Die Arbeit befasst sich mit der Ermittlung der Rechtsgrundlagen der humanitären Intervention unter besonderer Berücksichtigung des Kosovo-Konflikts. Schwerpunkte sind die Erörterung der klassischen modernen humanitären Intervention im Rahmen von Kapital VII UN-Charta, von Kapitel VIII UN-Charta sowie Rechtsgrundlagen über eine Analogie zu aktuellem Völkerrecht. Vertiefend wird auf die Entwicklung der Menschenrechte und die Auswirkungen dieses neuen Menschenrechtsverständnisses auf das humanitäre Völkerrecht eingegangen. Die Arbeit schließt mit einer Analyse des derzeitigen Völkergewohnheitsrechts sowie der Zusammenstellung aktueller Tatbestandsvoraussetzungen der modernen humanitären Intervention.

Stadtentwicklung in der afghanischen Hauptstadt Kabul nach der westlichen Intervention ist gekennzeichnet von der Verschränkung einer durch Staatsaufbau nach westlichem Vorbild gesteuerten Logik und der sich in diesem Rahmen ausbreitenden Aneignung des städtischen Raumes durch ganz verschiedene Akteure. Vor diesem Hintergrund wird das Ziel verfolgt, stadträumliche Entwicklungsprozesse in Kabul nach 2001 genauer in den Blick zu nehmen und mit jüngeren Debatten um urbane Informalität im globalen Süden zu verknüpfen. Dabei werden verschiedene, aufeinander bezogene Regime der Stadtplanung und ihre Raumproduktionen unter der Linse urbaner Informalität genauer betrachtet. Es soll herausgearbeitet werden, wie eine Herstellung und Zementierung städtischer Ungleichheit forciert wird, wie bestimmte soziale Dispositionen und Praktiken im Kontext von Informalität charakterisiert werden und wie urbane Informalität gezielt als Ressource zur Macht- und Wohlstandsaneignung eingesetzt werden kann. ; Urban Development in the Afghan capital after the Western intervention is framed by foreign-led state-building activities and its attendant appropriations of urban space by different actors. Against this background, the article aims to reconstruct spatial developments in Kabul after 2001 and to interpret these in the context of contemporary debates about urban informality in the Global South. In doing so, various interconnected regimes of urban planning that give rise to very specific productions of urban space are analysed using a framework of urban informality. The goal is to assess how urban inequality in Kabul is produced and maintained, how certain social dispositions and spatial practices can be explained in contexts of informality, and how urban informality itself can serve as resource for the accumulation of wealth and power.

Seit Beginn der Neunzigerjahre des vorigen Jahrhunderts kommt es in vielen Staaten der Welt zu kriegerischen Auseinandersetzungen, mit denen massive Menschenrechtsverletzungen einhergehen. Andere Staaten oder Staatenbündnisse versuchen diese Konflikte schlimmstenfalls mit Waffengewalt zu beenden und greifen somit in die Souveränität fremder Staaten militärisch ein. Ein solches Eingreifen trägt den Titel humanitäre Intervention, da es der Beendigung der Menschenrechtsverletzungen dient.In dieser Arbeit wird die Problematik humanitärer Interventionen erörtert. Der biblische Befund zeigt, dass die Anwendung von Gegengewalt durchaus gerechtfertigt sein kann, wenn sie zur Minimierung oder Abwendung von Gewalt notwendig ist.Das kirchliche Lehramt setzt sich auch mit der Problematik des militärischen Eingreifens in die Souveränität fremder Staaten auseinander und kommt zum Schluss, dass nicht nur mehr der Verteidigungskrieg, sondern auch humanitäre Interventionen erlaubt sein können. Innerhalb der katholischen und evangelischen Kirche Deutschlands kommt es zu einem Paradigmenwechsel, wonach nicht mehr der gerechte Krieg, sondern der gerechte Friede im Mittelpunkt der friedensethischen Überlegungen steht.Die traditionellen Kriterien von der Lehre vom gerechten Krieg bilden einen nützlichen Rahmen, um zu beurteilen, inwieweit humanitäre Interventionen gerechtfertigt sein können. Aufmerksamkeit muss bei der Beurteilung solcher militärischer Eingriffe auch der Zeit danach geschenkt werden. ; Since the early ninetieth of the last century in a lot of states of the world armed conflicts have erupted which have entailed massive violations of human rights. Other states or alliances of states have tried to stop these conflicts by the use of armed force and have therefore violently infringed on the sovereignty of foreign states. Such interventions are called humanitarian interventions, because their aim is to end the violation of human rights.In this doctoral thesis the problem of humanitarian interventions is discussed in detail. Biblical exegesis demonstrates that the use of counterforce may be basically justified if it is necessary for minimizing or averting violence.The magisterium of the Catholic Church faces up to the problem of military interventions that infringe on the sovereignty of foreign states. It concludes that both a defensive war and humanitarian interventions may be permitted in certain cases. A paradigm shift has taken place both within the Catholic and the Protestant church of Germany. The ethics of war and peace no longer is focused on a "just war" but on a "just peace" instead.The traditional criteria of the just war-teaching are a helpful framework for assessing the justification of humanitarian interventions. In Humanitarian Intervention, Volker Heins traces the evolution of humanitarian intervention as developed from the portrait of the Good Samaritan, to the establishment of the Red Cross with its focus on neutrality, to the current "humanitarian industrial complex" with its asymmetry between victims & helpers, highlighting the change in meaning from sentimental-religious over the juridical to the political. 22 References. In this article, the author discusses that humanitarian intervention is no new international phenomenon. Hugo Grotius, the father of modern international law, had already realized that a war could be fought in favor of foreigners if it prevents injustice. With the exception of self-defense against armed attacks, the prohibition of violence was existent throughout the years. Until recently, humanitarian interventions did not take place & human rights violations were observed from far away. The Kosovo war was in a way a starting point to a new orientation, since the NATO intervened & sent troops into the region. Wie lassen sich die Entwicklungsländer für eine Norm humanitärer Interventionen gewinnen, die das Souveränitätsprinzip verletzt? Im Rückgriff auf die pragmatistische Sozialtheorie von George H. Mead entwickelt die Studie ein neuartiges Konzept normativen Wandels: Dieser wird nicht als Übernahme westlicher Normen, sondern als sozialer Wandel untersucht, der darauf beruht, dass Staaten Rollen freundschaftlicher Kooperation lernen. Die empirische Basis bilden fünf Interventionsfälle seit 1990, wobei erstmals auch die Entwicklungsländer systematisch berücksichtigt werden (China, Arabische Liga, Organisation der Afrikanischen Einheit/Afrikanische Union). Signifikanter Normfortschritt wurde nur in den Fällen erzielt, in denen der Westen durch Selbstbeschränkung zur Kooperation einlud. Es zeigt sich also, dass eine liberal-demokratischen Weltordnung ihr Fundament weniger in gemeinsamen Werten als in der gelingenden, fallspezifisch herzustellenden internationalen Kooperation hat. On March 17, 2011, the UN Security Council authorized with Resolution 1973 a humanitarian intervention in Libya. It referred to the Responsibility to Protect (R2P) to preserve the civilians from massacres. Germany abstained and thereby not only sent the wrong signal with regard to peace and international order but also broke with its traditional active multilateralism on the side of its Western allies.
