De afgelopen jaren zijn de regels rond arbeidsongeschiktheid ingrijpend gewijzigd. Verzekeringsartsen dienen vast te stellen welk werk iemand nog zou kunnen doen na twee jaar ziekte. Die beoordeling heeft een statisch karakter en richt zich niet op de vraag of de patiënt ook daadwerkelijk aan het werk komt. In de toekomst zou de nadruk in de beoordeling meer moeten liggen op participatie en minder op compensatie, waarbij de beoordeling niet per definitie na twee jaar hoeft plaats te vinden. Als terugkeer naar de eigen werkgever niet meer mogelijk is, moet de verzekeringsarts ingeschakeld worde

Consumenten die rechtstreeks met een verzekeraar een verzekering willen sluiten, kunnen meer informatie via e-mail en internet ontvangen dan consumenten die de hulp van een assurantietussenpersoon inroepen. In januari 2011 is professor Marc A. Huybrechts 70 jaar geworden. De editors van dit boek vonden het dan ook passend om hem ter gelegenheid van deze verjaardag een huldeboek aan te bieden. Dit huldeboek is méér dan een Liber amicorum. Dit boek wil tegelijk een blijk van vriendschap aan de gevierde en een hulde aan deze schitterende jurist zijn. De gevierde heeft zich op verschillende gebieden ingezet, altijd met de bedoeling dat iedereen er baat bij zou hebben. Allereerst in het onderwijs: op onvermoeibare wijze heeft hij meerdere generaties van juristen laten kennismaken met de wondere wereld van het recht. Hij wees er steeds op dat een jurist verder moet kijken dan zijn eigen rechtstelsel, wat tegelijkertijd een verrijkend en relativerend inzicht in het recht geeft

After the sharp conflicts between the government & the medical unions in 1964, concerning health insurance reform involving an `agreement system' for medical fees & repayments by the health insurance funds--a form of bargaining economy has developed in Belgian health care, with sick funds & medical unions as the major parties. This 'Pax Medica' appears to be threatened by a series of financially motivated government measures aimed at reducing the medical associations' professional autonomy & dominance. The historical context, the parties involved, & the development of this conflict are discussed. A striking analogy with the 1964 conflict is pointed out, particularly regarding union strategy. The present state of affairs does not suggest a threat to the 'Pax Medica,' but rather a stabilization of the established power relationship between government, sick funds, & medical unions, which will respect the rules of democratic compromise. Such a conflictual situation helps in making various aspects of the overall situation more perceptible. The scene is dominated by two groups of organizations: medical unions & the sick funds. They function on the background of _a market economy that is accepted by both. Hence, fundamental social changes in the area of medicine are unlikely. Modified HA.

Supporting people with disabilities is a cornerstone of the Dutch welfare state. It has become part of our cultural ideal that government people who can not (more) provide (WRR, 2006, p. 115). Care for themselves Especially after World War II, the government has expanded its involvement with the landmark introduction of the Exceptional Medical Expenses Act (EMEA) in 1968. The EMEA is a national insurance scheme, every resident of the Netherlands secures long-term care and assistance at home or in an institution. Were increasingly welfare-related forms of support in the care of the government in the sixties of the twentieth century, moreover, brought and created a versatile professional sector, with specializations as neighborhood and community work, and social work with elderly people (Duyvendak, 2002). Third-country nationals can use regulation 1231/10 to invoke regulation 883/04, However, the territorial limitation imposed by regulation 1231/10 still limits third-country nationals. The main issue is that regulation 1231/10 is restricted to EU territory. Outside of the EU, any requirement regarding equal treatment in accordance with regulation 1231/10 is not applicable. Decision 3/80, the European Convention on Social Security, the Dutch-Turkish social security treaty and ILO Treaty 118 also consider facts outside of the EU, as demonstrated by figures of the Employee Insurance Agency and Social Insurance Bank. Relevant facts outside of the EU include for example the periods of time third-country nationals lived and worked in third countries and the export of benefits to these countries. My proposal to conclude new treaties with third countries on the EU level was discussed in the context of the four analysed coordination schemes. In the discussion, I have researched what possibilities exist to include the techniques of the involved schemes in treaties with third countries, to address those exact issues faced by third country nationals as a result of the limited territorial scope of regulation 1231/10. In addition to facing possible issues because the territorial scope is limited to the EU, third-country nationals also face issues from regulation 1231/10 resulting from the requirement that a third-country national must be in a situation which is not confined in all respects within a single EU Member State. We have seen that the analysed coordination schemes do not require the cross-border movement between at least two EU Member States before involved persons can call upon the concerned coordination schemes. With respect to these coordination schemes, it suffices that the involved persons move from one treaty country to another. This is therefore not limited to just EU Member States. There are no relevant objections for cancelling the requirement that third-country nationals as a result of regulation 1231/10 ...
