The author defines the state of law as a typical product of German political culture which corresponds to, but also differs from, both the experience of the English rule of law and that of the French l'Etat-Nation. The author pays particular attention to the issue of the legitimacy of the state of law. He focuses on two different approaches to this issue in the works of Volker Gerhardt and Ernst Wolfgang Böckenförd. Following a critical analysis of their fundamental assumptions the author goes on to divulge the thesis on the necessity of a balance between rights and power in the functioning of modern political systems. The article is dedicated to Professor Richard Wisser. It is a critical analysis of Husserl's essay "The crisis of European sciences and transcendental phenomenology". The author first outlines Husserl's diagnosis of the crisis of science, philosophy and culture, followed by the elements and the mechanisms of that crisis. The root of the crisis of European science and culture lies in foregoing the genuine productive humanity. The authentic humanity cannot be based nor explained from its objectivizations but solely through the analysis of its productive imagination. The author also deals with the crisis of spiritual sciences, which he claims have brought about the loss of insight into the ultimate purpose of the existence of Europe as a brainchild of the historical humanity. Husserl's concept and definition of the living world represents a sort of the pinnacle of his later philosophical works. In the form of a new universal science - transcedental phenomenology - and by defining the living world as - for us - immediate and contiguous world, the known and acknowledged inter-subjectivity, Husserl provides a critique of the modern age i.e. the domination of the paradigm of the objectivist sciences. Husserl's phenomenology also delves into the equally central political and social problems of the contemporary age; Husserl calls for the establishment of a new rationality in judging social and political issues. Particular attention i given to Husserl's vehement critique of anti-liberalism as well as his novel relation "I - We", i. e. the individual and the community or the state. (SOI : PM: S. 153)
The author continues his research work on Croatian constitutional tradition. This tradition includes the system of national values on which Croatian politicians in the l9th century founded their national programs. Therefore, the author tries to analyze the basic values and structures included in that tradition, to explore its genesis, and to investigate its historical influence on the development of political and social life in Croatia. In his opinion, other authors did not consider this tradition either a "dogma" or an "ideology", as the recent historiography puts it, because here the legal and sociopolitical values, on which the new political, state and social system is founded, are in question. Out of abundant researches on that subject, the author singles out only the analysis of the "Address" which Croatian Parliament, after a long discussion, brought in 1861 as its most important document, i.e. as the national program which was presented to the king in the form of demands. On the occasion of the bicentennial of the publication of Kant's "Treatise on perpetual peace", the author attempts to evoke and actualize that classic of modern philosophy of politics. According to Hajo Schmidt, the strong point of Kant's concept was his realism which prevented him from slipping into intellectual, utopian idealization of human nature and political relations among people. Having in mind not only the rational but also irrational aspects of human nature, i.e. the insuperable chasm between good and evil, Kant in that respect offers edifying peacemaking propositions. This he achieves by advocating the concepts of free individuals, independent national states and the cosmopolitan unity of humankind. These three moments make up the content of Kant's concept of republicanism. Their identity and plurality are the foundations of the world peace. (SOI : PM: S. 18)
There have been a number of philosophical, legal and political concepts dealing with the issue of peace. The most famous discourse on the topic of peace is undoubtedly Kant's writing "Perpetual Peace" not only for the cogency of its ideas but also for the applicability of the majority of them in practice, particularly in terms of collective security. Kant's starting point was that peace is a rational and moral imperative of human nature, realized solely through human efforts. Though written two hundred years ago, his ideas have found acolytes in the post-coldwar period since they are, to a large extent, considered as emancipatory. Kant finds the guarantees for the realization of peace in the moral doctrine and thus rejects the use of force in the creation of peace. The relations among states are based on cooperation, not competition so that some elements of his project are reminiscent of the solutions applied in the system of collective security. The author looks into the viability of Kant's ideas in the post-coldwar period. (SOI : PM: S. 69)
