Dottorato di ricerca in Diritto dei mercati europei e globali, crisi, diritti, regolazione ; La tesi, composta di tre capitoli, si propone di verificare quale sia la normativa applicabile e quali siano gli adempimenti necessari allo svolgimento dell'attività assicurativa in libera prestazione in Italia da parte di imprese europee. In particolare, i profili che suscitano maggiore perplessità riguardano il confine tra il diritto di stabilimento e libera prestazione di servizi, soprattutto qualora l'impresa estera operi tramite internet, e l'interpretazione della clausola di salvaguardia dell'"interesse generale". Specificamente la distinzione tra libertà di stabilimento e libera prestazione (relativamente alle peculiarità del mercato assicurativo) dovrebbe fondarsi, alla luce del combinato disposto degli artt. 56 e 57, pf. 3, TFUE, sul criterio della temporaneità, inteso non tanto come intervallo di tempo, ma come occasionalità della prestazione. La seconda zona grigia è costituita dalla clausola dell'interesse generale e dall'impossibilità di precisarne il contenuto a priori e definitivamente. In conclusione, sulla base dello studio condotto (su testi normativi, dottrina, giurisprudenza e prassi applicativa delle Autorità di settore), il mercato unico può davvero funzionare solo se si raggiunge un grado di omogeneità sia tra le normative degli Stati membri sia della loro applicazione da parte delle Autorità competenti, confidando in particolare in un elevato grado di cooperazione tra Autorità nazionali e sovranazionali (merita rilevare l'istituzione dell'EIOPA con Reg. n.1094/2010). ; Freedom to provide insurance services and the IVASS control The dissertation consists of three chapters and aims at verifying which law is applicable and what are the necessary requirements that the European insurance companies should respect to operate in freedom provide services in Italy. In particular, the issues that give rise to greater concern refer to the border between the right of establishment and the freedom to provide services, especially where the foreign company operates through the internet, and the interpretation of the safeguard clause of the "general interest". Particularly, the distinction between right of establishment and freedom to provide services (with regard to the case of the insurance market) should be based, in the light of the combined provisions of sections 56 and 57, pf. 3, TFEU, on the criterion of temporariness, interpreted not as much as time, but as an occasional and limited performance. The second gray area is the general interest clause and the difficulty of specifying the content definitively. In conclusion, on the basis of the study (on legislative texts, doctrine, jurisprudence and application practice by sectoral Authorities), the single market can really work only if a degree of homogeneity between the laws of the Member States and their application by the competent authorities is achieved, with particular reference to a high level of cooperation between national and supranational authorities (it should be noted the establishment of EIOPA with Regulation No. 1094/2010).

Il saggio –basato principalmente su documenti attualmente conservati presso l'Archivio Storico dell'INA, a Roma– esamina le vicende legate alla nascita dell'Istituto, costituito in un regime transitorio di monopolio relativo nel settore delle assicurazioni sulla vita.A causa del suo significato economico e politico, questa speciale forma di monopolio statale diede luogo a molte reazioni nell'ambito finanziario e politico nazionale, pertanto l'INA iniziò i primi anni di attività in una situazione conflittuale ed incerta.Il saggio inoltre approfondisce le ripercussioni sul mercato assicurativo internazionale in seguito alla nascita dell'INA.Durante il decennio di monopolio parziale dell'Istituto nel settore delle assicurazioni sulla vita (1912-1922), le compagnie di assicurazione straniere ritennero compromessi i loro interessi finanziari nel mercato italiano, e lo osteggiarono fino al 1923, quando una nuova legge riformò il mercato assicurativo sulla vita, abolendo il regime di monopolio.The essay –mainly based on documents actually preserved in the Historical Archives of INA, in Rome– examines the events connected with the foundation of the Institute, established in a transient condition of partial monopoly system in life insurance sector. Because of its economic and political meaning, this special form of state monopoly gave rise to many reactions in the financial and political national context, and so INA started its first years of activity in a troubled and unstable situation. The essay also discusses about the repercussions on international insurance market in consequence of the foundation of INA.During the ten-year perior of partial monopoly of the Institute in life insurance sector (1912-1922), foreign insurance companies deemed their financial interest in Italian market jeopardized, and contrasted with it until 1923, when a new act reformed life insurance market, abrogating monopoly system.

La ricerca ha ad oggetto l'analisi della disciplina della responsabilità del vettore terrestre di merci per conto terzi ed i riflessi che detta disciplina ha avuto modo di svilupparsi nel mercato assicurativo. L'attenzione è stata rivolta al contratto di trasporto di cose in generale, seguendone la disciplina codicistica e le evoluzioni legislative intervenute. Particolare rilievo assume la novella apportata all'art. 1696 c.c., introdotta dall'art. 10 del Dlgs. 286/2005, grazie alla quale l'ordinamento italiano ha potuto codificare il limite di indennizzo dovuto dal vettore nell'ipotesi di colpa lieve, L'introduzione del limite legale di indennizzo per le ipotesi di responsabilità per perdita o avaria della merce trasportata ha generato nel mondo assicurativo interessanti reazioni. L'elaborato esamina anche l'evoluzione giurisprudenziale formatisi in tema di responsabilità vettoriale, evidenziando il crescente rigore imposto dalla giurisprudenza fondato sul principio del receptum. Tale fenomeno ha visto immediata reazione nel mercato assicurativo il quale, sulla base di testi contrattuali non dissimili tra le diverse compagnie di assicurazioni operanti sul mercato domestico e che traevano origine dai formulari approvati dall'ANIA, ha seguito l'evoluzione giurisprudenziale apportando significative restrizioni al rischio tipico previsto dalle coperture della responsabilità civile vettoriale. La ricerca si è poi focalizzata sull'esame delle più comuni clausole contemplate dalle polizze di assicurazioni di responsabilità civile e sul loro significato alla luce delle disposizioni di legge in materia. Tale analisi riveste preminente interesse poiché consente di verificare in concreto come l'assicurazione possa effettivamente costituire per l'impresa di trasporto non tanto un costo bensì una opportunità di risparmio da un lato ed un modello comportamentale, sebbene indotto, dall'altro lato per il raggiungimento di quei canoni di diligenza che qualsiasi operatore del settore dovrebbe tenere durante l'esecuzione del trasporto ed il cui venir meno determina, come detto, sensibili effetti pregiudizievoli di carattere economico. ; The Candidate focused his studies on laws and regulations applicable to civil liability of third parties carrier and on the implications originated from such laws and regulations over the insurance market. The survey started analysing the principal aspects of carriage of goods contracts and examining the relevant provisions set in the Civil Code. The study analysed under that viewpoint the new regulation applicable to freights and the legal provisions that, for the first time, introduced in our country the principle that civil liability must be shared among all the parties involved, with different assignements, in the carriage by land. The introduction of legal limits to compensation in the event of total or partial loss of the goods caused interesting effects on insurances. Together with such issue the study describes the gradual development of carrier's liability case law, starting from the 80's, underlining the strictness of the judgements based on the "receptum" rule, which limits the possibility of carrier's discharge to very few particular cases. On such basis almost all of the italian insurance policies, which were drafted according to ANIA's forms, set relevant limitations to carriers' liability coverages, strictly delimited the risk insured and imposed specific loss prevention conducts to the carriers. The study also examines the most common clauses carried by the liability policies and explains their scope and meaning with reference to all applicable provisions. Such matter is particularly interesting because it shows the reasons why insurance represents a saving opportunity for carrier rather than a cost and it highlights the benefits arising from the compliance to the rules of conducts that the carriers are obliged to follow in order to prevent insurers' obiections to pay insurance indemnity in the event of loss.

[The insurance against tuberculosis: historical aspects and criteria of legal medicine]In the period after the First World War, tuberculosis was a real social emergency and, as such, has been addressed by the legislature providing for the economic conditions that would ensure the worker and his family. It was discussed whether today still makes sense to keep up this protection in the light of the presence of other significant social problems. In recent years, however, tuberculosis has increased again and, for this reason, it is not to be relegated to a minor problem. The economic benefits, of course, cannot replace the loss of earnings due to illness but makes the period considered less traumatic. Furthermore, considering the high specificity of modern diagnostic tests, the whole issue should be revisited.This article briefly outlines the historical evolution of insurance against tuberculosis and the medical and forensic criteria to be assessed in the different phases of tuberculosis.
