Celem artykułu jest przedstawienie procesu legitymizowania systemu demokratycznego na poziomie obywateli - ich postaw i zachowań, w kontekście przemian, jakie zachodzą w bardziej zaawansowanych w procesie demokratyzacji niż Polska, krajów. Punktem wyjścia jest teoria J. J. Linza, wskazująca na zależności pomiędzy stabilnością systemu a legitymizacją. Dalej omawiane są liczne badania dotyczące przejawów legitymizacji systemu na poziomie indywidualnym w Polsce oraz krajach Zachodniej Europy oraz sprawdzana jest hipoteza dotycząca zależności pomiędzy przemianami aktywności politycznej (w tym wzrostem aktywności typu niekonwencjonalnego) a stopniem legitymizacji systemu. ; The purpose of the paper is to present the legitimization process of the democratic system at the level of individual citizens - their attitudes and behavior - in the context of the transformations that are occurring in more advanced democracies than Poland. The starting point is provided by the theory of J. J. Linz, who points to the dependence between the stability of the system and legitimization. Next, numerous studies are discussed concerning the symptoms of system legitimization on the individual level in Poland and Western European countries. A hypothesis of the dependence between the transformation of political activities (including increasing unconventional activities) and the degree of legitimization of the system is also tested.

Celem artykułu jest przedstawienie procesu legitymizowania systemu demokratycznego na poziomie obywateli – ich postaw i zachowań, w kontekście przemian, jakie zachodzą w bardziej zaawansowanych w procesie demokratyzacji niż Polska, krajów. Globally, it is worth stressing that international law, European law and national laws must fulfill the same standards, considering the human rights laws. Since the end of the Second World War, the sphere of international human rights law, including the set of rights of human beings, increased tremendously. In the sphere of human rights, the set of refugees' rights is one of the most important. On the other hand, the sphere of human rights since September 11 had to face the problems of security on a global scale. Today, security impacts the governments, international organizations, NGOs as well as human beings. Let us say that security influences both local and global policy. From this point of view, the article analyzes an important question: Is the human rights system able to function properly with the growing lack of security both in international and regional relations? Can the European Union and its Member States afford total acceptance of international refugee rights regulations referring to African natives? The article refers to the facts from the last few years which totally changed the attitude to human rights laws. It seems that today international organizations such as the United Nations and its specialized agencies should again work on the system of human rights referring to refugees, including legal aspects of counterterrorism. The author also takes into account the necessity of cooperation between the governments in a wider scale, including mutual cooperation and legal activity. ; W opracowaniu analizie został poddany status obywatela Unii Europejskiej z punktu widzenia jego praw podmiotowych w kontekście praw uchodźców wynikających z regulacji międzynarodowych. Zasadniczym celem było określenie granicy pomiędzy prawami obywatela UE a prawami uchodźców. Opisano także wpływ Arabskiej Wiosny Ludów na problem migracji oraz związane z tym zagrożenia bezpieczeństwa wewnętrznego państw członkowskich UE. Zasygnalizowano problemy, które pojawiają się w związku z destabilizacją sytuacji na arenie międzynarodowej w rejonie Afryki Północnej i Środkowego Wschodu, rozwojem skrajnych ruchów islamistycznych oraz efektywnym zetknięciem się warstwy jurydycznej norm ochrony praw człowieka i bezpieczeństwa międzynarodowego.

W artykule zostało przedstawione pojęcie dyskrecjonalności w polskim prawie administracyjnym oraz w prawie unijnym. Nierównorzędność stron stosunku administracyjnoprawnego jest potęgowana przez działanie organów administracji publicznej w ramach władzy dyskrecjonalnej. Sytuacja prawna jednostki wobec organu ulega tym większej dysproporcji, im więcej luzu decyzyjnego przyznanego przez prawodawcę posiada organ. Problem ten zauważa także prawodawca unijny. Z tego względu istniejące standardy oraz planowane regulacje w zakresie prawa administracyjnego (Europejski kodeks postępowania administracyjnego) mają na celu przede wszystkim ochronę jednostki. Wskazuje się na konieczność zachowania równowagi między interesem publicznym a słusznym interesem strony. Trybunał Sprawiedliwości Unii Europejskiej zauważył, że w porządku międzynarodowym podmiotami są nie tylko państwa członkowskie, ale także same jednostki i to one zostały objęte szczególną ochroną prawną. ; This article presents the concept of discretion in Polish administrative law and EU law. The inequality of parties in an administrative law relationship is increased by existence of administrative discretion. The legal situation of an individual is weaker when the administrative body has clearance decision-making. This problem has also been reflected in the planned regulation and standards of the EU legislation in the field of administrative law (Law of Administrative Procedure of the European Union) designed to protect individuals. It is recommended that a balance between the public interest and the legitimate interests of the party be maintained. The Court of Justice of the European Union pointed out that in the international order it is not only Member States, but also individuals who are subject to protection.

The aim of the study is a comparison of re-privatization policy pursued in Poland and other countries of Central and Eastern Europe, with particular emphasis on the former GDR. Poland has chosen a completely different approach to this issue from that of the Germans. Despite the claims of former owners concerned, in almost 2/3 of the former GDR territory, the German legislature quickly and decisively resolved these issues, so that they do not impinge on the current social and economic life of Germany. Poland however, after two decades of transformation, has still not developed a clear position on this issue, while successive legislation projects end in failure or are postponed indefinitely. This practice leads to doubt as to whether our country can be regarded as fully integrated with the West in terms of compliance with standards of the modern state, which resolves sensitive issues and seeks to eliminate hot spots in contacts with foreign countries (e.g. the return of former Jewish property). Reprivatization is important for several reasons, of both legal and economic nature. Lack of a solution raises a sense of injustice among former owners, generates numerous conflicts on the citizen-state line, and calls into question the constitutionally guaranteed protection of property rights in Poland. On the other hand, a thankless objective of an economist is to assess the economic aspects of a possible compensation program – could Poland afford it? What would be the costs of abandonment of any action? In the first part of the study the regulations on property restitution in the former Eastern bloc countries are shortly discussed. Then attention is paid to the legal and economic conditions of the property restitution process in Poland. The article ends with conclusions. ; Cel opracowania stanowi porównanie polityki reprywatyzacyjnej prowadzonej w Polsce i w innych krajach Europy Środkowo-Wschodniej, ze szczególnym uwzględnieniem byłej NRD. W Polsce zaobserwować można zupełnie odmienne podejście do tej problematyki niż u naszych zachodnich sąsiadów. Pomimo, że roszczenia dawnych właścicieli dotyczyły niemal 2/3 terytorium byłej NRD, niemiecki ustawodawca szybko i zdecydowanie rozwiązał te kwestie, dzięki czemu nie rzutują one na obecne życie społeczne i gospodarcze RFN. Polska natomiast po dwóch dekadach transformacji wciąż nie wypracowała jasnego stanowiska w tej sprawie, zaś kolejne rządy podejmują bezskuteczne próby regulacji lub odsuwają problem w bliżej nieokreśloną przyszłość. Taka praktyka każe wątpić, czy można uznać nasz kraj za w pełni zintegrowany z Zachodem, w sensie spełniania standardów nowoczesnego państwa, które rozwiązuje drażliwe sprawy i stara się likwidować punkty zapalne w kontaktach z zagranicą (np. zwrot mienia pożydowskiego). Reprywatyzacja jest istotna z kilku przynajmniej powodów o naturze zarówno prawnej, jak i ekonomicznej. Brak rozwiązania dawnych krzywd rodzi poczucie niesprawiedliwości, generuje liczne konflikty na linii obywatel-państwo i rodzi wątpliwości w gwarantowaną konstytucyjnie ochronę praw własności w naszym kraju. Z drugiej strony należy pytać o aspekty ekonomiczne ewentualnego programu odszkodowawczego – czy Polskę po prostu na to stać? Jakie są koszty zaniechania jakichkolwiek działań? W pierwszej części opracowania omówione zostaną uwarunkowania prawne i ekonomiczne procesu reprywatyzacji w Polsce. Następnie przybliżone zostaną regulacje dotyczące zwrotu majątku w wybranych krajach byłego bloku wschodniego. Artykuł kończą wnioski.

Artykuł został zamieszczony w numerze specjalnym czasopisma pt. "Rola prawa w życiu jednostki w ujęciu nauk społecznych". ; Celem niniejszego opracowania jest systemowa i oryginalistyczna (tj. historyczno-językowa) analiza II Poprawki do Konstytucji Stanów Zjednoczonych, stanowiącej następująco: "dobrze zorganizowana milicja jest niezbędna dla bezpieczeństwa wolnego państwa; prawo ludzi do posiadania i noszenia broni nie może być naruszone". Zadanie to wymaga przedstawienia analogicznych do II Poprawki regulacji występujących w konstytucjach poszczególnych stanów, charakterystyki umiejscowienia przepisu w indywidualistycznie zorientowanej Karcie Praw (Bill of Rights) oraz zwięzłego opisania ewolucji pojmowania prawa do posiadania broni przez amerykańskie sądy federalne, w tym zwłaszcza wiążących interpretacji poczynionych w wyrokach Sądu Najwyższego USA, który ostatecznie w sprawie District of Columbia v. Heller z 2008 roku uznał prymat indywidualistycznego modelu prawa do posiadania i noszenia broni jako naturalnego i niezbywalnego prawa każdego człowieka. Niniejsze opracowanie, choć opierające się na doświadczeniach prawnych Stanów Zjednoczonych, stanowić może również istotny głos w dyskusji nad prawem do posiadania broni w Polsce. ; The purpose of this paper is a systemic and originalist (i.e. historical and linguistic) interpretation of Amendment II to the U.S. Constitution which states: "a well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed". This task requires providing an account of regulations found in constitutions of particular American states which are analogous to that of Amendment II, characterization of the placement of law in an individualistically-oriented Bill of Rights, as well as a concise overview of an evolution of interpretative conclusions regarding the right to own arms reached by federal courts, especially the rulings of the Supreme Court of the United States which in the case Heller v. District of Columbia of 2008 finally recognized the right to keep and bear arms as a natural and inalienable right of every individual. This paper, although based on the American legal experiences, could also be a stimulus for discussion about gun possession in Poland.

Standardem we współczesnych państwach demokratycznych stało się jednoczesne funkcjonowanie wielu organów mających na celu zapewnienie przestrzegania prawa. Jednym z nich pozostaje instytucja Ombudsmana, która zyskała na znaczeniu w wielu krajach świata zarówno o ustabilizowanej, jak i odradzającej się demokracji. Za główne cechy tej instytucji uznaje się niezależność Ombudsmana od innych organów, łatwość dostępu do niego, a także wiarygodność i elastyczność działania. Dzisiaj funkcjonuje ona w ponad 100 krajach i wciąż widać tendencję wzrostową. Nawet w ramach Unii Europejskiej od 1995 r. działa Ombudsman Europejski, a Rada Europy od 1999 r. powołuje Komisarza do spraw Praw Człowieka. W państwach Europy Zachodniej proces tworzenia urzędów ombudsmańskich szczególnie intensywnie przebiegał po II wojnie światowej, co spowodowane było m.in. wzrostem zainteresowania ówczesnych społeczeństw ochroną praw człowieka w związku z przebytymi doświadczeniami "brunatnego" i "czerwonego" totalitaryzmu. Natomiast w ramach transformacji ustrojowych zapoczątkowanych w latach dziewięćdziesiątych, proces ten zaczął dotyczyć również bloku państw Europy Środkowo-Wschodniej i Południowej. W przypadku bloku tych państw wprowadzanie instytucji ombudsmańskich do porządku konstytucyjnego poczytuje się jako część procesu transformacji ustrojowej i ich demokratyzacji. Warto przy tym podkreślić, że wśród tych krajów Polska należała do prekursorów w tym względzie. ; The functioning of many organs which aim to ensure the rule of law is standard in democratic countries. One of them is the institution of the ombudsman, which has become significant in both those countries with strong democratic systems and emerging democracies. The most important features of this institution are independence, easy access, reliability and flexibility. Nowadays, it functions in approximately 100 countries and it is estimated that this number will increase in the near future. There has been a European ombudsman in the European Union since 1995, and the Council of Europe appointed a Human Rights Commissioner in 1999. In West European countries, the process of creating the office of the ombudsman was particularly intensive after the Second World War, as a result of their experience of totalitarianism. This process could also be observed in Central-Eastern and Southern Europe during the political transformations of the 1990s. It was a symbol of the transformation and democratization of those countries. Poland can be safely assumed to have been a forerunner in the process in this region.

The work of the administration should serve the interests of the parties involved and of the public. That very need for proportionate and reasonable actions of the administration has led to establishing one of the basic principles in the process of issuing administrative acts, the participation of the interested parties in the procedure before the administrative authority. This is achieved by the requirement that, before issuing the act, the authority is to gather the opinions and statements of the members of the public who will be affected by it and to reflect them in the final act. The guarantee that members of the public will be allowed to participate in the procedure and influence the final content of the act is the judicial review of the administrative act.
