Owing to certain natural and Political conditions, it is only when these natural conditions are vanishing and these political ones becoming modified that we fund this vast question thrust upon us and a demand is felt for a solution of the problem before it goes beyond the controlling line. In treating this question, I desire to take up first, a fit of history closely connected with the United States, and to consider the political, economical, moral, and social effects, and try if possible to offer a partial solution to this great question. Immigration and emigration are said to be the phenomena of modern life. As early as we have a record, it is an undisputed fact that men will change their location with the attending good or bad results.

The rise of immigration prosecution as the central feature of the federal criminal justice system challenges conventional understandings of the relationship between the criminal and immigration systems. This Article shows that, in the domain of immigration, the immigration state and criminal state operate as an integrated process in which defendants' rights and criminal procedural mechanisms have been redefined. On a doctrinal level, the integration of immigration and criminal enforcement has meant that rights traditionally accorded criminal defendants - such asMirandaand bail pending trial - are unevenly distributed along alienage lines. On an institutional level, immigration prosecution has supported an alternative federal adjudicatory structure, largely outside the confines of Article III criminal courts, that is defined by quick, mass processing of guilty pleas. Drawing on court rulings, government documents, legislative history, statistical data, and interviews, this Article argues that there are two significant consequences of the federal immigration prosecution regime. First, it incentivizes prosecutors to borrow the tools of civil immigration enforcement to support criminal prosecution, thereby distorting the criminal procedural rules that would otherwise apply. Second, it deputizes criminal prosecutors to act as de facto immigration screeners, thereby threatening the substance and process of immigration law. This Article's study of the interdependence between the immigration agency and the criminal prosecutor thus reveals a fundamental disruption in one of the central dichotomies in our legal system - the civil/criminal divide. In practice, the immigration agency interacts with criminal process to erode procedural protections afforded criminal defendants, expand criminal law enforcement power beyond the confines of the criminal state, and reorder the aims of the criminal law.

The Supreme Court's jurisprudence is littered with special immigration doctrines that depart from mainstream constitutional norms. This Article reconciles these doctrines of "immigration exceptionalism" across constitutional dimensions. Historically, courts and commentators have considered whether immigration warrants exceptional treatment as pertains to rights, federalism, or separation of powers—as if developments in each doctrinal setting can be siloed. This Article rejects that approach, beginning with its underlying premise. Using contemporary examples, we demonstrate how the Court's immigration doctrines dynamically interact with each other, and with politics, in ways that affect the whole system. This intervention provides a far more accurate rendering of how immigration exceptionalism translates into practice. By simultaneously accounting for rights, federalism, and separation of powers, our model captures a set of normative tradeoffs that context-specific appraisals have dangerously missed. For better and worse, the doctrines of immigration exceptionalism can operate very differently in combination than they do in isolation. Moreover, our expanded frame offers new insights on controversies arising at the intersection of constitutional dimensions, including the recent landmarks of United States v. Texas, Arizona v. United States, and President Trump's executive orders issued in his first few weeks in office. Indeed, the transition between Presidents with drastically different views on immigration crystallizes the types of tradeoffs the Article highlights.

The article aims to provide an extended reflection on Michael Howard's (former Leader of the British Conservative Party) 2005 pre-election speech on immigra- tion, in order to expose the violence and ethical corruption embedded within the political discourse and policies of immigration in Britain and elsewhere. It does so by referring to the work of Jean-Luc Nancy regarding figures of immanentism which, in the case of immigration control, function through the will to absolute separation, technicism and the notion of mythical collective identity. As a response to this problem of immanentism, the ethico-political thinking of Levinas and Derrida is invoked in an attempt to stress upon the necessity of a politics of generosity founded on ethical hospitality and total exposure to alterity rather than self-enclosure and fear of otherness.

Immigration is highly salient for voters in Europe and the United States and has generated considerable academic debate about the causes of preferences over immigration. This debate centers around the relative influences of sociotropic or personal economic considerations, as well as non-economic threats. We provide a test of the competing egocentric, sociotropic, and non-economic paradigms using a novel constrained preference experiment in which respondents are asked to trade-off preferred reductions in immigration levels with realistic estimates of the personal or societal costs associated with those reductions. This survey experiment, per- formed on a national sample of British YouGov panelists, allows us to measure the price-elasticity of the public's preferences with regard to levels of European and non-European immigration. Respondents were willing to admit more immigrants when restriction carries economic costs, with egocentric considerations as important as sociotropic ones. People who voted for the UK to Leave the European Union in the 2016 referendum are less price-elastic than those voting Remain, indicating that non-economic concerns are also important.

What moral standards ought nation-states abide by when selecting immigration policies? Peter Higgins argues that immigration policies can only be judged by considering the inequalities that are produced by the institutions – such as gender, race and class – that constitute our social world. He challenges conventional positions on immigration justice, including the view that states have a right to choose whatever immigration policies they like, or that all immigration restrictions ought to be eliminated and borders opened. Rather than suggesting one absolute solution, Higgins argues that a unique set of immigration policies will be just for each country. He concludes with concrete recommendations for policymaking.

This book makes an essential contribution to understanding the dynamics of contemporary immigrant inflows and integration in Europe. Though embracing a Continent-wide outlook on migration processes, it accounts, in particular, for Southern and Eastern European perspectives. This is accomplished by analysing the long-term transition countries undergo from net emigration to net immigration, as well as developments in their migrant inflows, integration and policy. Balance is achieved between describing the common European experience and the intra- and inter-regional differences characterising migration's underlying factors and trends. This volume is one of few attempts to conceive of the 'Old Continent' as a common economic and cultural space that fully incorporates its eastern part, while still viewing post-enlargement Europe as an area that – despite nation-specific histories – maintains a high degree of social and political coherence. The book is very comprehensive, with deep insights into aspects of immigration throughout different periods and changing socio-economic environments. Contents come from new empirical evidence, specially designed and collected. A great asset is the mix of authors, representing several academic centres across Europe yet pursuing a common vision of European migration, past, present and future.

How vital is the issue can be seen by the briefest glance at the civilization and swiftly changing political issues of the Occident as compared with the Orient of the present age. Moreover our very independence and existence as an Nation is hanging in the balance, and the destiny of the future lies more largely in the hands of present-day statemen than it did with the "Fathers of Federation". Especially is this so because of the increasing tide of immigraiton to our shores.
