There are now more than 5,000 ethnic and 2,500 language groups in the world, while there are virtually no monoethnic states left. Almost all states have interethnic problems, which determines the severity of the problem and its relevance. The relevance of the topic is: 1) to gain experience of Brazil, Canada, India in solving the problem of the constitutional status of indigenous peoples; 2) in emphasizing the need to provide them not only with language rights, but also with an appropriate level of well-being; 3) in the ability to help stabilize the domestic political situation in Ukraine and strengthen relations with neighboring countries and the European Union. The purpose of the article – an attempt to conduct a comparative analysis of the constitutional status of the indigenous peoples of Brazil, Canada and India on the basis of studying the relevant provisions of the Constitutions, special international documents, scientific papers. The Conventions of the United Nations and the International Labor Organization of 1957, 1982, 1989 «On protection and integration of indigenous and other peoples leading tribal and semi-tribal lifestyles in independent countries», «On indigenous peoples and peoples leading tribal way of life in independent countries» were considered and analyzed. An analysis of the Constitutions and Constitutional Acts of Brazil, Canada and India, which reflect the reaction of these states to these Conventions, was also conducted. There are similar and distinctive features in the formation of the constitutional status of the studied ethnic groups. Similar features: centuries-old cruel treatment of the colonizers, the corresponding influence of international documents on the design of the constitutional status, the introduction of their requirements into the constitutions. As the leading country among the developing coun-tries, India still uses its own vision for the resolution of the problem of attribution of profits to permanent estab-lishment. At first, India does not recognize the authorized OECD approach (AOA) and does not use Art. 7 of the OECD Model Tax Convention as revised in 2010 in its own treaty relations with other countries. The key reason of such position is that the application of the AOA might have contradictory results in the context of asymmetrical investment relations between the state of residency and the state of the source of income. In other words, the ap-plication of the AOA based on the analysis of functions, assets and risks determines the ignorance of the condi-tions that have an impact on the profit of non-resident but are not connected with the factors of supply side because belongs to the factors of demand side. At the same time, the domestic legislation of India allows to apply a wide range of different mechanisms of attribution of profits to permanent establishment including the formulary appor-tionment and the method based on the functions, assets and risks analysis (FAR analysis). All these approaches have determined the situation in which their applica-tion is unpredictable. In addition, it might have negative impact on the investment climate of India. Based on the above-mentioned facts, India proposed the new approach to attribution of profits to permanent establishment in April 2019. It is unique because of the proposal to apply the formulary approach as an alternative to the method based on the FAR analysis that is highly recommended by the OECD as the leading center of standard setting in the area of international taxation. The proposal for fractional apportionment is formulated for application in case of the necessity to define the profits of non-resident generated on the territory of India. It is based on three key factors that are sales, employees (manpower & wages) and assets. Additionally, it should be mentioned that there is also the possibility to modify the proposed approach for the in-clusion of additional factor that is user participation in India. This modification is needed in case of the modern business models that do not need the significant presence of non-residents in the country of source but generate in-come because of the user participation in India. ; Індія як провідна держава, що розвивається, уже тривалий час дотримується власного підходу до вирі-шення проблеми віднесення прибутків до постійно-го представництва нерезидента. По-перше, Індія не визнає авторизованого підходу Організації еконо-мічного співробітництва та розвитку і не використо-вує у своїй договірній практиці сучасної редакції статті 7 Модельної податкової конвенції Організації економічного співробітництва та розвитку. Основною причиною цього є те, що використання авторизовано-го підходу Організації економічного співробітництва та розвитку має неоднозначні наслідки в контексті асиметричних відносин між державою резидентства і державою джерела доходу з погляду інвестиційних потоків. Інакше кажучи, використання авторизовано-го підходу Організації економічного співробітництва та розвитку, заснованого на аналізі функцій, активів і ризиків, зумовлює ігнорування умов, які визначають рівень прибутку, але пов'язані не з чинниками поста-чання, а із чинниками ринку збуту. Незважаючи на це, авторизований підхід Організації економічного спів-робітництва та розвитку рекомендований у безальтер-нативній формі як основний у Модельній податковій конвенції Організації економічного співробітництва та розвитку. По-друге, внутрішнє законодавство Індії дозволяло використовувати досить широкий обсяг ме-ханізмів віднесення прибутків до постійного представ-ництва – від методів формульного розподілу і до мето-ду, заснованого на аналізі функцій, активів і ризиків. Таке широке розмаїття можливих методів зумовило виникнення неоднозначної практики їх застосування та негативно відображається на інвестиційному клі-маті. З огяду на зазначене, у квітні 2019 року Індія винесла на публічне обговорення пропозиції щодо змі-ни правил віднесення прибутку до постійного представ-ництва, унікальність яких полягає в тому, що ними вперше пропонується використання формульного під-ходу, який є альтернативою авторизованому підходу Організації економічного співробітництва та розвитку. Пропозиція щодо фракційного розподілу заснована на визначенні прибутків нерезидента, отриманих із тери-торії Індії, на основі трьох чинників, як-от об'єм прода-жів, наймана робоча сила (кількість у поєднанні з опла-тою праці) та розмір активів. Окремо варто зазначити, що передбачено також можливість модифікації такої формули для введення додаткового показника рівня залученості користувачів з Індії в разі використання сучасних бізнес-моделей, які можуть не передбачати істотної присутності нерезидента в Індії, однак водно-час прибуток такого нерезидента генерується через іс-нування значної кількості користувачів в Індії та їх-ньої активної залученості.

The article is devoted to the analysis of British impact upon the system of professional training of border guards in the Republic of India. The aim of the article is to investigate the British role in the system of training of border guards in the Republic of India and to point out the efficiency of some methods and forms for modern system of training. The article proves that there are a wide range of similar threats for border security systems in the Republic of India and Ukraine and therefore the author persuades that it is necessary to compare the systems of training of servicemen of border agencies of the Republic of India and the State Border Guard Service of Ukraine and to outline recommendations for creative implementations of some principles and approaches.On the basis of analysis of literature the author admits that the necessity to select the training of border guards within the system of military training due to specific functions of border guards was done in the British Indian Army and special forces were established. Also the article proves that the training was divided into three phases: basic individual training, progressive or group training and integrated training. The border guards were supposed to obtain the following skills: marksmanship, vigilance, mountain warfare, hill warfare, piqueting, map reading, intelligence, scouting, technical competence, physical endurance, etc. To train border guards there were established permanent training camps along the North-West frontier, some mountain warfare schools, and later higher educational establishments where special disciplines on border warfare were taught. The article describes the methods and forms of training of border guards. They are the following: training in real conditions, war games, project method, practical exercises, combined lectures, conferences, "sandbox" exercise, and illustrative methods. The author emphasizes that a range of official documents concerning training of border guards were issued: Operation Memorandums, Field Manual for border guards, Guidelines for border warfare, etc. ; У статті детально проаналізовано британський вплив на становлення професійної підготовки прикордонників в Республіці Індія. The article concerns the definition of notion professional military competence of border guards in the Republic of India. We have defined professional competence of experts in border agencies in the Republic of India as a combination of professional knowledge, abilities, skills and attitudes which ensure efficient execution of professional activities at the particular state border sector designated to the certain border agency regarding the specific character of state border protection. On the basis of analysis of scientific and pedagogical literature, considering the peculiarities of state border protection in the Republic of India, we have outlined structural components of professional competence of border guards in the Republic of India. They are the following: coordinating and purpose-oriented, organization and pedagogical, resultative, conceptual, motivation and orientational, operation and activity, appraisal and reflexive. Taking into consideration that professional competence of border guards is a phenomenon that can be measured, the author has distinguished two groups of criteria of professional competence of border guards in the Republic of India. Objective criteria are indirectly connected with border guards' training but have some influence on final result. They are as follows: coordinating and target, organization and pedagogical, appraisal and resultative. Subjective criteria are directly concern activity of students; and they include cognitive, axiological, educational and professional, agency-specific and behavioral, appraisal-reflexive ones. Moreover, in the article there have been recognized four levels (high, sufficient, average, and low) of formation of professional competence of border guards in the Republic of India and indices determining each level. ; У статті розглядається поняття професійної компетентності прикордонників у Республіці Індія. На основі аналізу науково-педагогічної літератури, зважаючи на специфіку охорони державних кордонів Республіки Індія, визначено структурні компоненти професійної компетентності прикордонників у Республіці Індія. The given paper features the second part of the extended research focused on the investigation of the linguistic situation as a development factor of the English language lexicography in India. Thus, in this article the main parameters of the linguistic situation during the British Raj period, with English being the case study, are scanned. The diachronic approach used towards the analysis of the linguistic situation constituencies elicits certain stability of quantitative, qualitative and evaluative parameters as regards local languages in India and the pivotal changes as regards English. The English language quantitative parameter mirrors the fluctuation in demographic rate, national identity and professional occupancy of English speaking population in India during the Raj period. The qualitative parameter of linguistic situation being enriched by another Indo-European language, maintains its multilingual, heterogeneous and unbalanced features. The English language evaluative parameter reveals the main stages of the colonial language incorporation into the linguistic situation in the country. English in India goes through the perception as the language of traders and missionaries into its adoption as а means of education obtainment, social stability access and interaction mechanisms both with foreigners and citizenry of other multilingual country regions. Such position of English in colonial India prompts the alteration of its functional characteristics with political, pedagogical and lingua franca functions being the most essential. Their actualization is only feasible due to the flourish of lexicographic practice in colonial India. Thus, the English language serves the base for a number of glossaries, bilingual and explanatory dictionaries describing various lexical layers of English in India. ; Ця публікація продовжує цикл статей, присвячених вивченню мовної ситуації як фактору розвитку англомовної лексикографії Індії. В роботі розглядаються основні параметри мовної ситуації Індії в колоніальний період, який є визначальним для подальшого положення й розвитку англійської мови в країні. Застосування діахронного підходу при описі та аналізі складових мовної ситуації в Індії дозволяє виявити певну стабільність кількісних, якісних і оцінних параметрів щодо корінних мов країни й кардинальні зміни щодо до положення англійської мови. Так, кількісний параметр англійської мови в Індії відображає зміни демографічного показника, національної приналежності й професійної зайнятості людей, які володіють англійською мовою. На якісному рівні мовна ситуація в Індії залишається багатомовною, гетерогенною і нерівноважною та поповнюється ще однією мовою індо- європейської сім'ї – англійською. Протягом періоду колонізації англійська проходить на оцінному рівні стадії від сприйняття її як мови торговців і місіонерів до прийняття корінним населенням країни як засобу отримання знань, можливості соціального зростання в суспільстві, інструменту спілкування не тільки з британцями та іншими іноземними громадянами, а й, враховуючи багатополюсну мовну ситуацію в регіоні, з мешканцями інших регіонів країни. Таке положення англійської мови в країні веде до зміни її функціональних характеристик. Найбільш значущими виявляються політична, педагогічна функції і функція мови посередника. Їх реалізація вимагає активного розвитку лексикографічної практики, яка проявляється у створенні на матеріалі англійської мови глосаріїв, словників, як двомовних, так і тлумачних, що описують у залежності від мети упорядника, особливості лексичного складу мови в Індії.

English in India goes through the perception as the language of traders and missionaries into its adoption as а means of education obtainment, social stability access and interaction mechanisms both with foreigners and citizenry of other multilingual country regions. Such position of English in colonial India prompts the alteration of its functional characteristics with political, pedagogical and lingua franca functions being the most essential. Their actualization is only feasible due to the flourish of lexicographic practice in colonial India. Thus, the English language serves the base for a number of glossaries, bilingual and explanatory dictionaries describing various lexical layers of English in India. ; Ця публікація продовжує цикл статей, присвячених вивченню мовної ситуації як фактору розвитку англомовної лексикографії Індії. В роботі розглядаються основні параметри мовної ситуації Індії в колоніальний період, який є визначальним для подальшого положення й розвитку англійської мови в країні. Застосування діахронного підходу при описі та аналізі складових мовної ситуації в Індії дозволяє виявити певну стабільність кількісних, якісних і оцінних параметрів щодо корінних мов країни й кардинальні зміни щодо до положення англійської мови. Так, кількісний параметр англійської мови в Індії відображає зміни демографічного показника, національної приналежності й професійної зайнятості людей, які володіють англійською мовою. На якісному рівні мовна ситуація в Індії залишається багатомовною, гетерогенною і нерівноважною та поповнюється ще однією мовою індо- європейської сім'ї – англійською. Протягом періоду колонізації англійська проходить на оцінному рівні стадії від сприйняття її як мови торговців і місіонерів до прийняття корінним населенням країни як засобу отримання знань, можливості соціального зростання в суспільстві, інструменту спілкування не тільки з британцями та іншими іноземними громадянами, а й, враховуючи багатополюсну мовну ситуацію в регіоні, з мешканцями інших регіонів країни. Таке положення англійської мови в країні веде до зміни її функціональних характеристик. Найбільш значущими виявляються політична, педагогічна функції і функція мови посередника. Їх реалізація вимагає активного розвитку лексикографічної практики, яка проявляється у створенні на матеріалі англійської мови глосаріїв, словників, як двомовних, так і тлумачних, що описують у залежності від мети упорядника, особливості лексичного складу мови в Індії.

The topicality of our research is stipulated by the similarity of threats at the Ukrainian and Indian borders, status of developing countries and non-member states of military alliance, existence of border disputes. It allows us to come to the conclusion that there is a need to study professional training of border guards in theRepublic ofIndia to implement creatively some of its elements.The research aims to analyze methodological fundamentals of professional training of border guards in theRepublicofIndia, to outline methodological approaches and to describe the peculiarities of their implementation within the process of training of specialists of border guard agencies.Thus, the author explains the notions of «methodology», «approach», and «methodological approach». On the basis of scientific sources there have been selected five methodological approaches to investigation of professional training of border guards in theRepublicofIndia: competence-based, systems, person- and activity-oriented, andragogical and ethnoaxiological.Competence-based approach means the orientation of professional training towards formation and development of professional competences (knowledge, capabilities, skills, attitudes, etc.) which are necessary for professional activity. Systems approach concerns the analysis of professional training as integral generalized holistic system from the point of view of interaction of all its subsystems. Person and activity oriented approach is the approach to training including application of various types of learning activity which are suitable for specific subjects and taking into consideration the students' needs and preliminary experience. Andragogical approach means training and retraining of adults. Ethnoaxiological approach concerns the fact that in the process of professional training it is necessary to consider philosophical concepts, national traditions and customs as well as inculcated in cadets universal values common to all mankind.It is necessary to admit that these approaches are not universal and in order to achieve the goal they should be used in combination. In the article on the example of two states, the Republic of Turkey and the Republic of India, the forms and methods of implementing the changes in the policy of memory in recent decades have beenexamined, their directions have been revealed, their positive and negative impact on society has been analyzed. It is shown that the policy of historical memory strongly correlates with the politicaldiscourse of the country, but increasingly responds to external challenges. Changes in the policy of memory mean changes in the semantic organization of the country's space. At the same time, broadpolitical, cultural and, accordingly, memorial pluralism is not a guarantee of social harmony. Important components of the experience of implementing the policy of memory in these countries have been established, they can be taken into account in the development of the corresponding direction of the state policy of Ukraine. ; У статті на прикладі двох держав – Республіки Туреччина та Республіки Індія – розглянуто форми і способи здійснення перетворень у політиці пам'яті в останні десятиліття, виявлено їх напрями, проаналізовано позитивний і негативний вплив на соціум. Показано, що політика історичної пам'яті жорстко корелює з політичним дискурсом країни, однак дедалі більше реагує на зовнішні виклики. Зміни в політиці пам'яті означають і зміни в семантичній організації простору країни. Водночас широкий політико-культурний і, відповідно, меморіальний плюралізм не є гарантією соціальної злагоди. Встановлено важливі складники досвіду здійснення політики пам'яті в зазначених країнах, які можуть бути враховані в розбудові відповідного напряму державної політики України.
