Prawnomiędzynarodowe uwarunkowania ochrony krajobrazu w Unii Europejskiej i w jej państwach członkowskich

The European Union does not have an autonomous and self-standing public policy concerning the protection of landscape. Instead, it adopts fragmentary and incidental measures meant to protect landscape. These measures are adopted within the frameworks of other EU policies, most importantly the EU environmental policy as well as other policies which are integrated with it (such as agricultural policy or policy concerned with special planning). In all these realms, the EU shares its powers with its member states. In some important areas, such as e.g. the property regime, the member states retained their exclusive competences. This particular distribution of powers makes the implementation of the extra-EU international law instruments rather difficult and not sufficiently effective to produce a worthwhile impact. These obligations have a limited influence because most of them are obligations of "a diligent pursue" rather than "firm result". As such, they are unlikely to give rise to direct application of respective conventional provisions. Notwithstanding, their importance is much more pronounced in the area of legal reasoning, where even the EU or domestic measures have to be interpreted in the light of the EU and/or its member states' obligations arising from international conventions on landscape protection.
Systems of Immobile Property Taxation in the States of the Visegrad Group ; Systemy opodatkowania nieruchomości w państwach Grupy Wyszehradzkiej
The aim of this paper is to present the current systems of immobile property taxation in the states of the Visegrad Group. In Europe, beside the systems which base on the value of the property, characteristic of the vast majority of the EU, there are also surface area and mixed systems occurring, They are still in force, even though since the beginning of the 1990s it has been noticeable in Central Europe that the systems based on the area of the real estate are abandoned in favor of the taxes on the its value. In Poland, Czechia and in Slovakia the area still dominates as the basis for taxation, and the value functions in reference to certain types of immobile property only. It is similar in Hungary, where local governments are not interested in the systems based on the property value, even though they have such a choice. Why are they these countries where the reforms of property taxes has not been implemented yet, despite numerous declarations and prepared concepts? This article is an attempt to anser the question.

Only a Theoretical Possibility of the Ad Valorem Property Tax System – the Regulation on Immovable Property Taxes in Hungary ; Jedynie teoretyczna możliwość wprowadzenia katastralnego systemu opodatkowania nieruchomości – uregulowania w zakresie podatków od nieruchomości na Węgrzech
The immovable property taxes have a long tradition in the modern tax system, as well in the Hungarian regulation. They are now an important revenues of the Hungarian municipalities, but this taxation is now primarily an area-based system. First of all, the traditions of the property taxation and the current regulation on property taxes will be reviewedby the article. A tax system of a modern democracy which is based on the rule of law requires the high quality of the tax administration. Therefore in the second part of the article the quality of the Hungarian tax system and the quality of the local taxation will be reviewed. In the third part of the article the main problems and the failed reform attempts of the Hungarian property taxation and the barriers to the implementation of the ad valorem system will be reviewed. Finally, the main findings of the review will be summarized.

Major Problematic Issues in the Property Taxation in the Czech Republic ; Główne zagadnienia problematyczne związane z opodatkowaniem nieruchomości w Republice Czeskiej
This article aims to open the debate on the recurrent property tax in the Czech Republic, to define most important problems of the existing legal regulation and to set the list of possible solutions de lege ferenda. The hypothesis that the immovable property tax is a good tax and a traditional part of the Czech tax system, was confirmed. The most problematic issue is the low tax revenue. However, ad valorem system does not seem to be the solution and the unit system (area) tax base should be retained. There should be one maximum tax rate in the legislation for every type of property, and municipalities should have the right to introduce their own specific tax rates below that level. At the same time, there should be another rate (standard rate) in the legislation for those municipalities that do not set their own specific tax rates.

Issues of international power ; Problematyka władzy międzynarodowej
One of the fundamental categories of general sociology concerns power. Regardless of differences in interpretation, power can be defined as the dependence between subordinator and subordinated. This relation is unidirectional. When discussing influence, this property is significant, as otherwise it could be reciprocal, or an influence could be exerted by many other entities that are not bound by the relationship of subordination. The nature of international relations is too specific to allow a simple transfer of power-related phenomena from the realm of domestic relations. One can indicate the presence of delegated power, resulting from the mutual assignment of subordination rights to international decision- making bodies. The processes of international power are divided into procedures of hard power, soft power and smart power, the latter signifying the manifestation of effective power, making use of the mechanisms of the former two. It is also important to take into account the specificity of the legitimization of international power and manifestations of accountability. Also not without significance is the capacity for the implementation of international power, equipped with the relevant enforcement instruments. ; One of the fundamental categories of general sociology concerns power. Repairing Damage Caused by Restricting the Use of Property in Connection with Nature Protection: Selected Issues ; Naprawienie szkody spowodowanej ograniczeniem korzystania z nieruchomości w związku z ochroną przyrody – wybrane zagadnienia
Establishing legal forms of nature conservation entails a restriction on the right of ownership and other property rights. For this reason, the legislature introduced in the Act of 27 April 2001 on Environmental Protection Law solutions allowing for the purchase of real estate or payment of damages. The provisions of the Environmental Protection Law set out an administrative-judicial procedure of claiming for remedying a damage caused by the legal operation of the public administration related to the protection of environmental resources. This procedure is based on the fact that a claim, essentially of a civil nature (a claim for remedying a damage caused by restricting the use of property) is pursued in two stages – the first in an administrative proceeding in which the administrative authority issues a decision and in the second, where the case is decided by a general court. The first stage is obligatory, in the sense that in the event of a dispute for compensation, the aggrieved party must apply to the administrative body for compensation. The second is initiated as a result of the action of the party dissatisfied with the compensation awarded by the administrative body.

Derogation from Copyright Protection Based on the Implementation of Freedom of Information and of Media. Notes on the Judgement of the European Court of Justice of 29 July 2019 in the Proceedings between Funke Medien NRW GmbH and Bundesrepublik Deutschland ; Odstępstwa od ochrony prawa autorskiego z...
Public discussion in 2018, concerning the European Parliament, passing the Directive on copyright and related rights in the Digital Single Market, in the public discourse referred to as ACTA 2, evoked huge social emotions. The source of the conflict were two colliding values: the need to protect copyright and to ensure economic interest of authors and freedom of expression (freedom of the Internet), particularly important for users of works and Internet users. The decisions of the European Court of Justice, given on 29 July 2019 in the proceedings between Funke Medien NRW GmbH and Bundesrepublik Deutschland and the coincident decision in the case Spiegel Online GmbH vs Volker Beckow, deals with the above-given conflict of values. This article provides a description of the main arguments of the above-mentioned judgements of the ECJ and points at their consequences in the scope of changing the current interpretation of the provisions of copyright. The article also contains remarks on the influence of these decisions and their consequences for the disabling of content by providers of content-sharing service providers which violates freedom of expression considering the new Directive of 17 April 2019. The author presented arguments confirming that the Directive (EU) 2019/790 of 17 April 2019 on copyright and related rights in the Digital Single Market and the new way of interpreting copyright rules provided by the judgements of the ECJ has significantly changed the hitherto may of perceiving the rules of permissible use of works.

This article is a comparative analysis of the legal nature and the rights and obligations of parties concluding property insurance contracts under the provisions of the Maritime Code and the Civil Code. When navigating a ship, the shipowner conducts a business commonly referred to as the operation of a ship, which includes, inter alia, its use for business purposes. The shipowner business is therefore an economic activity and the owner is the entrepreneur who runs his business which s/he is liable for. It is his/her broad interest to insure permanent assets of his/her company against damage as well as his/her civil liability. As the text indicates, s/he is treated by the legislature more severely than a person conducting a standard property insurance. In addition, the legal nature of the policy, due to the requirements of maritime traffic, differs from that from the Civil Code. The purpose of this study is to identify the key differences between the two regulations.
Culture and cultural diplomacy of the European Union – the example of the Creative Europe Programme. A political science analysis ; Kultura i dyplomacja kulturalna Unii Europejskiej na przykładzie Programu "Kreatywna Europa". Analiza politologiczna
The intention of the author of this paper is to present a scientific analysis of the influence of culture and the cultural diplomacy of the European Union on the animation and stimulation of Europe's integration process, which is in a constant state of perturbation and lack of stability. It examines the problem-related approach to the European Union's change and development strategy, including the "Europe 2020" strategy for smart, sustainable and inclusive growth, which envisages the implementation of many new communal initiatives and practical solutions introduced by the European Union, including ones that concern both the cultural sector and the creative and audiovisual sector. The European Union, from 2020 onwards, intends to be ready to reach a high level of employment and efficiency, and a higher level of social integration. To enable this, the European Union must ensure attractive framework conditions for innovation and creativity. In that respect, the cultural sector and the creative and audiovisual sector are the source of groundbreaking ideas which may develop into products and services that could contribute to economic growth and job creation, thereby fighting the crisis and social problems. The economic and social crisis in Europe has also been influencing the world of culture. A series of problematic issues associated with the fragmentation of culture and its inventions are identified, including globalisation and digitalisation, underinvestment, inadequate protection of intellectual property and copyright, and insufficient international cultural cooperation. ; The intention of the author of this paper is to present a scientific analysis of the influence of culture and the cultural diplomacy of the European Union on the animation and stimulation of Europe's integration process, which is in a constant state of perturbation and lack of stability. Zmiany stosunków własnościowych w Polsce po roku 1989 ; Changes in ownership relationships in Poland after 1989
; This paper presents structural changes that took place in Poland after 1989, and which enabled its transition from a centrally planned economy to a market economy. The deep and thorough legal, economic and social reforms undertaken in that period made it possible, after years of communist rule, to shape a new, democratic system. The systemic transformation was possibleowing to some basic amendments to the Constitution, including the articles defining the essence of ownership and the duty to respect it, as well as the adoption of other legal acts necessary to re-define ownership relationships (such as the law on commercialisation and privatisation of state-owned enterprises, or the law on the management of agricultural property). The concurrent reforms of the banking system and the monetary and credit policy enabled inflow of foreign capital and development of private entrepreneurship. As a result of the transformations of the past 25 years, Poland is now a democratic state and a member of the European Union, while Polish economy is getting increasingly competitive. Sadly enough, despite these substantial structural transformations in the ownership sphere, in the last quarter of the century Poland has continued to be unable to resolve the problem of returning to the lawful owners the property taken by the communist regime.
