Zusammenfassung 969 ; Die Dissertation analysiert den Umgang mit Kriegsflüchtlingen aus dem ehemaligen Jugoslawien in Berlin in den Bereichen Politik, Verwaltung (Innen-, Ausländer- und Sozialbehörde) und Justiz. Es werden sowohl die Wechselwirkungen zwischen den verschiedenen Handlungsfeldern als auch die Eigengesetzlichkeiten und Charakteristika der jeweiligen Akteure und Entscheidungsräume in den einzelnen Kapiteln herausgearbeitet. Zudem werden Rechtsprechungsvorgaben, die für ein Verständnis der Vorgänge unabdingbar sind, in ihrer prozesshaften und interessengeleiteten Entstehungsgeschichte dargestellt. Das Handeln der Berliner Ausländerbehörde steht jedoch im Zentrum der Analyse, denn sie prägt die Praxis maßgeblich. Die Darstellung lebt von dem umfangreichen veranschaulichenden Material und von zahlreichen Einzelfallbeispielen, die die allgemeinen Thesen nachvollziehbar und abstrakt erscheinende Vorgänge in ihrer konkreten Wirkung auf menschliche Schicksale verstehbar machen sollen. Anhand zahlreicher Behördenbescheide, Weisungsvorgaben und Gerichtsurteile usw. werden die Mechanismen der Ausschaffung erläutert der Begriff Ausschaffung (schweizerdeutsch für Abschiebung) soll die Vielzahl der behördlichen Strategien der Außer-Landes- Schaffung von Flüchtlingen, die sich nicht auf das Mittel der Abschiebung beschränken, umschreiben (sozialrechtliche Diskriminierung, aufenthaltsrechtliche Ausgrenzung und Illegalisierung, allgemeine Entrechtung, Einschüchterung, ideologische Diffamierung usw.). Über das konkrete flüchtlingspolitische Thema hinaus handelt es sich um eine Studie der Bürokratie. This lecture for the 100th anniversary of Die Friedens Warte explores the contradictions & complimentarity of the goals of peace & the Geneva Conventions & those of the Red Cross. While the aims of promoting peace & humanization of war appear to conflict, the 20th century has demonstrated that there is a necessary relationship between the two. Both the pacifistic & humanitarian movements were driven by the same events in the same time frame, with the development of a distinct civil consciousness in Europe. A look at the last 100 years shows that the aims of the period have been largely achieved with respect to regulation & institutions. Although neither peace nor humanity has been secured, & conflicts & humanitarian catastrophes have in fact multiplied, one can only imagine the situation without the efforts of those such as contributors to Friedens Warte, which has become an invaluable organ for international questions. Over the last decade, three new regimes were set up in the realm of humanitarian arms control. It is characteristic for these new forms of arms control & disarmament that the treaties were deliberately negotiated outside existing institutions such as the United Nations: this was the case for the anti-personnel mines convention as well as for the recent cluster munitions convention. Moreover, humanitarian arms control, in particular the Programme of Action on the Illicit Trafficking of Small Arms, also aims at reforming the security sector. At the same time, the new regimes are confronted with the challenges of the 21st century: Fragile statehood, the privatization of security, resource wars, organized crime, terrorism as well as poverty & economic underdevelopment all place constraints on their implementation. Referring to the selling of indulgencies to which Martin Luther protested in the 16th century (Wenn die Munze in dem Kasten klingt, die Seele in dem Himmel springt = With the coin hitting the box, the soul jumps out into heaven), the present article discusses Unicef and its grasp far beyond development-political discourse, to reach just about any man to think about the living conditions of children in foreign countries. Being the third largest humanitarian organization in Germany however, doesn't help fighting against decreasing donations, especially when concerning countries with a negative image (North Korea, Iran, Eastern Europe). Furthermore are discussed donators indulgencies, and publicity surrounding donations. A second part of the article concerns an interview with Tarneden, spokesman for Unicef Germany, amongst others on donations regarding countries in chronic crisis, and failures within the own organization. In this article, the author discusses that humanitarian intervention is no new international phenomenon. Hugo Grotius, the father of modern international law, had already realized that a war could be fought in favor of foreigners if it prevents injustice. With the exception of self-defense against armed attacks, the prohibition of violence was existent throughout the years. Until recently, humanitarian interventions did not take place & human rights violations were observed from far away. The Kosovo war was in a way a starting point to a new orientation, since the NATO intervened & sent troops into the region. The author concludes by stating that the development of international law has gone back to where it started with Hugo Grotius. Adapted from the source document.
