The International Humanitarian Law regime undoubtedly calls for its implementation at a national level in order to have an adequate impact in the regulation of armed conflict. This paper aims to critically explore the application of such regime in Ecuador, not only in terms of the implementation of international treaties in national legislation, but also regarding the role of government and other institutions. For this purpose, Ecuador's accession to international treaties and its connection with national legislation will be analyzed, as well as other actions related to institutions such as the Ministry of Foreign Affairs, the Ministry of Defense, educational institutions, the National Commission of International Human Law and the Ecuadorian Red Cross. ; El régimen de Derecho Internacional Humanitario, sin duda, requiere de su implementación a escala nacional para tener un impacto apropiado en la regulación de los conflictos armados. El presente trabajo busca explorar de manera crítica la aplicación de dicho régimen en Ecuador, no únicamente en términos de implementación de tratados internacionales en la legislación nacional, sino también en el rol del gobierno y otras instituciones. Con este propósito, se analizará la adhesión del Ecuador a tratados internacionales y su vinculación con la legislación nacional, así como otras medidas relativas a instituciones como el Ministerio de Relaciones Exteriores, el Ministerio de Defensa, entidades educativas, la Comisión Nacional de Derecho Internacional Humanitario y la Cruz Roja Ecuatoriana.

He also served as a Secretary of Agriculture and Commerce, was a forefather of Humanitarian Law with his fight against genocide, and fought the negationists. His criticism to totalitarianism is present in his writings from the beginning of the 1940s to his death. In the cartography of the Spanish exile of 1939, and in his models of critical reason, Ruiz-Funes adds to his condition of exile and fighter against barbarity the condition of a witness of his time: to tell what happened. This article reviews the role of International Humanitarian Law (IHL) in demilitarized countries with a case study of Costa Rica and Panama, two small Central American countries that have constitutionally abolished their armies. The paper addresses the question of whether a country that has not a regular army can in fact be respectful and supportive of the international rules governing armed conflicts. Through a detailed review of national bodies and legislation in both countries, the findings allow the author to conclude that the lack of regular armies or military forces is not a convincing argument to disobey and ignore the norms of IHL.

Under the principle of distinction States are obliged to distinguish between civilians and combatants in the context of armed conflict. According to the International Court of Justice, this is one of the cardinal pillars of international humanitarian law. The author reviews the foundations of this general principle of international law from a historical, political and ethical perspective. From a historical perspective, the principle of distinction goes through different stages, until it reaches its positive recognition in international treaties, observing change and continuity in some of its essential notes. From a political perspective, the principle of distinction reflects a delicate balance of state interests, between military necessity and humanity. Finally, the principle of distinction is justified due to ethical considerations that, while generating discussion in the doctrine as to its implications, denote the strong moral component of this international obligation of States. ; El principio de distinción obliga a los Estados a distinguir entre civiles y combatientes en el contexto de los conflictos armados. Según la Corte Internacional de Justicia, se trata de uno de los pilares cardinales del derecho internacional humanitario. Al respecto, se revisan los fundamentos históricos, políticos y éticos de este principio general del derecho internacional. Desde una perspectiva histórica, el principio de distinción pasa por distintas etapas, hasta llegar a su reconocimiento positivo en los tratados internacionales, observando cambio y continuidad en algunas de sus notas esenciales. Desde una mirada política, el principio de distinción refleja un delicado balance de intereses estatales, entre necesidad militar y humanidad. Finalmente, el principio de distinción se justifica en consideraciones éticas que, si bien generan discusión en la doctrina en cuanto sus implicancias, denotan el fuerte componente moral de esta obligación internacional de los Estados.
In the Colombian Constitution of 1991, the political crime receives a differentialand preferential treatment, compared with common crimes, as they can be pardonedor amnestied by the President; in reference of them extradition does notproceed and generate no disabilities for public office. Therefore, in Colombia it iscurrently under discussion in the context of the peace dialogues which crimes canbe related to political crimes. Some actors of Colombian politics have interpretedthat Colombia cannot apply transitional justice measures for punishable offensessuch as homicide against protected persons, and attacks on property protectedby International Humanitarian Law, as it would breach international obligationsarising from the Rome Statute. However, other sections of public opinion havedefended the possibility of an amnesty for crimes committed in the context ofarmed conflict, including attacks on people and property protected by IHL. InColombia there is no legal or constitutional concept of political crime, but thereare rules and court decisions that excludes from this category certain offences. Atthe end of the article, alternatives that contribute to overcoming one of the legalobstacles to the peace process are presented. ; En la Constitución Política colombiana de 1991, el delito político recibe un tratamiento diferencial, preferente, respecto de los delitos comunes, ya que pueden ser indultados o amnistiados por el Presidente; respecto de ellos no procede la extradición y no generan inhabilidades para el ejercicio de cargos públicos. Por ello, en Colombia se debate actualmente, en el contexto de los diálogos de paz, sobre qué delitos pueden considerarse conexos a los delitos políticos. Algunos actores de la política colombiana han interpretado que Colombia no puede aplicar medidas de justicia transicional para conductas punibles como el homicidio contra persona protegida, y atentados a los bienes protegidos por el DIH, pues se estarían incumpliendo obligaciones internacionales derivadas del Estatuto de Roma. Otros sectores de la opinión, por el contrario, han defendido la posibilidad de una amnistía por delitos cometidos en el contexto del conflicto armado, incluidos los atentados a personas y bienes protegidos por el DIH, siempre que no tengan el carácter de sistemáticos, o que no se trate de los máximos responsables. En Colombia no existe un concepto legal o constitucional del delito político pero sí normas y decisionesjudiciales que excluyen de esta categoría ciertas conductas. Al final del artículo, se plantean alternativas que aportan a la superación de uno de los obstáculos jurídicos al proceso de paz.
Operational law, which emerged to regulate the public force's operations, is a recent branch of law on whose definition and delimitation there are insufficient contributions. This article sets out to determine what operational law is in light of its relationship with human rights and international humanitarian law. First, the concept is described from a legal, jurisprudential, and doctrinal perspective to understand its characteristics and various conceptions. Then, the concepts of human rights and international humanitarian law are characterized to underline their nature, content, and application scope. Finally, it analyzes how operational law relates to both concepts while identifying their differences to provide a delineated definition. ; El derecho operacional, surgido para regular las operaciones de la fuerza pública, es una rama reciente del derecho sobre cuya definición y delimitación no hay suficientes aportes. Este artículo se propone determinar qué es el derecho operacional a la luz de su relación con los derechos humanos y el derecho internacional humanitario. Primero, se describe el concepto desde la perspectiva legal, jurisprudencial y doctrinal, con el fin de comprender sus características y diversas concepciones. Luego se caracterizan los conceptos de derechos humanos y derecho internacional humanitario, para resaltar su naturaleza, su contenido y su ámbito de aplicación. Finalmente, se analiza cómo el derecho operacional se relaciona con ambos conceptos, al tiempo que se identifican sus diferencias con ellos, para brindar una definición delimitada.
This text gives a brief account of the norms and perceptions regarding IHL (international humanitarian law) and Human Rights have been applied in Colombia, and on moving the Colombian government and the Revolutionary Armed Forces of Colombia, FARC-EP, ELN National Liberation and the Army, in which requires the exclusion of civilians from direct attacks in the context of the conduct of hostilities by armed forces in war, these settings are accompanied Martells Clause and Article 3 common. ; El presente texto hace un breve recuento de las normas y percepciones respecto al DIH y DDHH que se han aplicado en Colombia, y sobre las que se mueve el Estado Colombiano y las Fuerzas Armadas Revolucionarias de Colombia-FARC-ep, y al que el Ejército de Liberación Nacional-ELN, en donde se exige la exclusión de la poblacion civil de los ataques directos en el marco de la conducción de las hostilidades por parte de las fuerzas armadas en contienda, estas configuraciones están acompañadas de la Cláusula Martells y el artículo 3 común.
Historically Colombian society has always been affected by the armed conflict being experienced in the country. Tere is a considerable need to seek ways for getting answers to what has been called a civil war by some and by others as terrorism, and in other cases an internal armed conflict; in that sense it is easy to observe that at the institutional and social level, the armed conflict is defined without any academic rigor, thus limiting the establishment of valid categories and consequently the absence of an appropriate mechanism or instrument that provides adequate treatment of the problem of the armed conflict in Colombia. Te recourse to international humanitarian law has beneficial effects such as the protection of civilians, holding perpetrators accountable, humanizing hostilities and its point of consciousness to present a common language that accordingly allows a solution without arms to the problem that fuels the armed conflict in Colombia. Added to this, some violentologists have taken part in the analysis conceptualizing the armed conflict facing Colombia as a behavioral issue that is clearly based on defining the Colombian man as violent by nature, a fact which from our observation one should be weary of and to resist, as whenever Colombia has experienced wars, it could be due to various causes differing from that of classifying the nature of man in Colombia, such as that of the decolonization, independence, state-building, the establishing of binding rules, the monopoly of force and the ordering of society of itself. In accordance with the above, an ongoing Doctorate in Sociology of Law and Political Institutions at the External University of Colombia was established in order to solve the question that was posed of how to define the Colombian armed conflict in a meaningful way using a recognized category, to somehow limit the qualifications that were provided by governments and society itself according to their interests in that some cases coincide with those of the State but that in others, subject civilians to extensive damages arising from armed actions, without there being an exit that greatly exceeds the military option. ; La sociedad colombiana ha estado siempre afectada por la confrontación armada que históricamente vive el país, existe una sensible necesidad de tener caminos y de obtener respuestas frente a lo que se ha venido calificando para unos como guerra civil, para otros como "Terrorismo", y en otros casos como un conflicto armado interno; en ese sentido, es fácilmente observable que a nivel institucional, así como a nivel social se califica la confrontación armada sin ningún rigor académico, lo que limita el establecimiento de categorías válidas y consecuentemente la ausencia de un mecanismo o instrumento idóneo que permita un tratamiento adecuado del problema armado en Colombia. La invocación del Derecho Internacional Humanitario contiene efectos benéficos como la protección de civiles, responsabilizar victimarios, humanizar las hostilidades y en su punto de conciencia presentar un lenguaje compartido y acorde que permita una salida no armada al problema que alienta la confrontación armada en Colombia. Sumado a lo anterior, algunos violentólogos han tomado parte en el análisis conceptuando frente al problema armado en Colombia como un asunto claramente conductual que se fundamenta en definir al hombre colombiano como de naturaleza violenta, hecho éste que desde nuestro observador advierte resistencia, toda vez que las guerras que ha vivido Colombia podrían obedecer a causas diversas a la calificación de la naturaleza del hombre colombiano,tales como la descolonización, la independencia, la construcción de Estado, el establecimiento de las normas vinculantes, el monopolio de la fuerza; el orden en sí de la sociedad. De acuerdo a lo anterior, se originó en curso del Doctorado en Sociología Jurídica e Instituciones Políticas en la Universidad Externado de Colombia, resolver el interrogante que se planteaba de cómo definir de manera válida mediante una categoría reconocida el problema armado colombiano, para de alguna manera limitar las calificaciones que se surtían por gobernantes y por la misma sociedad de acuerdo a sus intereses que en algunos casos coinciden con los del Estado, pero en otros, someten a la población civil a innumerables daños frente a las acciones armadas, sin que exista una salida que supere en gran medida la alternativa militar.
This work studies the sources of international humanitarian law that protect the environment during an armed conflict. Likewise, it studies the rules of Chilean military law regarding environmental institutions and the outlawing of detrimental behaviors to the environment. ; En este trabajo se investigan las fuentes de derecho internacional humanitario que contienen normas que protegen al medio ambiente en tiempos de conflicto armado. Asimismo, se estudian las normas de derecho militar chileno referidas a la institucionalidad medioambiental y a la penalización de conductas nocivas para el medio ambiente.

During an armed conflict, a change in the application of the human right regulations and international humanitarian law can be observed in the practice of contemporary international law. It is possible to observe at UN and International Courts' levels an interesting trend in the sense of considering the application of both systems simultaneously in cases of international crisis as well as in internal conflicts. This innovation in contemporary international law can be observed initially in the change experimented by the legislation of the Human Rights' European Court and specially and clearer in the Human Rights' Inter American Court, which in cases against Honduras, Colombia, Paraguay and other countries, states that the State, being warrantor of the efficient protection of civil population, must apply and honor not only the Human Rights' American Convention, but also the articles 13th and 14th of the II protocol of the Geneva Conventions of 1949. The convergence of both branches of the Law, and its application may help to achieve a better defense and efficiency of the fundamental rights of the human being. ; En la práctica del derecho internacional contemporáneo se puede observar un cambio en la aplicación de normas de derechos humanos y de derecho internacional humanitario en casos de coflicto armado. A nivel de Naciones Unidas y de tribunales internacionales es posible apreciar una interesante tendencia en el sentido de considerar la aplicación de ambos sistemas en forma simultánea en casos de crisis internacionales y también en conflictos internos. Among the changes generated by the process of globalization of the 21st century to the military field is the emergence of new actors willing to provide the State with security services as an alternative in asymmetric warfare. These dynamics have prompted violations of human rights and international humanitarian law. This document critically and descriptively addresses the incidence of private military and security companies in these situations. This study reveals that the participation of 21st-century mercenaries in international, non-international and internationalized armed conflicts call into question the actions of the States because of their failure to assume the due international responsibility. A methodology of qualitative analysis with a descriptive approach was used in the research. ; Dentro de los cambios que trajo el proceso de globalización del siglo XXI para el campo militar, está la emergencia de nuevos actores dispuestos a prestar servicios de seguridad para el Estado como alternativa en confrontación de asimétricos. Estas dinámicas han propiciado violaciones a los derechos humanos y al derecho internacional humanitario. El presente documento aborda de manera crítica y descriptiva la incidencia de las empresas militares de seguridad privada en estas situaciones. En el estudio se evidencia que la participación de los mercenarios del siglo XXI en los conflictos armados internacionales, no internacionales e internacionalizados ponen en cuestión el accionar de los Estados, puesto que estos no asumen la debida responsabilidad internacional. En la investigación se empleó una metodología de análisis cualitativo con un enfoque descriptivo.
This article examines the relationship between international humanitarian law and the development of military operations to analyze the current state of that relationship and project future scenarios in which those operations will take place and their new challenges. To this end, the article assumes a qualitative methodology and is developed in three sections: 1) definition of a military operation; 2) international humanitarian law and its role in the framework of military operations is defined; and 3) finally, in prospective, future scenarios of military operations and their relationship with international humanitarian law are considered in four dimensions: land, sea, air, and cyberspace. This prospective study focuses on the Colombian case, emphasizing on the National Army. ; Este artículo investiga la relación del derecho internacional humanitario con el desarrollo de operaciones militares, para analizar cuál es el estado actual de esa relación como también proyectar los escenarios futuros en los que esas operaciones se desarrollarán y sus nuevos retos. Para ello, el artículo asume una metodología cualitativa y se desarrolla en tres secciones: 1) se define qué es una operación militar; 2) se define el derecho internacional humanitario y su función en el marco de las operaciones militares, y 3) finalmente, en prospectiva, se plantean futuros escenarios de las operaciones militares y la relación de estos con el derecho internacional humanitario en cuatro dimensiones: terrestre, marítima, aérea y cibernética. Esta prospectiva se enfoca en el caso colombiano, con énfasis en el estudio del Ejército Nacional.
