessi degli investitori perseguite dalla disciplina. Seguendo questo percorso, l'ultima parte volge uno sguardo doveroso alle tematiche concernenti le funzioni della separazione dei patrimoni nell'ambito dei mercati finanziari e del diritto positivo, senza pretermettere le categorie civilistiche, di diritto interno e di diritto straniero, sottese alle fattispecie considerate. ; The work aims to reconstruct the legal status of investment fund, on which law has not taken any position expressed in terms of ownership. The first part focuses on an analysis of the regulation of investment funds and collective investment management. The second part focuses on the problematic aspects concerning the legal nature of funds and its ownership. In this light, the prospective aims to explore the leading cases regarding the investment fund and some of the theories emerging in the doctrine, with particular attention with the traditional categories of civil law and the real essence of the regulation of investment funds. The last part examines the functions of the separation and segregated liability in financial markets and in the positive law.

Dottorato di ricerca in Diritto dei mercati: crisi, diritti e regolazione ; La presente ricerca ha ad oggetto la eventuale configurabilità nell'ordinamento giuridico italiano di risarcimenti con funzione anche sanzionatoria e/o deterrente nelle ipotesi in cui la tradizionale funzione compensativa della responsabilità civile rischia di non assicurare un adeguato livello di tutela effettiva alle situazioni giuridiche soggettive lese (illeciti senza danno, microviolazioni, reati bagatellari, danni non patrimoniali). Il tema in esame si inscrive nel dibattito dottrinale e giurisprudenziale concernente la natura mono o polifunzionale dell'istituto aquiliano. Per procedere allo svolgimento di necessarie riflessioni sul punto, si è preliminarmente focalizzata l'attenzione sugli ordinamenti giuridici che per primi hanno concepito rimedi ultracompensativi nell'alveo della responsabilità civile (Paesi di common law capitolo I, parte I), sull'evoluzione registratasi nel tempo con riferimento alle problematiche e agli inconvenienti che hanno occasionato. Altrettanto indispensabile si è rivelata l'indagine sugli argomenti di segno contrario alla configurabilità dei risarcimenti punitivi e/o deterrenti adottati nelle esperienze giuridiche dei principali Paesi di civil law e le aperture, più o meno significative, che si possono riscontrare in tali sistemi giuridici (capitolo I, parte II). Dato atto delle aperture in chiave punitiva del risarcimento presenti in giurisprudenza alla luce del diritto europeo al fine di garantire l'effettività della disciplina sovranazionale, degli orientamenti della Corte di Giustizia e della Corte di Strasburgo rilevanti per il tema in esame, delle problematiche poste dal diritto unionale e convenzionale, nonché dei tentativi di armonizzazione del diritto della responsabilità civile (v. capitolo II), si è ricostruita la evoluzione storica dell'istituto aquiliano – dal diritto romano ad oggi (capitolo III, parte I) – e notato che le regole della responsabilità civile sono state concepite per riparare un "danno" e quindi il deterioramento o la distruzione di un bene sia esso materiale o spirituale - a differenza di altre forme di tutela civile o pubblicistica - con la conseguenza che la introduzione di sanzioni civili punitive e/o deterrenti richiede necessariamente una espressa previsione legislativa (nazionale o europea) e l'osservanza dei principi di prevedibilità e di proporzionalità (tra risarcimento riparatorio-compensativo e risarcimento punitivo e/o deterrente e tra quest'ultimo e la condotta censurata). Di qui l'analisi delle ipotesi tipiche previste all'interno dell'ordinamento giuridico italiano che rispondono a tale finalità sanzionatoria e/o deterrente (capitolo III, parte I e II) e i relativi corollari sostanziali e processuali muovendo, alla luce della disciplina della fattispecie e della conformazione dell'effetto giuridico, dalla necessaria differenziazione tra risarcimenti con funzione anche punitiva e/o deterrente (capitolo III, parte II) e altre obbligazioni pecuniarie non risarcitorie, misure di coercizione indiretta o istituti sui generis riconducibili alla disciplina dell'arricchimento ingiustificato ovvero di altre obbligazioni indennitarie (capitolo III, parte I). Conclusa l'opera di inquadramento giuridico degli istituti implicati nell'attività di ricerca, sono state esaminate le controverse ipotesi di risarcimenti con funzione anche punitiva e/o deterrente e i profili problematici derivanti dal potenziamento della prevenzione e/o sanzione dell'illecito civile esaminando le aperture de jure condito e de jure condendo prospettabili nell'ordinamento giuridico italiano. ; This thesis is focused on punitive damages in Italian private law in the light of main Common law and Civil law perspectives. The latter object, particularly controversial, is widely discussed in doctrine and recent case law incresased interest in the subject manner. Although Italian private law knows different civil sanctions, there are no specific legislative (formal) provisions on "punitive damages". Neverthless some authors underline that traditional compensatory function of tort law (aquilian liability) could not ensure adeguate and effective protection in many problematic situations concerning infringments of rights. For example, mere compensation is not an effective method to deal with personality right infringements; undercompensation situations could take place in mass tort litigations, lucrative breach of contract or calculative torts; moreover, public enforcement does not produce satisfactory results in all situations of wrongdoing. In this sense, punitive damages could improve private enforcement of tort law, deterring and punishing wrongful conducts in society. In order to find out whether this civil remedy is avaible in Italy, it is firstly necessary to understand the meaning of punitive damages, the main characteristics and issues that it has dued in American and English common law (Cap I, par. II). Secondly it is necessary to focus on the reasons for the non-existence of punitive damages in continental Europe, the debate and possible developments in European civil law systems (Cap. I, part. II). The discussion addresses the positions of the European Court of Human Rights, the legislator of the European Union and the Court of Justice of the European Union on punitive damages, the increased attention and need for effective preventive, dissuasive and proportionate sanctions related to European law and the contribute to the enhancement and harmonization of tort law in Europe (PETL and DFCR) with particular reference to this subject matter (Cap. II). The research diffusely focuses on Italian tort law – from ancient Roman law tradiction to nowdays – and the so called multy-functionality conception that – according to some authors and case law – belongs to the system of tort liability. (Cap. III, part I and II). Under this point of view, it is noticed that in Italian tort law, punitive damages are not ontologically inconsistent with the legal system, but a series of fundamental limits have to be observed. In contrast of common law systems, Italian Courts cannot increase the amount of damages pursuing the aims of deterrence and punishment by introducing punitive damages without a typical legislative provision. It is central to ensure the predictability of decisions (cases and condictions in which such award applies and its amount) and punitive damages must comply with the principle of proportionality (among compensatory damages and non compensatory damages and among these one and the wrongful conduct sanctioned or the seriousness of tort). Consequently the research examinates Italian legislative provisions characterized by punishment and/or deterrence in private law. It is important to underline that not all these provisions concern with tort liability. Some special provisions deal with others civil remedies or others civil punitive and/or deterrent sanctions (Cap. III, part I) with relevant corollaries in order to the substantial and processual discipline. In specific cases the amount of damages (or indemnities) is determined having regard to some profiles referred to the wrongdoer (such as seriousness of the offence, the reiteration of the wrong, the enrichment of the wrongdoer, his economic wealth etc.) and, at the same time, to the victim (economic and non economic losses he/she has suffered) (Cap. III, part II). In these hypothesis tort law, specially with regard to immaterial and non economical damages, could have a deterrent and/or punitive function in addition to the traditional compensatory aim. The research, after reviewing the state of art, ends with the possible future developments.
